  • Court dissolves 10-year marriage

An Igando Customary Court in Lagos yesterday dissolved the 10-year marriage between Mrs Florence Anyasi and her husband, Stanley, over infidelity.

The court president, Mr Akin Akinniyi, dissolved the union because all efforts to reconcile the couple had failed.

Akinniyi ruled: “Since both parties consented to the dissolution of their marriage, this court has no choice than to dissolve the marriage. The court hereby pronounces the marriage between Mrs Florence Anyasi and Mr Stanley Anyasi dissolved today.

“Both of you henceforth cease to be husband and wife, each of you should go on his or her separate ways unmolested. The court wishes both of you well in your new journey of life.

“The court grants the custody of the children, age 10, 8, 6 respectively to their mother, the petitioner, pending when they attain the age of 18 years to decide who to stay with.

“The respondent must be responsible for the children’s school fees, medical bills and must be paying N15,000 monthly for the children’s feeding which must be channelled through the court.”

The News Agency of Nigeria (NAN) reports that Stanley was taken to by his wife, who accused him of being a chronic womaniser.

The 36-year-old trader told the court that her husband used to sneak into their maid’s room to sleep with her.

“My husband is a womaniser, he used to leave me in the bed at night and sneak into my maid’s room. I have caught him severally on my maid’s bed sexually assaulting her. A neighbour approached me and told me to warn my husband to desist from asking her daughter to have love affairs with him.

“I once caught him sucking the breasts of my niece, who is a minor and he is also fond of wooing my friends,” she said, as she reeled out her grievances before the court.

The respondent denied the allegations. He accused his wife of adultery, claiming that her lover even bought her a car.

“In January, 2017 she came home with a car of N1 million; when I queried her where she got the car from, she claimed she bought it with her money. I strongly disagreed with her because she is only selling foodstuffs and can never afford that kind of car,” he said.

The 40-year-old businessman said his wife packed out of their matrimonial home in 2017 without his knowledge.

“I came home from work and discovered that my wife had packed all her belongings with the children to start living with her lover. I called her severally, she refused to pick but she eventually picked my call last January and informed me that our last baby she delivered in May 2017 was not mine that the child belongs to the man she is presently living with.”

The respondent urged the court to grant his wife’s request saying he was also no longer interested in the marriage.

An Ado-Ekiti Customary Court has dissolved a 26-year-old marriage between a bricklayer, James Kayode Oguntuase and his wife, Felicia.

Oguntuase (75) had dragged Felicia (53), a trader, to court accusing her of adultery, stealing, stubbornness and denying him sex, allegations which the respondent denied.

In his evidence before the court, the petitioner claimed that he had caught the respondent with three different men, adding that she had aborted three pregnancies for her lovers.

Oguntuase also alleged that Felicia stole his N35, 000 meant for the purchase of carpentry materials.

He revealed that he had dragged his wife to court sometime in 2013 on account of her alleged sexual escapades.

The union was blessed with six children, namely Caroline (25) who had been married, Peter (23), Akin (18), Ife (15), Rachel (12) and Tolulope (6).

The respondent urged the court not to dissolve the union, even as she denied allegations of adultery and stealing. She told the court that she denied the petitioner sex on grounds of ill-health.

In his judgment, Court President, Joseph Ogunsemi dissolved the union; saying the marriage had broken down irretrievably as the two parties failed to avail themselves of the opportunity given to them to settle the dispute amicably.

The court also awarded custody of the children who are below the age of 18 to the petitioner while Peter and Akin who are above 18 years are free to decide where to live on the grounds that they are adults.

The court also ordered the petitioner to arrange for an alternative accommodation for the respondent; the cost of which should not be more than N60, 000 and not less than N48, 000 per annum.

The Court’s President, Pa Adekunle Williams, ruled that the parties ceased to be husband and wife and free to go their separate ways.

The petitioner, Mrs Mariam Lawal, had sought the dissolution of her marriage over the long separation between them.

“We have been separated for seven years but whenever he sees me in public, he embarrasses me in the presence of my friends, especially the opposite sex. Despite the fact that he had married another woman, he doesn’t want to see me with another man. There was a time he assaulted a male friend and tore his clothes. He is very troublesome and I need freedom,” she said.

A Lagos Island Customary Court has granted the request of a 38-year-old woman, Mary Iyayi, by dissolving her two-year-old marriage to a pastor, Samuel Iyayi, over battery and infidelity.

The Court President, Chief Awos Awosola, dissolved the union and told the parties involved to maintain the peace ‘’anywhere they see each other.’’

“Starting from today, you ceased to be addressed as husband and wife, you must maintain the peace anywhere you see yourselves,” he said.

Awosola ordered that the petitioner, Mary, should return her dowry of N1000 to her 35-year-old ex-husband.

The News Agency of Nigeria (NAN) reports that right inside the court, Mary gave back her dowry to the pastor.

The petitioner approached the court on May 14, seeking the dissolution of her two-year-old marriage, citing battery and infidelity.

The petitioner told the court that her husband raped her and caused her to lose her two-month-old pregnancy.

The petitioner, Mary, a makeup artist, who lives at Oke-Olu Street, Iponri, Lagos, told the court that her husband was brutish.

“He held my hands to the wall, so I could not move, l told him that l was pregnant and that I was fragile. He did not listen and forcefully made love to me.

“After, I started bleeding and l lost the pregnancy. He told me later that he merely helped me to flush the pregnancy.

“I had three abortions for him during our courtship, I did that in order to save his ministry from crumbling.

“It was after l got married to him that l knew that he married me because of my money and not that he had true love for me.

“He once told me that he prefers a woman with big breast which l do not have,” she told the court.

Mary told the court that her husband used beat her at any slight provocation.

“He beat me, pushed me and l hit my tommy on the wall, l lost another pregnancy in the process,’’ she said.

She also told the court that before she left her husband house in June 2014, her husband had stopped sleeping in the same room with her.

“Due to the three abortions and two miscarriages l had, l was told at the hospital that my womb had been tampered with and that it will take the grace of God for me to be pregnant.

“Also, my husband threatened to kill me if l leave him because in their church, they cannot marry another wife if the former wife is not dead.

“I packed my belongings out of his house except for my wedding gown which he seized. I want my wedding gown back because he might use it against me.

“I am the only child of my parents, I do not want to die, I want the court to help me collect my wedding gown from him and dissolve the union,” she said.

She said she discovered her husband had mental sickness after she had her first baby.

“My husband is mentally sick, I have stayed with him for 20 years, thinking he would get well, he always exhibits his madness by destroying our household items and misbehaving.

“I discovered after I had my first baby but I decided to stay praying to God to cure him of the illness,” Abosede, a designer said.

She also accused her husband of always threatening her with acid and dangerous weapons.
