    Uba brothers battle over senatorial seat

    TWO brothers,  Chief Chris Uba and Senator Andy Uba, are set to fight for the Anambra South seat.

    Andy, the eldest, who represents the district at the National Assembly, is facing a stiff battle from Chris.

    The brothers have pitched their tents with different camps of the state’s Peoples Democratic Party (PDP) after purchasing forms at the cost of N11 million each.

    The Nation gathered yesterday that Chris, regarded as the godfather of Anambra State politics, has vowed to stop Andy.

    Already, the youth, women, traders and businessmen are invading Chris’ residences in Enugu, Awka and Uga in Aguata Local Government Area to urge him on.

    It was learnt that they were angry that since Andy went to the Senate, he had not made any meaningful contribution in the chamber.

    They also alleged that he had done nothing for the people, except about two weeks ago, when he came with some vehicles and other equipment to empower a few people.

    One of their relations, who spoke yesterday under anonymity, said since both declared their interests “they have not been seeing eye-to-eye.”

    The source added: “Andy is our brother, likewise Chris. But the senator does not help anybody. Chris may have his deficiencies, but he carries everybody’s problem, fights for people and does not like suppression or oppression.

    “Everybody is happy that Chris has come out to contest this election. He had been crowning people in Anambra State and one of the beneficiaries is his elder brother, Andy.”

    Efforts by The Nation to speak with Senator Uba proved abortive as his phones were said to have been switched off.

    But Chris said it was true that he purchased PDP senatorial form. He, however, denied being at war with his brother.

    He said: “This is politics; everybody has his own interest. I think I have tried for so many people in this state. I want to go there and help the less-privileged in the seven local government areas in my zone.

    “I have vowed not to touch my salaries at the National Assembly for the next four years.

    “But my constituents will meet to decide the way they want to share it throughout my stay there. I want to go there to speak for the Ndigbo.”

    Saraki disagrees with Uba on new polling units

    The Chairman Senate Committee on Ecology and Environment, Senator Bukola Saraki, on Thursday faulted pressure being put on the Independent National Electoral Commission (INEC) to suspend its proposed creation of additional 30,000 polling units across the country.

    Saraki in a statement issued by his Special Assistant on Media, Bamikole Omishore, in Abuja, noted that the view of the Chairman, Senate Committee on INEC, Senator Andy Uba, was at best his personal opinion.

    He said the call for the suspension or cancellation of the exercise by Uba should not be construed as a resolution of the Senate on the matter.

    Uba had written a letter to the INEC, advising it to suspend the exercise or risk being barred by the Senate.

    Saraki said INEC should be allowed to decide whether to go ahead with the exercise or not as an independent organization irrespective of the opinion of the Senate committee on electoral matters.

    However, Saraki warned politicians to stop interfering in the activities of INEC in order not to compromise its independence.

    He, however, urged INEC to maintain its credibility by holding strong the founding tenets of the organization which is independent of any political party or group.

    Supporters of the two parallel governorship candidates of the Peoples Democratic Party (PDP) for the Anambra election, Senator Andy Uba and Mr. Tony Nwoye on Saturday  engaged in fisticuffs at the convention ground.
    Trouble started when some of Nwoye’s supporters attempted to yank Andy Uba’s younger brother, Chris off his seat. The three Uba brothers, Ugochukwu, Andy and Chris were seated next to one another.
    Incidentally, Nwoye was seated one seat away from the three brothers on the same row.
    A few of the Uba supporters resisted the attempt to drag Chris away from his seat, a development that led to exchange of blows among the supporters.

    Minister of Aviation, Mrs. Stella Oduah who was at the scene quietly walked away from the rowdy scene. Looking unruffled, the Uba  brothers sat quietly and watched the drama that lasted for about 20 minutes before normalcy was restored.

    One of the factional chairmen  of the Anambra chapter of the PDP, Chief Ejike Oguebego sat close to the Uba brothers; while his rival, Ken Emeakayi sat close to Nwoye.
    Andy Uba emerged the PDP candidate through a congress organised by Oguebego, while Nwoye emerged through the Emeakayi faction.
    The leadership of the PDP has given recognition to the Emeakayi faction, while the Independent National Electorsl Commission (INEC) has declared  Oguebego as the authentic chairman of the Anambra chapter of the party.

