    • Imo CP redeployed

The Inspector-General of Police (IGP), Mr. Kayode Egbetokun, yesterday, read the riot act to perpetrators of electoral violence to steer clear of Saturday’s governorship election in Bayelsa State.

The police boss, who gave the warning during a courtesy visit to Government House, Yenagoa, said the force and other security agencies were fully ready and duty bound to ensure free and fair poll in the state and that troublemakers would be made to face the full weight of the law.

He explained that his visit was in respect of the election and assured that the police was neutral.

While calling on Bayelsans to have confidence in the police, he emphasized that the increased deployment of its personnel in the state was in order to forestall any violence during the poll.

The IGP thanked Governor Douye Diri for his support to the state police command and assured him of adequate security before, during and after the election.

Earlier, on Channels Television, Politics on Sunday, the IGP assured electorates in those states of police neutrality in the elections.

During the live interview, he had also revealed the redeployment of Imo State Commissioner of Police (CP), Mohammed Barde to the Force Headquarters, Abuja.

The police also disclosed that they were prepared for the elections, and that adequate deployment had been done in all areas.

Force Public Relations Officer, ACP Olumuyiwa Adejobi said, “We are ready and have prepared well for the elections in Kogi, Imo and Bayelsa states. Adequate deployments have been done to all areas, including the protection of Independent National Electoral Commission officials, accredited observers, media, materials and facilities. We have made arrangements for necessary escorts during the elections.

“The IGP has ordered additional allocation of logistics, equipment and personnel to the states and other states that will support the concerned states. The IGP was in Imo to address stakeholders on Thursday. We are good to go.”

Egbetokun also urged all stakeholders in the three states to embrace peace, uphold the sanctity of the rule of law and be law-abiding in their endeavours before, during and after the elections as the police and other security agencies have been placed on alert to avert any unruly acts capable of disrupting the elections in any of the states.

Explaining the rationale behind the redeployment of Imo CP, Adejobi, in a statement on Monday, said the IGP’s decision to reshuffle the CP underscores the Police Force’s unwavering neutrality.

The Police PRO added that the redeployment was not an indictment on the affected officer but is rather part of a broader strategy aimed at bolstering security measures, promoting transparency, and upholding the integrity of the electoral security management.

Adejobi said the IGP is resolute in ensuring that a secure environment is provided for all stakeholders, political parties, candidates, and citizens to participate in the electoral process.

He urged all to cooperate with the Police and other security agencies and adhere to the law in order to ensure a smooth and successful election while maintaining the principles of democracy.

Bayelsa: Saraki canvasses credible poll as APC chieftain Seibarugu decamps

The former Senate President, Bukola Saraki, has appealed to the Independent National Electoral Commission (INEC) to ensure that the Bayelsa governorship election is free and credible.

He equally implored the law enforcement agencies to ensure that the election is peaceful and that the people’s will prevailed.

Senator Saraki made the appeal when he joined Governor Diri’s campaign trail to some communities in Yenagoa Local Government Area of the state at the weekend.

He spoke to journalists shortly after he inaugurated the newly-built Government Science and Technical College, Swali, Yenagoa.

Also, a former chieftain of the All Progressives Congress (APC), Chief Werinipre Seibarugu, has said the opposition party in Bayelsa State is virtually empty following his defection and other critical stakeholders from the party.

Seibarugu urged the people to vote PDP in this Saturday’s governorship poll.

In his remarks, Senator Douye Diri acknowledged the invaluable contributions of the Ekpetiama people not only to the development of the state but also the country.

The governor expressed delight that Seibarugu returned to the PDP to work for its success in the November 11 governorship election.

Diri’s ex-aide urges Bayelsans to vote Sylva

Former Senior Special Assistant to the Bayelsa State Governor on Special Duties, ‘General’ Charles Kurobo, has called on Bayelsans to vote out the incumbent Governor Douye Diri by casting their vote for Chief Timipre Sylva of the All Progressives Congress (APC).

Kurobo, who is also the Chairman, Niger Delta Ex-agitators’ Leadership Forum, First Phase, Bayelsa State chapter, had earlier dumped the Governor’s camp for the APC, citing hunger and lack of welfare as major reasons for his defection.

