  • Alleged N1.2bn laundering: Former INEC chair Iwu granted N1bn bail

The Federal High Court in Lagos on Friday granted a former Independent National Electoral Commission (INEC) Chairman, Prof Maurice Iwu, bail for N1billion with two sureties in like sum.

Justice Chuka Obiozor ordered the sureties to submit their bank statements and two passport photographs each.

Each of the sureties must provide three-year tax clearance evidence, the judge ruled.

Justice Obiozor ordered Iwu to deposit his passport with the court’s Deputy Chief Registrar.

He remanded the former INEC chairman in prison custody until he fulfils the bail terms.

The Economic and Financial Crimes Commission (EFCC) arraigned Iwu on Thursday on a four-count charge of laundering N1.2billion.

The agency said Iwu, between December 2014 and March 27, 2015, aided the concealment of N1,203,000,000.00 in Bioresources Institute of Nigeria (BION) Limited’s account.

The account, numbered 1018603119, is domiciled in United Bank for Africa Plc, EFCC said.

The commission alleged that Iwu “reasonably ought to have known” that the money “forms part of proceeds of unlawful act to wit: fraud.”

The alleged offence is contrary to sections 18 (a) and 15 (2) (a) of the Money Laundering Prohibition Act, 2011 and punishable under Section 15 (3).

Iwu’s counsel, Ahmed Raji (SAN), urged the court to grant his client bail on liberal terms and to disregard EFCC’s claim that the defendant could run away or interfere with witnesses.

Opposing the bail application, prosecuting counsel, Rotimi Oyedepo, said some of those who will testify in the trial worked closely with Iwu.

“If granted bail, he will intimidate and interfere with our witnesses.

“In the unlikely event that the bail is granted, I urge your lordship to impose such conditions that will compel him to come to court and conditions that will make sure our witnesses are not tampered with.

“I also urge the court to impose conditions that will ensure that if he absconds, we would be able to lay hands on something that is equivalent to the N1.2billion,” Oyedepo said.

Ruling, Justice Obiozor added that the first surety must be a Lagos resident and a property owner.

“The defendant shall cease all manner of communication either directly or by proxy with any of the witness the prosecution might call in this matter,” Justice Obiozor said.

The second surety, he said, must be a civil servant in Lagos on Grade Level 16 or a professor in any Nigerian university.

The judge said the sureties, who must provide proof of three-year tax payment, must live in Lagos and as proof of address, shall provide statements of account to which their passport photographs will be attached, “which the bank shall depose as the true identity of the account holder”.

He said Iwu must not travel outside the country without the court’s approval.

“Deputy Registrar of the Lagos Division shall verify all documents submitted by the defendant and sureties.

“Pending the perfection of bail, the defendant shall be remanded in prison custody at Ikoyi Prison,” Justice Obiozor ruled.

Iwu was accused of procuring BION Ltd “to retain the aggregate sum of N1,203,000,000.00 ” in the UBA account, contrary to sections 18 (c) and 15 (2) (c) of the Money Laundering Act.

The prosecution, in the third count, said the defendant “used” the money when he ought to know that it was reasonably suspected to form part of proceeds of fraud.

EFCC said Iwu and a lawyer, Victor Chukwuani, between December 23 and 29, 2014, procured BION Ltd “to retain the aggregate sum of N407,000,000.00” in the same account.

Iwu pleaded not guilty to the charge.

His trial will begin when the court resumes from its ongoing annual long vacation.

Justice Obiozor is sitting as a vacation judge and is attending to only urgent cases.

The case may be assigned to a different trial judge.

  • Sowore urges court to vacate detention order

The convener of #RevolutionNow, Omoyele Sowore, has asked the Federal High Court in Abuja to vacate the order it made on Thursday, granting permission to the Department of State Services (DSS) to further detain him for 45 days in the first instance.

Operatives of the DSS arrested Sowore, who is the publisher of Sahara Reporters and presidential candidate of the African Action Congress (AAC) in the February 2019 elections, in the early hours of August 3 in a hotel in Lagos.

On August 8, Justice Taiwo Taiwo, who is sitting as the vacation judge at the Federal High Court, Abuja, ruled on an ex-parte motion by the DSS and granted the agency leave to further detain Sowore for 45 days in the first instance. The DSS had applied for 90 days.

But, in a motion filed yesterday by his team of lawyers, led by Femi Falana (SAN), Sowore is seeking an order “setting aside, discharging and/or vacating the ex parte order of this Honourable Court for the detention of the respondent/applicant for a period of 45 days made on the 8th August, 2019, Coram: Taiwo Taiwo J, in Suit No: FHC/ABJ/CS/879/2019 between State Security Service V. Omoyele Sowore.”

