Lekki Gardens Estate Ltd on Wednesday denied violating an order of the Federal High Court in Lagos in a suit involving it and the Registered Trustees of Osborne and Foreshore Residents Association (OSFRA).
The firm, in a statement by its Executive Director Emily Atebe and Chief Executive Officer (CEO) Richard Nyong, said such claims were “outright falsehood”.
Justice Nicholas Oweibo on July 9 granted an interim injunction restraining Lekki Gardens Estate Ltd and Foreshore Waters Ltd from carrying out any further construction, development or building activities in Osborne Foreshore Estate II, Ikoyi, Lagos.
But Lekki Gardens explained that it “promptly filed an application before the same Federal High Court judge to vacate the order obtained by OSFRA.”

It asserted among others that neither the firm nor its officers were contemnors because the Supreme Court had “decisively and conclusively held that the defendant to an ex parte order cannot be in breach or in contempt if he has filed an application to vacate or set the order aside.
“Our Company had promptly filed an application before the same Federal High Court judge to vacate the order obtained by OSFRA.”
Describing itself as a “peaceful and law-abiding organisation” the firm pledged its commitment to upholding the rule of law “as we go about our legitimate business.”
