  • Kyari didn’t influence Oyo-Ita’s investigation, says EFCC

THE Economic and Financial Crimes Commission (EFCC) on Monday said the ongoing probe of the Head of the Civil Service of the Federation, Mrs. Winifred Oyo-Ita was not instigated by the Chief of Staff to the President, Mallam Abba Kyari.

It said its investigation has always been evidence-based and most often triggered by petitions or intelligence.

The agency said it is an independent agency created by law to fight corruption without fear or favour.

The EFCC made the clarifications in a statement by its Head of Media and Publicity, Mr. Wilson Uwujaren against the backdrop of the ongoing investigation of a N3billion fraud in the Office of the Head of the Civil Service of the Federation.

The statement said: “The attention of the Economic and Financial Crimes Commission (EFCC) has been drawn to reports by a section of the media, insinuating that the ongoing investigation of the Head of the Civil Service of the Federation, Mrs. Winifred Oyo-Ita by the commission was instigated by the Chief of Staff to the President, Mallam  Abba Kyari.

“The commission wishes to state that there is no truth in these claims, and urges the general public to disregard the reports as the handiwork of mischief makers.

“For the avoidance of doubt, investigation by the EFCC is evidence-based. Most often, they  are triggered by petitions or intelligence.

“In the case of the HoS, Oyo- Ita’s investigation, it was prompted by intelligence received by the Commission.

“The EFCC is an independent agency created by law to fight corruption without fear or favour. In the discharge of its mandate, the commission does not take instructions from extraneous bodies neither will it lend itself to be used to settle scores by anyone.

“The commission again wishes to appeal to the media to be circumspect in their reportage and not lend themselves to actions that could befuddle the activities of the commission.”

  • Setting the agenda for Abba Kyari’s second coming

On Friday July 5, 2019, President Muhammadu Buhari made his first major appointments for his second term. The President gave the nod to Boss Mustapha and Abba Kyari to continue as Secretary to the Federal Government and Chief of Staff respectively. These are said to be positions meant for the President’s most trusted advisers. The operators of the so-called Kitchen Cabinet; where the beneficiaries of the Power and governance decisions in Aso Rock are determined.

Mustapha, a latter day Buhari appointee is not as popular as Kyari who is always in the news. In fact, Kyari’s media mentions may just trump President Buhari’s. That’s how popular Kyari is. Perhaps never have we had so much interest in an appointee of the President. This makes it imperative for the interest and fixation on Abba Kyari to be constructive and geared towards engendering good governance in Nigeria.

Prior to Kyari’s re-appointment, the media was awash with several campaigns in his favour as well as those designed to snuff out his influence in President Buhari’s administration. The media frenzy was immense. Several names were touted as possible replacements. Col. Hameed Ali (rtd), Adamu Adamu and Babatunde Raji Fashola were said to be the main contenders to the exalted office of Chief of Staff.

Ali, the unbending Buharist and current Comptroller General of the Nigerian Customs Service, was touted as one that would bring “discipline” while Adamu and Fashola, immediate past ministers of education and minister of works, housing and power respectively, were also considered as “progressives”.

Several reports quoted “Presidency sources” who “authoritatively” confirmed that President Buhari was set to drop Abba Kyari’s following outcome of investigation into various allegations. Unconfirmed reports were syndicated to instigate public outcry and angst against Kyari. The media war was so apparent to discerning Nigerians, to whom it was crystal clear that the drama was all about political posturing and positioning.

Yes, we have seen this play out in the polity time and again. Well, the President has elected to keep the services of Abba Kyari. This, regardless of the position of the warring factions, should be viewed as an endorsement of his performance. Consequently, all parties should in the interest of the nation unite and join hands with the President and his advisers to ensure Buhari’s second term is successful.

While congratulating Abba Kyari on his re-appointment, the Cambridge University trained lawyer must put all the drama behind him. Nigerians are expecting progress at the speed of light. His office is critical to setting the tone for the nation to make strategic and effective strides towards peace, progress and prosperity.

Abba Kyari needs to shield President Buhari from sycophants and those who are only seeking to feather their nests at the expense of Nigeria’s commonwealth. Kyari needs to coordinate far-reaching stakeholder engagement plans that will give Buhari’s administration access to multiple portals for discharging good governance equitably across the nation.

This second coming presents Abba Kyari a golden opportunity to help Buhari develop a legacy beyond fighting corruption and insecurity. Although these are essential for development, they do not guarantee sustainable growth. Abba Kyari neees to help Buhari build strong institutions.

