Court orders Evans to return 233,000 Euros ransom

    • Kidnapper to pay extra N50m damages

The Lagos High Court sitting at the Tafawa Balewa Square (TBS) in Lagos Island has ordered billionaire kidnap kingpin, Chukwudumeme Onwuamadike, alias Evans, to refund 233,000 Euros ransom he collected from one of his victims, Chief Donatus Dunu.

Justice Olukayode Ogunjobi also ordered Evans to pay N50 million as general damages in favour of the claimant.

Evans abducted Duru, CEO of Maydon Pharmaceutical Company, on February 14, 2017. Duru escaped from captivity, but not before Evans obtained 233,000 euros from him.

Consequently, Duru filed a suit demanding the return of the 223,000 euros and N50 million as damages.

In his testimony before the court, he narrated that Evans ordered him to instruct his brothers, Anselm Duru and Innocent Duru, to pay the ransom. He said despite Evans receiving the money, he did not release him but he had to escaped by himself.

Anselm corroborated his brother in his witness statement on oath sworn to on May 1, 2022.

His evidence was that a day after the kidnap, Duru instructed him to pay his abductors N100 million for his release. The abductors later demanded £1 million, he added.

According to Anslem, his relation, one Uchenna Okagwu, delivered the 233,000 Euros to the abductors.

Evans, in his defense however, contended that the strength of the claimant’s case was predicated majorly upon criminal trial against him and others. He also said the only evidence before the court as to the payment of the 233,000 Euros, and to whom, if any, it was paid to, was the evidence of Okagwu who allegedly delivered the money to the abductors.

He added that in the criminal trial, Okagwu testified that he dropped the said sum on the ground and fled and did not see anybody or delivered the money to anyone. Evans also argued that Okagwu’s evidence, which was the only direct one, must pass the test of proof beyond reasonable doubt.

The defendant also submitted that the judgment delivered by Justice O.H. Oshodi on February 25, 2022, is now subject of an Appeal at the Court of Appeal, Lagos Division.

But Justice Ogunjobi, who dismissed his reasoning, found that the defendant, among others, gave inconsistent evidence. He said having watched Evans’ demeanor while giving evidence, he concluded that Evans was not a witness of truth, and his evidence could not be trusted.

Justice Ogunjobi held: “It is settled in law that no witness who gives materially inconsistent evidence on oath is entitled to the honour of being accorded any credibility and such does not deserve to be treated as a truthful witness. Besides, adducing conflicting pieces of evidence on oath, I have watched the defendant’s demeanour and came to the conclusion that he is not a witness of truth. I do not believe his evidence. I accept the unchallenged and uncontroverted evidence of the claimant and his witnesses. The evidence supports the reliefs sought by the claimant.

“Consequently, the claimant is entitled to be paid, repaid or recover from the defendant 233,000 Euros ransom coercively paid to the defendant when he was kidnapped in 2017. N50 million is also awarded as general damages in favour of the claimant against the defendant.

“Post judgment interest is awarded on the 233,000 Euros at the rate of 10 per cent per annum from judgment, i.e. February 14, 2023, until final liquidation. The adjudged sums – 233,000 Euros and N50 million –should be paid or recovered from the defendant’s assets. This is the judgment of the court.”

The court however refused claims for pre-judgment interest of 40 per cent per annum on the 233,000 Euros.

Police arraign man for swindling commercial sex worker

The police yesterday arraigned a 22-year-old businessman, Abdulrazak Lawal, at a Kado Grade I Area Court, Abuja, for allegedly swindling a commercial sex worker of her mobile phones worth N266,000.

Lawal was charged with cheating and theft.

Prosecution Counsel Stanley Nwafoaku said the complainant, Ms Charity Joseph of Jabi Masalachi, on January 30, reported the matter at Life Camp Police Station. According to her, about midnight of January 25, Lawal approached Charity for her services. They negotiated for N10,000 for the night at White House hotel, Jabi daki-biyu, but the defendant allegedly stole Charity’s IPhone valued at N266,000.

Nwafoaku told the court that Lawal did not pay the N10,000 as agreed, saying during police investigation, he was arrested and all efforts to recover the phone were unsuccessful.

He added that Lawal admitted to have sold the phone for N35,000 to one Abba who absconded to Katsina State. The offence contravenes Sections 322 and 288 of the Penal Code Law.

