    Uphold my mandate, Plateau governor urges Supreme Court

    Plateau State Governor Caleb Manasseh Mutfwang has urged the Supreme Court to uphold his election.

    He said of eight issues distilled before the Court of Appeal, only one was determined and others were untouched.

    He said the decision of the Court of Appeal was contrary to the directive of the Supreme Court that intermediate courts should pronounce on all issues placed before it.

    He said since he was not given a fair hearing by the Appellate Court, its decision to nullify his election as governor was manifestly flawed.

    Mutfwang, who made the submission in his brief at the Supreme Court by an eight-man team of Senior Advocates of Nigeria, said: “The law is settled that wherever there is a wrong, there must be a remedy.”

    A three-member tribunal on September 22, 2023, unanimously upheld the election of Governor Mutfwang.

    But the Court of Appeal on November 19 sacked the governor and declared the governorship candidate of the All Progressives Congress (APC), Nentawe Yilwatda, as the winner.

    Mutfwang, however, faulted the Court of Appeal judgment and asked the Supreme Court to restore his mandate.

    The apex court, has fixed Tuesday for hearing in the matter.

    Through his legal team, led by Kanu Agabi (SAN), the governor said when he presented eight issues before the Court of Appeal, only one was considered to invalidate his election.

    The governor’s brief reads in part: “Eight issues were distilled and placed before the court below for determination.

    “Unfortunately, only one issue (of jurisdiction) was determined by the court below leaving untouched seven issues.

    “This court has stated in a number of cases that intermediate courts should pronounce on all issues placed before them.

    “They should not restrict it to one or more issues which its opinion may dispose of the matter.

    “This is to give the apex court the benefit of their views in the matter should there be a need to consider other issues not determined by the intermediate court.”

    Mutfwang insisted that since he was not given a fair hearing, the Supreme Court should dismiss the judgment of the Court of Appeal, which invalidated his election.

    He added: “It is our further submission that having denied fair hearing to the appellant with respect to the Notice of Preliminary Objection as well as a motion to strike out the incompetent grounds of appeal, the decision of the lower court to dismiss same is, with all due respect, manifestly flawed.

    “The implication of denial of fair hearing renders proceedings null and void.

    “We respectfully urge the Honourable Court to invoke its powers in Section 22 of the Supreme Court Act by upholding the Notice of Preliminary Objection of the appellant embedded in his Brief before the lower court and also granting the Motion of the appellant filed on 2nd November 2023 before the lower court by striking out Grounds 1 – 9, 11, 12, 15, 16, 17, 20, 21 and 22 of the Notice and Grounds of Appeal of the first and second respondents.”

    Mutfwang listed eight reasons why the Supreme Court should validate his election.

    He said: “The issue of nomination and sponsorship which underpinned Ground 1 of the petition is not only a pre-election issue but within the internal affairs of the fourth respondent and as such the first and second respondents lacked the locus standi to canvass it.

    “The judgment of the lower court delivered on 19th November, 2023 is fatally flawed for want of jurisdiction having regard to Section 285(2) of the Constitution (supra).

    “Disobedience of court order is not one of the grounds for maintaining election petition under Section 134 of the Electoral Act (supra) nor is it part of Section 177(c) of the Constitution (supra), let alone disqualifying the appellant from contesting the election.

    “At any rate, given the overwhelming oral and documentary evidence including but not limited to EXHIBITS U and 2RA3, the fourth respondent complied with EXHIBIT G1 by conducting State Congress on 25th September 2021 in Plateau State.

    “The evidence of PW16 was thoroughly discredited and controverted and as such the lower court was clearly in the wrong to have heavily relied on it against the appellant.

    “The first and second respondents woefully failed to discharge the requisite burden of proof on them and as such not entitled to the reliefs sought in their petition more so that having impugned the election as invalid for non-compliance, it is absurd of them to lay claim to victory for the same election.

    “The lower court was, with all due respect, in grave error when it held that the tribunal was wrong in striking out the offensive paragraphs of appellant’s reply and in utilising evidence of PW16, PW24, PW27 and PW28 as a tribunal of first instance.