In addition, Kyari should do all within his power to avoid  mainstream politics and focus on policy formulation. As a son of the Borno Kingdom, Kyari must uphold the pride and integrity of the reverred Kingdom. It also will not hurt for Kyari to shed the garb of being introverted;  he needs to be more convivial to engender opportunities of learning from others.

The onus is on Abba Kyari to ensure a coherent Presidency; one that is forthright, visionary and unwavering. Hopefully, the distractions and agitations that preceded Abba Kyari’s second coming will inspire him to work even harder and serve selflessly in accordance to the expectations of Nigerians.

  • Why Buhari reappointed Mustapha, Kyari, 11 others

PRESIDENT Muhammadu Buhari shocked lobbyists on Friday by reappointing the Secretary to the Government of the Federation, Mr. Boss Mustapha and his Chief of Staff, Mallam Abba Kyari.

It was learnt that the President returned the two leaders to his inner team in order to ensure continuity.

Buhari was also said to have used the appointments to demonstrate that he cannot be stampeded by anybody or group.

The President was said to be angered by isolated protests against Kyari and his nephew, Mamman Daura over cabinet appointments.

In two separate statements by the Senior Special Assistant on Media and publicity, Garba Shehu, Buhari had approved the reappointment of Mustapha, Kyari and 11 personal aides.

The 11 aides are Mohammed Sarki Abba (Senior Special Assistant to the President (Household and Social Events); Ya’u Shehu Darazo (Senior Special Assistant to the President on Special Duties); Dr. Suhayb Sanusi Rafindadi (Personal Physician to the President); Amb. Lawal A. Kazaure (State Chief of Protocol); Sabiu Yusuf – Special Assistant (Office of the President); Saley Yuguda – Special Assistant (House Keeping).

Others are Ahmed Muhammed Mayo-Special Assistant (Finance & Administration); Mohammed Hamisu Sani – Special Assistant (Special Duties); Friday Bethel – Personal Assistant (General Duties); Sunday Aghaeze – Personal Assistant (State Photographer); and Bayo Omoboriowo – Personal Assistant (Presidential Photographer).

Investigation revealed that there had been issues within the kitchen cabinet of the President and outside on the choice of aides and cabinet members.

Although the President kept mum on his direction, he was overwhelmed and bemused by agitations over his personal aides and ministerial nominees.

A reliable source, who spoke in confidence, said: “In all honesty, the reappointment of Mustapha, Kyari and all other aides was informed by the need for continuity. He felt it is not easy having a new Chief of Staff managing his schedule.

“He is appreciative of their loyalty, especially when he had medical challenges. Despite insinuations, he decided to sustain the bond between him and his aides.

“There was no single leak on his health status until the President himself opened up after recovery.

“A few names were recommended to replace Kyari but the President weighed all options and it was difficult to understand why he should drop Kyari whose sense of duty and commitment he appreciates.

“Security reports on some of these recommended nominees were unfavourable. One of the nominees was actually linked with slush funds traced to the late Head of State, Gen. Sani Abacha and his family.”

Findings however revealed that sponsored demonstrations against Kyari and his nephew actually made Buhari to do what a source described as “damning the consequences.”

Another source added: “The President has shown that he cannot be stampeded by anybody or group. He was shocked by the isolated protests against Kyari and his nephew, Mallam Mamman Daura, in Abuja and Kaduna.

“Security reports indicated that some desperate office seekers were behind the protests. The President felt the protests were personalised and he was not ready to condone the desperation.

“From the feelers at hand, the protests actually triggered the reappointment of Kyari. The President decided to be his own man rather than being intimidated by outside forces.

“Buhari has a peculiar fixation as a leader with a military background. He detests being forced or intimidated to take a decision on any issue or appointment.

“I think those who bankrolled the protests got it wrong because Buhari was angry with their desperation. Heckling at Daura’s residence in Kaduna by the protesters weighed heavily in favour of Kyari.

“As at the time Buhari went to Saudi Arabia, a former Minister was among the leading favourites to succeed Kyari.

“While in Saudi Arabia, a respected influential person in the power corridors even whispered to the ex-minister not to decline being the Chief of Staff if offered by the President.

“We do not know whether or not the ex-minister refused to accept to be the Chief of Staff and Buhari took advantage to retain Kyari.”

But a source admitted that Daura and powerful kitchen cabinet members (the Cabal) played a major role in the retention of Kyari and the 11 aides.

The government source said: “Those who wanted drastic changes in Buhari’s strategic aides actually wanted to dismantle the kitchen cabinet of the President, whose arrowhead is Daura. All over the world, it is always difficult to tamper with any power cabal.

