  • APC convention: Court refuses to stop Lagos’ delegates

A Federal High Court in Abuja has refused a motion seeking to restrain the All Progressives Congress (APC) and Independent National Electoral Commission (INEC) from recognising Lagos State’s delegates for the June 23 national convention of the APC.

Justice Babatunde Quadri, who read a ruling prepared by Justice Binta Nyako, said the motion for interlocutory injunction filed by a member of the APC in Lagos, Bunmi Tayo Church, was without merit and proceeded to dismiss it.

Justice Quadri said it was wrong to grant the orders sought by Church when all those to be affected by the court’s pronouncement, who emerged from the last Ward, Local Government and state congresses of the party in Lagos, were not before the court and have not been heard.

“This application cannot be granted because all the parties to be affected by the reliefs sought are not before the court. The application therefore fails,” the judge said.

He proceeded to grant accelerated hearing in the substantive suit currently pending before Justice Nyako.

Justice Quadri said he was asked by Justice Nyako, who was bereaved, to help read the ruling which she already prepared and signed.

He said the Federal High Court’s Civil Procedure Rules, under Order 23 Rule 2,  allows that where a judge is bereaved, another judge can deliver a ruling signed by the judge handling the case, but bereaved.

Church, whose substantive suit marked: FHC/ABJ/CS/ 583/18, is challenging the outcome of the last Ward, Local Government and State congresses of the APC in Lagos State, had sought the interlocutory injunctions pending the determination of the main suit.

He urged the court, in the motion, to restrain defendants – APC and INEC – “from according recognition or giving effect to the results of the 1st defendant’s (APC) Lagos chapter’s purported Ward congress, Local Government congress and State congress pending the determination of the substantive suit.”

Church equally prayed the court for an interlocutory injunction restraining the APC from parading any person(s) or permitting any person(s) to parade themselves as being the persons elected by virtue of the 1st defendant’s Lagos chapter’s purported Ward, Local Government and state congress pending the determination of the main suit.

In his affidavit supporting the main suit, Church, who claimed to be interested in contesting for the party’s Chairmanship position in Mushin Local Government in Lagos, said he would have realised his ambition and become a delegate, but for the unlawful way the congresses were conducted.

It is his contention that the congresses conducted in Lagos were in violation of the party’s constitution, its guidelines for the conduct of Ward, LG and state congresses and the Constitution of Nigeria (as amended).

Church’s lawyer, Akin Olujinmi (SAN), had while arguing the motion on June 14, contended that, since the APC’s national convention was scheduled for June 23, there was need to preserve the res (subject) of the substantive suit.

He said there was special issues to be tried in the main suit, which seeks among others, the determination of whether the congresses conducted in Lagos State should not be set aside, the party having allegedly flouted the nation’s constitution, its constitution and its guidelines for the conduct of Ward, LG and state congresses.

Bola Aidi, who represented that APC queried the competence of the motion for interlocutory injunctions and urged the court to refuse it.

INEC’s lawyer, Alhassan Umar, also urged the court to refuse the motion on the grounds that it contains similar prayers as those contained in the substantive suit.

Umar argued that the plaintiff failed, in the entire of his entire argument, to disclose any legal right he seeks to protect or showed any serious issues to be tried in the main case.

He added: “Where the facts in support of the interlocutory application are similar to those in support of the main claim or are entirely interwoven with the facts required to determine the case on the merit, a court of equity is enjoined to decline granting the interlocutory application.

“Instead, the court is enjoined to order accelerated hearing of the substantive matter. This is so because the court, in doing otherwise, may fall into the unhealthy situation of deciding the same issue twice.

“First, at the interlocutory stage and then, the ultimate decision at the end of the trial. Such a procedure will be prejudicial to a fair trial of the substantive case.

“The law is that the court should avoid the resolution of complex and intricate issues at the interlocutory stage.

“It is submitted that the plaintiff/applicant has not satisfied the requirements to enable the court exercise its discretion in favour of granting the reliefs sought on the face of motion for interlocutory injunctions,” Umar said.

