    ‘29 errant employers fined N205m in Q3’

    •As PenCom recovers N959m contributions, drag others to court

    Twenty-nine errant employers paid two per cent penalty on unremitted pension contributions of their employees to their Retirement Savings Account (RSA) in Third Quarter of last year, The Nation has learnt.

    The penalty totalling N205.9 million was surcharge by the regulatory authority, the National Pension Commission (PenCom) for not remitting N959.05 million deducted from their employees’salaries.

    Meanwhile, 19 defaulting employers have been recommended for appropriate legal action.

    The commission made this known in its “Update on Recovery of Outstanding Pension Contributions and Penalties from Defaulting Employers Third Quarter Report 2022”.

    According to the report, the total amount paid by the employers is N1.16 billion during the period under reveiw.

    The report read: “Following the issuance of demand notices to defaulting employers whose pension liabilities were established by the Recovery Agents (RAs), N1.164 billion representing principal contribution N959.05 and penalty N205.90 was recovered from 29 defaulting employers during the quarter under review.

    “Meanwhile, 19 defaulting employers have been recommended for appropriate legal action, after  administrative steps taken to make them comply failed. From the commencement of the recovery in June 2012 to 30 September 2022, a total of N23.29 billion, comprising principal contributions N12.39 billion and penalties of N10.89 billion was recovered from defaulting employers.”

    Section 11 (5) (b) of the Pension Reform Act (PRA 2004) provides that the employer shall not later than seven days from the day the employee is paid his or her salary, remit an amount comprising the employee’s and employer’s pension contributions to the custodian specified by the Pension Fund Administrator (PFA) of the employee.

    Furthermore, Section 11 (7) of the PRA 2004 provides that any employer who fails to remit the contributions within the time prescribed shall, in addition to making the remittance already due, be liable to a penalty to be stipulated by the Commission provided that the penalty shall not be less than 2 percent of the total contributions that remains unpaid for each month the default continues.

    NNONYMOUS: I have a problem with my pension. I am a police officer. My pension has not been paid into my pension account since 2017. I have been on this for the past three years by moving from one office to another but all my efforts prove abortive. Kindly help me.

    DENNIS: Dear Sir, my name is Dennis and my Pension Fund Administrator is FGPL. I retired from the Nigerian Police Force on June 1, 2008 and my monthly pension is N26,451.84. I have been receiving this amount for 14 years and six months and I have not been enhanced. Please can you tell me why? Thank you.

    PENCOM: The pension enhancement is only for Retirement Savings Account holders that have received significant growth due to return on investments over the years.

    AKPUDOGWU: My name is Akpudogwu and my Pension Fund Administrator is Veritas Glanvill Pension. My compliant is that I have been running around for my 25 percent benefits since my appointment was terminated in April. I have concluded everything and submitted my documents.

    Accoding to my PFA, my documents have been sent to PenCom but they haven’t approved the payment.

    Emails have been sent to them as a reminder yet no payment.

     I was later posted to Civic Centre, Victoria Island, Lagos, between April 2017 to November 2018, but none of my pension was remitted to my Leadway Pensure account.

    Please persuade the company to remit my pension for the aforementioned years. Thank you.

    My RSA is First Guarantee Pension Limited. I have been paid but my complaint is my pension was calculated with 13, 11 instead of 14,11. The lump sum given to me was less than what was paid to my colleagues despite getting appointment at the same period.

    PTAD: survey only for U.S-based pensioners

    The Pension Transitional Arrangement Directorate (PTAD) has reminded pensioners under the Defined Benefit Scheme (DBS) living in the United States that the Directorate’s Diaspora Pensioners’ Survey for pensioners is still open.

    The Executive Secretary, Dr. Chioma Ejikeme, who made this known, however, said the survey was only for the U.S.

    She called on them to log on to PTAD website to participate.

    She said: “USA Residents who are pensioners under the Defined Benefit Scheme managed by PTAD are enjoined to log on to PTAD website to complete the survey form. This is for both verified and un-verified pensioners, even if they participated in the I Am Alive Confirmation Pilot.

    “The survey will provide PTAD with a comprehensive database of the contact information and other related information of Diaspora Pensioners residing in the U.S. It will also assist the Directorate plan for the verification and biometric capture of those that are yet to be verified. They are to click on the link to participate now on https://www.ptad.gov.ng/

    “Pensioners who face challenges filling out the survey form can send an email to complaints@ptad.gov.ng or info@ptad.gov.ng for assistance.’’