    “The lower court denied fair hearing to the appellant by dismissing his Notice of Preliminary Objection as well as Motion to strike out certain grounds of the Notice of Appeal of the 1st and 2nd Respondents without properly considering same.”

    The governor’s lawyers said they attached enough evidence to prove that the Court of Appeal should not have cancelled his election.

    They submitted: “We have demonstrably shown in this brief that, to all intents and purposes, the judgment of the lower court, with the greatest respect, has occasioned injustice of unquantifiable magnitude to the Appellant.

    “The law is settled that wherever there is a wrong, there must be a remedy. This principle of law which is of considerable antiquity is expressed in the Latin maxim, ubi jus, ibi remedium.

    “We, therefore, most respectfully urge the Honourable Court to allow the appeal, set aside the judgment of the lower court and thereupon affirm the appellant as the duly elected Governor of Plateau State.”

    Tinubu okays six executive directors for NPA, NIMASA

    President Bola Ahmed Tinubu has approved the appointments of six new executive directors for two agencies under the Ministry of Marine and Blue Economy; the Nigerian Ports Authority (NPA) and the Nigerian Maritime Administration and Safety Agency (NIMASA).

    Those appointed as NPA executive directors are Ms. Vivian Edet (Finance and Administration), Olalekan Badmus (Marine & Operations) and Ibrahim Umar (Engineering and Technical Services).

    For NIMASA are Jibril Abba (Maritime Labour and Cabotage Services), Chudi Offodile (Finance and Administration) and Fatai Adeyemi (Operations).

    Special Adviser to the President on Media and Publicity, Ajuri Ngelale announced their appointments yesterday via a statement.

    Ngelale explained that Tinubu believes that the appointees would use their “collective mandate to create the conditions required to significantly raise the contribution of the Marine and Blue Economy sector to the nation’s GDP (Gross Domestic Product).

    He added that the President hopes to see them help in making the nation’s economy “a labour-intensive and inclusive one that creates new opportunity for all Nigerians in accordance with the Renewed Hope Agenda”

    Borno youths drink fermented urine to get high – NDLEA

    The National Drug Law Enforcement Agency (NDLEA), has revealed how youths in Borno state drink fermented human urine, preserved over 10 days, as an alternative to hard drugs.

    The commander of narcotics of the NDLEA in Borno state, Iliyasu Mani, disclosed this in a statement issued in Maiduguri on Thursday, January 4.

    He expressed deep concern over the prevalent abuse of psychoactive substances among the youth, noting they also mix other unconventional substances such as lizard dung, camel urine, and mentholated spirit with soft drinks.

    He revealed they also inhale toilet fumes and gutter dirt in their quest to get intoxicated.

    Mani said: “Let me state categorically here that these new psychoactive substances that are commonly abused today include Cannabis Sativa, skunk, Cough syrup with codeine; Ice, Tramadol, Rohypnol, Diazepam, Pentazocine, rubber solution, glue, gutter dirt, toilet fumes, lizard dung.

    “Others include Lipton soaked in gin, camel urine, Mentholated spirit in soft drinks; 10-day-old human Urine, and so on.”

    Mani said the NDLEA command, under his watch, had fought a hard battle against drug abuse but “unfortunately, the issue of substance abuse is even getting challenging, especially with the involvement of young teens in the abuse of new psychoactive substances, especially women.”

    “Despite all these, we must not lose our hope as the agency has strengthened its efforts towards prevention strategy through the establishment of remodeled counselling/rehab centre within the premises of Borno State Command,” the NDLEA commander said.

    Mani said his command had also established drop-in centres across all tertiary institutions to serve as drug abuse research centres for the benefit of all.

    He said the command, under his watch, had seized  4.5 tonnes of illicit substances and arrested 863 suspects.

    Of those arrested, he said 53 had been convicted while 736 were undergoing counselling.