  • APC Convention: Nwosu urges S/East delegates to vote Oshiomhole

…says he will steer party out of crisis

Ahead of the Saturday National Convention of the All Progressives Congress (APC), the Chief of Staff to the Imo State governor and frontline governorship aspirant under the party, Chief Uche Nwosu, has enjoined APC delegates from the Southeast to support former Edo State governor, Adams Oshiomhole for the National Chairman.

Nwosu who briefed journalists in Owerri, the Imo State capital, noted that Oshiomhole’s emergence as the National Chairman of the party will usher in a strong, focused and transparent leadership that will steer the party out of imminent crisis.

The Chief of Staff also advised Southeast APC stakeholders to avoid politics of bitterness and acrimony and file behind the Imo governor, Rochas Okorocha as the leader of the party in the zone so as to forge a common front and speak with one voice in the convention.

He said, “It is very obvious that our party is grappling with internal crisis and what we need now is a strong leadership that can resolve all issues in the interest of the party. It is also very obvious that some of the members of the outgoing National Working Committee had put selfish interests above the party interest. That is why we should all rally round Oshiomhole who has the experience and strength of character to return the party to the people”.

Nwosu continued that, “I am convinced that his emergence will also best prepare the party for the 2019 election, which is just a couple of months away. We are aware that opposition parties are waiting to see the outcome of the Convention and if we fail to get it right, we may be giving them the chance they have been waiting for”.

According to him, “some self-styled politicians are working to undermine the leadership and position of the party in the zone for selfish reasons, noting that most of them are actually working against the best interest of the party. So it is imperative that we identify our genuine leaders and obey their directive to save our party because the so called leaders are waiting for the party to fail in the zone so that they will return to the parties they defected from”.

Nwosu who passed a Vote of Confidence on governor Okorocha and former Senate President, Ken Nnamani, assured that despite the current challenges in the party in the zone, the party will ensure landslide victory for President Muhammadu Buhari in 2019.

He said, “Let me state with all confidence that President Buhari will win with a wide margin in the Southeast in 2019, this is because our people have seen tangible achievements recorded by his administration in the zone in the last three years.

Some of these landmark projects include the second Niger Bridge, which has been an object for politics for many decades, the Onitsha/Enugu road, Enugu Port Harcourt road and the International Cargo Airport in Owerri, among others, were executed in the Southeast by the Buhari’s administration in just three years, while the People’s Democratic Party (PDP) has nothing to point at in the zone for 16 years it was in power”.

  • Tight security as APC holds rally in Ekiti

Heavy security cordon has been thrown around Ado-Ekiti, the Ekiti State capital, ahead of the All Progressives Congress (APC) flag off rally Tuesday.

Armed security operatives are standing guard on all major roads in the city.

Regular policemen lined the major highway in Ikere and Ado on the route to be taken by Vice President Yemi Osinbajo.

Osinbajo is expected to touch down at Akure Airport and travel by road to Ado, which is about 50 minutes’ drive from the Ondo State capital.

The vice president is expected to present the party flag to the APC governorship candidate, Dr. Kayode Fayemi at the rally.

Senior party figures including the APC National Leader, Asiwaju Bola Tinubu and former Interim National Leader, Chief Adebisi Akande, had arrived the city on Monday.

Men of the regular and mobile police are stationed on major junctions while officers of the Federal Roads Safety Corps (FRSC) were also mobilized to ensure free flow of traffic.

People entering the stadium are being frisked before being allowed in.

The two covered terraces of the stadium are draped in green, red, white and sky blue colours of the APC.

Television and radio stations expected to beam the rally live are also fully on ground with their Outside Broadcast (OB) Vans and other equipment.

They include Channels TV, Television Continental (TVC), Nigeria Television Authority (NTA), Federal Radio Corporation of Nigeria (FRCN), Ondo State Radiovision Corporation, Adaba FM, Orange FM all based in Akure and Voice FM, Ado-Ekiti.

