•’APC candidate will win by wide margin’

Governor Hope Uzodimma of Imo State has said that the presidential candidate of the All Progressives Congress, Bola Ahmed Tinubu, is not just a good product the Igbo will benefit from, but one who will end Ndigbo’s lamentations if elected president next year.

Uzodimma who is the South East Coordinator of the APC Presidential Campaign Council, spoke at Abakiliki, the Ebonyi State capital during the presidential campaign rally that took place on Thursday.

“There will be no more lamentation for the South East if by the grace of God Asiwaju becomes president next year,” Governor Uzodimma noted, adding that, “Asiwaju Bola Ahmed Tinubu is a very good product that Ndigbo will benefit from.”

The governor said that Tinubu as the APC candidate will rely on his already established and known achievements to win the people’s trust just as it is a known fact that,”his running mate, Senator Kashim Shettima, a well-tested professional.”

Meanwhile, a  chieftain of the Bayelsa State chapter of the All Progressives Congress (APC), Chief Preye Aganaba, has asserted that the presidential standard bearer of the party, Asiwaju Bola Ahmed Tinubu, will win the 2023 presidential poll by a landslide.

Aganaba, a founding member of the APC and former governorship aspirant in the state, made the assertion yesterday after emerging the Bayelsa State Coordinator of the Tinubu/Shettima Grassroots Independent Campaign Council (ICC) in Yenagoa.

The independent campaign council was inaugurated to complement the presidential campaign council ahead of the 2023 poll.

Aganaba said Tinubu’s victory was sure, stressing that the campaign structures were only concerned about the margin of difference between the APC candidate and the candidate that would come second at the poll.

Aganaba described the APC in Bayelsa as formidable and recalled that the party in the last election won the governorship poll and gave President Muhammadu Buhari over 42 per cent of the votes.

He said the ICC had structures in the 36 states and Abuja as well as in the 776 local government areas in the country.

    • Enugu West LP candidate’s substitution reversed

A Federal High Court in Abuja has voided the nomination of a House of Representatives member, Chris Azubogu, as the senatorial candidate of the All Progressives Grand Alliance (APGA) for Anambra South Senatorial District in next year’s election.

Azubogu is a member of the House of Representatives, representing Nnewi North/ Nnewi South/ Ekwusigo Federal Constituency on Peoples Democratic Party’s (PDP’s) platform.

Justice Inyang Ekwo, in a judgment yesterday, held that Azubogu was still a member of PDP when, in June this year, he participated in the primary election held by APGA for Anambra South Senatorial District.

Justice Ekwo ordered that Ben Nwankwo’s name be submitted to the Independent National Electoral Commission (INEC) as the lawful candidate of APGA for the senatorial district.

He restrained Azubogu from further parading himself as APGA’s candidate for the senatorial district.

The judgment was on the suit marked: FHC/ABJ/CS/909/2022, filed by Nwankwo, who argued, among others, that Azubogu was unlawfully nominated.

Justice Ekwo held that Azubogu violated sections 65 and 68 of the constitution.

The judge upheld the plaintiff’s contention that Azubogu ought to have resigned, defected or cross carpeted from PDP to APGA before he could lawfully qualify to participate in the primary of another political party.

Justice Ekwo held that Azubogu ought to have relinquished the seat if he had actually resigned his membership, defected from PDP to APGA or another political party.

He further held that without complying with the mandatory sections 65 and 68 of the 1999 Constitution and Article 27 of the APGA guidelines for primary election for 2022, there was no way Azubogu could have lawfully participated in any primary election of any party other than that of the PDP.

Justice Ekwo found that as at June 1, when APGA conducted its primary election, Azubogu was not qualified to participate.

He held that any action taken in contravention or breach of the 1999 Constitution was unconstitutional, null and void, adding that Azubogu, having not been a member of APGA at the time he purportedly stood for the primary election of the party, could not be lawfully nominated by APGA.

In another judgment yesterday, Justice Ekwo reversed the unlawful substitution of Chukwuma Amadi as the candidate of the Labour Party (LP) for Enugu West Senatorial District.

The judge held that Amadi remained the candidate of the party unless he either withdrew his candidacy or in the event of death.

The judgment was on the suit marked: FHC/ABJ/CS/1194/2022 filed by Amadi to challenge his purported substitution by the LP.

Justice Ekwo ordered the removal of Uchenna Ekwe, who was unlawfully nominated by the party in the place of Amadi.

Justice Ekwo invoked sections 29, 31, 32, 33 and 34 of the Electoral Act to nullify the substitution of the plaintiff.

