  • Anambra polls: Court orders investigation, prosecution of senator-elect, returning officer

    A FEDERAL High Court sitting in Anambra has ordered the investigation and prosecution of senator-elect, Ifeanyi Ubah of the Young Progressives party (YPP) and the Independent National Electoral Commission’s (INEC’s) Returning Officer.

    The order followed the application of an order of Mandamus brought by Chris Uba of the People’s Democratic Party (PDP), in suit No, FHC /AWK /CS/29/2019 before Hon Justice I B Gafai, yesterday in Awka, Anambra State.

    The court also ordered INEC to, within 14 days, conduct or cause investigation into the criminal allegations of the applicant.

    Again, “where it considers it inexpedient to prosecute through its legal officers, consider at its liberty, the appointment of the applicant’s solicitors in this suit for the purpose of such prosecution.”

    Other reliefs being sought by Uba, include:

    Order of Mandamus compelling the 1st  Respondent (INEC) to prosecute the 2nd  Respondent (Prof M N Umenweke -Returning Officer) for the offence of delivering or causing to be delivered to the 3rd Respondent a false declaration of result/return to the effect that he won the election to the Senate of the Federal Republic of Nigeria to represent Anambra South senatorial District in the senate even as he knew that the said election was still inconclusive.

    A further Order of Mandamus compelling the Respondents to prosecute the 2nd  and 3rd  Respondents for announcing or publishing a false result to the effect that the 3rd  Respondent had won the election held on the said 23/2/2019 even when they both knew that the said election was inconclusive and from which no genuine result had thereby been generated.

    Alternatively, and where it be in expedient or impossible for the 1st Respondent to undertake the prosecution, an Order of Mandamus compelling her to issue out an authority to any Counsel in the law firm of the Applicant to undertake the prosecution on the 1st Respondent’s behalf.

  • Uba: I will rescue Anambra South from poor representation

    THE candidate of the Peoples Democratic Party (PDP) for the Anambra South senatorial race, Chief Chris Uba, says he is in the contest to rescue his people from the poor representation they have witnessed over the years.

    Uba who spoke at Orumba North, Orumba South and Ihiala town hall meetings at Umunze, Ajalli and Ihiala respectively said no body in Anambra State had contested any election without his support, including governors, senators, members of the House of Representatives and those of the state House of Assembly since 1999.

    The PDP candidate said he came to contest the seat in anger, because those who had represented his people had failed in their duties by abandoning them, saying “enough is enough”.

    He urged the people to stop selling their votes and conscience, because the time to rescue them is now. “You told me to come out and I have complied with your wishes,” he added.

    Uba who is widely regarded as the godfather of Anambra politics said those who were there today were not experienced than me in politics. He added that they would never regret sending him to Senate.

    He said: “If voted into power, I would work with any president without antagonizing him. After my tenure, no person would have the courage to come out to contest again, because of the record I would set at the Senate.

    “Fear not, I have the resources for this election. I have the brain; I have the connection and I have the capacity to become your senator.

    “I’m ready for this fight and ready to give my constituents what they had lacked in many years and I’m ready to sign an agreement with Orumba North and Orumba South Local Government areas to show my seriousness in this election.”

    Uba said he would visit all the seven local government areas that make up Anambra South. He added that the town hall meeting is the first step and that it would be followed by main rallies this week.

    At Ihiala, the PDP candidate said he was not going to the Senate to amass wealth, but to help the widows, the needy and other less-privileged people in the society.

    Addressing a mammoth crowd in the town, Uba told the people that he would make sure all the things due to Ihiala would get to them.

  • Chris Uba takes campaign to Ekwusigo, Nnewi

    The Peoples Democratic Party (PDP) Senatorial candidate for Anambra South, Chief Chris Uba, has told his constituents to keep their PVCs ready for next month’s elections.

    Uba spoke yesterday during his campaign at Ekwusigo and Nnewi North Local Government Areas of Anambra State.

    According to him, he organised the town hall meeting to tell the people to “close their doors against other contestants”. He added that he was ready and adequately prepared for the election irrespective of any opposition from any person or other political parties.

    The lawmaker representing Ekwusigo constituency in the House of Aseembly, Onyebuchi Offor, who accompanied Uba, told the people the 12 wards in Ekwusigo and 10 wards in Nnewi North.