  • “It’ll be tragic for PDP to rule Abia for another 4yrs”

A member of the Board of Trustees (BoT) of the All Progressives Congress (APC), Prince Benjamin Apugo has said it will be tragic if the Peoples Democratic Party (PDP) rules Abia State for another four years.

Speaking with select journalists at his Nkata Ibeku, Umuahia country home, Apugo said for nearly two decades the affairs of the state have been in the hands  of the PDP, Abia has suffered tremendously as there was  practically nothing to show for all the years they were in power.

“If the PDP rules the state for the next four years, there will be nothing like Abia State again, people will die of malnutrition and hunger because in the past 20 years PDP has been in power, there are no good markets, infrastructure and the general things that can create wealth in the state.”

The BoT member said the only way forward is for the people of the state to vote for APC in 2019 so that the needed change will come to the  state as in other APC controlled states across the country.

He opined that the success recorded by President the Muhammadu Buhari- led administration in the fight against corruption and the amount so far recovered from looters has endeared him to the Igbo.

He said, “We the Igbo especially in Abia, are beginning to appreciate the achievements of the Federal Government, we have nothing to fear under Buhari; APC will give us nomination in 2023.

When PDP was in power under former President Goodluck Jonathan, Boko Haram came to Abuja, bombed everywhere but now the President has fixed Nigeria by not only tackling the insurgents, stopping more corruption, he has just started it and he needs another four years.”

Speaking further on the decision of the nPDP to suspend further discussion with the Presidency, Apugo who is also a member, assured that the nPDP will not pull out of the All Progressives Congress (APC).

“We can’t leave the house we built, we helped the president to win election in 2015 through mass mobilisation, he contested three times before and lost. The truth is that nobody should bring his personal problems to and put it on the nPDP as a bloc, we have talked with the party and the Federal Government and we have agreed, the only mistake Buhari has made so far is neglecting us and not putting members of the nPDP in positions of trust.”

  • Buhari has done well in Delta State more than Jonathan – Emerhor

A stalwart of the All Progressives Congress (APC) in Delta State, Olorogun Otega Emerhor on Wednesday night declared that President Muhammadu Buhari has done well in Delta State more than former President Goodluck Jonathan, who hails from the zone.

He spoke with State House correspondents after meeting with the Chief of Staff to the President, Abba Kyari.

On what are the chances of Buhari in the South South, Emerhor said, “In 2015, we had President Jonathan who is from the south south, that created an emotional issue but we have seen now that even when Jonathan was in power, he did not do for Delta what President Buhari has done for us.

“The Ogoni cleaning exercise that is going on there is one of the major thing we can count on. The east west road is being completely rehabilitated and that did not happen when one of our own sons was the President.

“So, we are very confident that the south south this time around wants to belong to the center and that is why we are going to be able to deliver the President there.” he added

Giving more reasons why the South South will support Buhari, he said that the Buhari’s administration has reactivated the amnesty programme; the Maritime University in the Ijaw-Ishekiri side of Delta is now functioning.

He went on: “And he has done a lot for us in Delta. He has empowered a lot of our people in Delta.

“We have the Minister of State Petroleum and the Minister of Transportation from South-South, the N-Power programme is working so all these have created the enabling environment for us to deliver the President in 2019.” he said

Optimistic that the APC can take over the reins of leadership in Delta State from the People’s Democratic Party (PDP), he said that the current Governor off the State has not done enough thus, clearing the coast for the APC to take over.

“Let me tell you, we are so fortunate that the Governor of Delta Sate, who is a PDP man, is not doing anything. Delta has a lot of resources and the expectation is that the State should be doing better than Edo State for example, which is our neighbour but the APC Governor in Edo is doing so well; even Willie Obiano in Anambra that doesn’t having anything is doing so well.

“So it’s so obvious that the finances of Delta State are not being applied and everyone in Delta is now convinced that APC must takeover because they produce performing Governors,” he stated.

Commenting on alleged divisions in the APC in Delta State, he said the issue was not peculiar to Delta State.

