    IG discontinues case against Andy Uba, Etu over alleged N400m fraud

    The Inspector-General of Police (IGP) has withdrawn the two-count charge filed against Senator Andy Uba and Benjamin Etu.

    The IGP had, in the charge, accused Uba and Etu of obtaining N400 million under false pretence from an Abuja businessman, George Uboh.

    The IGP had alleged that Uba, Etu, and Hajiya Fatima (said to be on the run), sometime in 2022, obtained “by false pretence, by making a presentation to Mr. George Uboh that they had perfected ways for the appointment of the Managing Director of Niger Delta Development Commission (NDDC) to any interested persons who could afford N400 million”.

    When the case was called yesterday, the prosecuting lawyer, Aminu Abdullahi, told the court that he was willing to withdraw the charge.

    Abdullahi said a notice of discontinuance had been filed by the prosecution on the grounds that the parties had settled the matter.

    The lawyer averred that the defendants and the nominal complainant (Uboh) had amicably resolved all the issues in dispute, adding that Uba and Etu hac repaid the N400 million involved in the charge to the nominal complainant.

    The prosecuting lawyer said the notice of discontinuance was filed pursuant to Section 108(5) of the Administration of Criminal Justice Act (ACJA) 2015.

    He urged the court to terminate any further proceedings in the case forthwith.

    The lawyer to the defendants, C. F. Odiniru, said he was aware of the prosecution’s notice of withdrawal and was not opposed to it.

    Odiniru urged the court to dismiss the charge rather than strike it out in view of the fact that the parties had settled.

    He said his request for dismissal of the charge was in line with Section 108(3) of ACJA, 2015.

    Ruling, Justice Mohammed Umar allowed the notice of discontinuance and struck out the charge and discharged Uba and Etu.

    A Federal High Court in Abuja has rescheduled the planned arraignment of Senator Andy Uba and Benjamin Etu in the alleged N400 million fraud case for November 6.

    Uba and Etu were to be arraigned on Tuesday but for the absence of the judge, Justice Mohammed Umar, who was said to be sitting at another division of the court outside Abuja.

    With the agreement of lawyers in the case, officials of the court rescheduled the arrangement for November 6.

    The judge, on September 24, threatened to issue a bench warrant for the arrest of Uba, the former Senator representing Anambra South, should he fail to appear in court on October 28.

    The threat to issue bench warrant was informed by an application by the prosecuting lawyer, Aminu Abdullahi, that the court should compel UBA to attend court.

    Uba’s lawyer, C.F. Odiniru pleaded with the judge to reject the prosecution’a request for a bench warrant.

    Odiniru attributed Uba’s continued absence to ill health.

    In count one of the two-count charge, Uba, Etu and Hajiya Fatima now at large, are alleged to have, sometimes in 2022 conspired amongst themselves to commit the offence.

    Uba and others were accused of obtaining by false pretence, by making a presentation to Mr George Uboh that they had perfected ways for the appointment of the Managing Director of Niger Delta Development Commission (NDDC) to any interested persons who could afford N400 million.

    “A presentation which you know is not true and thereby committed an offence contrary to Section 8 and punishable under Section 1 (3) of the Advance Fee Fraud and other Fraud Related offences Act, 2006.”

    The offence, the prosecution said, is contrary to Section 1 (2) and punishable under Section 1 (3) of the Advance Fee Fraud and other Fraud Related offences Act, 2006,” the count read in part.

    Uboh, in a letter dated April 5, 2023, and addressed to the I-G, said the petition was based on documentary and voice recording.

    According to Uboh, the evidence is overwhelming and irrefutable.

    No fewer than six witnesses had been listed to testify against the ex-lawmaker and Etu.

    A Federal High Court in Abuja has threatened to issue a bench warrant against Senator Andy Uba should he fail to appear before it on October 28 to plead to a criminal charge pending against him.

    Uba is named with Benjamin Etu as defendants in a charge bordering on fraud to the tune of N400 million filed in the name of the Inspector General of Police (IGP).

    Justice Mohammed Umar issued the threat on Wednesday after Uba’s lawyer, C.F. Odiniru, pleaded for more time to allow his client to attend court in person.