    Rivers State yesterday made progress in the implementation of the peace deal brokered by President Bola Tinubu between Governor Siminalayi Fubara and Federal Capital Territory (FCT) Minister, Nyesom Wike.

    The former Majority Leader, Edison Ehie, who was chosen as ‘Speaker’s by the group of four lawmakers, dropped the case instituted against the 27 members of the House of Assembly, led by Speaker Martins Amaewhule.

    The withdrawal of the lawsuit was consistent with the first item of the eight-point resolution signed by the governor, the minister and other party leaders.

    According to “Resolution One,” all the cases triggered by the crisis should be withdrawn by the parties.

    Fubara, who also reflected on the political impasse yesterday during his visit to his Bayelsa State counterpart, Douye Diri, described the crisis as unfortunate.

    The Bayelsa governor urged Fubara and other leaders to embrace peace in the interest of the state.

    Ehie withdraws case

    Ehie, who recently resigned his membership of the House of Assembly, withdrew his contempt case against his 27 colleagues, in the spirit of the peace accord.

    As ‘Speaker,’ elected by the group of four lawmakers, he had declared the seats of the 27 lawmakers vacant, following their defection from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC).

    Ehie, an ally of  Fubara, had filed contempt proceedings at the Rivers State High Court in Port Harcourt against the lawmakers for allegedly disobeying the order of the court to discontinue sitting.

    When the matter came up for hearing before the court, his lawyer, Mac-Barango, tendered a notice of discontinuance filed by his clients and appealed that the court should give effect to the notice.

    The request was not challenged by the defendant’s lawyer and the judge  struck out the matter.

    Diri sues for peace

    Diri urged Fubara to work for peace in a bid to realise his vision to develop Rivers when he hosted him at his country home in Sampou, Kolokuma/Opokuma Local Government Area.

    It was Fubara’s first visit to the state since he assumed office on May 29, last year..

    Fubara also visited Senator Azuta Mbata in his residence to felicitate with him on his birthday.

    Stressing the importance of peace, Diri said no development can take place where there is crisis.

    The Bayelsa governor said in a statement by his Chief Press Secretary, Mr. Daniel Alabrah, that Rivers and Bayelsa have a long-standing brotherly relationship, adding that lwhatever affects one affects the other.

    He disclosed that he had worked behind the scene to ensure peace returned to the state.

    Diri cautioned against giving ethnic coloration to the crisis, saying that the Ikwerre of Rivers and the Ijaw of both Rivers and Bayelsa were one.

    He also advised Fubara to be tolerant and patient while focusing on implementing his projects for the benefit of the state

    While expressing willingness to forge closer ties with the Rivers governor in the interest of both states, Diri welcomed Fubara’s olive branch to find an amicable solution to the legal tussles between both states over the Soku oil wells and the Rivers State House that was demolished in Bayelsa.

    Diri said: “Rivers and Bayelsa are one and the same. That is why during the political crisis, we worked behind the scene to ensure peace reigned in your state. What affects Rivers affects Bayelsa.

    “My thinking is that there has to be peace in Rivers State. God should grant you the wisdom to govern. At this time, you must be patient and tolerant. You should also communicate with God and He will guide you.

    “Some people wanted to give the crisis ethnic colouration, but I said no. We should all look for peace and not escalate it so that the governor will also focus on delivering development to his people. I again call for peace and understanding so that both states will experience development.”

    Diri said he was happy that the rift between thectwo states woukd be amicably resolved.

    He said: “We have some cases in court and I am sure you have been briefed. That is why you said we should talk about our issues. I am very prepared to discuss with your government to resolve them.

    “Our politics must be people-oriented. If we serve our people well, we serve God. We also need to meet more closely and explore areas of mutual benefits to both states.”

    Fubara said his visit was to foster unity and seek areas of collaboration between both states.

    He said the two states had a lot in common, adding that they could not afford to work at cross purposes.

    Crisis unfortunate, says Fubara

    Fubara said the recent crisis in Rivers was unfortunate, pointing out that the issues were being resolved.

