  • Court orders EFCC to return $20,000 collected as condition for bail to owner

Court orders EFCC to return $20,000 collected as condition for bail to owner

An Ikeja Special Offences Court has ordered  the Economic And Financial Crimes Commission (EFCC) to release $20,000 collected in 2019 to its owner, Mr Olalekan Abdul.

Justice Mojisola Dada gave the orders while ruling on a motion on notice filed before the court and after hearing from T.A. Mokuolu for the prosecution and O.C. Olatunji for the applicant.

Justice Dada granted an order granting delivery and/or restoration to the defendant,

Olalekan Abdul, $20,000:00 property of the defendant tendered and admitted as Exhibit B at the trial proceeding of March 8, 2023 and ordered to be held and kept in escrow Domiciliary Account in Polaris Bank, Ikeja in the name of the Chief Registrar of the High Court of Lagos State in pending completion of the case, now – concluded.

The court also granted  an order lifting the lien on and directing the release to the defendant, Olalekan Abdul, N10million held in defendant’s surety, Mrs. Jemilat Oluremi Yusuf-Sada’s Access Bank Account No. 1374520332 as condition for defendant’s bail as per the ruling of the court dated  January 31, 2020) pending completion of  trial on the charge now concluded.

It would be recalled that the court had on March 5 discharged and acquitted the Chairman of Cleanserve, Azubuike Ishiekwene, and Managing Director/CEO, Olalekan Abdul, of the case of fraud and forgery made against them by a nominal complainant.

The EFCC had arraigned the defendants on a 26-count charge bordering on conspiracy, forgery, using false documents without authority, possessing fraudulent documents, stealing and making documents without authority.

The Commission was acting at the behest of a nominal complainant, a certain Mr. Chris Ndulue, who claimed he was a director in the private company but was not in the file of the Corporate Affairs Commission and had no valid proxy.

Ishiekwene and Abdul, however, pleaded not guilty to the charge, following their arraignment on January 30, 2020.

During the pendency of the charge, which started five years ago with suit number ID/11126C/2019, the prosecution had called nine witnesses, while the defence had called four witnesses.

Mr. Adeyinka Olumide-Fusika (SAN) appeared for the first defendant, Abdul, and Dr. Muiz Banire (SAN) appeared for Ishiekwene, the second defendant.

Following a series of applications, one of which challenged the EFCC’s use of a fiat by Lagos State in a case in which the defence counsel argued that a $20,000 bribe had compromised an operative and that the prosecution was on a mission of “persecution,” the office of the Attorney-General of Lagos State, Mr. Lawal Pedro (SAN), stepped in and took over the matter after a review.

Before the Lagos State AG stepped in, the court had ordered the recovery of the $20,000 from the custody of the EFCC and admitted the same as an exhibit.

During the investigation, an EFCC operative demanded a bribe in 2019 to “kill the matter” because, according to him, the facts suggested that Ndulue had no case.

A report of the demand was made through Mr. Ola Olukoyede (then the Secretary of the Commission), who ordered a sting operation in Lagos, during which other EFCC operatives apprehended their colleague.

When the report reached the then-chairman of the EFCC, Mr. Ibrahim Magu, he squashed it, redeployed the operative who had demanded a bribe, and turned the case against the defendants who had reported the operative.

    • Governor offers free Ihram, transportation, others

Lagos State Governor Babajide Sanwo-Olu has promised 1,432 pilgrims embarking on the Hajj to Saudi Arabia a robust welfare package.

The governor, represented by the Commissioner for Justice/Attorney-General, Lawal Pedro, SAN, made the promise while addressing the pilgrims during a special one-day seminar and prayer session organised by the State Muslim Pilgrims Welfare Board.

Highlighting the spiritual and logistical significance of the Hajj, Governor Sanwo-Olu emphasised its importance as the fifth pillar of Islam, demanding complete submission, purification and physical and mental preparedness. In a move to prioritise the well-being of the pilgrims, the state government has implemented a free, comprehensive and compulsory medical screening conducted across 10 decentralised locations.

The initiative, coordinated by Dr. Mazeedat Erinosho, included vital health assessments and essential vaccinations administered by the Port Health Services.

Governor Sanwo-Olu acknowledged the substantial financial investment of N8,784,085.59 paid by each pilgrim, assuring them of a comprehensive Hajj package designed to provide excellent value.

