  • Sagay, SANs: Senate’s directive to remove Magu illegal

Sagay, SANs: Senate’s directive to remove Magu illegal

Senior lawyers Tuesday said the Senate lacked powers to direct Acting President Yemi Osinbajo to remove the Acting Chairman of the Economic and Financial Crimes Commission (EFCC) Ibrahim Magu.

Presidential Advisory Committee Against Corruption (PACAC) chairman Prof Itse Sagay, constitutional lawyer and renowned legal author Sebastine Hon and Chief Emeka Ngige, all Senior Advocates of Nigeria, said the Senate’s demand was illegal.

Sagay said the Senate should be ready to bear the consequences of bringing government to a halt should it make good its threat to suspended all confirmation of appointments until compliance with its resolution.

He accused the Senate of trying to usurp the President’s powers on appointment.

Besides, Sagay said the provision in the EFCC Act that the commission’s chairman’s appointment was subject to Senate confirmation was invalid for being inconsistent with the Constitution.

The eminent professor of law said: “This is a Senate that does not realise that it is part of the legislature and not an executive body. And they want to do both the legislative and executive work together, which will totally eliminate the principle of separation of powers. That’s the sort of people they are. They’re legislators, but they’re hungry to be the executive body.

“If they threaten to bring government to a halt, they will bear the responsibility and consequences that will arise. Let them be ready to take the consequences of their actions.

“In fact, it may be good for this country for them to expose themselves like that and let the country know the people who constitute a problem to good governance in Nigeria.”

Sagay said the Senate lacks the powers to direct Osinbajo to remove Magu.

“How can they say he should remove somebody? That is an executive power. The Constitution empowers the President to appoint the chairman of EFCC and other such agencies directly.

“So, if they’re uncomfortable with the fight against corruption and feel threatened by a man who is upright, committed and will not be distracted from doing his job, if they’re not comfortable with that, it’s unfortunate. But nobody is going to listen to them as far as that is concerned.

“If they want to indulge in the misadventure and danger of bringing government to a halt, then on their head will be the consequences,” Sagay said.

On the provision of Section 2 (3) of the EFCC Act that the commission’s chairman’s appointment was subject to Senate confirmation, Sagay said it was not binding.

The section reads: “The Chairman and members of the Commission other than ex-officio members shall be appointed by the President subject to the confirmation of the Senate.”

On why the section is invalid, Sagay said: “It is invalid because it is in conflict with the provisions of the Constitution.”

Ngige described the Senate’s demand as “ill-advised”, adding that threatening the executive amounted to arm-twisting.

He urged the lawmakers to approach the Supreme Court for determination of the issue.

Ngige said: “I think the action is ill-advised. The issue in contention is the correct interpretation of section 171 of the 1999 Constitution as it pertains to whether senate confirmation is required for certain class of political office holders.

“My take is that the Senate should invoke the original jurisdiction of the Supreme Court on the issue and get a final and definitive pronouncement on the matter.

“I think what the senate resolved to do by going on strike, as it were, is undemocratic and tantamount to arm-twisting the executive.

“In my view, the issue of judicial interpretation of Section 171 of the Constitution is highly recommended because either side can win if tested in the apex court.

“The matter should not be personalised on the status of Magu after his failed confirmation hearing.”

Hon also believes the Senate lacks constitutional powers to compel Osinbajo to remove Magu.

He said: “The powers of the National Assembly are, by sections 4 (1), 58 and 59 of the Constitution, limited to lawmaking.

“Not even sections 88 and 89 of the Constitution, which provide for oversight functions of the National Assembly, imbue the Senate with such powers – since those provisions have nothing to do with a person expressing a personal opinion on an issue.”

He argued that if the Senate was aggrieved, it could go to court and not resort to grandstanding, which would needlessly heat up an already charged polity.

  • IYC flays security agencies for refusing to arrest Arewa youths

IYC flays security agencies for refusing to arrest Arewa youths

    …Accuse them of double standard

The Ijaw Youth Council (IYC) Worldwide, Monday, lambasted the police, the Department of State Security (DSS) and other security agencies for failing to arrest the Arewa youth leaders, who issued quit notice to Igbo residents in the north.

IYC, an umbrella body of Ijaw youths, in a statement signed by its President, Mr. Eric Omare, said treating the northern youths with kid gloves smacked of double standard on the part of security agencies.