    The judge’s decision followed an application by prosecuting lawyer, Aminu Abdullahi, that a bench warrant be issued against Uba in line with the provisions of Section 394 of the Administration of Criminal Justice Act (ACJA), 2015, in view of Uba’s continuous absence in court.

    Earlier, when the case was called on Wednesday, Etu mounted the dock, prompting the court to ask about Uba’s whereabouts.

    Odiniru then rose and apologised to the court, claiming that Uba was unable to attend court because of ill-health.

    Responding, Abdullahi expressed concern about Uba’s consistent absence.

    He noted that Odiniru gave a similar excuse about Uba’s absence when the case last came up in July.

    “On the last date, we reluctantly accepted, and the matter was adjourned. And today the same reason was advanced.

    “My lord, we cannot fold our arms and continue this way. We will be applying for a bench warrant under Section 394 of ACJA, 2015, against the 1st defendant,” he said.

    Abdullahi said Uba’s consistent absence had shown disrespect to the court, which had equally stalled his trial.

    He noted that since the charge was filed in 2024, Uba has never appeared in court.

    Odiniru, however, opposed Abdullahi’s application for a bench warrant.

    “We are opposing this application because consistently before the court, we have informed the court that the 1st defendant is ill and out of the country,” he said.

    He said Uba, currently, was receiving treatment at a United States hospital.

    He said he had also furnished Abdullahi with documents detailing Uba’s state of health before the court proceeding commenced in the morning, in accordance with the court directive, which was made on the last adjourned date.

    “I told him (Abdullahi) and showed him the documents. These applications for a bench warrant, my lord, are made for an absconding suspect, and not for a person like the 1st defendant.

    “Section 37 of ACJA says if you are interested in a bench warrant, you should go by oath,” Odiniru submitted.

    “So what you are saying is that we are going to remain this way even if it will take 10 years?

    “Have you seen where a person has been brought to court on a stretcher?” the judge asked Odiniru rhetorically.

    Responding, Odiniru said there were procedures the prosecution could take to confirm if what he was saying was true or false.

    But Abdullahi disagreed with Odiniru’s submission.

    The lawyer said, contrary to Odiniru’s argument, he was not furnished with any documents about Uba’s ill health.

    He said Odiniru’s submission was mere speculation.

    “He is just reprobating and approbating to my lord,” he said.

    “He (Odiniru) didn’t make any attempt to call me for anything, my lord, because he knows that what he is holding is not acceptable,” he said.

    He, therefore, opposed Odiniru’s plea while urging the court to grant his request for a bench warrant.

    “I will give you the last opportunity,” the judge told Odiniru.

    Justice Umar advised the lawyer to ensure that Uba is in court on the next adjourned date.

    The judge subsequently adjourned the case till October 28 for plea.

    The Attorney-General of the Federation (AGF) had, on July 7, given the Inspector-General (I-G) of Police permission to prosecute Uba and Etu.

    The prosecution had, on March 5, amended a two-count charge filed against Uba and his co-defendant before the former trial judge, Justice Inyang Ekwo.

    The police had earlier named Uba, the former Senator representing Anambra South, and two others in the first charge marked: FHC/ABJ/CR/538/2024.

    Uba’s co-defendants, in the two-count charge filed Oct. 10, 2024, by Abdulrashid Sidi in the Legal/Prosecution Section at the Police Force Headquarters, Abuja, were Crystal Uba and Benjamin Etu as the 2nd and 3rd defendants, respectively.

    But in the amended charge filed March 4 by Sidi, Uba, and Etu are listed as 1st and 2nd defendants, while Crystal Uba’s name had been dropped from the charge.

    In count one, Uba, Etu, and Hajiya Fatima, now at large, sometimes in 2022, were alleged to have conspired amongst themselves to commit the offence.

    Alleged N400m fraud: IG amends charge filed against Andy Uba, Etu

    Inspector General of Police (IGP) Kayode Egbetokun has amended a two-count charge earlier filed against Senator Andy Uba and Benjamin Etu over their alleged involvement in a N400 million fraud.

    Uba was a Special Assistant on Special Duties and Domestic Affairs to ex-President Olusegun Obasanjo and later the senator representing Anambra South in the National Assembly.

