    Lawyers to INEC: death of APC candidate does not invalidate election

    Lawyers yesterday told the Independent Electoral Commission (INEC) that the death of the governorship candidate of the All Progressives Congress (APC) does not invalide the on-going election in the state.

    They urged INEC to allow  the deputy governorship candidate of the APC, Abiodun Faleke, to conclude the on-going election.

    The former Chairman of Nigerian Bar Association (NBA), Ikeja Branch, Monday Ubani; a member of the Ogun State Judiciary Service Commission, Abayomi Omoyinmi and a lecturerý of Law at University of Lagos (UNILAG), Akoka, Wahab Shittu said the process should be concluded.

    Ubani said: “Since the Electoral Act didn’t specifically provide for things like this happening in the course of an election, we would have to make recourse to the judicial pronouncement in the case of Rotimi Amaechi where the Supreme Court said in an election, it is the political party that is the beneficiary of election and not the candidate.  That is why Amaechi that didn’t contest elections was sworn in.

    “In this situation, the deputy governorship candidate would have to step in to conclude the process. If he wins the election, the APC would then decide on another  deputy for him”.

    According to Ubani, the time to choose a candidate through primary election had lapsed for all the political parties and it is not possible for any of the parties to go for primaries anymore.

    Omoyinmi said: “In the eyes of the law, the deputy should ordinarily conclude the re-run election for the office of the governor and it is now left for him to pick a new running mate”.

    Omoyinmi said the kind of situation in Kogi was not envisaged.

    Shittu said the matter could be viewed from different perspectives.

    Shittu said since the election was declared inconclusive, the running mate should be allowed to step in and conclude the process of the supplementary election.

    This, he said, has become necessary because the electoral law did not envisage such an incident–Audu’s death.

    On the other perspective, he said since it is the ýparty that fields the candidate, and that since the election has turned this way, the party would have to replace the governorship candidate.

    “Which means that election might be conducted afresh. The death of a candidate during the process of an election automatically voids the election. It is not a question of an election being inconclusive. The entire electoral process is now altered with the death of the governorship candidate,” he said.

    Constitutional lawyer and Senior Advocate of Nigeria (SAN) Malam Yusuf Ali said the situation in Kogi is “very complex, because the election has been declared inconclusive”.

    He said: “If he had won the election outright, it would have been a different matter, but with the way things are, it is very delicate.”

    Chief Niyi Akintola (SAN) said: “There can be fresh election. INEC can only conduct supplementary election in the 91 polling units. The death of Audu cannot nullify the election. It was APC that contested the governorship election not Audu as an individual.”

    Akintola explained that it is left to the APC to pick another candidate from among those that contested the governorship primary with Audu or ask the deputy governorship candidate, James Faleke to take over.

    “The decision lies with the APC,” he added.

    The presidential candidate of the United Progressive Party (UPP) in the last general elections, Chief Chekwas Okorie, said it was a very shocking development that threw everybody off-balance.

    He said: “ From every indication, it is a political party that wins an election; the result so far released suggests that the people of Kogi State are favourably disposed to an APC government to be in-charge of affairs in the next four years. What it therefore means is that the APC still has a chance, even his death, to govern the state, based on the result already declared.

    “So, they should follow up the supplementary election with the same atmosphere of peace that we witnessed in last Saturday’s election. If their choice is the APC, then let the APC rule them in the next four years.”

  • APC candidate asks tribunal to declare him Gombe governor-elect

    The Gombe State All Progressives Congress (APC) governorship candidate, Mohammed Inuwa Yahaya, has asked the Governorship Election Petition Tribunal to either declare him the winner or nullify the results of the April 11 election.

    He said Governor Ibrahim Dankwambo and the Peoples Democratic Party (PDP) were not duly elected and did not score the lawful majority votes cast at the election and ought not to have been returned.

    The tribunal yesterday ordered a substituted service on Dankwambo after hearing a motion ex parte by Chief Niyi Akintola (SAN), Yahaya’s lawyer.

