  • A senator’s many troubles

    TO the uninitiated, Senator Dino Melaye’s many troubles may be intriguing. To those who know him, the Kogi West senator is not new to trouble. It may even be right to say Melaye courts trouble. The author of One Day One Trouble may have characters like Dino Melaye in mind. Melaye’s many troubles push him on the spot light, more often than not, for the wrong reasons.

    Melaye’s days in the House of Representatives were turbulent. That he was a thorn in the flesh of the leadership of the House was not in doubt. His posturing in the lower chamber earned him indefinite suspension when he led few others to accuse the Dimeji Bankole-led House of misappropriation and abuse of due process. Melaye was only saved from the blazing hammer of the House by the court.

    Melaye’s swagger perhaps is not anything better now that he is in the Senate. The only difference this time around is that he appears to be in the good book of the Senate leadership. He is tagged the ‘political son’ of the Senate President, Dr. Bukola Saraki.

    In the Senate, Melaye has, no doubt, stepped on toes, some of them big. He moved the motion that led to the suspension of Senator Mohammed Ali Ndume. He was linked to the removal of Senator Abdullahi Adamu as chairman, Northern Senators Forum. He raised the motion that culminated in the resolution to refer Senator Ovie Omo-Agege to the Committee on Ethics, Privileges and Public Petitions for investigation. The Delta central lawmaker apparently sensing danger repudiated his submission of the controversial election sequence crisis.

    The list is endless. Of all his troubles, however, Melaye appears to have met his match in his state governor, Yahaya Bello. He is battling to frustrate a recall notice hanging over his neck. Aggrieved members of Kogi West accused him of poor representation. He, however, saw the hands of Bello in the attempt to recall him from the upper chamber.

    He is crying blue murder and has vowed to fight on to the end. The Court of Appeal where he ran to seek protection ruled that the recall process was in order. The court gave its nod for the process to continue unhindered. On the basis of the court ruling, the Independent National Electoral Commission (INEC) on Wednesday set aside April 28 for the recall process of Melaye to commence. Kogi State Resident Electoral Commissioner, Professor James Apam, told stakeholders in Lokoja, the state capital, that the commission’s position to commence that recall process is based on the Court of Appeal ruling. Apam described INEC as a law-abiding body that will adhere strictly to the pronouncement of the Court of Appeal, which ordered the commission to restart the recall process.

    Apam said the recall process will start with the verification of signatures of the electorate on the recall register. At least 51 per cent of the signatures must be fully verified, he said. A referendum of the electorate will be conducted on May 5, which will depend on the success of the verification exercise being able to verify at least 51 per cent of the signatures. He added: “We will invite all those that signed the recall register to come forward to identify their signatures. If this process is successful, the commission will proceed to the next stage where a referendum of all registered voters will be conducted. “Here, voters will be asked to vote either yes or no to the question of whether they want Sen. Dino Melaye recalled. If they are able to meet the constitutional requirement of 51 per cent yes, the process moves to the next stage, but if it fails, the process stops.” Melaye has taken the matter to the Supreme Court for further adjudication. He was also arraigned before a Federal Capital Territory in Abuja High Court for alleged misinformation. The Kogi West senator was slammed a two-count charge of giving false information to the police about an assassination attempt on his life in April 2017. He pleaded not guilty to the charges. The office of the Attorney General of the Federation filed the charges, marked CR/106/18 on January 31, 2018. Melaye was accused of falsely incriminating the Chief of Staff to Governor Yahaya Bello of Kogi State, Mr. Edward Onoja David, in the alleged assassination attempt.

    The offences were said to be punishable under sections 140 and 393 of the Penal Code Law, Cap. 89, Laws of Northern Nigeria, 1963. He was granted bail after a plea application filed by his lawyer, Mr. Rickey Tarfa (SAN). The bail application was opposed by Mr. Shuaibu Labaran, the prosecuting counsel. The judge, Justice Olasunbo Goodluck, dismissed the opposition which she ruled was based on inadmissible affidavit evidence.

    She granted bail to the defendant in the sum of N100,000 with one surety who must be a federal civil servant of at least Grade Level 14 in any federal parastatal or establishment. The surety must also provide proof to be a resident of the Federal Capital Territory. Only last week, the Kogi State Police Command dragged Melaye before a Federal High Court, Lokoja, to answer charges of criminal conspiracy and unlawful possession of prohibited firearms. Public Relations Officer, Force Headquarters, ACP Jimoh Moshood, told reporters while parading two alleged political thugs, Kabiru Saidu, also known as Osama and Nuhu Salisu also known as Small, in Lokoja, that Melaye was allegedly linked to the activities of the thugs.