“The truth is that the President has absolute faith in the judgment of his nephew because when it was rough for him, only Daura was the last man standing. It was Daura who recommended Kyari for the job. To drop the Chief of Staff will be a slight on Daura.

“The retention of Kyari has deepened the bond between the President and Daura.”

Asked what will change, the source added: “I think the President will pay more interest to the conduct and activities of these aides around him.”

  • Buhari’s cabinet: Security screens states nominees

The Presidency has ordered tighter security around President Muhammadu Buhari’s  nephew, Alh. Mamman Daura.

The enhanced security is also for the Chief of Staff, Mallam Abba Kyari and some other members of the President’s Kitchen Cabinet, following protests over the cabinet, which is yet to be formed.

Security agencies, who are screening nominees from the states, are said to be trailing the sponsors of the attacks on Daura  and Kyari.

It was also learnt that the President is finalising the consideration of ministerial nominees with three shortlisted per state for broader perspective.

Besides, preliminary background checks on some of the nominees are still on going.

But it was unclear last night whether or not the President will have a 36-man cabinet or a 42-man team.

The presidency is said to have been disturbed about personal attacks on Daura and Kyari.

Besides street protests against Kyari in Abuja, there was also the invasion of Daura’s home in Kaduna on Tuesday.

The protesters, who officials believe were sponsored,  had assumed that the two leaders and other members of Buhari’s kitchen cabinet could  stop their candidates from being ministers.

It was gathered that the presidency was bitter that the jostle for ministerial tickets has become “personal assault.”

A President source said: “The Presidency has directed that security be strengthened for Daura, Kyari and other close associates of the President, who are being targeted.

“The challenge most lobbyists are having is that the President is keeping the list of his incoming cabinet to himself. Not even APC leaders or governors have access to the list.

“Some may have dropped names but the President is always keeping quiet. It is difficult to read his mindset. So, attacking Daura and Kyari was unfortunate. They do not have any role to play in compiling the list of those who will be members of the Federal Executive Council.”

Responding to a question, the highly-placed source added: “ Security agencies are investigating those behind the unwarranted personal attacks on Daura and Kyari and others being assumed to be in charge of the cabinet list, who are said to be sponsored. “I believe these agencies will unmask them.”

Another source told The Nation that the final consideration of likely ministerial nominees is being done by the President.

Most states have as many as three nominees from whom the President will pick  one.

Said the source: “ The list in most states comprises three nominees, but the President has adopted broader perspective in considering the nominees, including some former ministers.

“ Preliminary background checks on some of the nominees are ongoing. But before the President sends the list to the National Assembly in July, the checks would have been concluded and the best chosen for cabinet appointments.”

It was unclear if the President will retain the 36-man structure or allow six more ministers for each of the six geopolitical zones to make 42.

A Presidency source said: “ The constitution allows either 36 or 42 ministers.

“It is the prerogative of the President to determine what is best for the nation.”

Section 147(1-3) directs the President to appoint at least 36 ministers unless the constitution is amended.

The section reads:  “There shall be such offices of Ministers of the Government of the Federation as may be established by the President.

“Any appointment to the office of Minister of the Government of the Federation shall, if the nomination of any person to such office is confirmed by the Senate, be made by the President.

“Any appointment under Subsection (2) of this section by the President shall be in conformity with the provisions of Section 14(3) of this Constitution:

“Provided that in giving effect to the provisions aforesaid the President shall appoint at least one minister from each state, who shall be an indigene of such state.”

  • Abia APC backs zoning of Senate Presidency to Southeast

The Abia State Chapter of the All Progressives Congress (APC) has joined other Abians and well-meaning Nigerians to call on the National leadership of the party to ensure that the position of Senate President in the 9th National Assembly was ceded to the Southeast.

Abia APC speaking through the Publicity Secretary of the party in the state, Comrade Benedict Godson on Thursday in Aba, the commercial nerve of the state posited that it will be both politically and morally correct to do so.

According to Godson, the call was important going to the recent political development in the country where both the newly elected and already serving senators from different parts of the country have started scheming for a position, the APC publicity secretary said would ordinarily be zoned to the southeast to balance power sharing among the major ethnic groups in the country.

Those touted to be key contenders of senate Presidency include former governor of Abia State, Dr. Orji Uzor-Kalu (Southeast), Senator Ahmad Lawan from Yobe (Northeast), former Gombe State governor, Danjuma Goje (Northeast), Senator Ali Ndume from Borno (Northeast )and Senator Adamu Abdullahi from Nasarawa State (North-central).