“The issue of congresses and division did not happen only in Delta. It happened across the country but this is the period of reconciliation. There is a group that did not work with the majority of the people in Delta; we formed a unity group in Delta that had so many Governorship aspirants and leaders working together.

“But as you know, the Ogboru and Omo-Agege group put their own governorship aspiration ahead and decided to work separately but the move we are making is to bring everybody together, provide a level playing field so that all the Governorship aspirants will work together.

“But the great objective we have is how to deliver the President in Delta State 2019. That is our priority and the ground is ripe for us to take over that State and deliver 2 million votes for President Buhari in 2019,” he said.

  • Osun 2018: APC promises transparent primary

The All Progressives Congress ( APC ) in Osun has promised to ensure credible and transparent primary among its 27 aspirants ahead of the Sept. 22 gubernatorial election in the state.

Mr Gboyega Famodun, the state Chairman of the party, said this on Wednesday at its secretariat in Osogbo when one of the aspirants, Mr Peter Babalola, declared his intention to contest.

Babalola, who is from the West District, however, said that even if the party does  not give him the ticket, someone from the district should be considered.

The aspirant, who is the Chairman of the State Civil Service Commission, said he was vying for the governorship election to consolidate on  Gov. Rauf Aregbesola’s legacies.

  • EKITI 2018 : Fayose  accuses APC, INEC of  plotting to rig poll

Ekiti State Governor Ayo Fayose has accused the All Progressives Congress (APC) of perfecting an alleged plot to rig the July 14 governorship election in cahoots with the Independent National Electoral Commission (INEC).

Addressing reporters in his office late Tuesday night, Fayose alleged that APC and INEC had struck a deal to disenfranchise 50 per cent of the Ekiti electorate by “heavily preloading the smart card readers.

He alleged that thousands of voters would be disenfranchised in Ikere-Ekiti, the hometown of the People’s Demoratic Party (PDP), Prof. Kolapo Olusola and Ado-Ekiti, the hometown of his running mate, Mr. Ayodeji Ogunsakin.

Fayose claimed that the APC has been distributing what he called fake empowerment forms to lure voters.

He said: “It has come to our attention that the All Progressives Congress (APC) in Ekiti State has devised another sinister plot to disenfranchise thousands of eligible voters in areas considered as strongholds of the People’s Democratic Party (PDP), particular my where the PDP standard bearer comes from , which is Ikere-Ekiti.

“The APC is working in collaboration with some unscrupulous elements in the Independent National Electoral Commission (INEC) to delete not less than 40 percent names from the Voter Register, using the Automated Fingerprint Identification System (AFIS) as a decoy and targeting Ado Ekiti, the State capital and Ikere Ekiti where the PDP candidate comes from.

“The APC did not stop at this; they are currently distributing fake Empowerment Forms and cash to unsuspecting electorate, using a phony organisation, with the aim of deactivating Voters Cards, thereby disenfranchising thousands of voters.

“They are also putting pressure on INEC to use Incident Forms as alternative to the Smart Card Readers, so as to be able rig the July 14 election.

“It should be noted that the Incident Forms, being contemplated for Ekiti were  not used during the Anambra election.  The question is; what why the plan to use it in Ekiti?, ” he said.

“To heighten their game, the APC in collaboration with INEC are planning to heavily preload the Smart Card Readers and also release ballot papers to their members for ballot stuffing to justify the preload.

“We are concerned again by APC  plan to cause violence again the state, ahead of the election. “The whole world is therefore placed on alert on the desperate bid of the APC to circumvent the will of Ekiti people at all cost, not minding the danger it portends for democracy in the country. “I am a leading g opposition in this country, the APC is not campaigning, but they want to rig the election at all cost.

“We are raising this alarm to save this country from major consequences in the buildup to the 2019 general elections because the planned rigging of the Ekiti State election will serve as a prelude to their planned rigging of the elections, which is capable of plunging the country into avoidable anarchy.

“We call on the international community to in the interest of democracy in Nigeria, take interest in the Ekiti election and ensure that it is free, fair and credible.”