“The Arewa youths quit notice to Igbos living in the north to vacate the north by October 1, 2017 amounts to grave threat to national security and the indivisibility of the country.

“However, the relevant security agencies have deliberately kept a deaf ear to the security threat posed by the Arewa youths treasonable quit notice”, Omare said.

He argued that if a similar threat had been issued by youths from other parts of the country especially the Niger Delta region, communities such as Kaiama, Okerenkoko, Warri, Yenagoa and the entire Niger Delta region would have been under security siege.

“We totally and in strongest words condemn this double standard by the Nigeria security agencies. It is totally unacceptable for security agencies to apply double standard in response to security threat in different parts of the country.

“The standard applied to youth groups and agitators in the south should also be applied to same class of people from the north”, he added.

Omare argued that the inaction of security agencies was an indication that some powerful persons in the north and the Federal Government were behind the Arewa youths.

He said: “This fact has already been confirmed by Arewa Youth leader, Yerima Shettima who said that their leaders are behind them.

“The IYC is confident that if Yerima Shettima and his co-travellers were to be Niger Deltans, they would have been behind bars now.

“It is on record that Niger Delta activists such as Daniel Ezekiel, Jones Abiri and others are still in detention without trial for mere allegations of threat to national security.

“The IYC therefore calls on the security agencies to rise above politics and stop the double standard in the performance of their duties.

“The Arewa youth leaders who issued the treasonable quit notice to Igbos in the north should be made to account for their actions to avoid unnecessary loss of lives and properties as a result of their quit notice”.

Omare also told Acting President Yemi Osinbajo that his ongoing consultations were cosmetic as they would not address the root cause of ethnic uprising in the country.

He asked Osinbajo to take appropriate steps towards addressing the causes of the tension in the country rather than embarking on talk shows.

He noted that northern oligarchy was a hinderance to genuine reconciliation through deliberate reconstruction of the federation.

Describing Osinbajo’s move as a talk show, Omare said consultations only amounted to postponement of the evil days.

Omare said: “IYC says that talks by Acting President Yemi Osinbanjo with various regional and ethnic leaders without taking practical steps to address the causes of the tension in the country amounts to postponing the evil days.

“The IYC is of the view that Nigerian and Nigerians have deceived themselves enough and it is time to face the reality which is that the centre can no longer hold except steps are taken to reconstruct Nigeria to satisfy the yearnings and aspiration of the different ethnic nationalities making up the country.

“It is on record that the southern parts of the country including some parts of the middle belt have consistently called for reconstruction of Nigeria to reflect the tenets of federalism with the centre allowed to handle only issues relating to foreign affairs, currency, defence and few other issues of national importance.

“However, the opposition of the Hausa/Fulani oligarchy of northern Nigeria is holding the entire country to ransom in the quest for restructuring.

“However, it is now obvious that restructuring is an idea whose time has come and no amount of Hausa/Fulani oligarchy opposition can stop it from coming to a reality”.

    …Orders security reinforcements

Acting President Yemi Osinbajo on Thursday condoles with the victims of the recent violent attacks in a number of communities in Taraba State, where deaths have been reported.

He condemned the acts of violence, assuring that perpetrators of the attack would be brought to book.

In a statement issued by the Senior Special Assistant on media and publicity, Laolu Akande, Osinbajo also commiserated with the people of the affected communities, the entire government and people of Taraba State.

The Acting President, over the matter, summoned and held an emergency meeting with top security officials of the Federal Government and Governor Darius Dickson Ishaku.

He also ordered the deployment of an extra military battalion, police and the Nigeria Security and Civil Defense Corps to the areas affected.

The Acting President also ordered the provision of relief materials to be delivered to the affected communities in Toffi, Mayo Daga, Mayo Sina, Tamiya, Kwara-Kwara, Tungan Lugere, Timjire, Nguroje and other villages in the hinterlands of Mambilla Plateau.

  • PDP commends Osinbajo on tension-dousing steps

PDP commends Osinbajo on tension-dousing steps

The People’s Democratic Party (PDP) has commended Acting President Yemi Osinbajo on steps he had taken to douse tension in the country occasioned by “hate speeches’’

Sen. Ahmed Makarfi, Chairman, PDP National Caretaker Committee, said at a news conference on Wednesday in Abuja, that Osinbajo deserved to the commended.