    He thanked President Tinubu for brokering a truce in the state, promising to support his laudable policies and programmes for the country.

    While thanking the people of Bayelsa for their solidarity, he said he would forge a closer relationship with Diri, which would enable both states to make progress.

    He said Rivers was willing to dialogue and resolve the legal issues involving both states, insisting that as brothers, an amicable solution can be found to the challenges threatening to divide them.

    Fubara stressed: “There is no difference between Rivers and Bayelsa. The creation of Bayelsa was for development purposes. We are one and the same people.

    “My visit is a unification meeting. We are here to tell our brother that we want to work together for a common purpose, which is the development of both states.

    “We have a lot of things jointly owned by both states. We need to meet and settle all issues. We cannot be developed in a situation of crisis. Peace is the major ingredient for development.

    “We appreciate the people of Bayelsa for their solidarity during our trying period. Whatever affects Rivers affects Bayelsa. But equally important is that Nigeria needs peace in Rivers because of our strategic importance.”

    Ijaw group lauds Rivers/Bayelsa mediation

    An Ijaw group, Izon-Ibie Political Front (IIPF)   commended Diri and former Governor Seriake Dickson for  rallying support for Fubara in the course of resolving the Rivers crisis.

    A statement by its spokesman, Walter George,  expressed gratitude for their united front and and bond of unity. 

    He said the display of support by Dickson and Diri  underscored their solidarity that transcended political affiliations.

    George said: “The unity demonstrated by  Dickson and Diri in supportin Fubara is a testament to their commitment to regional stability and progress. It sets a positive precedent for collaborative governance.

    “The IIPF recognises the intricate nature of the current political landscape, particularly,  the ongoing tensions between  Fubara and his predecessor, Chief Nysemo Wike,  the Federal Capital Territory Minister.”

    He added: “As a group, we stand firm in solidarity with you during this challenging period and we know this is a test of leadership and it can be surmounted through unity and strategic collaboration.“

    Qurix’s tenure would end on Monday after serving for six years as Vice – Chancellor.

    A former Executive Secretary of the Tertiary Education Trust Fund, Prof Suleiman Bogoro said Qurix transformed the university after taking over.

    Prof Bogoro spoke during the valedictory lecture in honour of Qurix delivered by the Secretary – General, Committee of Vice-Chancellors of Nigerian Universities, Prof Yakubu Ochefu on Thursday.

    Governor Sule made this known yesterday at the Government House, Lafia when he hosted the new official of the Nasarawa State Football Association led by the Chairman, Salisu Galadima.

    He said the contributions of Salisu towards the growth of grassroots soccer are a position to be reckoned with.

    Galadima appreciated Governor Sule for his inputs to the growth of football and sports in the state.

    He noted that apart from new reforms that include capacity building of football officials across the state, the association is also ready to commence activities that would further herald the growth of football in Nasarawa State, just as he used the forum to seek Governor’s support towards building a football secretariat at par with international best practices.

    Killings: Northern governors laud Tinubu’s steps to curb recurrence

    The Northern Governors’ Forum has praised President Bola Tinubu for making efforts to probe the security crises in Plateau and Kaduna states in order to prevent a reoccurrence.

    Chairman of the forum and Gombe State Governor Inuwa Yahaya, who gave the commendation in Hausa language on behalf of the body, also thanked the President for supporting the survivors and victims of other crises.

    Yahaya addressed reporters at the Presidential Villa in Abuja after a meeting with President Tinubu.

    “In my capacity as the Chairman of Northern Governors’ Forum, I praise the steps taken by the President in order to get to the root of what happened in these two states and the pledge he made that the right action would be taken to prevent future occurrence of these incidents. A bove all, I am thanking him for the support given to victims or survivors,” he said.

    Commenting on Plateau killings, the governor noted that it was not a new thing, but said there was need for a review of the immediate and remote causes to find a lasting solution.

    “Despite the fact that this matter has been there for long, it is time for stakeholders to have a round table and tell each other the truth and then take deliberate steps toward loving each other. Before now, the people were living in peace and going about their normal businesses.