    A court bailiff, Mohammed Dawaki, was on Friday prevented from pasting the court process on the gate of the Government House in Gombe, the state capital.

    In an application before the tribunal, the APC and its governorship candidate averred that of the 285,369  total votes cast, 114,610 invalid and unlawful votes were credited to Dankwambo.

    The APC and its candidate faulted the results from 11 local government areas. They claimed that some of the results were either inconclusive or marred by all sorts of grandiose electoral malpractices.

     

  • More endorsements for APC candidate

    A group, Coalition of Christian non-governmental organisations (NGOs), Lagos State, has endorsed the governorship candidate of the All Progressives Congress (APC), Mr. Akinwunmi Ambode, and other APC candidates.

    The Chairman, Christian Association of Nigeria (CAN), South West Zone, Archbishop Magnus Atilade, said the decision to endorse Ambode was based on their assessment of his competence and experience.

    He said the gathering, which started with a road procession, became a political rally by the children of God.

    “The change has started but is not completed because it is one of the first days Christians are coming together, putting their voices together on a political issue.

    “Our man of the moment has put himself forward to serve Lagos State; therefore I move the motion to endorse the man of the moment.”

    Ambode thanked the clerics for believing in him and promised to represent all interest groups.

    “Before I started this calling, I sought your permission, everything that God stands for is what APC stands for and that I would definitely stand for,” he said.

    Another group, Nollywood Team Buhari (NTB), has declared its support for Ambode.

    The group described the victory of Muhammadu Buhari as a welcome development, saying it will bring the desired change in the nation’s creative industry.

    The group’s coordinator, Eze Harris Chuma, said: ‘’Our dear President–elect, we are hopeful that you will use your good offices to instil discipline and restore sanity in our creative industry, where issues of corruption and lawlessness will be discouraged.

    ‘’We will continue to work to ensure the victory of APC candidate in Lagos and other states. We use this medium to re-emphasise our support for Ambode.’’

    APC candidate rejects Edo Central results

    The All Progressives Congress (APC) candidate for Edo Central, Chief Francis Inegbeneki, has urged the Independent National Electoral Commission (INEC) to cancel the National Assembly elections in his area.

    Speaking at a press briefing yesterday, Chief Inegbeneki accused the PDP of rigging in the area.

    He alleged that there was widespread multiple thumb printing of ballot papers as well as the use of soldiers by the Peoples Democratic Party (PDP) to intimidate and harass APC members

    “Apart from the fact that they induced our people with money at the polling units, soldiers were used to chase away APC members and arrest some of them.

    “In most polling units in Uromi, Irrua and Ekpoma, the PDP were giving people N5,000 and N10,000 on the queue to vote for them.

    “They brought in soldiers to intimidate, harass and arrest our leaders as well as members and prevented them from voting.

    “In Uromi and Igueben, they were thumb printing ballot papers. So we are rejecting the result of the exercise and calling for its cancellation. While our people were working hard to campaign, PDP was planning to use soldiers to intimidate our people, which they succeeded in doing”.

    The All Progressive Congress (APC) candidate in Mushin Local Government, Lagos State, Hon Semiu Ishola Karaole (aka KAMS), has urged Nigerians to vote wisely during Saturday’s general elections.

    He said APC and its candidates must be voted for based on their achievements.

    Karaole, who spoke at his Mushin campaign office, said that Nigerians should be careful, urging them to vote out the Peoples Democratic Party (PDP), claiming that its members had been lying and fooling the people since 1999. He accused the PDP of failing Nigerians in the provision of security, education, infrastructure, health and agriculture, among others.

    He said APC had fulfilled its promises in several ways and was ready to take democracy to the citizens’ door steps.

    He said the choices in the coming general elections must be based on whether the promises made by the opposition party members since their election were fulfilled.

    Karaole said democracy is a change of promises and a social contract which must be based on trust. Noting that a candidate that fulfils his promises in the first tenure will not stress much before being re-elected, he said a new candidate that run his campaign on promises, while an incumbent should run on his records.