    Moshood said the two suspects were apprehended by the police at Agojueju in Dekina local government area of the state, after engaging the men of the command and team of the Federal Special Anti-Robbery Squad in a gun duel for several hours.

    The police spokesman said the suspects upon investigation confessed that they have caused mayhem, disruption of peace, destruction of lives and property as well as belonging to a dreaded and vicious kidnap gang terrorizing the state. Moshood said the gang leader, Kabiru Saidu, claimed that Senator Melaye handed over a bag to him containing one AK 47 rifle, two Pump Action rifles and the sum of N430, 000, to start training others preparatory to the 2019 elections. He said consequent upon the criminal confession against Melaye by Kabiru Saidu, the police wrote the senate president informing and requesting him to release Senator Melaye to report at the office of the commissioner, Kogi State Command, to answer the allegation levelled against him.

    Moshood said that following the deliberate refusal by Melaye to honour the police invitation, a case of criminal conspiracy and unlawful possession of prohibited firearms had been filed at the Federal High Court, Lokoja, on the 16th of March. Melaye has since dismissed the allegations as unfounded and a calculated attempt by the police to malign him.

    He accused the police of playing out the script of the Kogi State Government to frame him up and to discredit him. He insisted that the development was an attempt to shut him up, especially since he has never seen or met the suspects in his entire life. The fabricated lies by Kogi State Government and the police against me will fail. It’s utterly laughable and preposterous. It’s a sign of desperation”, the embattled Senator had tweeted, adding: “No amount of lies and blackmail will detract my attention from speaking the truth and defending it”.

  • Melaye recall: INEC releases time-table

     

    The Independent National Electoral Commission INEC, on Wednesday announced time-table for commencement of the recall process of the member representing Kogi West at the National Assembly, Senator Dino Melaye.

    The Resident Electoral Commissioner in Kogi State, Prof. James Apam stated in Lokoja, that following the appeal court ruling that INEC can commence the recall process, the commission has fixed the last Saturday of April, 2018 as the verification date.

    It fixed the first Saturday of May 2018, for the referendum to be conducted in line with the electoral laws.

    Apam who spoke during a stakeholders forum in the state capital, said the process begins with thr invite all the electorate that signed the recall register to come forward and identify their signature”.

    According to him, if the process is successful, the commission will proceed to the next stage where a referendum of all registered voters would be conducted.

    He continued: “Here, voters will be asked to vote either Yes or No, to the question of whether they want Senator Dino Melaye recalled.

    “If the answer is able to meet the constitutional requirements of 51 percent Yes, the process moves to the next stage, but if it fails, the process stops”.

    The Court of Appeal sitting in Abuja, had last week ruled against Melaye’s suit challenging the move to recall him.

    “As a law abiding people, INEC will not do anything outside the dictate of the law. That is why we have to wait till after the judgement before going ahead with the process”, Apam said.

    On the continuous voters registration, he said that 210,000 Permanent Voters Cards were ready for collection, and employed the owners to collect them.

    Following the withdrawal of policemen attached to politicians and other VIPS by the Inspector-General of Police, Ibrahim Idris, the senator representing Kogi West in the upper legislative chamber, Dino Melaye, on Monday evening condemned the order, claiming he was the target of the IGP’s directive.

    He said on his twitter handle “withdrawal of police from VIP, I am the target. IGP wants to expose me so I can be killed. Having survived assassination attempt twice, I deserve police protection in a country where I’m a tax payer.

    Senate urges President Buhari to rescind decision

    The Senate on Wednesday urged President Muhammadu Buhari to review his position in withholding assent on the bill to establish Peace Corps of Nigeria.

    This followed the adoption of a Point of Order raised by Sen. Dino Melaye during plenary.

    Relying on the Senate rules, Melaye urged the Senate to revisit the bill with a view to veto the president if he failed to rescind his rejection of the bill.

    President Buhari had cited duplication of duty and funding challenges in declining assent to the Nigerian Peace Corps (Establishment) Bill, 2017 recently passed by the National Assembly.

    However, Melaye said that the bill should be given priority by Buhari.

    “The same thing happened when the Nigeria Security and Civil Defence Corps ( NSCDC ) was to be established; there was also the same complaint that there was no money and all of that.

