An Oyo State High Court sitting in Ibadan has struck out a suit of two billion Naira (N2billion) and 404.34 acres of land against the Registered Trustees of the Nigerian Baptist Convention and others who are defendants.
The suit, no I/288/2018, instituted at the court by Ramoni Fakorede and 29 others as claimants against the Registered Trustees of the Nigerian Baptist Convention and 30 others as defendants was struck out by Justice O. M. Lagunju on January 6 at Court 5, Ring Road, Ibadan.
The claimants on March 14, 2018 instituted the action at Oyo State High Court, Ring Road, against 31 defendants, claiming that the defendants should pay N2billion for an act of continuous trespass committed on a parcel of land situated at Idi-Ishin, Ibadan, which portion measuring about 404.74 acres of land and a jurisdiction.
Mr. Samuel Ogunjimi of Niyi Ogunjimi & Co, who was counsel to the 19th defendant, the Registered Trustees of the Nigerian Baptist Convention, on April 9, 2019 filed a notice of preliminary objection challenging the jurisdiction of the court on limitation of action and an abuse of court process among others.
There was no response to the notice of preliminary objection served on the claimants and this led to the withdrawal of the case by the claimants’ counsel and the striking out of the suit at the hearing of the case.