Godson said that the structural makeup of the current government from executive, legislative and judiciary, shows that it will be the most infallible and plain sailing decision for the party to cede the senate president to South East.

“If you can recall, Dr. Chris Ngige because of his defeat could not be made Senate President because he couldn’t come back to the national assembly and there was no way that they could have given it to Ekweremadu who is from another party. That gave way for the manipulation that brought Bukola Saraki in as the senate President.

“For us here, this should not be a difficult decision at all. It is a decision that will show inclusiveness in all ramifications. The structure of the current government from executive, legislative and judiciary calls for a space for the Southeast to accommodate and integrated.

“Our able leader, President Muhammadu Buhari is from Northwest, Vice President; Prof Yemi Osinbajo from Southwest, Secretary to Government of the Federation (SGF), Boss Mustapha and the Chief of Staff to the President, Abba Kyari are both from Northeast.

“Although the current senate president and Speaker of the House of Representatives are no longer our members, but both are from North Central and Northeast respectively. And the South-South until recently had the number one position in the judiciary (CJN). Even the National Chairman of our party is from the South-South as well.

“This goes to show that the Southeast is the only geo-political zone which has no ranking government official in the hierarchy of power within the APC led government. So, giving us this one is a no brainer I must say it unequivocally.

“Agreed, in 2015 we didn’t do much in terms of sending people from APC to the National Assembly, but the story is different today as we already have an elected Senator and members of House of Representatives. Even in the presidential election, we showed serious commitment and dedication to our party candidate who won convincingly,” he said.

Godson who said that he was sure that Kalu was going to deliver creditably if chosen as the Senate President going by his level of experience as a businessman, governor and former House of Representatives member noted that it was imperative that the National Working Committee of APC, all elected Senators from both Southeast and other zones among other stakeholders of the party joined hands to support Kalu to clinch the senate apex position for justice and equity within the party and the nation at large.

“Those of us from Abia are strongly behind our leader Senator Orji Uzor-Kalu and believe he should be considered for the post because he is capable and has collected his certificate of return from INEC and as such now a Senator of the Federal Republic of Nigeria from the Southeast.

“People may say he’s a greenhorn in the senate, but we must put records straight, because he is not new in the National Assembly.

“He was in the House of Representatives in 1991. He was deputy chairman, House Committee on Finance and Immigration, because his party, the National Republican Convention (NRC) was in minority then. He’s not a greenhorn at all.”

Speaking further, Godson said, “Let no one get this call twisted in anyway, our call and demand for this position is not in any way trying to say that the APC led Federal Government has not done well in the Southeast.

“That’s not what we are saying. The essence of this explanation is to make sure that people don’t twist it into that. In fact, our people are aware that the president Buhari led administration has executed more people oriented projects in the Southeast than previous administrations.

“So, we must make this clear before mischief-makers will turn our simple call for rightful accommodation and integration into the progressive APC government to mean an agitation of dissatisfaction with the APC led administration.

“We appreciate the Federal Government and all its efforts in the Southeast, but we are saying that it will be fair, politically and morally correct for our zone to be given the number one principal position in the Senate because we deserve it as it will make our party stronger and more balanced in national outlook.”

  • Police want me to implicate Saraki, says Offa robbery suspect

One of the suspects in the April 5th, 2018 bloody bank robbery in Offa, Offa local government area of Kwara state, Ayoade Akinnibosun on Friday revealed the police asked him to implicate Senate President Bukola Saraki.

The three accused persons also said that the principal suspect Michael Adikwu in the robbery incident was shot dead by one Inspector Vincent attached to the police Intelligence Response Team (IRT).

IRT, which office in Abuja, is headed by Deputy Commissioner of Police Abba Kyari Akinnibosun, who is the first accused person, Ogunleye and Abraham in the Offa robbery incident were examined and cross-examined by their counsel Mathias Emeribe and Prosecution counsel Razaq Gold in a trial within trial on how they were tortured and threatened by the police to make confessional statements.

Prosecution witness Inspector Hitila Hassan had on Thursday told the court that the suspects voluntarily gave their statements under his supervision.

Lead Prosecuting Counsel Prof Wahab Egbewole sought to tender the statements as exhibit but defence counsel Mathias Emeribe objected.

Mr. Emeribe argued that the statements were not voluntarily taken, noting they fell short of the provisions of the Evidence Act particularly sections 28 and 29.

At Friday’s proceedings, Akinnibosun said: “Abba Kyari told me to mention the name of Senate President Bukola Saraki that he gave me the guns for the operations. But I declined to do contending that my life is at stake.

