The Court of Appeal, Yola Division, has reserved judgment in the case between Prof Jerome Nyame, Independent National Electoral Commission (INEC), Peoples Democratic Party (PDP) and three others.
Nyame is seeking nullification of the judgement of the Federal High Court Jalingo that upheld the nomination of Lt. Col. Agbu Kefas (rtd) as governorship candidate of PDP in Taraba State.
The appellant argued that Agbu Kefas never bought nomination and expression of intent forms or participated in the screening.
“When some of the people who nominated him have claimed that they did not so nominate him, these are part of the issues that we presented to the trial court but in its wisdom, the trial court held that it was not enough and that our matter was not properly instituted and that we ought to come by originating summons. So, we are aggrieved by the trial court,” Eko Ejembi Eko, counsel to the appellant said.
Counsel to the second and third respondents, Musa Tende, said “they have not even complied with the court order that granted them leave to serve processes at the Federal High Court Jalingo which till now they have not served”.
He added that they are praying the court to dismiss the suit for lack of merit.
Justice Obande Festus Obunya adjourned to November 16 the appeal of Speaker of House of Assembly seeking to be joined as appellant in the suit filed by Prof. Nyame.
