Man City vs. RB Leipzig: Guardiola affirms desire to win Champions League

Pep Guardiola has  admitted  his Manchester City reign will be defined by success in the Champions League no matter how many times his side wins the Premier League.

City face Bundesliga high-fliers Leipzig in the second leg of their Champions League last-16 tie on tonight looking to advance to the quarter-finals for a sixth successive season.

Guardiola’s men were held to a 1-1 draw in the first leg, but are fancied to progress in front of their own fans at the Etihad Stadium.

For Guardiola, the quest to end City’s wait to win Europe’s elite club competition for the first time is both a source of frustration and inspiration.

The 52-year-old has lifted the Premier League four times, while also winning four League Cups and one FA Cup during his remarkably successful seven years in Manchester.

Yet for all his domestic glory with City, it is the Champions League that remains the Holy Grail.

Guardiola won the Champions League twice as Barcelona boss, in 2009 and 2011, but failed to repeat that success in his three years with Bayern Munich.

City lost to Chelsea in the 2021 final but has also endured a series of agonizing exits from the knockout stages, with last season’s astonishing late collapse against Real Madrid in the semi-finals an especially bitter blow.

Asked if his time at City would be judged solely on his European achievements, Guardiola told reporters: “Yes. It doesn’t mean I agree with that but absolutely we will be judged by this competition.”

However, he believes City’s gradual progress from outsiders to established members of Europe’s elite under his leadership deserves more respect.

“Since day one when I arrived, sitting here for the first time, they (the media) asked me ‘Are you here to win the Champions League?’” he said. “I said ‘What? If you are manager of Real Madrid maybe I accept that.’ But I accept it here. It’s not going to change.”

City midfielder Kevin De Bruyne is adamant the Guardiola era should still be deemed a success despite the failure so far to land the Champions League title.

“Every year we have been close, quarters, semis, final. We just haven’t done the last bit. We are going to try again,” he said.

“If you care about the noise then obviously it’s going to annoy you. I know we haven’t won it but we have done really well.

“I know people only judge on if you win it, but there have been a lot of circumstances.”

Dare urges Flying Eagles to win FIFA World Cup

The Honourable Minister of Youth and Sports Development, Hon. Sunday Dare has tasked the Nigeria Football Federation to adequately prepare the U20 boys, Flying Eagles, to challenge for the FIFA U20 World Cup trophy in Indonesia in a few weeks.

Dare threw the challenge to the NFF and Head Coach Ladan Bosso at a reception hosted for the Africa U20 Cup of Nations bronze medalists at the Moshood Abiola National Stadium, Abuja on Monday.

“You have returned from Egypt with the bronze medals and the FIFA World Cup ticket, and a few other prizes, but the FIFA World Cup is in a few weeks and I want you to focus your mind on winning it for Nigeria for the first time. I understand Ghana is the only African country that has won the FIFA U20 World Cup. If Ghana can win it, why not Nigeria?

“I am happy about your performance in Egypt because you were able to come from a position of adversity – a depressing loss to The Gambia in the semifinal – to fire on all cylinders to defeat Tunisia for the bronze medals. That is the spirit that the Government and people of Nigeria want you to take to the World Cup. We are on the same page with the NFF on adequate preparation of our National Teams for matches and competitions, and I believe they will provide you with good-enough preparation for the global finals in Indonesia.”

Head Coach Bosso praised the Minister for his fatherly love, encouragement and support for the team since hosting the team to a similar reception after it won the WAFU B U20 Championship in Niamey 10 months ago.

“We are always encouraged by your inspiring and motivating words, and the length you go to simply to support the team and our dreams. I told you after the victory in Niamey that our target was doing well at the AFCON in order to earn a FIFA World Cup ticket. Now, just as I told the Nigeria Ambassador to Egypt in Cairo on Saturday, I want you to know that our fresh target is doing very well at the FIFA World Cup,” Bosso said. All players and team officials were at the reception, bar Belgium-based Ahmed Abdullahi, who is back at his base in Europe.

Also at the reception were the Permanent Secretary in the Ministry, Alhaji Ismaila Abubakar; Director of Federations and Elite Athletes Department, Dr. Simon Ebhojiaye; Chairman of the IMC, Hon. Gbenga Elegbeleye; Chief of Staff to the Hon. Minister, Alhaji Abba Abdullahi Yola; NFF’s Director of Communications, Ademola Olajire and; NFF’s Head of International Competitions, Dayo Enebi Achor.