    “But today we can see the advantages of the civil defence and how they have helped in safeguarding the government infrastructure.

    “About 5.5 billion dollars was borrowed from euro bond; what part of it will the youths of this country benefit from.

    “About one billion dollars is to be spent on security and how does this affect the youth of this country.

    “Without fear or favour, the Peoples Democratic Party ( PDP ), in 16 years, borrowed N6 trillion and this government in three years, has borrowed N11 trillion but there is no specific programme that will empower the youth.

    “Also, N500 billion was earmarked for the social investment programme of the Federal Government but we have not seen any impact.

    “If the Peace Corps is given an opportunity to exist, thousands will be employed and this will help to fight unemployment in this country.

    “We may need to write Mr president to review his position if not we have the power on behalf of the Nigerian youths who voted us to veto him so that people will become the ultimate beneficiaries of this bill.

    “The youth of this country must be given priority and they must be respected,’’ Melaye said.

    Fed Govt arraigns Melaye on false information over assassination

    The Federal Government yesterday arraigned the senator representing Kogi West, Dino Melaye, before the High Court of the Federal Capital Territory, Maitama, Abuja over false information about an attempt on his life to the police in April 15, 2017.

    About 11 senators stormed the court to show solidarity with the Melaye, who is a member of All Progressives Congress (APC).

    Among the senators that appeared in court was Andy Uba, Ben Bruce, Phillip Aduda and many others.

    Melaye also stormed the court with a retinue of protesters welding placards with  inscriptions “I stand with Dino, if you speak the truth you die’’.

    The senator was accused of falsely accusing the Chief of Staff to Kogi State Governor Yahaya Bello, Mr. Edward Onoja David, in the said assassinations attempt.

    In the first count, the senator was accused of deliberately giving false information to the police to frame Governor Bello’s chief of staff as the mastermind of the assassination attempt on him at his home town in Ayeroro-Gbede in Kogi State last year April.

    According to the charges signed by Mr. Magaji Shaibu Labaran, the police discovered the alleged falsehood in Melaye’s claim while investigating the assassination claim.

    In the second count charge, Melaye was accused of making false statement of fact in a telephone conversation with Mr. Muhammed Abubakar, son of the late former Kogi State Governor with the intention of harming Onoja.

    After Melaye pleaded not guilty, his lawyer Mr. Ricky Tarfa (SAN) urged the court to grant the defendant bail on self-recognisance pending hearing of the matter.

    But the bail application was opposed by the prosecution counsel.

    He said if the defendant is granted bail, he was likely to use his position as a senator to intimidate potential witnesses.

    After dismissing the prosecutor’s opposition, Justice Olasumbo Goodluck granted the defendant bail in the sum of N100, 000 with one surety.

    However, the judge ruled that the surety to be provided by the senator must be civil servant of at Least Grade Level 14 in any Federal parastatal

    The surety must also provide proof of resident of the Federal Capital Territory.

    Justice Olasumbo adjourned the matter till May 16 and 17 for hearing.

    Kogi West Senator, Dino Melaye was Thursday arraigned before the High Court of the Federal Capital Territory in Abuja on two counts of giving false information about an assassination attempt on his life to the Police in April 2017.

    Melaye, who was arraigned by the Federal government was later granted bail with N100,000.

    Melaye was accused of falsely incriminating the Chief of Staff to Governor Yahaya Bello of Kogi State, Mr. Edward Onoja David, in the said assassination attempt.

    The Senate on Tuesday mandated its committee on Public Accounts to carry out a holistic investigation into the activities of the operation of a N34.423 billion account belong jointly to the Nigeria National Petroleum Corporation (NNPC) and Agip Oil company.

    This followed the adoption of a motion on “Urgent need to investigate NNPC, Nigerian Agip Oil Company 1PP Security” sponsored by Senator Dino Melaye (Kogi West).

    Melaye in his lead debate prayed the Senate to notes with serious concern the operation of an account by the NNPC/Agip Oil Company;

    He observed that the account opened with the name NNPC/ Nigerian Agip oil Company IPP Security account with address NNPC Garki, Herbert Macaulay Way, is domiciled in First Bank Nigeria Plc with account number 2006367288

    He also observed that the opening balance was N31, 704, 807, 979.2 with a closing balance of N34, 423, 738, 086.4 as at 25th April, 2017.