Makarfi, however, called on government to build on the effort by making all sections to be viable and operate an inclusive government.

He advised the government to ensure that its programmes, policies and steps were tailored in a manner that no section of this country would have the impression that it didn’t count.

Makarfi also called on leaders and governments at all levels to handle emerging challenges confronting the nation in best way possible.

According to him, the emerging challenges include insecurity in the North-East, herdsmen/farmers’ clashes, kidnappings as well as agitations and counter-agitations for secession.

He said that PDP believed that human and national development normally had challenges, but that “handling of such challenges determines the direction that the development takes’’.

“As a country and a people, we have faced several developmental challenges; some have been resolved while many others are yearning for resolution.

“Even after such resolution as it’s typical of the evolution of human societies, we should expect to be confronted by new and emerging challenges.

“It is thus the responsibility of each generation of our leaders to grapple with and handle such emerging challenges in the best way possible. It is always a work in progress,’’ Markafi.

On herdsmen and farmers’ clashes, he said that while both groups had constitutionally guaranteed rights to existence, government needed to come up with measures that would once-and-for-all address the issue.

“We must, however, be able to differentiate between the business of peaceful cattle rearing and criminal activities and take appropriate steps to protect lives and property.

“We must also secure our borders in order to prevent the influx of foreigners who may not respect the laws of our land.

“Of concern also is the issue of cattle rustling, which is also taking an altogether unprecedented dimension.

“This unlike the pastoralists/farmers problem, is clearly an issue of criminality, which governments and security agencies need to wake up to, to reassure victims that the state is there for them also.’’

On kidnappings, Makarfi said it was worrisome that school students and teachers were had become targets of the criminal act.

He said that the development underscored the urgent need for security agencies to “up their ante’’ in the fight against the scourge.

“Apart from additional funding, equipping and intelligence gathering, capacity of the security agencies must be improved as a matter of priority as this will enable the nipping of this criminal activity in the bud.

“We, however, wish to commend the security agencies for the bursting last week, of a criminal gang of kidnappers which had brought untold hardship and anguish to several Nigerian families.

“It is our hope that this feat is just the start of series of efforts to not only bring this criminal enterprise to an end, but also bring the perpetrators to justice. ‘’

Makarfi also urged the security agencies and the judiciary to ensure that criminals faced the full wrath of the law.

He said that PDP believed that in any democratic space, allowance must be made for people to express grievances and agitate for the redress of such.

He added that while PDP had no problem with agitations, those calling for succession should respect the rights legitimate rights and dignity of other citizens.

The chairman described recent altercation which degenerated into the issuance of ultimatum and counter-ultimatum for some Nigerians to leave certain parts of the country as an ill-wind that blew no good.

“Hate speeches either coming from the North, South, East or West must be avoided and be condemned by all of us.’’

Makarfi, however, prayed for President Muhammadu Buhari and wished him quick recovery.

  • Osinbajo to governors: Ensure safety of all Nigerians in your state

Osinbajo to governors: Ensure safety of all Nigerians in your state

…Bring to book those making hate speeches

Acting President Yemi Osinbajo on Wednesday urged State governors to take necessary steps to ensure safety of all Nigerians living in their states.

He made the call during consultative meeting with the 36 state governors, at old Banquet Hall of the State House, Abuja.

The meeting followed the consultative meetings with leaders of thoughts and traditional rulers from the North and South East over increasing ethnic tension in the country.

Some Arewa youths recently gave Igbos ultimatum to leave the North on or before October 1st, 2017.

They were reacting to the May 30th sit-at-home order issued out to Igbos IPOB.

Osinbajo, on Wednesday harped on the right of any Nigerian to live in any part of the country.

While calling on the governors to resist playing politics with issue of security, he said that those making hate speeches should be brought to book.

He said: “We as a Federal Government are committed to working with the State governments in ensuring peace and stability in our country. I want to charge each and every one of us as top of the agenda for us is the peace and security of lives and properties of those who live within the borders of our states.

“The security of their lives and properties, every one of them and assuring them constantly that we are committed to ensuring that all Nigerians, wherever they may be from, can live within the borders of our states happily as brothers and sisters.” he said

He added “We must not allow the careless use of words, careless expressions that may degenerate into crisis. We are a people that like to talk and we express ourselves loudly but it is expected for us to recognise that it is those same words that can cause conflagration, that can unfortunately lead to calamity.