The Flying Eagles will go on a short break before reconvening for the phased preparations for the FIFA World Cup, taking place in Indonesia, 20th  May – 11th  June.

NCF readies TBS Cricket Oval  for Women’s T20

The nation’s premium cricket grounds, Tafawa Balewa Cricket Oval in Lagos, is wearing new looks ahead of the forthcoming third edition of the NCF Women’s T20 Invitational Tournament scheduled between  March 25th   and April 3rd .

President of the Federation, Uyi  Akpata, has said the event beyond strengthening the ties between Nigeria and other top cricketing nations across the continent the tournament will help the country to build and expose the women’s team.

“In the last two years, the Tafawa Balewa Square oval has continually been upgraded and maintained in a bid to keep it in a tournament-ready state that we now have it,” he noted.

The 10-strip turf wicket grounds would be hosting all the games of the Women’s T20 Invitational that will feature, Cameroun, Ghana, Nigeria, Rwanda and Sierra Leone, which Akpata has said is going to be a different ground from what was played last year, because of the quality of attention give the facility.

The facility, would be hosting about 2,000 players, fans and visitors per day during the event including, students from cricket-playing schools, as a way to inspire them and bring them closer to the top talents representing the country.

“To manage the level of traffic we are envisaging during the tournament, we have had to also put all the complimentary facilities in proper shape. While we are hoping that our team will rise from the runner-up finish, last year, at the event to win, our success would need to find definition outside of the activities on the pitch,” he added.

The Nigerian Cricket Federation, he said, is deliberate about developing a sustainable event planning model, innovating, and keep re-inventing its value addition to corporate sponsors and partners; to be able to attract more partners in their journey to the game’s development.

Emeka Igwilo, the General Manager of the Nigeria Cricket Federation, said training and development for its key staff, to be able to handle the growing responsibilities that comes with the height and the vision they had mapped for the game of Cricket in the country.

“Nigeria is easily a major developmental hub for the game with an ambitious 250, 000 new entrants per year goals set by the present board. Events like the NCF Women’s T20 Invitational Tournament only go to complement all we have set as growth agenda, so we have to match up to it.” He added

Teams will start arriving for the 2023 NCF Women’s T20 Invitational Tournament on Friday, March 24th  , while Saturday,  March 25th   is set as the practice day for all teams ahead of the opening games on Sunday, March  26th  .

Moffi’s scoring consistency excites Nice coach

OG Nice coach Didier Digard has expressed satisfaction with their new signee, Nigeria international striker,  Terem Moffi particularly with his scoring consistency since joining the team from Lorient.

Moffi netted his third goal for Nice in their 2-2 draw against Nantes for  his 15th  goal of the season and Digard believed the Nigerian  ace would continue to improve.

“I think I’ll have the same speech every week. I am satisfied with him (Moffi). I understand that you have expectations of seeing him score but I think that’s reductive. When he doesn’t touch many balls, whatever happens, he is important. Opponents take a lot of precautions against him, either they play low or they are tight,” Digard said in  a post-match press conference at the weekend, “He always gives us something, by touching or not touching the ball. Today, he scored, which is good, he performed well.

“I’m still happy with him and his commitment since he’s been here. Either he scores or he allows us to score. He’s very consistent in what he does,” he added.

With a goal and assist in their 2-2 away draw at the weekend, Moffi beat his 2022 14 goal record after netting his 15th  goal this season in the French Ligue 1.

The Super Eagles striker was on target in the 4th  minute to shoot Nice to a 1-0 lead while he provided an assist to Youssouf Ndayishimiye in the 70th  minute.

Since joining Nice from Lorient in the January deadline transfer, Moffi has netted three goals for the Digard-tutored side.

Meanwhile, .Moffi is expected to lead Nice to host Sheriff Tiraspol at the Allianz Riviera on Thursday in the second leg of the Conference League Round of 16, a week after beating Sheriff 0-1 in Moldova.

Next Sunday, Moffi will face his former club Lorient in the week 28 of the league and Nice is in 7th place in the league with 43 points from 27 matches.

WTT Singapore Smash: Aruna faces stern test from French teenager

Quadri Aruna will early this morning face another Herculean task as he battles French teenage sensation Alexis Lebrun in the second round of the men’s singles at the WTT Singapore Smash taking place at the Singapore Sports Hub’s OCBC Arena.

Aruna who was at his best when he edged out Germany’s Ruwen Filus in a close contest that ended 3-2 in favour of the Nigerian in the first round on Sunday, will face a daunting task against the giant-killing French teenager who bundled out China’s Yuan Licen in the first round.