    Prosecuting lawyer M. L. Anthony announced this development when the case was yesterday before Justice Inyang Ekwo of the Federal High Court in Abuja.

    Anthony did not explain the reason for the amendment, but it was observed that while the earlier charge had three defendants – Andy Uba, Crystal Uba, and Benjamin Etu – the amended one has only Uba and Etu as defendants.

    Of the two defendants, only Etu was in court yesterday and Justice Ekwo instructed him to stand in the dock.

    Anthony told the court that the prosecution had not served the amended charge on the defendants.

    He sought an adjournment to enable him bring an application for leave for substituted service of the amended charge on Uba, as was done in the service of the earlier charge.

    Justice Ekwo granted the request and directed Etu’s lawyer, C. F. Odiniru, to allow the prosecution to serve the amended papers on his client immediately after the court’s proceedings.

    The judge adjourned till March 17 for the defendants’ arraignment.

    One of the counts in the charge reads: “That you Andy Uba, Benjamin Etu, and Hajiya Fatima (now at large) sometime in Year 2022 did conspire amongst yourselves to commit an offence to wit: obtaining by false pretences by making a presentation to George Uboh that you had perfected a way to an appointment of the managing directorship of the NDDC (Niger Delta Development Commission) to any interested person who can afford the sum of N400,000,000 only, a presentation which you know is not true and thereby committed an offence contrary to Section 8 and punishable under Section 1 (3) of the Advance Fee Fraud and other Fraud-Related Offences Act, 2006.

    It was learnt that the charge was informed by findings by police investigators, who acted on a petition filed by Uboh.

    In the petition, Uboh claimed, among others, to have been hoodwinked into parting with the N400 million.

    He said: “This petition is based on documentary and voice recording evidence, thus the evidence is overwhelming and irrefutable.

    “Andy Uba stated unequivocally to me that he has perfected a way to give NDDC managing directorship to any candidate who brings N400,000,000, that if the appointment does not occur, he will refund the money.

    “I nominated my sister, Honorable (Engr.) Doris Uboh, who, by profession, is qualified to be NDDC’s MD.

    “Andy Uba provided two accounts and instructed a transfer of N200,000,000 each into the accounts.

    “I instructed another sister of mine, Princess Engr. Ify Akanmode, who is a business partner and whose account I had some funds, to do the transfers.

    “Till date, Andy Uba has promised to pay and has not.”

    A former Special Assistant on Special Duties and Domestic Affairs to ex-President Olusegun Obasanjo, Andy Uba, has been accused of complicity in an alleged N400 million fraud.

    In a charge filed at the Federal High Court in Abuja in the name of the Inspector General of Police (IGP), Uba was alleged to have worked with three others to obtain N400 million from a victim, identified as George Uboh.

    Uba, Crystal Chidinma Uba, and Benjamin Etu (named as defendants in the charge) along with Hajiya Fatima (said to be on the run) allegedly obtained the N400 million from Uboh in the pretext that they could facilitate his appointment as the Managing Director of the Niger Delta Development Commission (NDDC).

    A part of the charge reads:

    “That you Andy Uba, Crystal Chidinma Uba, Benjamin Etu and Hajiya Fatima (now at large) sometimes in the year 2022 within  did conspire amongst yourselves to commit an offence to wit : obtaining by false pretences by making a presentation to George Uboh you have perfected way to an appointment of the Managing Directorship of NDDC (Niger Delta Development Commission) to any interested person who can afford the sum of N400,000,000, a presentation which you know is not true and thereby committed an offence contrary to section 8 and punishable under section 1 (3) of the Advance Fee Fraud and other Fraud Related offences Act, 2006.”

    The defendants were to be arraigned on November 13 but the arraignment was stalled when lawyer to the prosecution, M. L. Anthony, complained about his inability to effect personal service on the defendants, as required.

    Anthony claimed that the defendants had been evading service of the court documents after they were given administrative bail.

    The lawyer told the court that he had been on the case since 2023, adding that the defendants obtained a fundamental rights enforcement order, which prevented the police from bringing them to court.

    He added that it was after the order was lifted that the defendants were finally charged before the judge.

    Ruling, Justice Inyang Ekwo adjourned till February 18, next year, for the purpose of arraignment, and before which the prosecution is expected to effect service of the charge on the defendants.