    Melaye said that he is aware that there has been lodgment and withdrawals since January, 2017.

    He said that a lot of questions are begging for answers as regards this account a. The objectives of the account? b. The Signatories to the Account? c. Is the account known to the Federal Government? d. What are the sources of the account’s fund?

    The lawmaker said that he is convinced that there is an urgent need to investigate the rationale behind the operation of this account in the interest of the country

    The motion was not debated before it was referred to the public accounts committee to investigate.

    Senate to probe N3.4b NNPC / Agip security account

    The Senate on Tuesday mandated its Committee on Public Accounts to investigate the rationale behind a security account allegedly operated by the Nigeria National Petroleum Corporation ( NNPC ) and Nigerian Agip Oil Company.

    This followed the adoption of a motion moved by Sen. Dino Melaye (Kogi-APC).

    Moving the motion, Melaye said there was the need for the Senate to unravel the objective of the account and source of its funding.

    He alleged that the account opened with the name NNPC/AGIP Oil Company IPP Security Account with address NNPC Garki, Harbert Macauley way is domiciled in First Bank Nigeria Plc with account number 2006367288.

    Melaye allaged that the account had an opening balance of N31.7 billion and a closing balance of N34. 5 billion as at April 25, 2017, adding that there were lodgments and withdrawals since January 2017.

    “A lot of questions are begging for answers as regards this account.

    “While we need to know the objectives of this account, we also need to know the signatories to the account ; is the account known to the Federal Government and what are the sources of the account’s funding.

    “About N2 trillion is kept in various accounts of government, we are operating a Treasury Single Account yet money is kept in various personal accounts.

    “If these monies are properly remitted to government purse, we will have no business borrowing.

    “This Senate will continue to expose any corrupt practice in the country because it is time to protect the future of Nigerians unborn,” Melaye said.

    The Committee has four weeks within which to carry out its investigation.

    Senate to probe low JAMB remittance before 2016

    The Senate, on Wednesday, resolved to investigate the low remittance by the Joint Admissions and Matriculation Board ( JAMB ) into the federation account before 2016.

    The resolution was sequel to the adoption of a motion under matter of urgent public importance, moved by Sen. Dino Melaye.

    Moving the motion, Melaye said that JAMB before 2016 paid into the federation account a meagre N50 million as revenue generated from the University and Tertiary Matriculation Examinations (UTME).

    He said the revenue increased to five billion naira in 2016 and N7.8 billion in 2017.

    The senator, however, expressed concern why the revenue remitted by JAMB in the past had been low.

    “Since JAMB can remit seven billion naira in one month, we must work on relevant agencies as the National Examination Council (NECO) and the West African Examination Council (WAEC) to generate more revenue.

    “There is the need for the Senate Committee to effectively carry out its oversight function with a view to finding out what went wrong in the past and block all the leakages in the agencies,’’ Melaye said.

    Also, the Senate Leader, Sen. Ahmed Lawan said, “something was amiss and we need to find out what happened in the past and why there was a sudden increase in remittances’’.

    In his remarks, the President of the Senate, Dr Bukola Saraki, directed the Senate Committee on Education to investigate the matter and educate the Senate on reasons for the increased remittances.

    Saraki stressed the need to know what action had been taken to get those people, who were there in the past to explain what happened,’’ Saraki said.

    Senate gets committee on Electoral Act

    Senate President, Bukola Saraki, on Thursday announced a six-man committee to reconcile the Senate’s version of the amended Electoral Act with the version passed by the House of Representatives.

    The Senate’s conference committee has the Chairman of the Senate Committee on the Independent National Electoral Commission (INEC), Senator Suleiman Nazif, as chairman.

    Other members of the committee are – Senators Shehu Sani, Biodun Olujimi, Hope Uzodinma, Dino Melaye and Peter Nwaoboshi.

    The committee is expected to meet with the House of Representatives to harmonise the version of the amended electoral bill before being sent to President Muhammadu Buhari for his assent.

    The Senate had in 2017 passed an amended version of the 2010 Electoral Act.

    While the House of Representatives had on Tuesday amended the Electoral Act to change the 2019 general elections time table.

    This came barely a month after the INEC released the time table for the general elections.

    With the amendment, the National Assembly election will take place first, followed by gubernatorial and state assembly polls.

    The presidential election will be conducted last.

    The amendment was made at the Committee of the whole House, presided over by the Deputy Speaker, Yussuff Lasun.