    She stressed that PTAD is responsible for the pension administration of the DBS. PTAD was established to address the pensioners’ complaints that bother on issues such as non-payment of monthly pension, short payment of pension and gratuity, removal of name on pension payment voucher, non-payment of harmonised pension arrears, and irregular payment of federal pensions and non-receipt of pension after retirement, etc.

    “Empowered by Section 30, Sub- Section (2a) of the Amended Pension Reform Act, 2004, and it will take over the management of three of the offices running the old pension scheme.

    “These are the Civil Service Pension Department, the Police Pension Office and the Customs, Immigration and Prisons Pension Office (CIPPO),” she added.

    Lagos, Osun, Kaduna, FCT top list of pension compliant states

    Lagos, Osun and Kaduna states as well as the Federal Capital Territory (FCT) have remained on the top list of pension compliant states  as at Third Quarter of last year.

    However, on the bottom list are Kwara, Plateau, Cross River, Borno, Akwa Ibom, Katsina and Yobe states.

    This was made known in the National Pension Commission (PenCom) Quarter Three, 2022 Report obtained by The Nation.

    According to the report,  Lagos, Osun and Kaduna states and FCT have enacted laws on the Contributory Pension Scheme (CPS) and establised Pension Bureau/ Board in line with CPS.

    They are also remitting employer and employee contributions; conducted Actuarial Valuation Availability of RBBRFA; Funding Accrued Rights; Payment of Pension under CPS; and have Valid Group Life/Sinking Fund for their employees.

    Status of implementation of CPS

    On status of implementation of the CPS and other schemes, the report stated that the number of states with laws on the CPS remained 25 as at Q3 2022, with seven at bill stage.

    The Bauchi State Government enacted its law on the CPS last August 5.

    Meanwhile, five states have enacted laws on the Contributory Defined Benefits Scheme (CDBS) with two out of five states implementing the scheme while the other three – Gombe, Zamfara and Adamawa – are yet to commence implementation.

    Emerging issues in  CPS’implementation in Kaduna

    According to the report, the Kaduna State Pension Bureau requested a meeting with the Commission on July 27, 2022 to discuss its desire to implement  its pension arrangement.

    The report read: “The move was in the state’s efforts at finding solutions to the debacle of its huge accrued rights liabilities. However, the meeting could not hold due to the two-day public holiday declared on 27 and 28 July, last year, in the state. A new date is yet to be fixed for the meeting.

    “The state has, however, requested the requirements for the issuance of a ‘’no objection’’ by the Commission, to enable the PFAs invest in its bonds. A copy of the requirements was forwarded to the Executive Secretary of the Kaduna State Pension Bureau.”

    Lagos N2 billion monthly commitment on accrued rights

    The Lagos State Government paid  N1.5 billion and N1.11 billion for July and August, last year, to settle the outstanding accrued rights being owed to the state’s retirees.

    This brings the cumulative payment  made by the state from December 2021 and August 2022 to N9.33billion, instead of N18 billion.

    Benue State Pension Reform Law 2019

    The Benue State Pension Commission forwarded a Draft Pension Bill 2022 aimed at re-enacting a new Pension Law to the Commission, for review.

    The Commission has done its work and returned it for comments and observations to the state. The state had incorporated the Commission’s input, but is yet to present the Bill to the state House of Assembly for legislative processing, the report stated.

    Ekiti State retirement benefits’ payment

    PenCom said the Ekiti State Government on August 4, last year, issued retirement bond certificates totalling N18.84 million in favour of 30 beneficiaries.

    “The beneficiaries are the state’s first batch of retirees under the CPS. The Ekiti State Pension Commission (ESPC), via a letter of August 24, 2022, informed the Commission of its intention to implement a Voluntary Contributions (VC) under the CPS for  mandatory and exempted employees of the state.

    “The state subsequently forwarded a draft VC Guidelines to the Commission for review. The guidelines are being reviewed by the state’s Operations Department and Benefits and Insurance Department of the Commission.”

    “The Commission also received a copy of the amended Ekiti State Pension Reform Law 2022, on 5 September 2022. The law has been reviewed from both the operational and legal perspectives and forwarded to the state.”

    Bauchi State Pension Reform Law 2022

    The Bauchi State Governor signed the Bauchi State and Local Government Pension Bill 2022 on August 5,  last year into law.