“We must be careful of how we express ourselves. What we have seen in recent times is that some of the languages used have tended to degenerate badly and I think that we must begin to speak up against some of these things and ensure that we protect our democracy and our nation from the hands of rhetorics that may just divide us.

“From all of the consultations we have had, all agreed on certain issues. We agreed that Nigeria’s unity should not be taken for granted. No one wants to see us go done the path of bloodshed or war.

“We also agreed on the permanency of the Nigerian constitution, that 1999 Constitution is the basis for our unity. It is the basis for the legal contract that exists between all of us. Our meetings were frank and open as I hope this will be, we were able to agree on most of the critical issues that were discussed and in most cases changed perceptions that may have been long embedded in their minds.

“We also agreed that under no circumstances should we condone hateful speeches and that government should take all steps necessary to bring to book all those who preach violence, in particular the kind of expressions of dissent that can cause violence.

“We also agreed that we need to do more to engage our youth productively, create some jobs, and multiply the economic opportunities available. More importantly we agreed on the need for leaders to speak out forcefully to counter divisive speech or any kind of woe mongering, we agreed that leaders at all levels speak out forcefully against any kind of divisiveness or divisive speech.

“And we expect that our political leaders will do so without waiting to be prompted. All of those who spoke to, sometimes when leaders do not speak up promptly it always results in degeneration no matter what the problem may be.

“This applied to both the statement made by the young people in the
South East as well as the youth in the Northern states. We discovered there was a need for much greater resonance in the way that these things are done and for the leaders to speak up more forcefully.

“We believe that if the leaders do not speak up forcefully enough if for any reason matters are allowed to degenerate, not only does leadership loose their legitimacy, they run the risk of things going completely out of control,” he said

Commending the leaders from the North and South for their openness at the consultation meetings, he said that “they were extremely responsible even in their criticisms of what they felt were issues that should have been better handled. I think that their criticisms were fair and balanced. I must commend them for their sense of responsibility and their leadership.”

He told the governors that some of the issues that came up during the consultative meetings included the issues of the herdsmen and farmers crisis.

He said “Especially the way that some of these have resulted in flashpoint across the country. We started those discussions during the consultations we had and I believe that we will be able to deepen those discussions in our meeting and possibly hold a more expanded meeting where we will be to take a closer look at it.

“It is absolutely important that we are able to make lasting and satisfactory solutions to these problems. Of course the problems are multidimensional but the states have a very important role to play especially because they are in control of land in their territories.

“I must say that I trust that all of us must appreciate the need to show greater unity of purpose and the determination to work together to resolve various challenges that arise on a constant basis for the benefit of all Nigerians regardless of party affiliations.

“We must resist the temptation to play politics especially with matters of security, but to reach for simplistic narratives that might be originally expedient and satisfying but false, deceiving and sometimes unhealthy to proper understanding of the issues. Sometimes intensions are perceived on the account of the fact that they have wrong perception about a particular thing.

“I think it is in our place to ensure that we dig down the fact and ensure that people are given the fact and ensure that we don’t colour them with politics,” he stated.

The Oyo State Governor, Abiola Ajimobi, at the end of the meeting told State House correspondents that all the governors at the meeting are unanimously behind the Federal Government in keeping Nigeria one.

  • Hate speech: Osinbajo urges Northern traditional rulers to speak up

Hate speech: Osinbajo urges Northern traditional rulers to speak up

Acting President Yemi Osinbajo on Tuesday met with Northern traditional rulers and charged them to always speak up against hate speeches and divisive voices in their respective domains.

In his opening remarks at the meeting held at the old Banquet Hall, Presidential Villa, Abuja, Osinbajo said the meeting had become imperative in view of a spate of divisive statements in recent weeks, pitching the South-East against the North.

He maintained that the divisive rhetoric and agitations were unjustifiable, unacceptable and often times illegal.

“You are, by virtue of your vast knowledge, wisdom and experience, both a vital link with our past, and an important guarantee for the success of our future. This is why your role in national affairs is critical.

“The reason for these series of meetings is well known to all of us; it became necessary in the wake of a spate of divisive statements, in recent months and weeks, pitching the South-East against the North.

