  • Maku urges Nigerians to elect credible leaders

Mr Labaran Maku, the former Minister of Information, has advised Christians and other Nigerians to actively participate in politics in order to elect leaders of proven integrity during the 2019 general elections.

Maku, the 2015 governorship candidate of All Progressives Grand Alliance (APGA) in Nasarawa State, made the call on Sunday at St. Sylvester Catholic Church, New Nyanya, Karu Local Government Area of the state.

The News Agency of Nigeria (NAN) reports that Maku was in the church to attend its first service.

The ex-minister assured the church members of his continued support to the progress and development of the church and Nigeria at large.

He urged Christians and Nigerians to pray for the emergence of credible leaders during the 2019 general election in order for peace to reign in the country.

“Let continue to pray to God to give us leaders that would bring peace, unity and development in the country, this is my prayer.

“That is why I am in politics, as you know that the church for a long time taught that politics is not part of the church or for Christians; this is a great mistake because in the days of our Lord Jesus Christ ,he asked us to be loyal to all leaders.

“If you disconnect politics from the church, it will bring a lot of limitation.

“Therefore, I urge all of us Christians and other Nigerians to stand up and be counted.

“It is not true that politics is a dirty place to be left for evil people because those who control power have a lot of influence on your religion, political and social life.

“When you have good people in authority, whether they are Christians or Muslims, society will be good; but when you have evil people, a lot of people will die before their time and there will be poverty, among others.

“So, I call on all of us to show interest in politics and support those we believe will bring positive transformation to our lives,” he added.

Also speaking, Rev. Fr. Lawrence Soja- Soja-Ayembugu, who is the Parish Priest thanked Maku and others for contributing positively to the development of the church.

He stressed the need to elect God-fearing leaders in 2019 in order to enjoy the much needed dividends of democracy.

  • ‘Al-Makura wasted N390 billion with nothing to show’

Former Minister of Information and  governorship aspirant of the All Progressives Grand Alliance (APGA) in Nasarawa state, Labaran Maku has said that despite about N390 billion received by the state in the last seven years, the Al-Makura government has nothing to show to the people as achievement.

The former Minister who spoke after submitting his nomination form in Abuja also said that Nasarawa state governor, Tanko Al-Makura and Senator representing representing Nasarawa west, Abdullahi Adamu, are fighting because of the mandate stolen from him in 2015.

Maku contested the governorship election on the platform of the All Progressives Grand Alliance (APGA) but lost and alleged that the election was rigged to Umaru Tanko Al-Makura, incumbent governor of the state.

Governor Al-Makura and Sen. Adamu are presently at logger head as the governor has set up a committee to probe his predecessor (Adamu) for allegedly defrauded the state.

According to the governor, Sen. Adamu awarded a hydro-electricity power project in May 2004 at the cost of N5.4 billion. It was billed to be completed within 36 months. The project was abandoned after Aliyu Doma, Adamu’s successor, reviewed the cost upwards.

But Maku insisted that the fight between the outgoing governor and Sen. Adamu was as a result of his stolen mandate in 2015 governorship election, saying “both (Adamu and Al-Makura) of them know that they didn’t win the election. They know that they are sitting on a sit that they did not win. They know it and they have been confessing it in recent times of this crisis. They know Maku won the election but they upturned it and now there is crisis,” he said.

“You know robbers fight at the point of dividing the spoils, so now the crisis has erupted, that crisis tells the people of Nasarawa state clearly that the mandate was stolen – I knew there will be a fight over it – all they can do now is call the owner and hand it over so the state can witness peace and development, they don’t need to fight over it.”

The former minister said from 2015 till date, things have turned worse in the state, saying “In the period of this four years that the mandate was stolen, things have gotten worse in Nasarawa state, killings have multiplied. In many communities today people cannot go to farm.

“The government has been run in the most criminal way, N390 billion have been collected in these seven years but there is nothing substantive on the ground.

On his chances of winning the seat back in 2019, Maku said: “I took the ticket of APGA on Christmas day within three months, on April 11, I defeated the sitting governor Al-Makura in his own ward by 200 votes, in his own local government of Lafia, I defeated him, I defeated him in his own zone in four out of five local governments then I took the rest of the states, the results were awaited, some conspired and changed the results in the full glare of the people.