    “Some of the major issues that seem to allow the problem to persist include issues like farmer-herder clashes, the clamour for indigenes versus settlers. But the world over, if any society or country doesn’t welcome visitors, such a nation will not progress. After all, we here are one and the same family,” Yahaya said.

    Kano Govt releases N1b to victims of demolition

    • Victims: We’ve lost over 30 persons

    Leaders of Masallacin Eid Shop Owners and Traders Association, yesterday, said over 30 people lost their lives during and after the demolition of shops at Eid Ground by Kano state government.

    Legal counsel to the traders, Ma’aruf Muhammad Yakasai, said the state government has paid the sum of N1 billion for the demolition of his clients’ properties but insisted justice must be done to those who died or suffered injuries as a result of the demolition.

    The victims said they also want the “criminal aspect of the demolition” investigated and the culprits punished according to the law.

    The association had dragged Kano state government to court, claiming damages of N250 billion. But the court ordered the state government to pay N30 billion as compensation for the demolition of more than 6,000 of their shops at the Eid Ground.

    However, through out-of-court settlement, an agreement was reached that the state government will pay N3 billion in three tranches.

    Briefing journalists at Kano Press Centre, lawyer to the victims Yakasai, said: “We have already received alert of N1 billion for the demolition, but justice must be done to their members who died as a result of the demolition, including those who sustained varying degrees of injuries.”

    Yakasai said he has written the Kano State Commissioner of Police asking him to treat the case as criminal conspiracy, theft, misappropriation and mischief, contrary to sections 97, 286, 308 and 326 against Governor Abba Kabir Yusuf, Rabi’u Musa Kwankwaso and others.

    Part of the letter to the police reads: “We are only known as peaceful traders who only carry out lawful businesses within the area curved out from the Kofar Mata Eid-ground by Kano State Government and allocated to various individuals for commercial purpose.

    “Shortly before the 2023 Governorship election, some people were heard and seen physically and over the media repeatedly, stating unequivocally, that if his party wins the election, they would demolish all the structures/shops (own by our members) at the Kofar Mata Eid-ground.

    “Subsequently, NNPP emerged as the winner of the election, and Governor Abba Kabir Yusif, was sworn in. Unfortunately, even before cabinet members were nominated and appointed, Governor Yusif formed a committee with the sole responsibility of carrying out the demolition exercise. Our shops were demolished. Some criminal minds were also encouraged by the government to loot our properties as the demolishing was on going. They described our hard own properties as public properties and declared same as free for all.

    “Consequently, the suspects succeeded in destroying all the structures; goods and monies (cash) kept in shops were stolen. Some of the victims lost their lives, some are now patients with different sickness, including the killer ‘stroke.’

    “The victims’ orphans and children are left with no parental care and attention, many are rendered homeless. The total estimated value of the properties lost and destroyed is N260 billion…”

    “One of my primary focuses as your representative is to promote peace and unity among ourselves. Ohanivo Cultural Carnival, designed to showcase our rich and diverse cultural heritage, is one of the means of promoting unity and peaceful coexistence at Ohaozara/Onicha/lvo Federal Constituency and Ebonyi State.

    “Undoubtedly, no meaningful and measurable growth and progress can be achieved in the midst of crisis, chaos, bickering and disunity.

    “As a people, we’ve come a long way. From 1976 through 1996, we existed as one indivisible Ohaozara Local Government (now referred to as Old Ohaozara).The 1996 political expansion that split us into Ohaozara, Onicha and lvo local governments couldn’t divide us as it brought us into the same Ohaozara/Onicha/lvo Federal Constituency and we’ve continued to coexist peacefully.

    “Therefore, there’s now the need to make a unique definition of who we are through our culture, our way of life and tell our stories in our own unique way. This is what this carnival stands for and promotes.

    “This carnival is expected to serve as a unifying symbol for our people, a reminder that we’re one indivisible people,” he said.