“We are all aware of the so-called ‘ultimatum’ issued by a group of Northern youths, asking that all Igbos living in the North vacate the region.

“Before then, there was the clamour, and it’s still on-going, by some south-eastern youths, operating as IPOB and affiliated groups, demanding secession from Nigeria at all costs and by any means.

“In all our previous engagements with Northern and South-Eastern leaders, we all came to the consensus that Nigeria is stronger and better together, and that these hate-filled and divisive rhetoric and agitations are unjustifiable, unacceptable and often times illegal. And I would like to reiterate that today.” he said.
The acting president said that the traditional rulers had a great role to play in checking the divisive tendencies in the country.

He stressed that Nigeria had already seen enough violence and bloodshed during its history.
According to him, the price of Nigeria’s unity has already been paid with the blood and lives of hundreds of thousands of soldiers and civilians lost.
Recalling President Muhammadu Buhari’s commitment to one Nigeria from his experience in the military, Osinbajo said that Buhari fought side by side with Nigerians of every tribe and faith.
The acting president said: “We must protect each other, put our lives on the line for each other; we were brothers even in the face of death. This is the type of nation we must maintain.
“As royal fathers and leaders, I think you will agree with me that we all have a role to play in countering the voices of divisiveness, and the elements who seek to take us down a bloody path.
“Let us continue to counsel the misguided elements among our youth, who think that ethnic confrontation is a game and that words can be thrown around carelessly without repercussion.’’
Osinbajo assured the traditional rulers that the “government is not deaf to the legitimate concerns and frustrations in parts of the country.
“Every part of Nigeria has its own grievances. But these have to be expressed graciously and managed with mutuality rather than with scorn and disdain.
“I would like to assure you all that we are here to listen and to answer, and, very importantly, to reassure everyone that we are committed to the unity of Nigeria, and that upon the foundation of that unity we can together build a prosperous and great country.’’
He urged all Nigerians never take the nation’s diversity for granted, saying the fullness of the nation’s strength “actually lies in that diversity.

“And we must wield that diversity, not as divisive tool, but instead as a binding agent.

“As we round up these consultations tomorrow with a meeting with governors, it is clear to me that we are all resolved to by words, conduct and action, promote the unity of our dear nation.” he said

He, however, assured that the government would ensure that “the entire apparatus of government is deployed to ensure that no one threatens Nigeria’s territorial integrity and that no one threatens the lives or livelihoods of any Nigerian living anywhere in the country’’.

While thanking the traditional rulers for their unyielding cooperation and support, Osinbajo prayed that almighty God would continue to give them the wisdom and the strength to preside over their Kingdoms and the good health to reign long and reign well.

Among those who attended the meeting included the Sultan of Sokoto, Sultan Muhammadu Sa’ad Abubakar III; Emir of Kano, Muhammadu Sanusi and the Etsu Nupe, Alhaji Yahaya Abubakar.

Others were, Alhaji Muhammed Isah Muhammed, the Emir of Jama’a in Kaduna State, Justice Lawal Hassan, the Emir of Gummi; the Coordinator of the Northern traditional rulers council, Sakaruyi of Karo Dr. Emmanuel Kyauta, and the representative of the Emir of Katsina, Prof. Sani Lugga ,the Waziri Katsina.

The Emir of Ilorin, Alhaji Ibrahim Gambari; Alhaji Mustapha Agwai II, Emir of Lafia in Nasarawa State; Alhaji Kyari Umar El-Kanemi, Shehu of Bama representing Shehu of Borno and the Gbong Gwon Jos, Jacob Buba Jang, also attended the meeting.

“Every part of Nigeria has its own grievances. But these have to be expressed graciously and managed with mutuality rather than with scorn and disdain.

“I would like to assure you all that we are here to listen and to answer, and, very importantly, to reassure everyone that we are committed to the unity of Nigeria, and that upon the foundation of that unity we can together build a prosperous and great country.

“We must never take our diversity for granted; the fullness of our strength actually lies in that diversity. And we must wield that diversity, not as divisive tool, but instead as a binding agent.

“As we round up these consultations tomorrow with a meeting with governors, it is clear to me that we are all resolved to by words, conduct and action, promote the unity of our dear nation.” he said

The objective of the government, he said, is to provide the environment for a prosperous nation, where all, regardless of ethnicity or religion, can pursue their legitimate aspirations peacefully and securely.