“You are going to see a massive turnaround of the politics in Nasarawa state, i challenge the media to enter Nasarawa and make a survey anywhere, whether you see people in a bus, on a farm or in a hospital – or a wedding, ask them, you find out that six to seven people will tell you that they are waiting for APGA, they are waiting for Maku and the reason is that God has favoured me from 1999 as commissioner for four years from 1999 to 2003, deputy governor from 2003 to 2007.”

  • Appeal Court upholds Senator Victor Umeh’s election

The Court of Appeal, Enugu has upheld the election of Victor Umeh of All Progressives Grand Alliance (APGA) as Senator representing Anambra Central senatorial district in the National Assembly.

In a unanimous judgment delivered Wednesday, the appellate court dismissed the appeal by Mr. Nkem Ekweozor, challenging the judgment of the Anambra Central Senatorial Election Petition Tribunal which upheld the victory of Umeh in the January 13, 2018 senatorial rerun in the district.

Ekweozor who was the candidate of the Mega Peoples Progressives Party (MPPP) in the senatorial rerun, had claimed that Umeh was not validly elected by majority of lawful votes cast at the election and that the election was marred by corrupt practices.

Ekweozor alleged that Umeh was not qualified to contest for the election, as he got his nomination while still holding the position of National Chairman of APGA.

The appellant who joined Umeh, APGA and Independent National Electoral Commission (INEC) as 1st, 2nd and 3rd respondents respectively, prayed the court to order INEC to conduct a fresh election and that Umeh should be disqualified from the fresh election.

Delivering judgment, the three-man Appeal Panel headed by Justice Uwani Musa Abba Aji noted that the appellant has made no reference to any particular primary election conducted by the 2nd respondent (APGA), from which Umeh emerged as the candidate.

The judge held that the appellant’s complaints on the issue of nomination of the 1st respondent, Umeh, “are at large and ex facie.”

According to him, there was no dispute on the primary election of the 2nd respondent, APGA, which produced Umeh as its candidate.

Citing relevant authorities, the judge stated that the appellant’s averments in his petition bother on matters of mere conjecture and speculation, which the court or tribunal does not have jurisdiction to act on.

Justice Abba Aji further warned that a court should refrain from indulging in speculation, as it is not part of judicial exercise but a mere guess work.

He stated the law as settled by decisions of the Supreme Court is that the issues of primary election, nomination and sponsorship of a person as the candidate of a political party “are definitely pre-election matters.”

He said the tribunal was right when it held that it was not clothed with the jurisdiction to look into the complaints raised by the petitioner, which relate to the nomination, sponsorship and candidature of the 1st respondent.

“The decision to inquire into the conduct of primary election by political parties resides in the Federal High Court, the High Court of a state or the High Court of the Federal Capital Territory as donated by section 87 (9) of Electoral Act, 2010 (as amended),”the judge said.

On the striking out of some paragraphs of the election petition by the trial tribunal, Abba Aji said he carefully perused the averments as contained in the stated paragraphs and completely agreed with the findings of the tribunal that the said paragraphs clearly and absolutely fell short of the requirements of the provisions of paragraph 4 (1)(d) of the Electoral Act and therefore resolved the issue in favour of the respondents and against the appellant.

On whether the tribunal rightly evaluated the documentary evidence presented before it, vis-à-vis the oral testimonies of the petitioner/appellant and his witnesses in the proof of the petition, the judge said “mere making of an allegation does not shift the burden of proof to the other party.”

“It is incumbent on the party making an allegation to adduce credible evidence in support thereof before the onus of disproving such allegation could shift to the other party. Whereas in the present case, allegations made were unsupported with any scintilla of credible evidence, the allegations by themselves fall flat and remain dead,” he said.

“The remaining issue is: Whether the tribunal was right when it ascribed probative value to the documents tendered and admitted where the 3rd respondent failed to call oral evidence in respect of such document. The 3rd respondent did not call any witnesses at the trial but rather tendered a set of documents from the bar with the consent of the other parties.

“The said documents were result sheets forms EC8C (1) and EC8B (1) for the respective local governments and were admitted as exhibits R12 TO R24 respectively.

“Before us while arguing the appeal, the Appellant asked this court to hold that the first Respondent was ineligible to have contested the said senatorial elections and consequently order that the candidate with the second highest votes in that election be returned elected.

