    Asaba land encroachment issues resolved- PWANMAX Group Mgt

    The management of Property World Africa Network PWAN Group, (a continental real estate conglomerate giant), has described as false and unfounded the continuous claim of encroachment by one Mr. Osemele Theophilus Marshal, a plot of land buyer in one of its property located at Max Height, Admiralty Drive, Umuedi, off Ibusa Expressway, Delta State.

    It urged members of the public to discountenance claim made by Osemele in a recent publication where he painted picture of company’s consent to the encroachment on his plot of land, stating that it was a calculated attempt to tarnish the reputation and good image the real estate firm had built over the years.

    Throwing more light on what really transpired in a statement to newsmen yesterday, Chairman, PWANMAX Group, Dr. Augustine Onwumere, disclosed that Osemele subscribed to one plot of land measuring 928sqm in one of PWAN Max estates called Max Height Estate in 2021 was fully allocated his plot of land as specified that same year, but refused to fence his land. 

    He explained that the refusal or failure to fence one’s property after it had been allocated contravenes the company’s directive requesting that all allocated clients, including Osemele should either fence or develop their lands in a shortest period of time to avoid issues like this but he refused or failed to comply to the directive even till now.

    According to him: “After 4 years of leaving the piece of land unattended and failing to adhere to the company’s directives on allocate lands in all its estates, Mr. Osemele came up to raise issues of his land being encroached”, adding that even the beacons he had earlier erected to capture his land space was no longer visible.

    “Mr. Osemele usually paid visits to his plot of land in the past 4years wherever he visits Nigeria since he’s based abroad but in all the occasions, he only inspect the plots and returns. He never considered it necessary to either fence or develop the plot as directed by the company”.

    “We were taken aback when he showed up recently to raise alarm that his allocated plot of land had been slightly encroached on by someone developing his plot close to his and threatening to let hell loose if his plot was not given back to him intact”.

    “He notified the company, in which the company resolved the issues by readjusting his plot description and maintained the size to be 928sqm as the company was not in knowing of how his land was encroached on due to the activities of agents who also operates within the estate “.

    “Mr Osemele plot of land was recaptured fully on the same allocated plot of land in the presence of his own surveyor who certified at the end of the exercise that the land space was detailed”.

    He added: “Consequent upon this,  a Registered Survey and Deed of assignment of the realligned piece of land subscribed by Osemele was made available to him in line with the company’s policy to provide all subscribers their documents after purchase of the company’s property”.

    “We didn’t just stop there, the company also went ahead to put a dwarf fence on his allocated land to  clearly distinct it in that particular area as part of the measures being taken to avoid the repetition of an such an encroachment in the future”.

    “Now that Osemele has not shown any sign of appreciation to the effort made by the company in ensuring that his property was well secured, the company now wants Osemele to pay for the fence it erected on his piece of land and pleads with him to stop peddling misleading information about the company”.

    While noting that the company would continue to carry out its client service relationship with utmost trust and professionalism despite the efforts of the likes of Mr. Osemele to frustrate its good intentions, the company urged the public to be rest assured that their interest remains paramount to them in any business transactions.

    Osemele petitioned the Delta state Commissioner of Police. CP Olufemi Abaniwonda, over an alleged encroachment on his piece of land, even with the beacons he had erected to demarcate his property.

    He went on to accused some staff of the company of alleged complicity in collaborating with some agents to sell off part of his land to another customer and hereby distorting his land space, despite the fact that the company had allocated another portion to him to cover up for the area that was encroached upon within same plot.

    On his part, former Nigeria’s Minister of Information and Culture, Alhaji Lai Mohammed, commended the initiative and reiterated the importance of positioning Nigeria as an investment-friendly destination.

    In his remarks, President of the Ogun State Chamber of Commerce, Industry, Mines and Agriculture (OGUNCCIMA), Lion Niyi Oshiyemi, encouraged German investors to take advantage of the rising economic profile of Ogun State.

    “Ogun is fast becoming Nigeria’s economic hub. We are open to collaborations, especially in the area of affordable housing, industrial parks, and agricultural estates.”

    LASPPPA seals Lekki property over land title dispute

    Lagos State Physical Planning Permit Authority (LASPPPA) has sealed a construction site on Plot 18, Block J, Seagate Estate, Lekki Peninsula Scheme 1, over a dispute on land ownership and title documentation.

    The enforcement, carried out on the directives from the state Ministry of Physical Planning and Urban Development, follows a petition by United States-based Nigerian, Dr. John Umude, who claims to be the rightful owner of the disputed property, at 18 Yinka George Street, off Sparr Road.

    According to Umude, who has lived in the U.S. since 1975, he acquired Plots16 and 18 in 1994 and remained the registered assignee of Plot 18 after selling Plot 16 in 2013. He alleged the property was illegally encroached upon in 2021, with new construction initiated by individuals claiming ownership most notably, Frank Uche Ezeala, a lawyer.

    Efforts to secure a court injunction were initially thwarted by procedural issues, including the incorrect spelling of the defendant’s name and incomplete court filings. Umude later withdrew the suit and refiled based on revised title documentation and a newly submitted survey plan, adjusting the plot size to 800 square meters.

    Last October, he petitioned the Ministry of Physical Planning and Urban Development, requesting scrutiny of the building activity and permits. A letter dated March 25, this year, from the ministry indicated that investigations had been concluded and that enforcement measures would follow.

    Sources in the ministry confirmed that stakeholders, including estate developers Harris Property and officials from the Surveyor-General’s Office were consulted during the review. A Stop Work Order and Notice to Seal were issued after the property developers failed to comply with their directives.

    “The sealing of the property is purely regulatory and should not be interpreted as a judgment on land ownership,” a senior official stated.

    “Our focus is ensuring due process and safeguarding the public against potential legal and safety risks, especially regarding the sale of flats on a property under active dispute,” the source said.

    A representative for Ezeala refuted Umude’s claims. He asserted that the sealing stemmed from administrative oversights, specifically the failure to remit land rent and statutory fees not from a land title dispute.

    The representative said a property consultant hired for this purpose had defaulted, prompting a petition to law enforcement agencies to investigate and recover the funds.

    The theme of this year’s event is: ‘Sustainable Real Estate Value Chain: The Era of Green Initiatives in Africa’. The Conference, it was gathered, will bring together a broad coalition of stakeholders, including policymakers, private sector leaders and  urban planners.

    Speaking on the importance of the conference, REDAN President, Prince Akintoye Adeoye said it would be an opportunity to learn from top ESG and sustainability experts across Africa and beyond to explore green building innovations, sustainable financing options, and smart construction tools.

    He said : ‘Participants will also showcase their  projects or services, position your brand as a leader in ethical and sustainable real estate. The future of real estate is green, and Africa must not be left behind. As climate and sustainability challenges intensify, it is imperative that Developers, Financiers, Regulators, and Communities unite behind a shared vision of responsible urbanisation’.

    In recent years, ESG has gained global attention as a critical framework for ethical and sustainable investment and development. In the African context, however, ESG is far more than a global trend; it is an urgent call to action.

    Environmental degradation, rapid urbanization, socio-economic inequality, and weak governance structures continue to affect the housing and infrastructure sectors across the continent.