Lawal however pleaded not guilty to the charge and his lawyer, Charity Nwosu, made a bail application for him in the most liberal terms.

Nwafoaku did not object to the bail application. Justice Muhammed Wakili admitted the defendant to bail in the sum of N150,000 and one surety in like sum. He also ordered that the surety must provide a BVN print out, recent passport photograph and a valid identification card, which must be verified by the court registrar. He then adjourned the matter till March 1 for hearing.

  • Lagos REC will not be redeployed, says INEC

Lagos REC will not be redeployed, says INEC

The Independent National Electoral Commission (INEC) says it will not redeploy the Resident Electoral Commissioner (REC) for Lagos State, Mr. Segun Agbaje, over unfounded allegations.

The Chief Press Secretary to INEC Chairman, Rotimi Oyekanmi, in an interview with reporters yesterday in Abuja urged those demanding Agbaje’s redeployment to perish the thought.

There have been demands for Agbaje’s removal over alleged mismanagement of Permanent Voter Cards (PVCs) collection in some parts of Lagos and engagement of Musiliu Akinsanya (aka MC Olumo)-led Lagos State Parks Management Committee to convey election materials.

Oyekanmi implored the two political parties calling for Agbaje’s redeployment to respect the boundaries of the relationship between the commission and all political parties.

He dismissed the allegations against the REC, describing it as deliberate misinformation and distortion of facts.

“Let me make one thing clear upfront. Mr. Agbaje will not be removed as the REC for Lagos over unfounded allegations.

“He will not only conduct the Presidential/National Assembly election scheduled for February 25, he will also superintend over the Governorship/State House of Assembly election holding on March 11.

“He is a conscientious, honest, dependable and hardworking REC. His integrity speaks for him in all the places he has served.

“Let me break this down for you. During the recent Continuous Voter Registration that took place between June 2021 and July 2022, Lagos State under Agbaje registered the highest number of voters in the country – 585,629.

“On January 27 this year, we announced that out of the 940,200 PVCs delivered to Lagos State as of that date, 839,720 PVCs representing 89.3 percent had been collected.”

“This debunks the allegation that the Lagos REC deliberately withheld the PVCs belonging to persons from a particular region of the country.”

On the movement of election materials in Lagos State, Oyekanmi said INEC was engaging individual vehicle owners.

He said: “The unions don’t have vehicles and even if they have some, they cannot possibly provide the number of vehicles that the commission requires to conduct the general election.

“Rather, the unions are made up of individuals that own vehicles.

“You then have to negotiate with the vehicle owners and join the unions as witnesses and for accountability purposes.”

Oyekanmi reminded Nigerians that INEC had been conducting elections successfully in Lagos, using individuals that owned vehicles that met its specification.

He assured Lagosians and those who intend to vote in Lagos State that their votes will count.

At 70, Mamora calls for review of leadership recruitment

Minister of Science, Technology and Innovation, Sen. Olorunnimbe Mamora, has urged politicians to uphold the tenets of patriotism.

The medical doctor-turned-politician said if members of the political class shunned immorality and imbibed honesty and fidelity to the country, Nigeria would be better.

Dr. Mamora, who turns 70 today, spoke with reporters in Lagos ahead of the launch of ‘MEL Foundation’ and launch of a book in his honour at the Haven Centre, Ikeja.

He called for re-evaluation of politics and review of the leadership recruitment method, warning that monetisation of politics would cripple the process.

In his view, the country needs competent, experienced, patriotic and selfless leaders, who will take it to the horizon of progress and prosperity.

Mamora, who was Speaker of Lagos State House of Assembly before serving as a senator, said former state and federal lawmakers performed better than those in the saddle at the Houses of Assembly and National Assembly.

He said previous lawmakers embraced legislative governance with more seriousness and learned faster, urging the current crop of legislators to emulate them.

Reminiscing on his foray into politics, the minister said he learned politics first at the household level because his father, Merrychief Mamora, a former principal of Teacher Training College, Epe, was a leader of the defunct Action Group (AG) at Ijebu-Ife in Old Ogun Province.

He recalled that he later contested and won as Financial Secretary of the University of Ife Students’ Union where Prof. Olukotun, Rotimi Akeredolu, Segun Mimiko and Segun Adesegun were also activists.