The judge held that by Section 33 of the Electoral Act, 2022, political parties were not allowed to change or substitute their candidates, whose names had been submitted to the Independent National Electoral Commission (INEC) under Section 29 of the Act, except in the case of death or withdrawal by the candidate.

He said: “I find that the plaintiff is neither dead nor had withdrawn his candidature as the senatorial candidate of the Labour Party for Enugu West Senatorial District in the 2023 general election.

“Having so found, I state that this case is not about the primary election of the Labour Party that produced Uchenna Ekwe, but about whether or not, Amadi,  the plaintiff in this case, withdrew his candidature after having won the primary election that produced him for the same party”, he said.

The judge, therefore, dismissed the argument of Labour Party and Uchenna Ekwe that the plaintiff had no locus standi pursuant to Section 84 of the Electoral Act, 2022 because he was not an aspirant in the second primary election that produced Ekwe.

Justice Ekwo ordered Ekwe to henceforth, desist from parading himself as a candidate of LP in the coming election and the party from dealing with him in the capacity.

The judge added: “I will say that Ekwe has been duped by those who deceived him that there can be another primary election for Enugu West Senatorial District when Amadi was neither dead nor had withdrawn as a candidate.

“It is clear that those who contrived the purported letter of withdrawal by Amadi merely deceived Ekwe and nothing more.

“It is the law in Section 33 of the Electoral Act, 2022 that a political party shall not be allowed to change or substitute its candidate whose name has been submitted under Section 29 of the Act except in the case of death or withdrawal,” the judge said.

Edo govt disagrees with Oshiomhole on derivation fund

•I will react at appropriate time, says ex-governor •APC Forum accuses Southsouth governors of mismanaging N950b excess crude windfall

Edo State Government and a former National Chairman of the All Progressives Congress (APC), Comrade Adams Oshiomhole, have disagreed on the exact amount of 13 per cent derivation fund’s arrears received by Godwin Obaseki’s administration from President Muhammadu Buhari.

Oshiomhole, a former Edo governor, speaking in Warri, Delta State on November 19 during the kick-off of the governorship campaign of the Deputy Senate President, Senator Ovie Omo-Agege, said Obaseki received over N100 billion derivation arrears, without any commensurate project on ground in Edo to justify the humongous fund, which he said was never reflected in the state’s budgets.

Commissioner for Budget and Finance Joseph Eboigbe, briefing Government House correspondents yesterday, after the weekly Executive Council (EXCO) meeting, chaired by Governor Obaseki at the Government House in Benin, said the administration received N2.1 billion from the N28 billion that accrued to Edo as 13 per cent derivation fund.

He noted that N1 trillion was established for oil producing states, while a distribution methodology was adopted by the Revenue Mobilisation Allocation and Fiscal Commission (RMAFC), stressing that N28 billion accrued to Edo, and would be paid in five years of 20 tranches.

The commissioner claimed that the state government disbursed between N2 and N3 billion monthly for capital expenditure.

He described the Obaseki-led administration as transparent and accountable.

Commissioner for Orientation and Communication Chris Nehikare, berating Oshiomhole for his comment, alleged that the former national chairman of APC left office as Edo governor with a debt of N160 billion, after receiving N1 trillion from the federation accounts in eight years.

The Special Adviser to Edo Governor on Media Project, Crusoe Osagie, claimed that comments on the 13 per cent derivation fund’s arrears were targeted at creating unnecessary tension in the country, amid ongoing campaigns.

Comrade Oshiomhole said he would react to the allegations levelled against him by the political appointees of his successor, Governor Obaseki, at the appropriate time.

He spoke last night (8:11pm) through his media aide, Victor Oshioke, on the phone from Abuja.

Oshiomhole said: “I will react at the appropriate time, provided the levelled allegations are worthy of my reaction.”

The All Progressives Congress (APC) Parliamentarians’ Forum in the Southsouth yesterday raised the alarm that the six governors in the region have allegedly cornered the outstanding N950billion excess crude money and 13 per cent derivation due to the states through low rate discounts at banks.

The Director of the forum, Senator Ita Enang, made the accusation during the inauguration of the body in Abuja, which aims to support APC candidates in the 2023 general election.

He challenged any of the governors to deny his allegations, which he claimed were based on records accessed by the Forum, using the Freedom of Information Act.

Enang called on the Houses of Assembly of the affected states to carry out investigation on the alleged ridiculous discounts by the governors and begin impeachment proceedings against them.