    The duo appealed to the people to vote for their party and vice presidential candidate, Peter Obi.

    According to them, Obi did well in Anambra as governor and would transfer that to the Federal if elected. They described him as best for Igbo.

    A member of the Board of Trustees (BoT) of the Peoples Democratic Party (PDP), Chief Chris Uba, has warned his party against impunity or face more calamity.

    Uba, who expressed anger yesterday while addressing reporters in Awka, the state capital, on the outcome of Saturday’s election, said PDP failed at the poll because former Governor Peter Obi imported a foreigner and made him the party’s candidate.

    He recalled that the last time PDP won an election in Anambra was in 2003, when he made Dr Chris Ngige the governor.

    The Anambra political “godfather” said his heart bled because his efforts in the PDP had gone to the drains.

    Uba said the party, which was dreaded in Anambra, came a distant third in Satrurday’s governorship election because it failed to do the right thing.

    According to him, what has happened to the PDP and its members is painful.

    The PDP chieftain said the outcome of the poll was a warning to the party on the forthcoming national convention on December 9.

    He said Obi, who anointed Oseloka Obaze as PDP’s candidate, never won election in the state on his own without him (Uba).

    Uba said people like Rev Ejike Mbaka and Most Rev Maxwell Anikwenwa could attest to his claim.

    The politician said it was former President Goodluck Jonathan who brought Obi into the PDP, adding that the earlier the party stopped impunity, the better for it.

    He said Obi had no capacity to make anyone governor in Anambra without people like him supporting the candidate.

    Uba urged the former governor to apologise in five newspapers or he (Uba) would do the needful.

    The PDP chieftain said the party had eight members in the National Assembly but only one followed Obi.

    Little is being heard of erstwhile Peoples Democratic Party (PDP) strongman, Chris Uba, these days. Since the ruling All Progressives Congress (APC) booted out the PDP in the battle for the presidency last year, Uba has remained politically wounded. Just like his party has lost a lot of blood and is in need of serious blood transfusion to revive its ailing fortunes, Uba’s political fortune is on the verge of asphyxiation.

    But unlike some of his political companions who have taken to wailing in the public space like over-pampered kids whose ice creams were taken away, Chris Uba has maintained relative silence.

    The controversy generated by last Friday’s judgement of the Supreme Court recognizing the Ejike Oguebego faction of the Peoples Democratic Party in Anambra State and sacking Senators Andy Uba and Stella Oduah from the senate is taking a new dimension as Chris Uba has asked his brother and others to stop deceiving Nigerians and vacate their seats in the National Assembly honorably.

    Chris Uba also declared himself as the Senator representing Anambra South in the Senate, pointing out that he will be leading other beneficiaries of the judgement to INEC on Monday to demand their certificate of return.

    Uba who was the candidate of the PDP for the election was replaced by his elder brother following a decision by the Court of Appeal which set aside the decision of the lower court.

    Speaking with newsmen in Abuja, Chief Uba warned his brother, Senator Andy Uba, Ms. Stella Oduah and others to stop parading themselves as representatives of the people of Anambra state in the National Assembly.

    He said that last Friday’s judgment by the Supreme Court which affirmed an earlier High Court verdict recognising the Oguebego executive as the state’s authentic leadership, advised the affected ‘former’ senators and House Representatives members to accept their fate and honourably step down.

    He said he would be leading other members of the party who emerged as candidates under the Oguebego monitored primaries to the office of the Independent National Electoral Commission on Monday to demand for their certificates of return.

    Andy Uba and Oduah had faulted the assumptions that the Supreme Court judgment effectively removed them from office, arguing that they were not party in the suit which basically had to deal with issues of leadership crisis in Anambra PDP.

    Chris, who described himself as “Senator representing Anambra South” said he was shocked that those who should be conversant with the laws of the land could be deceiving the public regarding their true status after the Supreme Court failed to recognise the dubious way through which they got to the Senate.

    He said: “The time for substitution had passed and we were busy doing our campaigns when, one week to the election, the Andy Uba faction went to the Court of Appeal and set aside the judgement of the High Court.