“The implication of this volte face includes the fact that the appellant was no longer contesting the results as declared by the 3rd respondent.

“The further implication of this later posture of the appellant is that the arguments canvassed in respect of this issue are rendered academic. Courts exist to resolve live disputes between parties and would demur from delving into academic issues,” Justice Abba Aji said.

He added that in totality, the appeal is devoid of any form of merit and accordingly dismissed.

The other two justices, Moore Aseimo Adumein and Joseph Olubunmi Oyewole, concurred with the lead judgment.

The court however asked all the parties in the matter to bear their respective costs.

  • APGA receives over 3000 PDP defectors in Ikpeazu’s LGA

The leadership of the All Progressives Grand Alliance (APGA) has reportedly received about 3,500 members of the People’s Democratic Party (PDP) in Obingwa Local Government Area of Abia State.

Recall that Obignwa local government area where the incumbent Gov. Okezie Ikpeazu comes from is noted for their voting strength and in the 2015 election was said to have produced over 82, 000 votes that gave Ikpeazu victory in 2015 including Osisioma LGA.

The ceremony to receive the defectors to the APGA fold could have held last week at the National Institute for Nigerian Languages (NINLAN), Umuokahia, Obingwa council area, but was disrupted by thugs allegedly hired by PDP which prompted the state chairman of APGA to issue a statement condemning the action.

Speaking on behalf of the defectors, Hon. Maduka Akpulonu said they decided to dump their former party for APGA because according to him, PDP as a party has failed to provide purposeful governance to the people of the state in the past 20 years.

Akpulonu accused the chieftains of his former party of making efforts to stop them from defecting to APGA, stressing that nothing will make them to return to PDP.

“We decide to dump our former party for APGA because PDP as a party has failed to provide purposeful governance to the people of the state. Some chieftains of our former party made efforts to stop us from defecting to APGA, but we resisted that and nothing will make us return to PDP”.

While welcoming the governorship aspirant of the party, Dr. Alex Otti and other leaders of the party to the area, he urged him to extend his campaign tour to all the 11 wards of the council, Akpulonu apologized for the botched rally last week.

“We apologize for the botched rally last week. Our defection has shaken PDP to its foundation in Obingwa.  They frustrated our efforts to dump PDP. The party (PDP) won’t do anything for the people and won’t allow them to leave to a better party”

He boasted that APGA will win majority wards in Obingwa in 2019, adding that there was no going back as they were poised to take the message of APGA and Dr. Otti to every part of Obingwa.

Receiving the former PDP members, APGA State chairman, Rev. Augustine Ehiemere, stated that the people of Obingwa council area have nothing to show for producing the governor, Dr. Ikpeazu, adding that the council has the worst network of roads.

He commended the former PDP members for their courage to dump the party and assured of a level playing field for all members and expressed optimism that their defection marks APGA’s victory in the 2019 general election.

The governorship aspirant of the party, Dr. Otti said APGA was set for a total transformation of the state from bad governance by the PDP.

He vowed that Abia will be rescued from those he described as ‘blood sucking godfathers and council of elders in 2019 and urged the people to support APGA in this direction.

  • Defection: We still retain majority seats in Senate- Lawan

The Senate caucus of the All Progressives Congress (APC) has insisted that it still retains majority seats in the upper legislative chamber despite the defection on Tuesday of 14 of its members to the opposition Peoples Democratic Party (PDP).

Briefing journalists after an emergency meeting held shortly after the plenary session, the senators said the defection did not in any relegate them to minority status in the Senate.

Senate Majority Leader, Ahmed Lawan who spoke on behalf of his colleagues said the APC still has 52 members, while the PDP has 50.

Senator Joshua Dariye who is presently serving a 14-year jail term was counted among the 52 senators of the APC.

The African Democratic Congress (ADC) has three; the All Progressives Grand Alliance (APGA) has two. There are two vacant seats occasioned by the death of two senators from Bauchi and Katsina.

Lawan said the APC would win back the two vacant seats occupied by Senator Ali Wakili (Bauchi) and Mustapha Bukar (Katsina) until their death recently.

This, according to him, would raise the membership strength of the party to 54.

  • Okorocha denies plan to join APGA

Imo State governor, Rochas Okorocha, Tuesday dismissed as malicious and unfounded, reports that he is decamping from the All Progressives Congress (APC) to the All Progressives Grand Alliance (APGA).

