  • Court urged to void Bulkachuwa’s choice for Bauchi seat

who is the All Progressives Congress (APC) candidate for Bauchi North Senatorial District?

A chieftain of the party, Usman Abubakar Tuggar is insisting on being the candidate as the winner of the party’s primary elections held on October 3, 2018.

But the party listed Adamu Muhammed Bulkachuwa as its candidate.

Tuggar’s position is contained in a suit he filed before the Federal High Court, Abuja, in which he gave details of how he won in the direct primary option adopted by his party, and prayed the court to among others, order the Independent National Electoral Commission to accept his name as APC’s actual candidate for Buachi North, in place of Bulkachuwa.

The suit, marked: FHC/ABJ/CS/1240/2018 was filed for Tuggar by a team of lawyers, including Olisa Agbakoba (SAN) and Mike Ozekhome (SAN).

He stated, in a supporting affidavit, that after the primary, monitored by INEC officials, he won in six out of the seven Local Government that made up the Senatorial District and got a total of 71,308 votes, while Bulkachuwa came second.

Tuggar, who exhibited copies of the primary elections’ results sheets to support his claim, said he was taken aback when leaders of the APC elected to send Bulkachuwa’s name to INEC as the party’s candidate instead of his name, having won the primary and his victory acknowledged by INEC’s officials who were present.

The plaintiff stated that, on realising that Bulkacchuwa’s name was wrongly sent to INEC, he protested and wrote to the party’s National Chairman and other leaders, who, he said, failed to act to rectify the error, a development that informed his decision to approach the court for redress.

Tuggar wants the court to declare that, having been duly nominated by the defendant (APC) by virtue of the primary election held on October 3, 2018 and having been confirmed as validly nominated pursuant to the summary of candidates nominated at the primary, as produced by INEC’s representatives who witnessed the primary, the 3rd defendant (INEC) was bound to recognise him as APC’s “true and validly nominated candidate.”

He wants the court to set aside the purported submission of the name of the 1st defendant (Bulkachuwa) to INEC by the APC as its candidate and order the electoral body to expunge Bulkachuwa’s name from its record and replace it with his (the plaintiff’s) having won the primary and his victory confirmed by INEC’s representatives in their “summary of candidates nominated at the primaries.”

Tuggar is also praying the court to restrain Bulkachuwa from further parading himself as APC’s candidate; restrain INEC from further recognising Bulkachuwa as the party’s candidate, and to direct the electoral body to recognise him as APC’s true candidate for the Bauchi North Senatorial District seat.

In a counter-argument however, Bulkachuwa denied Tuggar’s claims, particularly in relation to the outcome of the primary elections and his choice as the party’s candidate for the seat. Bulkachuwa said, in a counter affidavit, that he came first in the primary elections with 56,784 votes.

He added: “Upon the submission of the report of the Bauchi State Electoral Committee of the 2nd defendant (APC) to its National Working Committee (NWC), the 2nd defendant’s NWC, at its meeting of 31th October, 2018, after a deliberation and consideration of the report of the Bauchi State Legislative Primary Election Committee, duly and unanimously reaffirmed my victory at the said election.

“Having emerged winner in the said election, the 2nd defendant (APC) officially listed my name as its nominated candidate for the Bauchi North Senatorial District for the 2019 general elections.”

Bulkachuwa, who also challenged the competence of the suit, claiming it was filed outside the 14 days allowed under the Constitution, argued that it is statute barred, and wants the court to dismiss it.

The suit, a pre-election matter, filed since October 30, 2018 and now pending before Justice Ijeoma Ojukwu, is yet to be heard.

  • PDP’s allegation, product of hallucination — Oyo APC

The All Progressives Congress (APC) in Oyo State says People’s Democratic Party (PDP)’s allegation that Gov. Abiola Ajimobi intends to cause mayhem during Saturday’s election is a figment of the opposition’s puerile imagination.

The APC Publicity Secretary in Oyo State, Dr Azeez Olatunde, said this in a statement in Ibadan on Monday.

The News Agency of Nigeria (NAN) reports that the PDP in the state had alleged that the APC and Ajimobi were planning to cause unrest during the election using transport union members.

“Our attention has been drawn to an allegation by the PDP that the governor is planning to use fake police and NURTW members to cause unrest in the state.

“We like to state categorically that this allegation is a figment of their puerile imagination and a product of hallucination,” the party said.

The APC said that everyone in the state knows that Ajimobi stood for peace and would not trade it for anything.

It said that Nigerians could not forget in a hurry the violent years of PDP and the ruins it caused which was gradually being salvaged by the APC administration of President Muhammadu Buhari.

The APC warned that it would resist election rigging and vote buying plans of the PDP in the gubernatorial election, stating that it won’t allow PDP to turn Oyo State into a macro finance bank.

“We wouldn’t have responded to PDP hallucinatory statements since the people know the party is synonymous with violence, maladministration, financial recklessness and mudslinging.

“With their rejection by Nigerians in the Feb. 23 election, we assumed that they would have changed their ways.

“But like the saying goes, old habits die hard. The habit of PDP to peddle falsehood is their second nature. Their antics to get to Oyo seat of power will be another futile effort.

“The electorates know them, they know how they ruined the country’s economy and perpetrated a lot of violence in Oyo State and across the country,” it said.

It said that the peace currently enjoyed in the state was elusive during the ruling years of PDP, saying it is only a party like PDP that would lay the foundation of peace and destroy same with its hands.

The APC said that the present administration in the state was people oriented and has vowed to sustain peace, safety and security that would bring evident development, growth and progress to the state.

It warned the leaders of PDP to steer clear of the state, saying the state’s fund could not be used to fund the PDP. (NAN)

“Everyone of you should go out to vote on Saturday and defend your votes, we cannot be cheated; not only you but tell your neighbours to vote for Obong Nsima Ekere and all APC candidates. Wait for your votes to be counted. It is the duty of the Federal government to provide security and we will do that. We will recover every one of our votes.

Also speaking, the National Chairman of APC, Adams Oshiomhole said the party was not in the state to lament but to thank the people of the state for doing their jobs and voting President Buhari.

He alleged that INEC colluded with some of the electoral officers to deny the state of its electoral victory on February 23, even though the people voted for the party.

“We have not come here to brag that our mandate was stolen last week. We have come to thank you that you voted for President Buhari, and all members of the party. You did your job but some armed robbers in INEC stole your votes.

“You think that those who stole your votes will have peace? We have come to reaffirm our commitment to democracy. We have come to affirm that no robber will go unpunished but when an electoral umpire is corrupt and collude with the opposition, we have the witnesses and we have lawyers to deal with that.

“On Saturday we are not going to wait for them to steal our votes. We call on Akwa Ibom people to protect their votes. We must maintain our sanity even in this hour of provocation. Those who committed democratic abortion would be brought to book,” he said.

The APC governorship candidate in the State, Nsima Ekere encouraged the people not to be deterred by the February 23 elections but to go out and vote during the March 9 elections, saying the party is sure of victory.

He said the people of the state were in need of change and proved it during his campaigns across the 31 local government areas of the state, and assured the President that after March 9 elections, Akwa Ibom state would not be in the opposition but will be reunited with the centre

He said, “Thank you for what you are doing for APC. The people voted for you, that vote is a revalidation of what the people want. You put Nigeria’s economy back on track.

“We are here because we have faith in you and Mr President, the opposition and INEC have no choice than to give us back our mandate. Whosoever shall attempt to work against the collective will of Akwa Ibom people, we shall collectively resist.

“We send a message to the electoral umpire and the other party that they must respect the votes of the people, every vote must count. Akwa Ibom people love APC”.