     The governorship candidate of the Peoples Democratic Party (PDP) for the November 16 gubernatorial election in Anambra State, Mr. Tony Nwoye, was on Wednesday presented with a certificate of return by the National Chairman of the party, Alhaji Bamanga Tukur.

    The presentation came just as the Uba brothers, Andy and Chris shunned the summon extended to them by the leadership of the party.

    Also summoned alongside the Uba brothers were Chief Benji Udeozor and Mrs. Tonia Nwankwo. They were ordered to appear before the party’s leadership at 10am on Wednesday.

    None of them honoured the invitation.

    They were summoned to explain their roles in the conduct of an August 24 parallel primary election through which Andy Uba emerged as PDP candidate for the Anambra poll.

    Shortly after collecting his certificate, Nwoye told reporters that he remained the authentic candidate of the party.

    Nwoye emerged from the Ken Emeakayi led faction from which the Independent National Electoral Commission (INEC) had withdrawn recognition.

    On the other hand, Andy Uba emerged a parallel candidate from the Ejike Oguebego led faction. Oguebego is recognised by the electoral commission as the authentic chairman of the Anambra chapter of the PDP.

    The Peoples Democratic Party (PDP) has announced a parallel candidate, Mr. Tony Nwoye, as the party’s candidate for the November 16 governorship election in Anambra State.

    The National chairman of the (PDP), Alhaji Bamanga Tukur, announced Nwoye as winner of the party’s primaries held on Saturday.

    The election was conducted by the Ken Emeakayi -led faction of the state’s executive committee.

    The announcement was based on a report on the election submitted to the party’s leadership by Katsina State Governor, Ibrahim Shema.

    Shema was the chairman of a five-man Anambra governorship congress committee set up the PDP to conduct the election.

    According to Shema’s report, Nwoye scored 498 votes to beat Prince Nicholas Ukachukwu who scored 357 votes. Dr. Alex Obiogolu came third with 13 votes.

    The report said 14 aspirants participated in the congress in which 916 delegates voted.

    However, a parallel congress conducted by the Ejike Oguebego faction had declared Mr. Andy Uba as winner of the congress and by extension the party’s flag bearer for the same election.

    The Oguebego faction is the one recognised by the Independent National Electoral Commission (INEC) while the PDP leadership backed the Emeakayi faction.

    Contrary to insinuations in some quarters, Senator Andy Uba is still interested in contesting the 2014 governorship election in Anambra State, Dare Odufowokan, Assistant Editor reports

    Senator Andy Uba has resonated as a political factor in the politics of Anambra State largely due to his bid to govern the state since 2007. The Senator who represents Anambra South in the National Assembly, The Nation can now reveal, is still very much interested in ruling the southeast state.

    Though Uba’s name has featured prominently among those of other likely aspirants in the countdown to next year’s governorship election in the state, his interest or otherwise in the race has remained a subject of intense debates within and outside the state.

    Uba’s cautious approach to questions about his next political move and the fact that he is yet to publicly declare his interest in the race prompted the thinking that he may be uninterested in the governorship contest which has already gathered momentum with politicians criss-crossing the state to propagate their candidacy.

    But following Uba’s penultimate Friday judicial victory over his long time political opponent, Mr. Nicholas Ukachukwu, in a suit meant to determine who is the duly nominated Peoples Democratic Party (PDP) for the 2011 senatorial election in Amanbra South, there are strong indications that he is now oiling his political machinery to make a strong bid for Governor Peter Obi’s job next year.

    Besides, an ally of the senator told The Nation that Uba has summoned a meeting of all his associates and allies to discuss his next political aspiration. The meeting, according to our source, focused on how Uba’s governorship aspiration would be.

    A chieftain of the PDP in the state said “The then unending judicial battle over his seat in the senate was one major factor why his governorship aspiration was not clearly spelt out. We were interested in knowing how that was going to end. This is politics and the result of the litigation will surely have an impact on his politics.

    “But now that we know he is the duly nominated candidate of our party and he is the rightful occupant of the Senate seat, there is nothing to distract us from the next project which is the governorship. I can tell you authoritatively that from now on, Andy Uba is the man to watch out for in the Anambra guber race.

    “We are already back to the drawing board to map out the strategies with which we will corner the PDP ticket and then go ahead to win the election again just like we did in 2007. The people of the state know their leaders. They know the man we need now is Andy Uba. They voted for him in 2007 and they are ready to vote for him again.”