    The law seeks to institutionalise the CPS in the state. The Commission  forwarded a roadmap to the state to guide the implementation of the scheme.

    Status of refund on Zamfara funds

    The Commission finalised and forwarded the report on the refunds of pension contributions to the Zamfara State Government and its employees to the Zamfara State Head of Service, the state’s consultant – Royal Rocks Consulting – and the Speaker of House of Assembly.

    Following the review of the report, the consultant had forwarded its observations to the commission and  it is being reviewed by the Commission, the report stated.

    ADEREMI: Hello Omobola, I thank The Nation for the special coverage on pensioners. l retired from NITEL. l did my verification since January 20I8.  But l am yet to get my pension from PTAD.

      My date of first appointment is July 2, I979 and that of retirement November I4, I99I.

    PTAD: In line with Circular B63304 X111/879 of June 29, 1992, any pensioner who served for less than 10 years as at March 31, 1977 or less than 15 years from April 1, 1977 to June 1, 1992 and less than 10 years with effect from June 1, 1992 does not qualify for pension. Therefore, the complainant is not qualified for pension as he served for less than 15 years (July 2, I979 to November I4, I99I).

    ANNOBYMOUS: My father was under the Defined Benefit Scheme (DBS).

    He was appointed on 3/7/89 and was removed on 27/4/1999.

    I would like to know if he is my eligible for pension.

    PTAD: Your father is not qualified for pension as he did not serve up to 10 years from 3/7/89 to 27/4/1999, in line with Circular B63304 X111/879 of June 29, 1992. He was short of being eligible by three months.

    MABAWONKU: My name is Mabawonku. This is a reminder to the newspaper that I have sent my bank statement from retirement to date to PTAD as directed since July 6 , 2022. but I have not received any response from them.

     I retired from Nigeria Educational Research and Development Center (NERDC) in 1993 after serving for 11 years. I complained that my federal share of my gratuity from 1982 to 1993 had not been paid.

    Secondly, my pension from January to July 1993 was not paid too.

    I did  verification at the PTAD’s office in Lagos in 2019, submitted bank statements from 2008 to date as requested by the PTAD, including the one showing the gratuity paid in 2017.

    My original pension file has been retrieved from NERDC by PTAD since November 2017. With the conditions met since 2019, the gratuity and pension arrears have not been paid.

    Please help.

    They have refused to pay my money for 17 years.

    ONOH: My name is Onoh, I retired from the Ministry of Public Utility on May 6, 2004. This is a reminder on my call for help with nonpayment of gratuity and monthly pension. Sir, I humbly beg you to help me solve this problem of nonpayment of my gratuity and 75 months pension allowance, which has lingered for years back, despite my complaints at several pension verification exercises. I am from Cross River State. My gratuity is N244,336.32 and monthly pension is N6,244.14. I was placed on pension payroll in September 2010, leaving 75 months behind. This amounts to N468,310.513.     Stanbic IBTC Pension Managers Limited  has denied giving  incentives to Retirement Savings Account (RSA) holders to woo them.

    It would be recalled that some media organisations (not this newspaper) reported that some Pension Fund Administrators (PFA)  were giving out gift vouchers worth millions of naira to some clients against the directive of the National Pension Commission (PenCom) which aims to end “unhealthy competition” in the industry.

    In a statement, Stanbic IBTC Pension states: “We would like to clarify that this news is false and does not represent our ethos and values as an institution. Further to PenCom’s directive in October 2022, our clients were notified of the directive and its subsequent implications leading to the discontinuation of our Loyalty Programme on November 5, 2022 as approved by PenCom.

    PenCom reiterates commitment to global best practices

    The National Pension Commission (PenCom) is providing global best practices in pension regulation and supervision, the Director-General, Mrs. Aisha Dahir-Umar, has said.

    Mrs. Dahir-Umar said the commission has been steadfast in its administration, with the staff and management shunning malpractices.

    She said the Pension Fund Assets under Management (AuM), which stood at about N15trillion as at last December, increased by N156.74 billion in Q3.

    She said the operators, which include Pension Fund Administrators (PFAs), Pension Fund Custodian (PFCs) and Closed Pension Fund Admistrators (CPFA), have also been complying with the Pension Reform Act (PRA) 2004.

    She said they were doing their best to keep the pension fund  under the Contributory Pension Scheme (CPS).

    She maintained that while it had not been easy keeping off elements that think the fund is another national cake to be shared, she and the staff members of the commission would ensure that they were eradicated.