    However, he declared the All progressive Congress (APC) is ready to make amends with the state Assembly elections on Saturday in the state.

    He spoke on Friday at Uga, Aguata local government area of Anambra State after the stakeholders meeting of the party.

    The meeting attracted all the National Assembly candidates who failed the elections on February 23 in all the zones and constituencies in the state.

    Addressing reporters, Uba said the meeting was to address those issues that led to the failure of their party during the presidential and National Assembly elections.

    He said it was also on how to make serious inroads in the state Assembly elections tomorrow.

    According to him: “We are battle ready and we are not relenting despite what happened in the last elections in Anambra and Southeast.

    “There were many forces against our party during the election in not only Anambra but the entire Southeast, we did our best in making sure Mr. President wins but the forces including the Churches were so much.”

    He said the allegation that the President would be hard on Anambra for not giving him enough votes does not hold waters, as Buhari was not someone with such vindictive posture.

    Uba, who was made Anambra state Coordinator for Muhammadu Buhari campaign organisation, said the other political parties should be prepared to face his party in elections in the State.

    He therefore congratulated President Buhari and others who won the elections on February 23, adding, the outcome of the elections would spur the members of the party further.

    ‘Nigeria lost N6tr worth of goods to fire disasters in five years’

    The Chairman of the Senate Committee on Interior, Sen. Andy Uba, says Nigeria has lost over N6 trillion worth of goods to fire disasters in the past five years.

    Uba made the disclosure at the International Fire Conference and Exhibition, organised by the Senate and House of Representatives Joint Committee on Interior, held on Tuesday in Abuja.

    According to him, nationally, direct and indirect reported and unreported losses to the economy have been put conservatively at about N6 trillion.

    “Alarming as these numbers are, they could be significantly higher if all the incidents in rural areas were recorded by an efficient operational fire statistics database.

    “There is a general consensus on the need to mitigate this trend to stopping the fire before they start,” he said.

    The lawmaker told the Federal Government to reposition fire service delivery to make it modern and efficient.

    Uba, who noted that less than two per cent of Nigeria’s population were safety literate, called for media partnership on creating awareness on the issue.

    Declaring the two-day event open, the Vice-President, Prof. Yemi Osinbajo, said that outbreaks were preventable given the necessary equipment and manpower.

    The vice-president was represented by the Minister of Interior, retired Lt.-Gen. Abdulrahman Dambazzau.

    He said that with support from the legislature and backing from the presidency, the Federal Fire Service would be one of the best in the world within the next five years.

    “The effort by the National Assembly in the 2016 budget to procure five equipment is encouraging. This did not happen in the last 30 years or more.

    “We are doing our best to ensure that Nigeria remains safe. There is a correlation between climate change and conflict,” he said.

    The President of the Fire Disaster Prevention and Safety Awareness Association of Nigeria, Mr Badanga Lamidi, commended the senate for its effort in ensuring safety of Nigerians.

  • On Andy Uba’s petition

    SIR: The petition written by Senator Andy Uba, addressed to the Anambra State Governorship primaries appeal committee of the APC refers.

    In the petition, Senator Andy Uba accused Dr Tony Nwoye of bringing thugs/NANS members into the accreditation venue to chase away delegates. This is not true as the accreditation was conducted peacefully. Delegates were identified through the following means- Permanent voters’ card (PVC) National ID card, driver’s license or international passport. They also came with their party membership slip with photograph issued to them by the party during registration.

    The party had already made the delegates list available to all aspirants, two weeks before the primaries. With the delegates known, there was little room for manipulation.

    The Nigerian Police Force led by Anambra State police commissioner, Umar Garba, the DSS and other security agencies provided adequate security at the accreditation venue, making it nearly impossible for the venue to be infiltrated by thugs. Our dear Senator Andy Uba even attested to this during his interview with pressmen at the accreditation venue.

    The allegation that delegates were swapped is simply laughable. After accreditation, delegates were conveyed to the voting centre on marked buses with full police escort. There was no room for any manoeuvre as the delegates had no physical contacts with outsiders.

    The road leading to the voting venue was not even accessible to commuters and other road users, as it was cordoned off by security agencies, making it impossible for any non-accredited person to gain entrance to the venue.