    A member of the Lagos State House of Assembly, representing Lagos Island Constituency 1,  Hon. Hakeem Masha has filed a Notice of Appeal against the judgment of Justice Ibrahim Buba of a Federal High Court, Lagos, which declared Wasiu Sanni-Eshilokun as the All Progressive Congress(APC) candidate for Lagos Island Constituency 1 in the April 11, House of Assembly elections.

    Justice Buba had also ordered the Independent National Electoral Commission(INEC)  to recognise and substitute Hon. Masha’s name with that of Sanni-Eshinlokun’s for the  April 11, House of Assembly elections.

    Hon. Mash is urging the court to set aside its judgment delivered last week  by   Justice Ibrahim Buba, which declared his opponent in the All Progressive Congress (APC), Wasiu Sanni-Eshinlokun the lawful candidate of the party, representing the Lagos Island Constituency 1 for the April 11 election into the Lagos State House of Assembly.

    In the notice of appeal filed by his lawyer, Mr. Bonojo Badejo (SAN), Hon. Masha based his appeal on five grounds.

    The appellant is seeking for a stay of execution of the judgment delivered by Justice Buba pending determination of his appeal.

    He stated that  Justice Ibrahim Buba erred by declaring Wasiu Sanni-Eshilokun as the lawful candidate.

    He claimed that the judge also ignored all fundamental issues raised by Hon. Hakeem Masha while adjudicating on the matter.

    Other ground of  his appeal was that the judge erred in law when he assumed jurisdiction to hear originating summons when the first respondent failed to explore or exhaust the internal dispute remedy enshrined in the APC constitution before proceeding to court.

    The appellant also faulted  the judge on the issue of waiver as the APC National Working Committee or its National Executive Committee had at no time, granted waiver to Wasiu Sanni-Eshilokun to participate in the primaries.

    He said Sanni-Eshilokun, who was declared winner by the court did not resign from his position within the stipulated time by the party’s constitution.

    It said the APC’s National Working Committee (NWC) had, in a response to the petition filed by Hon. Masha,  ruled that Sanni-Eshilokun did not resign within the mandatory 30 –day period as required by the party’s Constitution and was not qualified to contest in the primaries elections.

    The NWC of the party, it further stated, had then upheld the prayers of the petitioner, Hon. Masha and forwarded his name as the Party’s candidate for Lagos Island Constituency 1 to INEC.,

    •The application for stay of execution of judgment was served on the Independent National Electoral Commission (INEC) at its National Headquarters in Abuja on Friday, March 6,

    •The effect of the application  was to ensure that INEC does not carry out the order of the court until the application/appeal has been determined by the court.,

    During trial at the court, the plaintiff, through his lawyer, Mr. Wahab Shittu, sought a declaration of the court that the substitution of his name in the list forwarded to INEC with that of Masha, ran contrary of the provisions of Sections 33, 34, 35, 36 and 37 of the Electoral Act, 2010.

    In a 37-paragraph affidavit deposed to in support of the originating suit, Sanni-Eshinlokun had averred that he has  not, at any time withdrew his candidacy in the race for the Lagos House of Assembly on the platform of the APC.

    He insisted that he  remains the substantive and the lawfully nominated candidate of the APC.

    “I state that I am alive, fully fit and in good condition of health.”

    But the APC and Masha, through their own lawyers, Mr. Femi Falana (SAN) and Mr.  Bonojo Badejo (SAN), had raised objection to the plaintiff’s prayers.

    Falana and Badejo  described the suit as “frivolous, vexatious and an abuse of court processes” and urged the court to dismiss same for want of jurisdiction.

    They had also contended that the suit was “not initiated by the due process of law.”

    The candidate of the All Progressives Congress (APC) for Delta Central Senatorial District in the forth coming general election, Hon. Halims Agoda, has vowed to probe the sale of Delta Steel Company in Ovwian-Aladja, Delta State– if elected.