    She assured workers of safety of the fund and promised that retirees  would continue to receive their pension promptly.

    She noted that pension administration before 2004 was bedeviled by many problems.

    She said: “Prior to the enactment of the Pension Reform Act 2004, pension schemes had been bedevilled by many problems.The Public Service operated an unfunded Defined Benefits Scheme (DBS) and the payment of retirement benefits were budgeted annually.

    “The annual budgetary allocation for pension was often one of the most vulnerable items in budget implementation in the light of resource constraints. In many cases, even where budgetary provisions were made, inadequate and untimely release of funds resulted in delays and accumulation of arrears of payment of pension rights. It was obvious, therefore, that the DBS could not be sustained.”

    The DG continued: “In the private sector on the other hand, many employees were not covered by the pension schemes put in place by their employers and many of these schemes were not funded. Besides, where the schemes were funded, the management of the pension funds was full of malpractices between the fund managers and the Trustees of the pension funds.

    “This scenario necessitated a re-think of pension administration by the administration of President Olusegun Obasanjo.

    “Accordingly, the administration initiated a pension reform to eliminate the problems associated with pension schemes. The outcome was the enactment into law of the Pension Reform Act 2004,” she noted.

    The PenCom chief added that the Third Quarter 2022 Report provides  stakeholders and the public with details of strategic activities that focused on ensuring the prompt payment of retirement benefits, as well as efforts aimed at promoting a vibrant and sustainable pension industry that positively impacts the  economy.

    “I would like to commend the sustained efforts of the staff and management of the commission, which ensured the achievement of the commission’s medium and long-term objectives. I am also delighted to mention that despite the overwhelming head-winds in the global economic climate and the country’s challenging macroeconomic environment, the Pension Fund Assets under Management (AuM) increased by N156.74 billion from ?14.27 trillion as 30 June 2020 to N14.42 trillion as at 30 September 2022. This laudable performance, in the growth of the AuM, points to the fact that the pension industry will continue to deliver value and benefit to its stakeholders and the nation’s economy.

    “During the period under review, the Commission steadily pursued increased diversification of pension fund portfolios by ramping up efforts aimed at ensuring sustained investment of Pension Fund in alter- native Asset classes and structured infrastructure projects that meet the stringent requirements as enshrined in the Regulation for the In- vestment of Pension Fund Assets. Although the Commission’s efforts at diversifying investments of pension funds and hedging against inflation has gradually begun to yield results, it is, however, worthy to note that efforts are ongoing to ensure that the annualized average rates of return of pension funds across RSA and Legacy Funds are above headline inflation rates.”

    She continued: “Perhaps, the most significant achievement recorded in the third quarter of 2022 was the successful issuance of Guidelines on Accessing RSA Balance towards payment of Equity Contribution for Residential Mort- gage. The Guidelines give effect to Section 89(2) of the Pension Re- form Act (PRA) 2014, which allows eligible RSA holders to apply a per- centage of the balances in their Retirement Savings Accounts for payment of equity contribution towards residential mortgage for employees of the Public, Private and the Informal Sectors.

    “This significant achievement in the Nigerian Pension Industry could not have been possible without the right people, strategy, culture and governance structures that support the delivery of consistent and sustained value for all our stakeholders. We have, once again, demonstrated our firm assurance to serving the needs of our stakeholders and providing global best practices in pension regulation and supervision”, she added.

    EFE: Good day. I am Efe, writing from Warri, Delta State. Your efforts at ensuring retirees are not subjected to untold hardship are highly appreciated.

      I want to know if you only attend to federal employees because I retired from the Local Government Service Commission, Asaba, the Delta State capital.

      I retired in October 2020. Since then, I have not been able to access my RSA, although my PFA, Trustfund Pension, sent me a text message stating that I could access my RSA account while also requesting a letter from Asaba.

      I am confused. I don’t know what to do. Please do advise on what to do.

    MOMODU: Hello, last December 16, I received a text message from Access PFA, formerly FGPL, apologising for the delay in paying my benefit. It said the delay was due to the upgrade of their system. I am waiting to hear from them by this month.

    UREGI: My name is Uregi. Thanks very much for assisting us to solve entitlements’ problems.  

     You will recall that PenCom recently issued a circular on pension enhancement payment in which it indicated that “the exercise is for retirees under PW who have accumulated significant growth in their RSAs”.