    Uba, who was sworn in as governor after the 2007 election, but removed few days later through a court order which faulted the Independent National Electoral Commission (INEC) for conducting election in the state when Governor Peter Obi’s tenure was still running, has had to endure a long judicial challenge from Ukachukwu after the 2011 senatorial election.

    But the Court of Appeal sitting in Owerri, the Imo State capital on Friday May 31, ruled against Ukachukwu who had asked the appellate court to declare him the duly nominated candidate of the PDP in the 2011 senatorial election.

    In a lead judgement, Justice Inyang Okoro ruled that Ukachukwu had lost his “right of action” against Uba and could therefore not sue him over a pre-election matter.

    Although a similar suit is against Uba at a federal high court in Abuja, the judgement by Justice Okoro, being from a superior court is believed by Uba’s men to have effectively settles the matter thereby encouraging the Senator to return to his gubernatorial dream with more concentration.

    “The Abuja High Court case is no longer a problem as a higher court in Owerri has effectively settled the issues argued in the case. With this, Uba’s election has been affirmed,” one of Uba’s counsels told The Nation.

    It would not be the first time Ukachukwu would be losing in his bid to oust Uba from the Senate. Last January, the Court of Appeal sitting in Owerri, the Imo State capital dismissed his request to be declared as the duly nominated candidate of the PDP for the senatorial election which was won by Uba.

    In the suit no CA/OW/180/2012 between Ukachukwu and others versus INEC and Uba, the court had ruled that Justice J. Umar, then of the Federal High Court, Umuahia, was wrong to have transmitted the application to the Court of Appeal.

    The court further held that Ukachukwu had no grounds of appeal on the real issue in question and therefore refused to exercise its power under section 15 of the Court of Appeal Act to decide on who was the nominated candidate of the PDP.

    The Court of Appeal, therefore, ordered that the substantive suit pending at the Federal High Court, Umuahia, be transferred to the Chief Judge of the Federal High Court for re-assignment.

    Earlier in September 2011, the Court of Appeal, Enugu division dismissed a petition filed by Ukachukwu challenging the election of Uba for the Anambra South Senatorial Zone. The court presided over by Justice Abubakar Jega held that the petition brought by Ukachukwu was a pre-election matter which raised intra-party dispute.

    Consequently, the tribunal struck out the petition and upheld the ruling of the election tribunal sitting in Akwa. Ukachukwu had gone to the court to challenge the April election of Uba and his subsequent declaration by the Independent Electoral Commission [INEC]. A cost of N30, 000 was awarded against the respondents in the case.

    Uba had in January 2011, won the PDP senatorial ticket for the Anambra South Senatorial District in a keenly contested primary election that featured Chief Nicholas Ukachukwu, Dr. Andy Uba and Hon. Barr Nnamdi Ezike.

    Uba polled 1766 votes to Ezike’s 72 votes to emerge winner. Ukachukwu had 68 votes. With that victory, Uba went into the general elections where he matched up with Hon. Chumah Nzeribe who contested on the platform of the All Progressive Grand Alliance (APGA) and a number of other candidates.

    Uba defeated Nzeribe and his other challengers to emerge the winner of the 2011 senatorial election. However, his victory was challenged and INEC had to conduct a re-run election in the district a year later.

    At the March 2012 senatorial re-run election, Uba and the Peoples Democratic Party (PDP) defeated Chuma Nzeribe and the All Peoples Grand Alliance (APGA).

    Official results released by the INEC indicated that the former domestic aide to President Olusegun Obasanjo, polled approximately 42,804 votes, beating his main opponent, Nzeribe by some two thousand votes.

    Pundits say Uba’s entrance into the governorship race in Anambra will alter all previous permutations on the race for the gubernatorial ticket within his party, the PDP as well as on the general election.