A determined Aruna told NationSport yesterday that he knew what he would face against the French star.

“Playing against some of these talented players is not always easy because you have to be at your best throughout the match,” Aruna said.“Having played against his younger brother at WTT Contender Durban, I knew what I went through before overcoming him but Alexis is more experienced than his brother so I must redouble my effort and ensure I play my best without giving room for errors.

“Singapore Smash is nobody’s game because it is always 50-50 against any player as everyone here is capable of winning the title and for you to get to an enviable stage in the tournament; you have to beat the best to be considered the best.

“ I am eagerly looking forward to the match as I am getting used to the time zone in Singapore. There is no doubt that it is going to be another big match for me and I will surely give my best again in the match,”Aruna added.

Yesterday’s matches witnessed several upsets with te  exit of  number two seed Mima Ito of Japan following a shock 3-2 defeat at the hands of China’s Qian Tianyi (6-11, 12-10, 11-8, 9-11, 12-10).

While Quek Izaac is the first-ever Singapore player to make the second round at Singapore Smash after posting an extraordinary comeback win over Sweden’s Mattias Falck (6-11, 3-11, 11-7, 11-9, 12-10).

Romania’s Elizabeta Samara was on top of the world on Monday after a career best win over Singapore Smash defending champion Chen Meng of China. Samara fought her way to an incredible upset win over the World No.2, coming out on top 3-2 (6-11, 11-6, 2-11, 11-6, 11-8).

Lalong, Plateau United pay tribute to Mabo

Plateau State Governor Simon Bako Lalong said  he received with shock but total submission to the will of God the death of  former Super Falcons coach Ismaila Mabo who died in the early hours of yesterday in Jos.

Lalong said Mabo’s death  was a great loss not only to his immediate family but to the entire people of Plateau State and Nigeria at large considering the impact he made in his sporting career and football in particular.

He said  Mabo in his playing days devoted his strength, energy and talent playing for many great clubs including the famous Mighty Jets Football Club of Jos and the national team, Green Eagles.

According to the Governor, Mabo  as coach, was  credited with discovering and mentoring  of young talents as well as grooming  and exposing them thereby enhancing the sport.

“We remember fondly his exploits as the Head Coach of the female national team, the Falcons during the FIFA 1999 Women’s World Cup; 2000 and 2004 Summer Olympic Games; as well as the Quarter Finals of the World Cup among others,” he said.“ During his lifetime on earth, coach Mabo loved people and promoted peace, unity and oneness irrespective of ethnic, religious or political considerations.”

Lalong said he has lost a personal friend and mentor who did not only offered him support during his football days, but also offered him advise on enhancing the game of football when he became Governor.

Similarly, the Management of Plateau United Football Club of Jos has described Mabo’s  death as a great loss not only to the state , but Nigeria as a whole in view of his invaluable contributions to the growth of women’s  football .

” We are saddened by the passing away of coach Samaila Mabo. He impacted positively on female football in Plateau State and Nigeria and the vacuum he left behind, will difficult to fill,” the club said in  statement signed by its Media Officer Albert Dakup.

  • Nottingham pray for Awoniyi’s quick return

Nottingham pray for Awoniyi’s quick return

Following groin injury to Brennan Johnson at the weekend, Nottingham Forest is eager to have Taiwo Awoniyi back in the team.

According to The Athletic, Awoniyi is nearing a return as the striker has not featured for the Reds since scoring the winner in a 1-0 win over Southampton in January.

Forests have an injury list that is far from ideal. Several players are nursing problems at the moment and on Saturday,  Johnson became the latest to be added to the list.

The 21-year-old came off straight away after signalling to the bench that he had done something to his groin. Steve Cooper confirmed afterwards that he will need a scan.

Forest will have everything crossed that it’s not too serious. The Reds desperately need their nine-goal star and the club’s Premier League existence could depend on his injury problem.

Awoniyi’s return could therefore offer a timely boost. He was just starting to adapt to life in the Premier League and his goal against Southampton was his fifth for the Reds.

The 23-year-old was starting to be a real menace playing as a left-sided forward. His groin injury came at an awful time for the Reds and they desperately need him back quickly.

Awoniyi was brilliant for Union Berlin last season. He was called ‘excellent’ by a Bundesliga pundit during the campaign and Forest could dearly do with him back as quickly as possible.