    Most importantly, during voting proper, once a local government is called, the various ward chairmen are called to vote first, and then line up in front of the hall to identify delegates from their ward who then proceeded to cast votes.    The allegation of presence of thugs at the venue is untrue, except if Senator Andy Uba is now referring to genuine APC members as thugs simply because they did not vote for him.

    Senator Uba also alleged that some delegates have gone to court to depose affidavits on what transpired. The party should note that this is their usual tactics of scuttling elections once it doesn’t go their way.  Party leaders should note that this tactics was used in 2013 to scuttle the ambitions of the same Tony Nwoye after he defeated the same people in primaries televised live on national TV.  The litigation went all the way to the Supreme Court and by the time judgment was delivered Dr Tony Nwoye had just 10 days to campaign. Despite the short time left for him to campaign, he still finished second in the General elections.

    If Senator Andy Uba’s capacity could not win him the APC primaries, he does not have the capacity to win the November 18 elections in which votes are expected to count. I urge the distinguished senator to stop embarrassing himself and work for the party as earlier pledged.  His actions are being seen by Anambra State members as anti-party and our national leadership should not fail to wield the big stick when necessary.

    Anambra: Nwoye defeats Uba, ten others to emerge APC governorship candidate

    The member  of the House of Representatives for  Anambra East/West Constituency, Tony Nwoye has emerged the flag-bearer of the All Progressive Congress, APC, for the Anambra Governorship election slated to hold on November 18.
    Nwoye defeated his closest contestant, Andy Uba who is the Senator representing Anambra South Senatorial District and the National Auditor of the party, George Moghalu who placed third.
    Announcing the results, Governor of Borno State, Kashim Shettima who doubles as the Primary Election committee Chairman, said Nwoye got a total of 2146 votes out a total 4333 votes cast. Senator Uba got 931 votes, while Mr Moghalu got 525 votes.
    Votes for other contestants are : Bath Nwibe-414, Johnbosco Onunkwo-85,  Patrick Nwike-20, Paul Chukwuma-110, and Chike Obidogbo-22.
    Others are: Nonso Madu-21, Okonkwo Donatus- 10, Uzor Obinna-17 and Adaobi Uchegbu the only woman in the race got just one vote.
    Thirty one votes were declared invalid while the total valid votes were 4302
    With the result,  Governor Willie Obiano who has since clinched the All Progressives Grand Alliance, APGA, ticket and Mr Nwoye will slug it out in a rematch of the 2013 election which saw Mr Obiano beating Nwoye, then the flagbearer of the People’s Democratic Party, PDP.
    Incidentally, both are kinmen as they hail from the same Anambra East local government area of the state.
    Governor Shettima thanked the security agencies, party officials, INEC, members of the party everyone who assisted the committee to conduct a smooth primary election.
    He said the election was free and fair as the committee was neutral and impartial to all the contestants.
    Mr Nwoye thanked the Committee for the free and fair conduct of the election and called on his fellow aspirants to rally round him to ensure that the party is victorious at the polls
  • Andy Uba throws his hat in the ring again

    Instead of “the fewer the better,” it is a case of “the more the merrier” as the race for the seat of Anambra governor hots up ahead of the November elections.  Unlike other governorship tussles where one or two handpicked candidates represent their party, the situation in Anambra is akin to a royal rumble as the biggest and the best from the state keep throwing their hats into the ring.

    On the APC side are political behemoths like former national internal auditor, Chief George Muoghalu, billionaire businessman, Ifeanyi Ubah, and Senator Uche Ekwunife among others. And then there is the latest comer to the APC fold in the state, Andy Uba, who is undoubtedly the pick of the APC bunch so far due to his huge political and business clout and deep pockets, not to mention that he was also a former (albeit for just two months) governor of the state. Add to this the fact that the likes of ex-governor Chris Ngige could still declare their intention to pick the APC ticket and the race within the party is looking very juicy indeed.

    Whoever picks the APC ticket will have to enter the ring to face off against the might of incumbent Willie Obiano of the APGA who has the state’s political machinery in his pockets. He also enjoys the goodwill of the state’s voters due to hi strong performance, making him extremely difficult to unseat.