    The Economic and Financial Crimes Commission (EFCC) yesterday arrested a businessman, Mr. Chibuike Achigbu, in connection with a $15 million bribe allegedly offered a former chairman of the commission, Mallam Nuhu Ribadu, by ex-Governor James Ibori.
    Following the conviction of Ibori by a UK Court, the Delta State Government had gone to a Federal High Court to apply for the return of the bribe sum which is being kept with the Central Bank of Nigeria(CBN).
    But Achigbu initially filed an application on August 29 before a Federal High Court claiming that  the money belongs to him.
    He said he gave the money to a former presidential aide, Dr. Andy Uba, to finance the  Peoples Democratic Party (PDP) during the 2007 elections.
    Barely 72 hours after filing an application for the return of $15 million bribe sum to him, he made a U-turn by withdrawing the matter.
    The withdrawal made the EFCC to launch a full-scale investigation into how the bribe sum came about and the sponsors of the botched suit.
    According to a reliable source in the commission, the embattled businessman was arrested in Lagos on Thursday and flown to Abuja for interrogation.
    The source said: “The suspect, who was interrogated for many hours, has made a useful statement to our investigators, which could lead to how the $15 millon bribe was offered.
    “It is obvious that some forces were using Achigbu as a shield  over the bribe sum. We hope to effect more arrests on the curious suit.
    “If you look at the affidavit sworn to by the businessman, it contained many revelations which require in-depth  probe.”
    As at press time, it was gathered that although  the businessman had been granted bail, he was yet to meet the terms.
    The Head of Media and Publicity of the EFCC, Mr. Wilson Uwujaren, confirmed the arrest and grilling of Achigbu.
    “We have started investigation on issues that we feel he should clarify,” he said.
    Following the withdrawal of the case, the Congress for Progressive Change had insisted on a fresh probe of the $15 million donation.
    In a statement by the National Publicity Secretary of the party. Eng. Rotimi Fashakin, the CPC asked the EFCC to probe alleged donation of the $15 million to the PDP.
    “The Congress for Progressive Change (CPC) is appalled by the controversy generated by the alleged $15 million bribe money (currently in the custody of the Central Bank of Nigeria) offered to the former Chairman of the Economic and Financial Crimes Commission (EFCC), Mallam Nuhu Ribadu in 2007 by the former Peoples Democratic Party (PDP) Governor of Delta State, Chief James Ibori.
    “With the formal conviction and subsequent incarceration of Chief James Ibori (for money laundering offences) by a British Court, the need for  proper disposal of the money became a front-burner issue.
    “Understandably, the Delta State Government showed up as the rightful owner since the money was purloined from it by Chief James Ibori, in his capacity as the then substantive governor.
    “Whilst the matter was pending in court, a Nigerian business man, Mr. Chibuike Achigbu, stepped forward as the authentic owner. In a deposition, filed by a team of ten lawyers (including three Senior Advocates of Nigeria), Achigbu averred, inter-alia, that he raised the money for the purpose of donating to the electioneering campaigns of the PDP in the 2007 general elections.
    “Furthermore, the money was allegedly given to Dr. Andy Uba, the then Senior Special Assistant on domestic Affairs in a PDP Presidency and now a PDP Senator, for the purpose of authenticating (with the EFCC) its suitability for donation.
     “Uba was alleged to have passed the money to  Mr. Ibrahim Lamorde, the then Director of Operations of EFCC and now the substantive Executive Chairman.
    “As a party, we view the portent of this latest twist to the bribe money saga as foreboding for the fight against institutionalised corruption in the Nigerian polity.
    “Section 7(1)b of the EFCC Act 2004 states: ‘The Commission has power to cause investigation to be conducted into the properties of any person if it appears to the Commission that the person’s lifestyle and extent of the properties are not justified by the source of income.’
    “ This twist to the saga  has thrown up some questions:
    •    Does the EFCC Act empower the Commission to authenticate the suitability of a donation to a political party?
    •    Does the EFCC not have sufficient powers to investigate Mr. Chibuike Achigbu with a view to ascertaining the source of his income vis-à-vis justification for making such huge donation?
    •  Should the EFCC not investigate Senator Andy Uba as the locus in the latest controversy of the alleged bribe money?
    •  With the EFCC Chairman Ibrahim Lamorde’s name mentioned in the deposition, should he not tell the Nigerian people all he knows about this case?
    •  Has this deposition by an acolyte of a serving PDP Senator not exposed the ruling party as mostly responsible for the festering corruption in the Nigerian state?
    “The unexplained illegal jerking up of the expenditure for the 2011 fuel subsidy from N240 billion to N2.67 trillion is part of the continuing story of PDP’s unsuitability for the electoral trust of the Nigerian people.
    “As a Party, we owe it a sacred duty to the Nigerian people to expose the infra-dig in the polity for the purpose of ensuring its sustainable growth.”