He said the need for a change of government in the state had become important and must be seen as a matter of necessity to advance the growth and development of Bayelsa.

The former SSA said he doubted whether Governor Diri of the Peoples Democratic Party (PDP) who subjected his political appointees to begging could have good plans for the state.

Kurobo said: “His lack of initiative for development and focus for the future can be seen in a clear demonstration of the fact that he single-handedly denied APC’s vote for President Bola Tinubu during the February 25 presidential election, only for him to be among the first set of people to demonstrate solidarity for the President’s victory at the Supreme Court!

“I believe he was there to show support for the PDP, believing that Atiku stood a chance at the apex court only for him to switch when the Supreme Court judges affirmed Tinubu’s victory. And I ask, can such a person be trusted? Obviously not! Not with our votes or anything else.

“I can imagine how we got to where we are today! What I don’t understand is why Bayelsans will be listening to Senator Douye Diri canvassing for votes for a second term in office when it’s glaring that there’s virtually no hope for the future under Governor Diri.

The ex-agitator said that people who are trapped should make a decision and take bold steps to vote out Diri come Saturday, November 11, 2023.

  • Redeployment of Imo CP good, remove REC, says PDP

Redeployment of Imo CP good, remove REC, says PDP

Following the redeployment of the Imo State Commissioner of Police, Mohammed Barde, to the Force Headquarters, the Peoples Democratic Party (PDP) has called for the immediate redeployment of the Imo Resident Electoral Commissioner (REC), Prof Sylvia Agu.

The party, in a statement on Monday, November 6, commended the Inspector General of Police, Kayode Egbetokun for being responsive and proactive in nipping potential crisis in the bud.

The statement, signed by PDP’s National Publicity Secretary, Debo Ologunagba, made a similar demand on the Independent National Electoral Commission (INEC) to redeploy the Imo REC over his alleged compromise.

The call for the REC’s removal is coming ahead of the Imo State governorship election slated for Saturday, November 11.

The PDP charged the INEC chairman, Prof. Mahmood Yakubu to take a cue from IGP Egbetokun and redeploy Prof Agu in response to the outcry and demands for neutrality in the governorship election.

The statement said: “The PDP urges the INEC chairman to take a cue from the Inspector General of Police who redeployed the Commissioner of Police in Imo State in response to the outcry and demands of the people for neutrality in the November 11, 2023 governorship election in the State.

“Prof. Yakubu should forestall an impending crisis in the Imo State election by heeding the insistent outcry, petitions and protests by the people of Imo State, political parties, Civil Society Organizations as well as Ohaneze Youth Council for the removal of the Prof. Sylvia Agu who has been allegedly compromised by the APC.”

“The people of Imo State cannot accept any electoral process with Prof. Agu as REC, given her reported role in the brazen manipulation of the 2023 National and House of Assembly elections in Imo State in favour of the APC, which is still in the public domain.

“The redeployment of Sylvia Agu out of Imo State is therefore the only way to restore confidence in the electoral process, guarantee a credible election and avert crisis in the State.

“This is especially so as there are very disturbing allegations in the public space of clandestine meetings between Prof. Agu and certain APC agents said to have been facilitated by her close relative, who is an APC national officer, ahead of the November 11, 2023 governorship election in Imo State”.

The party called on the INEC Chairman to note that the integrity of an election principally lies in the confidence of the electorate in the electoral process.

The party said only the redeployment of the REC can restore the people’s confidence of the Imo people and the integrity of the electoral process.

Ensure peaceful poll, Diri urges security agencies

Bayelsa State’s Governor Douye Diri has restated the need for security agencies to ensure that the conduct of the forthcoming governorship election is peaceful and credible.

Governor Diri stated this yesterday when he received the Chief of Defence Staff, Gen. Christopher Musa, the Commander of the Joint Task Force, Operation Delta Safe, Rear Admiral E. O Ferreira, and other senior military officers in Government House, Yenagoa.

In a statement by his Chief Press Secretary, Daniel Alabrah, the governor urged the military officers not to allow anybody or group of persons to engage in acts capable of undermining the electoral process. The statement quoted Governor Diri as saying that the government will support the security agencies to prevent violence and ensure a peaceful election.