    This criterion appears confusing, and if left to PFAs to decide who to pay, using this criterion, the exercise could be subjectively implemented.

    Therefore, every pensioner should enjoy an enhancement every three years, because pensioners’ funds should have been gainfully invested during intervals.

    No pensioner would believe that his cash in the RSA was not invested for those years.

    I want to add that I retired in February 2014, but I got enhancement only once – 2017. I was denied an increment in 2020. I was also not convinced why I was excluded.

    Kindly provide us more explanation on this issue. Surely, I must have expressed the mind of thousands of concerned pensioners. Thanks a lot.

    HAMADU: My name is Hamadu. I retired in November 2017 from the Independent National Electroral Commission (INEC), Abuja as Deputy Director on Grade Level 16/9.

    ANNONYMOUS:  Hello Omobola. I worked as a marketing officer at Ovidi Microfinance Bank Okene, Kogi State for four years. The bank was liquidated. I sought to collect the money that I saved with it. But I was told that if I did not work up to five years, I could not collect my money.

    I argued that I made more contributions after I got anothe job  and, as such, should be entitled to another 25 per cent based on the new contribution I made when I became employed.

    I want to know if you only attend to federal employees’ issues,because I am a retired state worker of the Local Government Service Commission, Asaba, Delta State.

    I retired in October 2020. I have not been able to access my RSA, even though my PFA, Trustfund Pension, sent me a text mesage that I can access my RSA account, but at the same time requesting a letter from Asaba.

     I am confused. I don’t know what to do. Please do advise on what to do. – Efe from Warri.

    MOMODU: Hello, on December 16, last year, I received a text message from Access PFA, formerly  FGPL, apologising for the delay in paying of my benefit.

    He said the delay was as a result of their upgrade. I am waiting to hear from them by February.

    UREGI: My name is Uregi. Thanks very much for assisting us solve problems pertaining to our entitlement. PenCom recently issued a circular on pension enhancement payment in which it indicated that “the exercise is for retirees under PW who have accumulated significant growth in their RSAs”.

    This criterion appears confusing, and if left to PFAs to decide who to pay, using this criterion, the exercise could be subjectively implemented.

    Therefore, every pensioner should enjoy an enhancement every three years, because pensioners’ funds should have been gainfully invested during intervals of the three years.  

    No pensioner would believe that his fund in the RSA was not invested at all for three years.

    I retired in Febraury 2014, but I got enhancement only once in 2017. I was denied an increment in 2020. I was also not convinced why I was excluded.

    Please PenCom should provide us more explanation on this issue.

    ANNONYMOUS: Hello Omobola, I was a marketing officer at Ovidi Microfinance Bank, Okene, Kogi State for four years. I sought to collect the money that I saved, but was told that if I did not work up to five years, I could not do so. Kindly explain this for me.

    NKOYO:  Good day, I am Mrs Nkoyo. I worked with the Ministry of Defence. I was later deployed to Nigerian Navy as a nurse. I have not been paid since December 2021. I have been suffering under Standard Alliance Life Assurance where I have my annuity for life pension. I retired in March 2014.

    My PFA is Premium Pension. In 2016, I joined Leadway Pensure for Annuity.

    Up till now, my 2.5 per cent is yet to be paid. When l visited premium office in Makurdi, I was asked to apply for the payment which I did since July, last year.

    ODUNAYO: Dear Omobola, I had lodged a complaint on the non-payment of my late brother, Police Corporal Odunayo and you asked me to purchase The Nation, which I did but nothing about my case was mentioned. I even bought another edition. Still, nothing was said about it.

    It is almost five years that his pension was paid. His PFA is Premium Pension.

    He died in 2015 and necessary documents and verification were carried out at the Police headquarters, Eleweran. The bank statement has also been submitted. Yet, we have not got any message from the PFA.

    Ogun quarterly pension payment hits N600 million

    Ogun State Government has increased quarterly payment for pensioners from N500 million to N600 million, the Governor, Dapo Abiodun has said.

    The governor, who also said his administration has paid over N70 billion as gratuity and pension to retirees in the last three and a half years, made this known during a town hall meeting in the State.

    Abiodun stated that previous government had failed to pay the retirees, thereby making the debt to rise.

    He promised that his administration would ensure that the retirees enjoy the fruits of their hardwork.

    He assured workers that their entitlements – leave bonuses and others – would be paid as the finances of the state improve.