    “Based on that, they took the judgement to INEC and their names were used to substitute our own. We cried foul then, insisting we were not party to the suit but INEC insisted that our names were initially published based on an earlier court order and that we should go on appeal.

    “We appealed to the Supreme Court and the verdict on Friday clearly vindicated our position as the Supreme Court set aside that judgement of the Court of Appeal, agreed with the judgement of the High Court and even granted all our five prayers.

    “Now, they (Chris Uba and Oduah) went on air and issued press statements to deceive the public that the order from the Supreme Court did not affect them because they were not a party to the suit. The question is: when our names were removed by INEC and replaced with theirs, were we party to the suit?

    “Now they are shouting and trying to misinterpret a clear judgment that has removed them and given us victory. They are just deceiving the public. We will demand for our certificates of return from INEC on Monday because the judgement is clear. We do not need to seek for any further clarifications.”

    Uba said further: “When the whole exercise wanted to start, INEC wrote a letter to the PDP headquarters to avoid confusion, telling the PDP that the Ejike Oguebego exco was the one that it would recognise based on court order of a Federal High Court in Abuja.

    “Unfortunately, the PDP ignored that letter and, instead, set up a two-man caretaker committee to come to Anambra State to conduct primaries. Of course, there was no room for that caretaker committee to operate in the state because the key to conducting the primaries is the 3-man delegates from the 326 wards in the state.

    “It was obvious that without the state exco, the caretaker committee cannot be functional because the people who are supposed to organise the state congress were expected to liaise with the state chairman. From there, they would set up a committee to go to all the wards where the delegates would emerge from for electing candidates into the National and state assemblies.

    “So when they set up this caretaker, the Ejike Oguebego exco went to court and got a judgement recognising it as the right exco therefore making null and void the caretaker committee.

    “The judgment also instructed INEC and the PDP to conduct all the electioneering exercise under the Ejike Oguebego exco including all the candidates who were participating. So, we obeyed the court order and did our primaries as instructed. The exercise was duly monitored by INEC and all the relevant papers were signed.”

    He said it would amount to injustice if the court had ruled in favour of the other group comprising Andy Uba, Stella Oduah and others who allegedly did not undergo any primaries nor visited Anambra.

    “They just sat in their houses in Abuja. INEC and the PDP got copies of the results of our primaries and even sent our names to INEC and that was why the list containing our names was published as candidates before they went through the backdoor to remove it,” he stated.

    The mood in Anambra state is that of joy and sadness Friday, following the Supreme Court judgment that removed senators Andy Uba, and Stella Oduah from the National Assembly.

    But the Chief Chris Uba camp who benefited from the judgment is bubbling with the members of the party pumping champagnes in the state in celebration.

    Members of the party in the state Friday, described the judgment as the handiwork of God, having suffered in PDP in the hands of those they described as cabals, being engineered by a member of the national body.

    Some of the roads including adjourning streets were blocked by the PDP faithful loyal to Chief Chris Uba’s camp Friday.

    The implication of the judgment, according to a Chieftain of the party, Chief Nnamdi Okoye, was that Ejike Oguebego would take over the leadership of the party as chairman in the state, while Chris Uba and his line up during the primaries would take over their seats at the National Assembly.

    Also, the five members in the Anambra state House of Assembly who were not in the lineup of Chris Uba would equally vacate their seats for former Assembly member, Hon. Rebecca Udorji and others.

    The members of the PDP especially those at the Oguebego lineup were seen in virtually all the joints Friday in Awka purchasing assorted drinks and foods to passers bye and friends.

    The chairman of the party in the state, Chief Ejike Oguebego, described the verdict as the will of God, while thanking members of the party for their patience all the while.

    Also, he commended the Supreme Court judges for painstakingly going through the Anambra PDP scenario before arriving at their verdict, adding that it showed that God would never abandon his people.

    But those in the camps of senators and Uba and Stella Oduah were speechless, as none of them agreed to speak to The Nation on the judgment.

    President Goodluck Jonathan’s bid for re-election received a boost at the weekend, when the leader of the Peoples Democratic Party (PDP) in Anambra State, Chief Chris Uba, took the party’s campaigns to Ogbaru, Onitsha North and South local governments.