Commercial activities were paralysed yesterday in Onitsha, Anambra State, following protest by tricycle (keke) operators over alleged N300 extortion by touts.

The protest, which took off from DMGS roundabout with over 200 tricycle operators, caused gridlock on  Awka, Oguta, Enugu and Upper new market roads.

Commercials buses and private vehicles were forced to divert to other routes, while traders and civil servants could not get to their work places in time.

A tricycle operator, who identified himself as Pa Jero, decried what he termed government deliberate efforts to frustrate them, in a bid to generate money towards “turning Anambra to Dubai.”

Emmanuel absolved of fuelling corruption litigation against YPP candidate

A major advocacy group, Akwa Ibom Integrity Alliance, has absolved Governor Udom Emmanuel of being behind corruption litigation against the governorship candidate of the Young Progressives Congress (YPP), Senator Bassey Akpan.

Akpan, the lawmaker representing Akwa Ibom Northeast (Uyo) Senatorial District, is being tried for alleged corruption at the Federal High Court, Uyo.

He is alleged to have blamed Governor Emmanuel for his travails.

But the leader of Akwa Ibom Integrity Alliance, Mr. Stephen Abia, said it was unfair and uncharitable for the embattled senator to transfer blames of his travails to the doorsteps of Emmanuel, who neither originated the charges nor knew about the facts of the case.

The group said to remotely or directly blame the governor for the probe of Akpan’s financial impropriety was devilish, wicked and malicious.

“From investigations by our team of professionals, Emmanuel was not in office as governor when the case of bribery and corruption against Akpan began,” said Stephen Abia, a lawyer.

“The case was purely on the heels of a probe of the infamous alleged slush funds against a former minister of Petroleum Resources, where parts of the funds were allegedly linked to a certain Jide Omokore, who confessed during investigation that he used the funds to bribe Senator Akpan through car donations amounting to N204million to get contracts.

“For the avoidance of doubts, the Economic and Financial Crimes Commission (EFCC) arrested and detained Senator Akpan over cars he had allegedly received as bribe from Omokore while serving as Akwa Ibom Finance Commissioner and Chairman of the State Inter-Ministerial Direct Labour Coordinating Committee.”

“Investigations show that Omokore’s companies – Bay Atlantic Energy and Sahel Energy – received contracts from Senator Akpan’s Inter-Ministerial Direct Labour Coordinating Committee and EFCC claimed the vehicles were used to bribe Akpan.”

“We have discovered that it is only on the basis of jurisdiction that the case cannot be decided a long time ago when the trial was conducted at Justice O. A. Taiwo-presided Federal High Court in Lagos, hence the case was reassigned to the Federal High Court in Uyo, in line with Senator Akpan’s argument that the offence was committed in Uyo.

“When he was testifying at the High Court, Senator Albert admitted receiving the car bribe from Omokore and further brought some members of his campaign team as witnesses that they were given the contentious vehicles to campaign for Albert’s elections in 2015.

“Throughout the duration of this trial and till this moment, there is no record that Akwa Ibom State Government was a party in the case, nor could it be said that Governor Emmanuel or any of his appointees had testified in the case. It is therefore worrisome that Akpan will castigate Emmanuel for a sin he allegedly committed when he had not assumed the office of governor.”

Judgment is expected to be given tomorrow at the Federal High Court, Uyo.

Fire guts 10 houses, property worth millions of naira in Rivers

Fire has ravaged Okujagu slaughter market in Port Harcourt, Rivers State capital, destroying goods and property worth millions of naira.

It was gathered that the inferno destroyed at least 10 makeshift houses.

The fire was reportedly caused by suspected urchins, who smoked substances without caring for the leftovers.

One of the firefighters from the Federal Fire Service, who arrived on the scene with his colleagues, following a distress call, was beaten by youths.

The Commander of the Federal Fire Service in Rivers State, Abdullahi Alfa Audu, who confirmed the attack, said the youth were angry that his men did not arrive early to put out the fire.

He said: “We received a distress call and we turned up as usual to combat the fire. On getting there, we positioned our vehicle to start putting out the fire. Then hoodlums began to stone us. They beat up our men.

“They (firefighters) jumped into their vehicle to move. In the process, one of the firemen fell. They (hoodlums) held him and started attacking him with machetes.

“He had a deep cut on his hand. We rushed him to hospital and they stitched the hand and gave him pints of blood.

“We are complementing the efforts of the state firemen. The hoodlums don’t even know what we encountered before we got to the fire scene. They attacked us and tried to vandalise our vehicles.”