    Agoda, a former member representing Ethiope Constituency in the House of Representatives,  lamented the fate of the now comatose pioneer integrated steel plant.

    Addressing his supporters in Effurun,  Uvwie Local Government Area, he noted that the steel company was capable of employing thousands of teeming youths in the state, particularly in the central district where it is located.

    He said, “DSC, if well run and adequately financed, has the capacity to employ over 20,000 staff and this ought to be a blessing to Urhobo nation and not this present state were the multibillion dollar plant is allowed to rot away because some persons have personal interest to take over.

    “All those who contributed in one way or the other to bring DSC to this sorry state will have stories to tell Nigerians when I get to the Senate chambers,” he vowed.

    He also promised to facilitate mass employment in a bid to ensure crime reduction and taming of youth restiveness in the state and beyond.

    He said, “I am highly experience and intellectualized in the business of law making, having done it in both the State House of Assembly and the House of Representatives between 1999 to 2011. Since I am a senior Legislator, I will seat on the front row of the red chambers of the National Assembly, from where I shall be at advantage to move my motions. As a senior legislator, I must also be appointed as Chairman of various committees where I can relate with government agencies, parastatals, organisations and companies where I can facilitate employment for our teaming youths.

    “That is an opportunity my two opponents do not have because none of them has been to any law making House in this country. If you elect them, they will sit at the back row where they will be overwhelmed and can hardly be heard, because that is part of the rules of the House, new comers are usually relegated to the back without the privilege of bein appointed as committee chairmen. I urged you to vote for me since I am the best, and I can assure you that my first motion will request for the probe of the sale of DSC, which you and I know was corruptly done. Today DSC is moribund.”

    He also touted his achievements in past assignments, saying: “When I was in the House of Representatives, I moved the motion which led to the establishment of the Federal University of Petroleum Resources now in Ugbomro, near Effurun here in Delta State, and I also moved the motion which made it impossible for the federal government to relocate the prestigious Petrpluem Training Institute Effurun to the    North. This time, when I get to the Senate I will facilitate work in it with adequate infrastructure.”

    All Progressives Congress (APC) senatorial candidate for Ogun East, Prince Dapo Abiodun has released  N25 million to the Ibadan Electricity Distribution Company (IBEDC) being the first tranche of the N50 million required  to provide power supply to Ogun Waterside communities.

    The people of Ogun Waterside local government have been in darkness for over two years owing to poor connection, bad cables and faulty equipment.

    Abiodun had, at the commencement of his political campaign, asked communities in the district to prioritize their challenges.

    It was in that process that he was told about the predicament of the communities in the Ogun Waterside.

    He was said to have had talks with IBEDC on the situation and promised to assist to the tune of N50million so that electricity supply might be restored to the area.

    While receiving the cheque, the Corporate Affairs  Manager of IBEDC, Mrs. Bolanle Onagoruwa, said:”Prince Dapo Abiodun took it upon himself to partner with us and basically told us that his objective is that those Waterside communities should have power supply.

    “We submitted the quotation to him which covers what we call the 33KVA line. It’s quite a long line that will end up in the Waterside. By the time we fix the line, there would be power supply in the area.”

    At the cheque presentation at the palace of the Awujale of Ijebuland were seven traditional rulers from Ogun Waterside.

    The Awujale, Oba Sikiru Adetona, also speaking, expressed displeasure about incessant power outage in Ijebuland as a result of obsolete equipment and lack of maintenance.

    He, however, tasked the company to ensure that the work is done within the 30-day timeframe agreed with the APC candidate.

    The monarch declared that such was unprecedented, adding that the efforts being made by the politician are indications of what to expect when he gets to office.

    Responding on behalf of the beneficiary communities, the Onisin of Ilusin, Oba Adesanya Taiwo Oseni, stated that “the power project is the most important thing we desire in the Waterside. Our sons and daughters don’t come home during festive periods and their major complaint is power supply. As this project is done, Prince Abiodun has written his name in gold in Ogun Waterside.”