He said: “Bayelsa is a flashpoint. So you have to do everything within your power to ensure that we do not give room to those allegedly sewing military uniforms and plotting to impersonate military officers to undermine the election. As a government, we will give you every support to ensure that we do not lose one life.”

Diri, who also stressed the need to strengthen the country’s democracy, noted that all institutions, particularly the military, must collectively work to build viable democratic institutions. He said: “There are institutions that make democracy tick and one of them is the military. Listening to you, we have hope that the military will be up to its task to make democracy stronger and much better in the coming years.”

The governor also admonished the political class not to take democracy and the people for granted. But to see themselves as having a duty to serve the interest of the people and not as masters. He said: “Whatever position we find ourselves in this democratic experiment, we must see ourselves as those who came to serve and not to be the masters. Since we assumed office, we have been preaching peace. So this election means so much to us and we will need the security agencies to be on top of their game.”

Earlier, Gen. Musa assured that the off-cycle governorship elections in Bayelsa, Kogi and Imo states will be peaceful and credible in line with the directive of President Bola Tinubu. He said he and his team were in the state to assess the security situation and to ensure that Bayelsa was secure and protected ahead of the November 11 election.

He warned anyone planning to perpetrate violence to steer clear of the elections in the three states and cautioned security agencies against acts that would compromise the polls.

Also, he said security agencies have the president’s directive to bring acts of criminality, including sea piracy, illegal bunkering and pipeline vandalism to an end, to ensure that oil production output increases to boost the national economy.

He added: “We want to warn those who think it is their birthright to perpetrate violence during elections that henceforth it is not going to be business as usual. Any member of the armed forces caught compromising the election risks a court-martial.”

  • Appeal Court reverses Sylva’s disqualification

    Appeal Court reverses Sylva’s disqualification

    • Judiciary has vindicated itself over my Appeal Court victory, says APC candidate

The Court of Appeal in Abuja has set aside the October 9 judgment given by Justice Donatus Okorowo of the Federal High Court, Abuja nullifying the nomination of Timipre Sylva as the candidate of the All Progressives Congress (APC) in the Bayelsa State governorship election scheduled for November 11.

A three-member panel of the appellate court held, in a judgment on Tuesday, that the Federal High Court, Abuja lacked the jurisdiction to have heard and determined the case filed by

Demesuoyefa Kolomo described himself as a registered voter and a member of the APC.

The court held that having not been an aspirant, who participated in APC’s governorship primary, Kolomo lacked the locus standi to approach the court to challenge the nomination of the party’s candidate.

In the judgment read by Justice Binta Zubairu, the court held that since Kolomo was not an aspirant and did not participate in the primary from which Sylva emerged as APC’s candidate and cannot be clothed with the requisite locus standi as provided under sections 285(14) of the Constitution and 29(5) of the Electoral Act 2022.

Speaking with reporters at the APC National Secretariat in Abuja, shortly after consulting with the Deputy National Chairman (North), Alhaji Ali Bukar Dalori on the outcome of the judgment, Sylva said: “I believe that the Judiciary has vindicated itself. Because I had suffered defeat because of this issue of locus. I took Governor Dickson as he then was to court. On this issue of locus, the Supreme Court decided then that since I didn’t participate in that primary, I didn’t have the locus standi to take the matter to court and I lost the battle.

“But when the High Court now said, the guy who didn’t participate at all in the process had locus standi, I was a little bit confused. But the judiciary has vindicated itself. I am quite happy. We are ready.”

While delivering the judgment, the court indicated that from the provision of the law, one must be an aspirant, who participated in a primary before he can challenge the conduct or outcome of the primary concerning the qualification of the candidate nominated for the selection process.

It found that Kolomo failed to establish he was an aspirant in the APC primary and, as such, clothed with the requisite locus standi to institute the action on which the judgment disqualifying Sylva was given.

“Having held that the first respondent is not an aspirant, he lacked the locus standi to have instituted the matter under whatever guise before the lower court.

“Where a party lacked the locus standi to institute a case, the court has no jurisdiction to entertain and determine it, Justice Zubairu said and proceeded to hold that the Federal High Court in Abuja was without jurisdiction to have heard the case.

She proceeded to set aside the Federal High Court judgment, allowed the appeal filed by Sylva and granted all the reliefs sought.