This includes quality accommodation in close proximity to the holy sites in Makkah and Madinah, comfortable lodging in Mina and Arafah, air-conditioned transportation for Ziyarah to historical locations, and daily nutritious local cuisine adhering to health and religious standards.

“Trained personnel will be on-site to offer guidance and support to the pilgrims,” he said.

He said the cost of Hadiyah ram had been covered by the state, adding that pilgrims would receive the monetary equivalent for their Ihram clothing in Saudi Riyals.

Sanwo-Olu urged the intending pilgrims to serve as exemplary ambassadors in Saudi Arabia by maintaining high ethical standards and avoiding any action that could tarnish the country’s reputation.

He stressed adherence to rules and regulations in Nigeria and Saudi Arabia, cautioning against the severe consequences of non-compliance.

Commissioner for Home Affairs, Alhaji Ibrahim Layode, elaborated the governor’s comprehensive support, which included free medical screenings, Ihram clothing and transportation within Saudi Arabia.

The commissioner conveyed the governor’s request for prayers for Nigeria, Lagos State and President Bola Ahmed Tinubu’s success in the 2027 presidential election.

He said Lagos State first batch would depart Nigeria today.

The NAHCON Southwest Commissioner, Alhaji Tajudeen Abefe, underscored the sacrificial nature of the pilgrimage and implored Lagos pilgrims to uphold their renowned discipline and remain law-abiding.

He advised them to focus on completing the Hajj rites, obey their supervisors, prioritise prayers and remember to pray for the nation and its leaders.

Representative of the NDLEA, Aminu Shinkafi, warned against drug misuse and advised pilgrims to avoid carrying luggage for others, to prevent likely imprisonment for contraband.

He specifically prohibited kola nuts and emphasised the importance of respecting the laws of both countries.

Chairman, Lagos State House of Assembly Committee on Home Affairs, Alhaji Jibreel Abdulkareem, called on the pilgrims to be good ambassadors of Islam, focusing on their sole intention to worship Allah. He stressed the importance of maintaining good health to fulfil their religious obligations.

Representative of the medical team, Dr. Mazeedat Erinosho, advised pilgrims with pre-existing health conditions to inform the medical team before departure.

She cautioned against the extreme heat in Saudi Arabia, recommending ample hydration, fruit consumption and avoiding prolonged sun exposure.

She reminded them that sleeping pills are prohibited.

  • Tinubu to inaugurate Akure-Ikere Road dualisation Dec.

Tinubu to inaugurate Akure-Ikere Road dualisation Dec.

Federal Ministry of Works has assured Nigerians that the Akure-Ikere Road dualisation project will be ready for inauguration by President Bola Ahmed Tinubu in December.

The Federal Controller of Works in Ondo State, Olajide Hussein, an engineer, gave the assurance in an interview with the News Agency of Nigeria (NAN) yesterday in Akure.

He said the 15-km Phase 1 of the Akure-Ita Ogbolu-Iju-Ikere Road dualisation would be completed and inaugurated in December by the President.

According to him, the Phase 1 of the road project cost N19 billion, while the Phase 2 is expected to gulp N23 billion

He said it was the policy of the ministry to always do projects in phases so that road users would have unhindered access to one lane, while contractor would start work on the second lane.

Hussein praised the Minister of Works, Dave Umahi, an engineer, for being resilient to ensure the project was delivered on scheduled.

“Phase one covers 15-km single carriageway from Akure to Ekiti State border with some gaps; a gap of 3-km in between. The length of the road from Akure to Ikere, Ekiti State boundary, is 18.438-km.

“Now the phase 1 of this project is 15-km, meaning the Phase 1 is not expected to cover the whole stretch of 18-km, though we expect the contractor to complete these 18 km by December and for President Tinubu to inaugurate it.

“So that there will be a smooth unbroken traffic between Akure and Ikere before coming back to the other lane, which is the Phase 2.

“You know when we have a single carriageway and the road is dualised, the policy of the ministry is to construct one lane first; not to do both lanes simultaneously.

“This is to solve the problem of traffic first before you now think of constructing the other carriageway,” he explained.

Hussein, who praised the quality of work done by the contractor, said the only challenge faced in the process of construction of the road was obstructions by buildings; temporary and permanently structures.

He, however, hailed the affected property owners for removing their structures in collaboration with the state governments.