    Uba is contesting the Anambra South senatorial seat with the candidate of the All Progressives Grand Alliance (APGA) and former Nigeria Communications Commission (NCC) Chief Executive, Ernest Ndukwe.

    Following his acceptance in his zone, he took the PDP campaigns to the local governments to introduce other candidates and woo voters for President Jonathan.

    Many people were surprised when the name of Chris Uba, the state’s political godfather, appeared on the list released by the Independent National Electoral Commission (INEC), instead of his elder brother’s, Senator Andy Uba.

    It was learnt that his name was listed, because of the primaries held; only the one by the Ejike Oguebego group was monitored by INEC. Chris Uba’s name was on the list.

    Oguebego is the chairman of the party according to a court declaration.

    At the Ogbaru and Onitsha centres, the senatorial candidate of the party in Anambra North and former Minister of Transport, Prince John Emeka, was presented to the people, who cheered him.

    Oguebego presented the candidate to represent Ogbaru Federal Constituency, Benny Obaze, to the people. He also presented Ifeyinwa Anazonwu, the candidate for Onitsha North and South Federal Constituency. PDP flags were given to them.

    Uba urged the people to obtain their permanent voter cards (PVCs).

    He said he was expecting 100 per cent votes for President Jonathan and other PDP candidates, adding that the party would not disappoint the electorate.

    The crisis rocking the Peoples Democratic Party (PDP) in Anambra State, over the factions to produce candidates for legislative elections, may have been resolved.

    The Independent National Electoral Commission (INEC) yesterday in Abuja published the names of candidates submitted by the Ejike Oguebego-led executive in deference to a judgment.

    Although INEC indicated in its website that the publication was informed by a court order, it listed Chief Chris Uba, Prince John Emeka and Senator Annie Okonkwo as candidates representing the three senatorial districts.

    Another faction had submitted the names of Uche Ekwunife, Princess Stella Odua and Senator Andy Uba as winners of the primaries.

    The Oguebego faction, led by Chris Uba, insisted that it remained the duly recognised faction, as its primaries were monitored by INEC’s officials. A judgment on the matter attested to that.

    To justify its position, the faction said it relied on a Certified True Copy (CTC) of INEC’s official report, which said the delegation was led by Chika Okafor, an assistant director in the commission, Adam A.Dan-Shuaibu, a principal admin officer and Joy Uba, a senior executive officer.

    The list also included the names of 13 House of Representatives and 33 House of Assembly candidates submitted by the Oguebego faction.

    TWO brothers,  Chief Chris Uba and Senator Andy Uba, are set to fight for the Anambra South seat.

    Andy, the eldest, who represents the district at the National Assembly, is facing a stiff battle from Chris.

    The brothers have pitched their tents with different camps of the state’s Peoples Democratic Party (PDP) after purchasing forms at the cost of N11 million each.

    The Nation gathered yesterday that Chris, regarded as the godfather of Anambra State politics, has vowed to stop Andy.

    Already, the youth, women, traders and businessmen are invading Chris’ residences in Enugu, Awka and Uga in Aguata Local Government Area to urge him on.

    It was learnt that they were angry that since Andy went to the Senate, he had not made any meaningful contribution in the chamber.

    They also alleged that he had done nothing for the people, except about two weeks ago, when he came with some vehicles and other equipment to empower a few people.

    One of their relations, who spoke yesterday under anonymity, said since both declared their interests “they have not been seeing eye-to-eye.”

    The source added: “Andy is our brother, likewise Chris. But the senator does not help anybody. Chris may have his deficiencies, but he carries everybody’s problem, fights for people and does not like suppression or oppression.

    “Everybody is happy that Chris has come out to contest this election. He had been crowning people in Anambra State and one of the beneficiaries is his elder brother, Andy.”

    Efforts by The Nation to speak with Senator Uba proved abortive as his phones were said to have been switched off.

    But Chris said it was true that he purchased PDP senatorial form. He, however, denied being at war with his brother.

    He said: “This is politics; everybody has his own interest. I think I have tried for so many people in this state. I want to go there and help the less-privileged in the seven local government areas in my zone.

    “I have vowed not to touch my salaries at the National Assembly for the next four years.

    “But my constituents will meet to decide the way they want to share it throughout my stay there. I want to go there to speak for the Ndigbo.”