  • NFF mourns former Super Falcons’ coach, Ismaila Mabo

NFF mourns former Super Falcons’ coach, Ismaila Mabo

The Nigeria Football Federation has expressed deep sorrow over the death of former Nigeria defender and an accomplished Head Coach of the Senior Women’s National Team, Super Falcons, Pa Ismaila Mabo. He was 80.

Reports said Mabo died in the early hours of yesterday after a protracted illness.

“The death of Pa Ismaila Mabo came to me as a huge shock. Again, we have lost a great man and an accomplished trainer-of-trainers in the Nigeria Football fraternity, and my heart goes out to his immediate family and the other loved ones he has left behind.

“Mabo laid down a big marker for other coaches when he steered the Super Falcons to the quarter-finals of the FIFA Women’s World Cup in the USA in 1999. Yet, he was simple, humble and humane. We will miss him, but we are consoled that he left giant footprints in the sands of time and pray that God will grant him eternal rest,” President of NFF, Alhaji Ibrahim Gusau said yesterday.

A gifted central defender, Ismaila Mabo started as a schoolboy international with the Nigeria academicals team that broke the chain of Ghana’s constant whipping of Nigerian teams, when they defeated Ghana’s academicals 1-0 in Accra on 13th February 1966. It was the first time any Nigerian team would defeat a Ghanaian football team on Ghanaian soil.

Six days later, the Nigerian boys again defeated their Ghanaian counterparts 2-1 in Lagos. His team-mates included Peter ‘Baby’ Anieke, Tony ‘World 2’ Igwe, the illustrious Sam Garba Okoye and Eyo Essien.

After that accomplishment, Mabo joined Mighty Jets of Jos and was part of that club’s famous squad of the late 1960s and 1970s. He also featured for the senior national team, making his debut in a 1972 Africa Cup of Nations qualifying match against Congo in Brazzaville on 22nd  November 1970.

Mabo would later go into coaching, and was in the dug-out as Head Coach when the Super Falcons defeated North Korea 3-2, lost to USA and defeated Denmark 2-0 to reach the quarter-finals of the FIFA Women’s World Cup in 1999. The team stretched Brazil at that quarter-final stage before losing by a golden goal in extra time in Washington DC on July 1, 1999.

  • Lagos polls: Is LP forum shopping on e-transmission of results?

Lagos polls: Is LP forum shopping on e-transmission of results?

After losing a suit against the Independent National Electoral Commission (INEC) on electronic transmission of results at the Federal High Court in Abuja, the Labour Party (LP) filed and, on March 8, won a near identical suit at the court’s Lagos division, raising questions of forum shopping, described by lawyers as an abuse of court process. ROBERT EGBE reports.

    Lagos case

When news broke on March 8 that the Federal High Court in Lagos had ordered the Independent National Electoral Commission (INEC) to comply with electronic transfer of results for the March 11, 2023 elections in Lagos State, it sparked a frenzy of excitement among the 42 other applicants that filed the suit including the Labour Party (LP) and its governorship candidate Gbadebo Rhodes-Vivour.

The order, made by Justice Peter Lifu, compelled INEC to upload all results of the Governorship and State House of Assembly elections in Lagos State to its Result Viewing Portal (IReV) after collation by presiding officers in each polling unit.

The judge held that contrary to INEC’s argument, the court had jurisdiction to entertain the suit because it was commenced in accordance with the provisions of the law.

Justice Lifu also held that the subject matter of the suit was not a pre-election issue, as argued by INEC, because the reliefs sought by the applicants dealt with the preparation of the elections and not the conduct of the elections.

He reasoned that all the applicants were trying to do was to compel the electoral body to comply with the Constitution, its regulations and guidelines following its failure to do so during the Presidential and National Assembly elections held on February 25, 2023.

Specifically, the court granted the applicants an order of mandamus directing and compelling the defendant and all its agents to comply with and enforce the provision of clause 37 of the Regulations and Guidelines for the Conduct Of Elections, 2022 for the conduct of the elections on 11 March 2023 to wit:

“Mandating the Presiding Officer of all Polling Units to paste the Publication of Result Poster EC60(E) at the Polling Units conspicuously after completing the EC8A result sheet.”

The judge also mandated “the Presiding Officer of all polling units to transmit or transfer the result of the Polling Units electronically, direct to the collation system and use the Bimodal Voter Accreditation System (BVAS) to upload a scanned copy of the EC8A to INEC Result Viewing Portal (IReV) immediately after the completion of all the Polling Units voting and results procedures.”

At a first glance, the judgment seemed to put to rest the question whether e-transmission of results is mandatory or discretionary under the Electoral Act, 2022 and the INEC Guidelines.