It is Sowore’s contention that the said order breached the fundamental right provisions of the Constitution

“The detention of the respondent/applicant for an initial 4-day period before the grant of the ex-parte order is illegal by virtue of Section 35 of the 1999 Constitution (as amended).

“The order ex-parte brought pursuant to Section 27 (1) of the Anti-Terrorism Act, 2013 was obtained by the applicant/respondent to legalise an illegal detention by the applicant/respondent.

“The applicant/respondent dumped the video evidence in support of its application on the honourable court whilst the learned trial judge watched same in his chambers and not in the open court.

“The respondent/applicant was arrested on Saturday 3rd August, 2019 before the planned protest that took place on Monday, 5th August, 2019 while he was already under the custody of the applicant/respondent.

“The persons, who participated in the protests of 5th August, 2019 have been charged with unlawful assembly at the magistrate courts at Ebute-Metta, Lagos State and

“The applicant/respondent had concluded investigation of this case and announced its findings.

“The respondent/applicant had also volunteered statement to the applicant/respondent.

“At the time of the hearing of the motion ex-parte, the respondent/applicant was in custody of the applicant/respondent at Abuja, within the jurisdiction of this honourable court.

“The day the motion ex-parte was filed at the registry of this honorable court, the respondent/applicant was allowed by the applicant/respondent to consult his counsel, Mr. Femi Falana, SAN on phone.

“The motion ex-parte was predicated on suppression and misrepresentation of material facts.

“The motion ex-parte constitutes a gross abuse of the process of this honorable court.

“The applicant/respondent motion ex-parte filed 5th August, 2019, did not disclose any fact capable of linking the respondent /applicant to any terrorism activity.

“In the same vein, the motion filed 5th August, 2019 did not in the supporting affidavit allude to facts linking the respondents/applicants to any terrorism activity.

“The applicant’s detention has exceeded the maximum period a court of law can allow the respondent to detain the applicant in accordance with the provisions of which only empowered the Applicant/Respondent to detain the Applicants for a maximum period of two months from the date of their arrest.

“The order made on 8th August, 2019 was based on a wrong presumption and mistake that the complaint against the respondent therein relates to terrorism.

“By virtue of Section 293 of the Administration of Criminal Justice Act, 2015, an application for the remand of any suspect is to be made before a Magistrate Court.

“By virtue of the actions of the applicant/respondent, the respondent/applicant’s right to  life, dignity of human person, health and freedom of movement are under threat as same is currently being violated by the respondent without any justification known to law.”

Babalele is expected to account for about €41,900,000.

The two suspects have been under investigation since February for making cash payment without going through financial institution.

Some of the cash have been traced to the accounts of Osagie, Babalele, two slush firms and two Bureau De Change operators.

Although charges were said to have been preferred against the suspects, no date has been fixed for their arraignment.

A top source in the commission said: “The two suspects have been detained in preparation for their arraignment in connection with cash payment of $2million without going through financial institution. The sum exceeded the amount authorized by Law.

The EFCC had on February 11 intercepted a $1.6m transaction at a Bureau De Change on the Lagos Island.

A brief on the case reads in part: “In the course of our routine exercise of monitoring BDCs, our operatives went to a market on Lagos Island where they intercepted $1.6million at a Bureau De Change. We intercepted the dollars because they were unable to convert it into Naira.

“The $1.6m was already given to the BDC operator on the island for exchange into Naira. As at the time our operatives moved in, about $141,000 out of the $1.6million was already converted into Naira at the rate of N358 per dollar. The balance of $1, 459,000 was still intact because of the scarcity of Naira.

“Those interrogated claimed that the $1.6m belonged to a BDC man in Abuja. Further investigation on the real owner of the cash led to the identification of Mr. Uyi Giwa-Osagie.

“We interviewed Uyi but he was not forthcoming on how he came across the money.

“We however traced huge inflows into Uyi Giwa-Osagie’s account (Guernsey Trust Company Nigeria Limited) to the tune of €26,050,00million. The same account received the conversion in dollars.

“From this dollar account, transfers were made to BDCs and that was how we intercepted the $1.6m”.

“Painstaking investigation made by our operatives made them to discover how €41,900,000 was wired into an account of a suspected shell company called Afritech Utilities by Intels West Africa Limited. Part of the same inflows was transferred to various BDCs for the purpose of conversion to Naira. The signatory of Afritech Utilities happens to be Abdullahi Babalele.

“Investigation confirmed that Afritech Utilities has three staff including two directors and one secretary.

“The profiling showed that there is no particular business that Afritech is engaged in. Babalele at a point claimed the company is engaging in importation of cars but no shred of document to prove. Later he said the importation of the cars was for family use.

“It is more or less a shell company. Guernsey Trust Company Nigeria Limited is only protecting the interest of others.”