Mamora said the corridor of power was not for merrymaking, but a serious arena where the best people should decide the fate of millions, who looked up to them for leadership.

He spoke about the health sector, saying primary health care system was the most important.

He said the onus was on the state and local governments to equip the primary health centres with equipment and adequate personnel.

Oyo teachers to get 2022 annual leave bonus by February ending

Oyo State Governor Seyi Makinde yesterday reaffirmed his admiration for teachers and the teaching profession, noting that his administration will continue to do everything possible to ensure teachers and other workers are satisfied on the job.

The governor, who said the government would pay the teachers annual leave bonus for 2022 by the end of February, added that the welfare of workers would continue to be paramount to his government.

The Chief Press Secretary to the governor, Mr. Taiwo Adisa, on behalf of the Media Committee of the Governor’s Campaign Council, made this known yesterday in a statement when he met the representatives of the Nigeria Union of Teachers, Itesiwaju Local Government chapter in Otu.

The governor told residents of the council at separate meetings with the leadership of religious faiths and the traditional council that his administration would explore tourism and solid mineral development, to expand the state’s economy under Omititun 2.0.

Speaking with the traditional rulers at the Itesiwaju Local Government Hall, Otu, Governor Makinde said he was seeking to be re-elected to consolidate the gains under Omituntun 1.0, which were recorded in the last 44 months.

He equally met with the leadership of the Christian Association of Nigeria (CAN) at First Baptist Church, Otu; the League of Imams and Alfa at the Central Mosque, Otu as well as the traditional worshippers, urging them to support the Peoples Democratic Party (PDP) and its candidates in the National Assembly, state Assembly and governorship elections.

While campaigning at separate meetings with traditional worshippers, commercial motorcycle riders’ associations and non-indigenes of the council, the governor said his administration had delivered on its 2019 campaign promises.

He said everything his administration had been able to achieve under Omituntun 1.0 would be consolidated under Omituntun 2.0, warning residents not to allow opposition political parties, whom he said had nothing to campaign with, to deceive them ahead of the coming elections.

In his remarks during the traditional council’s meeting with the governor and his entourage, the Eleyinpo of Ipapo, Oba Yekeen Ademola, as well as representatives of each group met by the governor, hailed his administration’s achievements in the last 44 months.

They promised to work for the success of his second term bid.

  • Ex-commissioner: Tinubu is best for Nigeria

Ex-commissioner: Tinubu is best for Nigeria

All Progressives Congress (APC) chieftain Bosun Jere has urged Nigerians to vote for the party’s presidential candidate, Asiwaju Bola Ahmed Tinubu. He described him as the best for the country.

He said in terms of profile, pedigree, competence, skill and capacity, none of the candidates could match the former governor of Lagos State.

Jeje, a banker, lawyer and former Commissioner for Housing in Lagos State, said Tinubu had the best manifestos, adding that he would turn the country around as he repositioned Lagos when he was the governor.

He saluted the courage, audacity, resilience and focus of the eminent politician, who has continued to forge ahead, despite the antics of detractors.

The party chieftain said Tinubu had engaged more Nigerians during the campaigns than other candidates, adding that he had demonstrated energy, resilience and resolve to succeed.

Jeje said Nigeria required a president with adequate understanding of the economy, the imperative of infrastructural development and the need for sustenance of national unity.

The former commissioner described Tinubu as a bridge builder, a nationalist and a believer in the future of a greater Nigeria.

He said the APC candidate had invested in democratic development through his involvement in pro-democracy crusade and good governance initiatives as two-term governor of Lagos.

Jeje urged voters to make a wise decision on February 25 by voting for the only candidate who had a convincing blue print on the resolution of the lingering power crisis.

He thanked the progressive governors from the North for their principled position on power shift to the South.

Jeje said the move would boost mutual confidence and engender trust between the North and the South, thereby enhancing national unity.

He urged the youth to vote for Tinubu, who had plans for securing a prosperous Nigeria and guaranteeing a solid future for the younger generation.

Jeje also advised Lagosians to vote for Governor Babajide Sanwo-Olu, saying he had justified the confidence reposed in him by the electorate.

He said a second term for Sanwo-Olu would enable him spread the dividends of democracy in fulfilment of his ‘THEMES’ agenda.