Section 60(5) of the Electoral Act 2022 provides that “The presiding officer shall transfer the results including the total number of accredited voters and the results of the ballot in a manner prescribed by the Commission”.

Paragraph 38 of the Regulations and Guidelines, 2023 states: “On completion of all the Polling Unit voting and results procedures, the Presiding Officer shall:

“(i) Electronically transmit or transfer the result of the Polling Unit, direct to the collation system as prescribed by the Commission.

“(ii) Use the BVAS to upload a scanned copy of the EC8A to the INEC Result Viewing Portal (IReV), as prescribed by the Commission.

“(iii) Take the BVAS and the original copy of each of the forms in a tamper-evident envelope to the Registration Area/Ward Collation Officer, in the company of Security Agents. The Polling Agents may accompany the Presiding Officer to the RA/Ward Collation Centre.”

Thus, the Regulations and Guidelines seem to require that the presiding officer must electronically transmit the results from the polling units, after which the results would then be taken manually to the collation centres.

Some lawyers had argued, based on the above, that e-transmission of results is mandatory.

    But other senior lawyers disagreed.

For instance, Chief Adeniyi Akintola, SAN, argued that non-compliance with the e-transmission of results is not a ground for cancellation of such results, because e-transmission is discretionary.

He described the controversy as “the shenanigans of the oppositions on the issue of transmission of results and server.”

Akintola said: “Section 38 of the Electoral Act, 2022 referred to by Dino Melaye and their political parties has nothing to do with the transmission of election results.

“Section 60 (2) of the Electoral Act 2022 that deals with the transmission of results is at the discretion of the INEC; there is no mandatory provision regarding the transmission of results. In other words, the mode of transmission of the results is discretionary.”

“For the avoidance of doubt, Section 60 (2) reads ‘Subject to Section 63 of this ACT, voting at an election and transmission of results under this ACT shall be in accordance with the procedure determined by the Commission ‘.”

The senior lawyer explained that the rules and regulations made for the election by the INEC are “subject to the Electoral Act. The rules of procedure remain what it is, it is simply a rule. Election is a process and the Electoral Act 2022, has made provisions for the steps to take including resort to the judiciary for intervention.”

    Abuja case

Unknown to many Nigerians, the Federal High Court in Abuja had already dismissed a similar suit by the Labour Party seeking to compel INEC to adopt electronic method in transmitting 2023 election results.

Justice Emeka Nwite, in a judgment, held that Section 52(2) of the Electoral Act, 2022, cited by counsel to the party, Monday Mawah, provided for voting and transmission of results in accordance with the procedure to be determined by INEC.

According to him, this is to say that the commission is at liberty to prescribe or choose the manner in which election results shall be transmitted.

The judgment was delivered by Justice Nwite on January 23, prior to the Presidential and National Assembly elections held on February 25.

The LP, through its lawyer, had, on August 22, 2022, filed the originating summons marked: FHC/ABJ/CS/1454/2022 to sue INEC as sole respondent.

The party asked the court to determine whether having regards to combined effect of Sections 47 (2), 50 (2), 60(4), 60 (5) and 62 (1)(2) and other relevant provisions of the Electoral Act, 2022 the commission can still insist on manual collation of results in the general elections.

The LP sought two injunctive reliefs in the event that the question was resolved in its favour.

These include: “A declaration that the respondent has no power to opt for manual method other than the electronic method provided for by the relevant provisions of the Electoral Act, 2022.

“An order of this honourable court directing/compelling the respondent to comply with the Electoral Act, 2022 on electronic transmission of result in the forthcoming general elections. “

However, INEC neither responded nor filed any process in the suit.

Mawah, in his argument submitted that in view of the provisions of the law, manual collation of result was unknown to the Electoral Act, 2022 and therefore must be rejected or disallowed by the court.

Delivering the judgment, Justice Nwite held that the commission is at liberty to prescribe or choose the manner in which election results shall be transmitted,

He said from the argument of the plaintiff’s counsel, the bone of contention or the sections that sought for interpretation were Sections 50(2) 60(5) and 62(2) of the Electoral Act, 2022.

He said Section 47(2) as cited by the lawyer only dealt with accreditation of voters using a Smart Card Reader but not collation or transmission of result as postulated by him.

“The provision of Section 60(5) of the Electoral Act, 2022 as cited above has provided for the transfer of election result including the total number of the accredited voters from the polling unit.