    The Presidential candidate of the All Progressives’ Congress (APC), Gen. Muhammadu Buhari yesterday gained an unusual support as the Movement for the Emancipation of the Niger Delta (MEND) endorsed him.

    MEND, in a statement circulated by its spokesperson, Jomo Gbomo, anchored its decision on the need to deliver Nigeria, especially the Niger Delta, from the crunching effects of the reign of corruption that has become the most prevalent sign of governance in Nigeria.

    The group hailed Gen. Buhari for proposing to scrap the office of the First Lady, which it considered a drain on the commonwealth.

    “The Movement for the Emancipation of the Niger Delta (MEND) has, upon careful consideration of the state of the nation, endorsed and fully support the Presidential candidate of the All Progressives Congress (APC), Gen. Muhammadu Buhari.

    “Our decision to throw our full support behind Gen. Mohammadu Buhari stems from the pathetic state in which the country has been put by the government of Goodluck Jonathan and our strong belief in Gen. Buhari as the man and change the country needs.

    “President Goodluck Jonathan does not deserve a second more in the Presidency as soon as his tenure expires as he has continuously and blatantly disregarded the very people who voted him into office.

    “A President that told Nigerian to their faces that he does not “give a damn” when asked to declare his assets. A requirement that is constitutional on assuming the office of the President.

    “President Jonathan, since assuming his office, has setup countless number of “Committees”, none of which reports has ever been implemented. From the Nuhu Ribadu report to the KPMG and Fuel Subsidy reports, just to mention a few.

    “We re-state our disregard and lack of confidence in President Goodluck Jonathan. Rather than address the perennial issues in the country responsible for his administrations failures, he is concentrating government funds in a campaign of misinformation intended to hoodwink Nigerians who, unfortunately for him, are now wiser and smarter than he is.

    “Goodluck Jonathan’s actions, utterances and arrogance prove that he is totally disconnected with the situation facing the ordinary Nigerian and completely out of touch with reality.”

    On the situation with the Niger Delta, the MEND said: “Since President Goodluck Jonathan assumed office, the Niger Delta has experienced excruciating poverty faced by the people, worse pollution and environmental degradation and not once has he ever come out to openly condemn the destruction of our environment by the activities of irresponsible oil companies.

    “Recent reports confirm the country is losing billions of dollars in oil revenue due to oil theft. This theft has been aided by the pot-bellied Nigerian Army generals, in connivance with corrupt Nigerian government officials, the Joint Task Force and the Nigerian Navy. It is no wonder the once respected Nigerian Military has been reduced to a ragtag army by the Boko Haram terrorists. It can only take a bold and courageous man like Gen. Mohammadu Buhari to tackle the insecurity and oil theft plaguing the nation. He has done it before and he will and can do it again!”

  • Traders adopt APC candidate

    Market men and women in Ikenne Local Government Area of Ogun State at the weekend endorsed the All Progressives Congress (APC) senatorial candidate in Ogun East, Dapo Abiodun.

    In a meeting at Ikenne Town Hall, the traders declared that they do not engage in politics but they have shown interest because of the track records of the APC candidate.

    According to the Iyaloja General of Remo, Mrs. Mercy Owolana, Abiodun’s altruistic disposition attracted the group, which does not trust politicians because of their inconsistency.

    She said: “We gathered here to meet Prince Dapo Abiodun, our responsible and amiable son, because we have known him to be consistent. He doesn’t make empty promises.

    “He’s well known to us here and is capable of representing us at the Senate even better than those who did that in the past.

    “We came out to declare publicly today that all market women and men in Remoland have adopted Dapo Abiodun as their senatorial candidate for Ogun East.

    “We hereby call on all people of Remoland to join us in electing Dapo Abiodun as our senator in next month’s election.”

    Abiodun assured the traders that the first batch of beneficiaries of the interest-free loans he promised them would be released soon.