The court also awarded N1million cost in favour of Sylva.

In his October 9 judgment, Justice Okorowo held among others,  that Sylva, having been sworn in twice and served for five years as governor of Bayelsa, would breach the  Constitution should he be allowed to contest again.

Justice Okorowo declared that Sylva was not qualified to contest the November election because if he won and is sworn in, he would spend more than eight years in office as governor of the state.

Relying on the Supreme Court’s decision in the case of Marwa vs Nyako, the judge held that the drafters of the Constitution stated that nobody should be voted for as governor more than twice and that the parties to the suit agreed that Sylva was voted into office two times.

While arguing the appeal on October 27,  lawyers to Sylva and the APC  – Akinlolu Kehinde (SAN) and K. O. Balogun faulted Justice Okorowo’s position on Sylva’s qualification.

Balogun argued that it was wrong for the trial court to have entertained the suit by Kolomo because he lacked the locus to have approached the trial court.

He faulted the decision of Justice Okorowo, to the effect that Sylva took the oath of office twice as Governor of Bayelsa State.

Balogun said: “In 2007 he (Sylva)  was elected the Governor of Bayelsa State, but within eight months, the Court of Appeal (which was then the final court for governorship election petition) sacked him.

He added: “He contested again in 2008 and won. The eight months that he earlier spent in office was nullified, so he could not have said to have spent that with months because it was voided by the court.

“What he (Kolomo) is doing is fighting a proxy war. He cannot be a member of the APC and be fighting to destroy its candidate and chances at the election.

“What the first respondent (Kolomo)  is asking this court to do is to deem the nullified eight  months as 4 years.”

In another judgment on Tuesday, the same Court of Appeal allowed a similar appeal filed by the APC to challenge Sylva’s disqualification.

The court granted all the reliefs sought in the appeal marked: CA/ABJ/CV/1060/2023 and equally awarded N1m cost in favour of the appellant.

PDP accuses Uzodimma of booking all hotel rooms in Owerri ahead of poll

The allegation by the main opposition party, the Peoples’ Democratic Party(PDP) that the Imo State Government has booked all hotel rooms in Owerri, the state capital, has been generating tension in the state.

The allegation by the Director of Media and Publicity, Imo PDP Governorship Campaign Organization, Ikenna Onuoha suggests that Governor Hope Uzodimma plans to pay more than N5 billion to occupy over 4,000 hotels in the metropolis.

Onuoha said: “The Sam-Jones Governorship Campaign Organization in Imo State is utterly appalled to inform Imo people of another plot by Hope Uzodimma to hide foreign machinery in over 4,000 hotel rooms in the state. The renting will cost the state government over N5 billion cumulatively.”

He said that the reason for renting all the rooms is to frustrate election observers, Civil Society Organizations (CSOs), and officials of opposition political parties from having access to any hotel room when they arrive in Imo for election monitoring. He added: “This plot was uncovered in a letter dated 25th October 2023 with reference No: MTC&CA/S.76/VOL.1/T/90, captioned, “Request for Reservation of Your Hotel Rooms from 4th November-12th November 2023” and signed by the Commissioner for Tourism, Barr Jerry Egbule Egemba.”

Read Also: Supreme Court verdict: First Lady hails ruling as the ‘Lord’s doing’

But, the government, through the state Commissioner for Tourism, Egemba, said the state government’s action was to checkmate the influx of thugs which the opposition party intends to flood the state with during the election and not to muzzle election observers.

Egemba said: “If the directive intended to deny CSOs and Election Observers access to the hotel facilities as wrongly alleged by the opposition elements, the directives would not have been conveyed in an official letter to all the hotel owners and managers in the state in a full letter headed paper of the ministry fully endorsed by the honourable commissioner with his signature.

“What was there to hide even when some of the opposition members are hotel owners and managers and the letters were also sent to them? Certainly, we have nothing to hide. If indeed it was something sinister, the letters would not have been given to the hotels belonging to the opposition members.

“We are therefore stating without any fear of contradiction that the intentions behind the letter were genuine and patriotic and were borne in the best interest of the state for a peaceful conduct of the upcoming governorship election by denying thugs loyal to politicians access into the state.”
