    Top among the issues of concern was the “growing global concerns about the national security implications of cryptocurrency transactions through cryptocurrency exchanges, including consumer and investor security”; the current state of regulations. Are these adequate or is it, as some fear it to be – a case of the operators cart-dragging the regulatory horse? Or, better still, have the crypto exchanges been allowed to usurp the functions of the financial services sector regulator?

    Alluding to the United States of America Treasury 2022 National Money Laundering Risk Assessment report which indicated that “fiat and traditional financial activities contributed substantially higher (over 200 per cent) than digital assets transactions to global money laundering activities”, the concern by the members is that the widespread infractions currently experienced here “do not appear to arise in developed climes where appropriate statutes and regulations have been enacted and enforced to superintend crypto and other digital asset transactions.”

    The probe is also expected to beam its searchlights on the activities of international money transfer operators, payment gateways and platforms and cloud computing systems. So is the status of the e-Naira on the global cryptocurrency platform, the cost incurred, processes undertaken, and statutory compliance in creating the digital currency.

    In all, the House seeks to engage all relevant stakeholders “to initiate necessary processes for establishing required legislation and regulations, while establishing the profile of operators in the sector such as legal status, parent company, and assess their compliance with our existing statutes or complicity in infractions against Nigeria, including money laundering, illicit transactions, currency speculation and bad practices.”

    With the lifting of the restriction on cryptocurrency by the Central Bank of Nigeria (CBN), the Chief Executive Officer of Arvofinance, Ayotunde Bally has said the move will bolster economic growth.

    The fintech company boss declared this yesterday in Lagos.

    “I’m relieved to see the lifting of the cryptocurrency trading ban by CBN. This reversal aligns with my belief that embracing such technologies can benefit Nigerians.

    “The new policy has the potential to provide economic growth, offering citizens more financial opportunities,” Bally stated.

    To guarantee sustainability and investor confidence, he stressed the need for strong regulatory frameworks even as he acknowledged the significance of responsible and well-regulated implementation.

    The CBN had directed all banks to desist from transacting in and with entities dealing in cryptocurrency. It also directed banks to close accounts of persons or entities involved in cryptocurrency transactions within their systems.

    This directive was contained, in a circular dated February 5, 2021, signed by the Directors, Banking Supervision and Payments System Management, Bello Hassan and Musa Jimoh respectively, and communicated to deposit money banks (DMBs), Non-bank financial institutions (NBFIs), and other financial institutions (OFIs).

    “Further to earlier regulatory directives on the subject, the Bank hereby wishes to remind regulated institutions that dealing in cryptocurrencies or facilitating payments for cryptocurrency exchanges is prohibited. Accordingly, all DMBs, NBFIs and OFIs are directed to identify persons and/or entities transacting in or operating cryptocurrency exchanges within their systems and ensure that such accounts are closed immediately”, the circular stated.

    Due to the risks and weaknesses associated with money laundering and terrorist financing (ML/TF), as well as the lack of laws and consumer protection safeguards, the restriction was imposed.

    In May 2023, Nigeria’s Securities and Exchange Commission (SEC) subsequently, released regulations pertaining to digital assets, indicating that the continent’s most populous nation was attempting to strike a compromise between a complete prohibition on crypto assets and their uncontrolled usage.

    However, the CBN in another circular dated December 22, 2023, with reference number FPR/DIR/PUB/CIR/002/003 and signed by its Director, Financial Policy and Regulation Department, Haruna Mustafa lifted ban on crypto currency transactions in the country.

    The apex bank in the circular titled ‘Circular to all Banks and other Financial Institutions Guidelines on Operations of Bank Accounts for Virtual Assets Service Providers (VASPS)”, instructed commercial banks to jettison its previous instruction on crypto transactions.
