Supreme Court asked to reverse Abacha’s sack as Kano PDP guber candidate

The Supreme Court has been urged to reverse the February 10 judgments by the Court of Appeal in Kano voiding the nomination of Mohammed Sani Abacha as the governorship candidate of the Peoples Democratic Party (PDP) in Kano State. The apex court is also urged to order the Independent National Electoral Commission (INEC) to reinstate Abacha as the actual candidate of the PDP in Kano for the next governorship election.

These requests form part of the reliefs being sought in two notices of appeal filed before the Supreme Court by Mohammed Abacha, the eldest surviving son of the late Head of State, General Sani Abacha. In two notices of appeal filed by his lawyer, Dr. Reuben Atabo (SAN), Abacha argued that the Court of Appeal, Kano erred in law when it set aside an earlier judgment of the Federal High Court, Kano which recognised him as the actual candidate of the PDP in the state.

Abacha had claimed, in his suit at the Federal High Court,Kano, marked: FHC/KN/CS/01/2022 that he won the only validly conducted PDP governorship primary in Kano State, but had his name wrongly substituted with that of Sadiq Aminu Wali by some party leaders. In a judgment on December 22, 2023, Justice Abdullahi Liman of the Federal High Court, Kano held in Abacha’s favour and ordered INEC to recognise him as the PDP governorship candidate in Kano State, a decision Wali and the PDP challenged in separate appeals before the Court of Appeal, Kano.

In its judgments on both appeals on February 10 this year, the Court of Appeal set aside the Federal High Court judgment and held among others that Wali was the valid candidate, a decision Abacha has now appealed to the Supreme Court. In his two notices of appeal, containing 31 grounds, Abacha equally wants the Supreme Court to set aside the Court of Appeal’s judgment and affirm that of the Federal High Court.

In the 17-ground notice of appeal relating to the Appeal Court judgment in the appeal by the PDP, Abacha argued that the appellate court erred when it held that the trial court lacked jurisdiction to have entertained this suit and that he lacked locus standi to have instituted the case for not being an aspirant. Abacha argued that, as against the wrong position held by the Court of Appeal, he was an aspirant in the primary election conducted by the PDP and monitored by INEC in accordance with the proviison of Section 84(1) of the Electoral Act; Paragraph 15(c) , Part 1 of the 3rd Schedule to the Constitution, as well as the Supreme Court’s decision in the case of Sylva v. PDP.

He added that he emerged “as the candidate that scored the highest number of votes during the primary election organised by the 1st respondent (PDP) and supervised and monitored by by the 2nd respondent (INEC). The name of the appellant (Abacha), who emerged as the winner during the primary election, was wrongly substituted with that of the 3rd respondent (Wali) who scored zero vote during the primary election.” The appellant also faulted the Court of Appeal for holding that Wali did not participate in the primary election held on May 25, 2022 at No: 5A Lugard Avenue, Kano, which primary he (Abacha) won.

Abacha argued that contrary to the position held by the Court of Appeal, there are documentary evidence presented before the trial court that Wali actually participated in the primary. “The findings of fact made by the trial court in respect of the participation of the 3rd respondent in the 1st respondent’s primary conducted on May 25, 2022 at No: 5A Lugard Avenue, Kano was not challenged by the 1st respondent at the lower court,” he said.

Appeal Court dismisses ex-Minister Nwajiuba’s suit against Tinubu’s candidacy

The Court of Appeal in Abuja has dismissed an appeal by former Minister of State for Education, Chukwuemeka Nwajiuba, challenging the candidacy of the Presidential candidate of the All Progressives Congress (APC), Asiwaju Bola Tinubu.

In a judgment on Friday, a three-member panel of the court held that Nwajiuba’s appeal was without merit.

The appellate court upheld the arguments by Thomas Ojo (of Lateef Fagbemi and Co) who represented Tinubu and Babatunde Ogala (SAN) who represented the APC, that the appeal was frivolous.

The court proceeded to affirm the judgment of the Federal High Court and awarded a cost of N3million against him to be paid at N1m to each of the three respondents – Tinubu, APC and the Independent National Electoral Commission (INEC).

The court, in upholding the decision of the trial court, held that the Federal High Court “rightly held that it lacked jurisdiction to entertain the suit as the suit was filed outside the statutorily mandated and allowed period of 14 days.

“Appeals are by way of rehearing and the lower court having being robbed of jurisdiction, the court of Appeal lacks the jurisdiction to adjudicate.