The social media has been awash with reports of the governor returning to APGA, a party he dumped in 2012, following the outcome of the APC Congresses.

But the Chief Press Secretary to the governor, Mr. Sam Onwuemeodo, read that,  “aside the concocted story of Governor Rochas Okorocha leaving All Progressives Congress (APC), for the All Progressives Grand Alliance (APGA) trending on the social media, we have also been inundated with calls from media practitioners trying to confirm the authenticity or otherwise of the source less tale.

“Governor Okorocha is one of the principal founders of APC. And when he took the mainstream of APGA to join the merger that gave birth to APC, he was not under any pressure to do so. He even took that action at the risk of his second tenure”.

The statement added that, “he became the propeller of APC in Imo and the whole of South East, mobilizing people for the party in Imo, Ebony, Abia, Enugu and Anambra States. He was the rallying point. And he did that in the overall interest of the South-East and indeed, APC.

“If Governor Okorocha did not take good percentage of APGA to APC, the party would not have had the kind of national spread it has till today. For that reason, they called him all sorts of derogatory names which Nigerians all know, including Alhaji in Government House, Okoro-Hausa, and Rochas Buhari.

“When the APC came for campaign in 2015 in Imo and all the states in the South-East he was the point man. Today, APC has become the party to envy. Nobody is again talking about Rochas and Buhari going to use APC to Islamize the Igbo”.

It continued that, “today too, the same people who called him names have begun to market falsehood against him including the fake story of his leaving APC for APGA. All these could show the level of frustration on the side of the ten-man Coalition. They are been hunted by their inglorious actions.

“One may also wish to know that while the unfounded story of the governor leaving APC is yet to dry, they have also come up with another funny one that the governor is in coma. These people do not know God and of course they are afraid of both the present and the future.

“They won’t be allowed to reap where they didn’t sow. Their deceit will expire in no distant time. And no Landlord leaves his house for unfaithful tenants. The name Rochas is the fibre of APC in Imo and the whole of South-East.

“And anybody who says it is not true should tell Nigerians why it is only in Imo you have APC governor, 24 out of the 27 House of Assembly members, three House of Representative members and one Senator, in the whole of South-East. Time will tell what happens in APC in Imo and the whole of Southeast”.

  • Anambra Central: A/Court upholds Umeh’s election

    …Dismisses Okonkwo’s appeal

The Court of Appeal in Abuja has upheld the election of former Chairman of the All Progressives Grand Alliance (APGA), Victor Umeh as Senator representing Anambra Central Senatorial District.

A five-man panel of the court held, in a unanimous judgment Monday, that the appeal filed Obiora Okonkwo of the People’s Democratic Party (PDP) was without merit, and dismissed it.

Obiora had appealed the January 12, 2018 ruling by Justice John Tsoho of the Federal High Court, Abuja, in which the judge set aside the court’s earlier judgment of December 13, 2017 ordering the Independent National Electoral Commission (INEC) to issue a certificate of return to Okonkwo.

The Court of Appeal, in its judgment, held that Justice Tsoho was right to have set aside the consent judgment it delivered on December, 13, 2017.

Justice Frederick Oho, who read the lead judgment of the Court of Appeal, held that the lower court was in order in setting aside the judgment because it was a nullity.

Justice Oho said lower court has the inherent powers to set the records straight by setting aside the consent judgment once it was discovered that there were a lot of infractions leading to the judgment.

While noting that a court cannot sit as an appeal on its own case, Justice Oho said a court has the power to reverse itself if it discovers that its earlier judgment was obtained by fraud or that it was misled, as is the case here.

Justice Oho described as sacrilegious events surrounding the December 13, 2017 consent judgment of the Federal High Court.

He noted that, despite being aware of the decision of the Court of Appeal, ordering  that a fresh election be conducted for the seat within 90 days with the exclusion of the PDP and its candidate, the appellant (Okonkwo), who was the candidate of the PDP, still proceeded to mislead the lower court to give judgment in his favour.

Justice Oho described the attitude of the appellant as a clear disobedience to the orders of the Court of Appeal. He added Okokwo’s lawyer was duty bound to have furnished the court with all relevant facts in the case including the three judgments by the Court of Appeal.

He held  that whether the matter is a pre-election or post-election matter, the lower court must always give way to the appellate court on the same issue.