“He promised that they would reward me handsomely and set me free if I can indict Senator Saraki.

“When I disagreed they called some policemen to take me back to their cell. During this time my hands were tied to my legs in the back. Their children are in America and Europe you are allowing yourselves to be used as political thugs.”

Akinnibosun added he was the leader of Kwara South Liberation

Movement mobilising young jobless graduates for the Senator representing Kwara South district in the upper legislative chamber, Dr Rafiu Ibrahim.

The essence is to secure government jobs for the boys, he said.

Ayoade Akinnibosun, Ibikunle Ogunleye and Adeola Ibrahim gave graphic details of their horrifying experience allegedly in the police custody in Abuja.

During one of their encounters at the police IRT ‘theatre room,’ they said in their presence Inspector Vincent allegedly shot dead five Fulani men.

‘The theatre room,’ according to is the generator room of the IRT’s office and it also doubles as where suspects are extra-judicially executed.

The trio added that it was in the same ‘theatre room that Inspector Vincent otherwise known as ‘Mr. Torture,’ allegedly shot dead Michael Adikwu for failing to indict them in the robbery incident.

According to Ibikunle Ogunleye “they brought the late Adikwu to implicate us and he said he had not met any of us in his life that is why Mr. Torture shot him to death. “

Presiding judge, Justice Halimat Salman adjourned the case to March 25th for continuation of trial within trial.

  • Court adjourns hearing of Offa robbery suspects

A Kwara state High Court sitting in Ilorin, the state capital on Thursday abruptly adjourned resumed trial of Offa robbery suspects citing security reports.

The court had commenced sitting on the case at about 9am Thursday for the continuation of hearing as one of the prosecution witnesses Hitila Hassan continued to give his evidence in chief and was cross-examined by the defence counsel Mathias Emeribe.

At some minutes past 2pm, presiding Judge, Justice Halimat Salman said “reports reaching us are not favourable for the continuation of the case today. I don’t have anything doing but the court had to rise for the case to continue tomorrow.

“For the security of the suspects and all of us here, I have to rise. May God spare our lives till tomorrow for the continuation of hearing.”

The five accused persons standing trial in connection with the April 5th, 2018 bloody Offa, Offa local government area of the state, Ayoade Akinnibosun, Ibikunle Ogunleye, Adeola Abraham, Salaudeen Azeez and Niyi Ogundiran were in court.

In his evidence-in-chief, Inspector Hassan said the confessional statement of the first suspect (Ayoade Akinnibosun) indicted the Chief of state to Kwara state Government, Babatunde Abdulwahab, political adviser to Governor Abdulfatah Ahmed, Lekan Alabi and one Adeola Omiyale.

He added the first suspects alleged that he got the AK47 rifles allegedly used in the robbery incident from the above people, saying that informed their arrest by the police high command in Abuja. Hassan, who said he is an inspector of police attached to the Intelligence Response Team of the former Inspector General of Police, added that it is headed by Deputy Commissioner of Police (DCP) Abba Kyari.

Hassan said he supervised the recording of the confessional statements of Ibikunle Ogunleye (2nd accused person) and Adeola Abraham (3rd accuse person), adding that he helped write those of the first accused (Akinnibosun) and 5th accused person (Niyi Ogundiran) and he countersigned as the writer.

Lead Prosecuting Counsel Prof Wahab Egbewole sought to tender the statements as exhibit but Mr. Emeribe objected.

He argued that the statements were not voluntarily taken; noting that they fell short of the provisions of the Evidence Act particularly sections 28 and 29.

Said he: “They fall short of the Kwara state Administration of Criminal Justice Law because as it did not show the voluntariness of the statements as stated, particularly as it concerns section 33 of the Kwara state Administration of Criminal Justice Law 2018.

“Even in the absence of the law they did not comply with the judge’s rules. It must be understood that Kwara state Administration of Justice Law 2018 was created to protect the rights of the accused when statement of this nature is about to be taken. Failure to yield to these provisions will automatically render the admissibility of same null and void.

“I hold the view that the statements have failed to pass the test of admissibility. I submit that they were not taken voluntarily as required by the law.”

Reacting, Prof Egbewole said that section 33 of the Kwara state Administration of Criminal Justice Law is not applicable in the instance case.

He added that “Law does not have retrospective effect, adding that the Kwara state Administration of Criminal Justice Law came into force December 3rd, 2018 and all these statements were recorded in May last year.”

The presiding judge adjourned the case till today, March 15th for continuation of hearing.