“Section 62(2) on the other hand provides for compilation, maintenance and continuous update of the register of election result as distinct database for all polling units’ results as collated in all elections conducted by the commission.

“The said Section 62(2) has mandated that such register of election results shall be kept in an electronic format by the commission at its national headquarters.

“Now a close reading of Section 50(2) has provided for voting and transmission of result to be done in accordance with the procedure to be determined by the commission.

“This is to say that the commission is at liberty to prescribe or choose the manner in which election results shall be transmitted,” he said.

Nwite equally held that Section 60(5) empowered the polling unit’s presiding officer to transfer the election results including the total number of accredited voters and results of the ballot in a manner to be prescribed by INEC.

“This is also to say the commission is again at liberty to prescribe to the Polling Units’ Presiding Officers the manner in which to collate and transfer the election results as well as the accredited number of voters in an election under the Act.

“In view of the foregoing, can the act of the defendant (INEC) in collating and transferring election results manually in the forthcoming 2023 general elections be said to be contrary to the relevant provisions of the Electoral Act, 2022?

“The answer can only be in the negative as there is no wherein the above cited sections where the commission or any of its agents is mandated to only use an electronic means in collating or transferring of election results.

“If any, the commission is only mandated to collate and transfer election results and number of accredited voters in a way or manner deemed fit by it.

“In view of the above, I find that by the provisions of Sections 50(2) and 60(5) of the Electoral Act, 2022, the correct interpretation of the said statutes is that the defendant (Independent National Electoral Commission) is at liberty to prescribe the manner in which election results could be transmitted and I so hold,” he said.

    Forum shopping?

The similarity of the subject matter of both suits and the apparently conflicting decisions raised the issue of forum shopping by the LP.

    Forum shopping?

The similarity of the subject matter of both suits and the apparently conflicting decisions have raised the issue of forum shopping by the LP.

Lawyers agree that forum shopping is the unscrupulous practice of instituting an action in a court where a party is likely to receive a favourable decision. It also covers situations where a claimant gambles through different courts in a bid to “shop” for a favourable decision.

The court held in Alhaji Muhammadu Maigari Dingyadi & Anor v. Independent National Electoral Commission & 2 Ors, that forum shopping is an abuse of court process.

“It is not merely an irregularity that could be pardoned or overlooked but it constitutes a fundamental defect, the resultant effect of which would lead to a dismissal of the process that is abusive.

The Supreme Court in Arubo v. Aiyeleru held that once a court is satisfied that the proceeding before it amounts to an abuse of process, it has the right or duty to invoke its powers to punish the party which is in abuse of its process.”

Senior Advocate of Nigeria (SAN) Kunle Adegoke reasoned that the LP case seemed to fit the identity of a forum shopping example.

    He blamed politicians for it.

Adegoke said: “It is clear that politicians are the ones causing this problem. It is not really a problem of the judiciary, because if someone knows that the Federal High Court in Abuja has given a decision that the Federal High Court in Lagos may not be aware of, then that person comes to the Federal High Court in Lagos and makes a similar application, it becomes a problem.

“His Lordship in Abuja, not being aware that there is a decision of His Lordship’s brother in Lagos, saying something on the matter, might, based on persuasion by the lawyers, come to a different conclusion.

“The parties that are aware of the position of things are now seeking to take advantage of the situation. That amounts to forum shopping.

“If the first decision was given by the Abuja court in favour of INEC and the LP is aware and still approached the Lagos court, it is forum shopping.”

    What should INEC do?

Which of the two judgments should INEC follow? Does the Lagos decision stand?

Adegoke reasoned that if it is indeed confirmed to be a case of forum shopping, the Lagos orders, being second, can be set aside by INEC through an application.

He said: “An application can be brought before the court that gave the second order to say, ‘My Lord, vacate this order, because there is an order of your Lordship’s brother in so and so jurisdiction which had granted or refused a similar application, which they were aware of. For them to have come before your Lordship to seek the same order amounts to forum shopping and abuse of court process. “

The Silk noted that courts are jealous of their power and jurisdiction.

Adegoke said: “Every court in the land is under an obligation to protect its jurisdiction by ensuring that the process of the court is not abused. Where there is abuse, such abuse will be severely punished.

“That is why it is now incumbent on the courts where the second order was fraudulently obtained not only to set aside the order, but to equally impose heavy costs and sanctions on the parties that engineered such an abuse of court process.

“By that, it will become a deterrent for similar situations that politicians may want to take advantage of the court’s ignorance in various jurisdictions.