“The appeal is dismissed, as the court of appeal lacks the jurisdiction to entertain same.

“The suit at the lower court, having been filed outside the 14 days of the occurrence of the event, action or decision complained of.”

Nwajiuba had by the appeal marked: CA/CV/ABJ/26/2023 sought to reverse the December 23 judgment given against him by Justice Zainab Abubakar of the Federal High Court, Abuja and to order the trial court to hear his suit on the merit

The ex-Minister had, in his suit at the Federal High Court, marked: FHC/ABJ/CS/1114/2022 sought among others, to disqualify
Tinubu from the presidential race on various unsubstantiated grounds.

    Here are some security precautions to take on election day;

Avoid political arguments at the poll

Avoid participating in any political debate, especially if it involves a party other than the one you support. At polling units, it is inappropriate to engage in political discussions that could lead to arguments or violence.

Don’t reveal your preferred candidate at the poll

Don’t move about with huge cash

If you intend to move around with large sums of money during the election, you should reconsider. Miscreants take advantage of the period to rob people off their valuables.

Keep a safe distance from undefined crowds or groups of people

It is critical that you do not associate with an undefined crowd or group of people who enjoy analyzing political issues and candidates in public.

Do not partake of election violence

Do not allow yourself to be used by politicians to commit election violence. This is because some opponents may be lurking in the shadows, ready to harm those who do this.

Avoid bringing children to the polling units

It is important to keep children safe during the elections because of the high stakes involved. Children should not be brought to polling places in case of violence.

    Report unusual activities

Another important safety precaution that voters can take during the voting process is to report any unusual activity to the proper authorities.

Stay updated with issues on election day

Keep up with current events by constantly listening to the news and attempting to stay informed. This way, you can keep track of events as they unfold and avoid becoming involved in any unrest.

    Don’t keep late night

It is critical that you complete all of your tasks before late at night on election day. Avoid circumstances that will require you to stay out late on election day.

    Celebrate in a civil manner

If after the elections your candidate wins, then it is important that you celebrate in a civil manner.

  • United Airlines unveils $100m sustainable flight fund

United Airlines unveils $100m sustainable flight fund

United Airlines yesterday launched the airlines’ Ventures Sustainable Flight Fund of $150million.

It is the first investment vehicle to support start-ups focused on decarbonising air travel by accelerating the research, production and technologies associated with sustainable aviation fuel (SAF).

According to a statement by the airline, the fund starts with more than $100 million in investments from United Airlines and its inaugural partners, Air Canada, Boeing, GE Aerospace, JPMorgan Chase, and Honeywell.

Through the fund, potentially more corporate participants will invest alongside United in SAF technology and production start-ups identified by the carrier.

In the past two years, the statement added, United Airlines Ventures has invested in start-ups such as Cemvita, Dimensional Energy, and NEXT Renewable Fuels.

The statement reads: “And in a first among U.S. airlines, anyone who buys a ticket on the United website or app now has the option to contribute to supplement United’s investment in the fund.

“The first 10,000 people who choose to contribute will each receive 500 Mileage Plus Miles as a thank-you.”

“SAF is an alternative to conventional jet fuel that, on a lifecycle basis, reduces greenhouse gas (GHG) emissions associated with air travel compared to conventional jet fuel alone.

“SAF, which currently must be blended with conventional jet fuel to meet regulatory requirements for use within the aircraft, is being made from used cooking oil and agricultural waste, and, in the future, could be made from other feed stocks including household trash or forest waste.

“To date, United has invested in the future production of over three billion gallons of SAF – the most of any airline in the world.

“Solving climate change is doable but it requires hard work and real leadership,” said United  Airlines’s Chief Executive Officer ,  Scott Kirby.

“This fund is unique. It’s not about offsets or things that are just greenwashing. Instead, we’re creating a system that drives investment to build a new industry around sustainable aviation fuel, essentially from scratch. That’s the only way we can actually decarbonize aviation.”, he added.

The United Airline’s Ventures Sustainable Flight Fund is open to investment by corporations across industries and the fund will prioritize investment in new technology, advanced fuel sources and proven producers, all in an effort to scale the supply of SAF. Partners of the fund also have the potential to gain preferential access to environmental attributes associated with United’s supply of SAF.

United  Airlines said it has already made investments in or signed purchase agreements with companies using a variety of ingredients and technologies to produce SAF, including feedstocks like ethanol, animal byproducts, forestry and crop waste, and municipal waste, as well as early-stage, promising technologies like synthetic biology and power to liquids.
