    Murder allegation: Court orders Kano govt to pay Doguwa N25m for damages

    A Federal High Court sitting in Abuja has found former House of Representatives Majority Leader Alhassan Ado Doguwa not guilty of alleged murder the Kano State government filed against him.

    In a certified true copy (CTC) of the judgment of the Federal High Court, dated December 5, 2023, the judge, Justice D. U. Okorowo, cleared Doguwa of the murder allegation.

    The court ordered the Kano state government to pay N25 million to Ado Doguwa as damages.

    Doguwa, who is the Chairman of the House Committee on Downstream Petroleum, is representing Doguwa/Tudun Wada Federal Constituency of Kano State.

    The ruling New Nigeria People’s Party (NNPP) government in Kano State had accused Ado Doguwa of murder.

    Former Majority Leader of House of Representatives, Hon. Alhassan Ado Doguwa has been declared innocent by a Federal High court sitting in Abuja over allegations of murder slammed on him by Kano state government.

    In a certified true copy of the judgement of the Federal High Court dated 5 December 2023, now released in suit No: FHC/ABJ/ABJ/CS/714/2019, the judge, D.U. Okorowo cleared Doguwa of the murder allegation.

    The Court also ordered Kano State Government to pay  N25 million to Ado Doguwa as damages.

    Doguwa, the Chairman, House  Committee on Downstream Petroleum, is representing Doguwa/Tudun Wada Federal Constituency in Kano state.

    The NNPP government has dragged him to court accusing him of murder.

    But the court declared that Doguwa was wrongly accused and awarded N25 million as damages against the  Kano State Government and the police.

    Doguwa was arrested by the police in Kano and arraigned in court over the murder case.

    He was later released on bail at the orders of another court, after which he applied for the review of police investigations that led to his sudden arrest, arraignment and detention.

    The immediate-past All Progressives Congress (APC) government in the state had dropped the police investigation and exonerated him.

    The alleged murder case was, however, reopened by the the New Nigeria Peoples Party (NNPP) administration in the state,  accusing Doguwa  of killing over 15 people, mostly NNPP members.

    Howver, Doguwa sued the Attorney-General of the Federation, Inspector-General of Police, the Governor of  Kano State, and the Attorney-General of  Kano State over alleged infringement of his rights to dignity, liberty, and freedom of movement.

    Justice Donatus Okorowo, in a judgment, also awarded a N25 million damages against Gov. Yusuf for causing psychological pain and damage to Doguwa.

    Justice Okorowo also gave “an order of perpetual injunction, restraining the respondents from further interfering with the fundamental rights of the applicant whatsoever.”

    Doguwa, who represents Doguwa/Tundun Wada Federal Constituency of Kano State, was, on February 28, arrested at the Mallam Aminu Kano International Airport, while boarding a flight to Abuja.

    The police had said they received a report that he led thugs to set ablaze the secretariat of the New Nigeria People’s Party (NNPP) in Kano.

    Two persons were said to have died in the incident.

    Although the legislator denied any wrongdoing, he was arraigned in March at a magistrate court in Kano and was later remanded in prison.

    He was granted bail in the sum of N500 million by a FHC, Kano after a few days in prison.

    However, the charges were withdrawn after the prosecution said it could not “find sufficient evidence to link Doguwa with the said offences.”

    But the lawmaker, through his lawyer, Afam Osigwe, SAN, filed a fresh suit marked: FHC/ABJ/CS/831/23, to seek for an order enforcing his fundamental rights before the Abuja court, following a hint about an attempt to re-arrest him.

    In the suit, the lawmaker, sued the Attorney-General of the Federation (AGF), the Inspector-General (I-G) of Police, the Executive Governor of Kano State and the A-G as 1st to 4th defendants respectively.

    Doguwa had sought the protection of the court against alleged plan by the state government to re-arrest and detain him in connection with the electoral violence that ensued during the presidential and national assembly elections leading to the death of some people in the state.

    Justice Okorowo had, on June 20, ordered the parties in the suit to maintain status quo pending the hearing and determination of the substantive matter. The order followed a motion ex-parte moved by Osigwe.

    But the governor and the A-G, in their counter affidavit argued by their lawyer, M. K. Umar, said that Doguwa was not being invited because of the violence that erupted during the Feb. 25 presidential and national assembly elections in Kano or on the firearm issue.

    Umar said contrary Osigwe’s argument, Doguwa was wanted in Kano to answer to the allegation of homicide preferred against him by the state government.

    The lawyer said there were emerging new facts which needed to be investigated and that the A-G had the power to review the case in the wake of the emerging facts.

    Former majority leader of the House of Representatives, Alhassan Ado Doguwa, on Monday won his case against the New Nigeria People’s Party candidate, Salisu Yushau Abdullahi.

    The court ruled that the Member Representing Doguwa/Tudunwada Federal Constituency, Doguwa, was legitimately elected.

    Delivering judgement on Monday in a petition filed by the NNPP House of Representatives candidate against the reelection of Doguwa, the leading judge, Justice L.B. Owolabi, said the petitioner failed to prove his petition within legal reasonable doubt.

    “The petitioner in whole has failed to make any case capable of truncating the election of Alhassan Ado Doguwa, and as such, he is hereby returned duly elected by a majority of votes,” the judge said.

    Justice Owolabi dismissed the applicant’s petition, saying all the three grounds relied upon by the petitioner of corrupt practises allegedly perpetrated by Alhassan Doguwa, non-compliance with electoral law, and failure to have the needed lawful votes to win the election are baseless and could not be accepted as reasons to cancel the election.

    On violence during elections, all the petitioner’s 21 witnesses testified that there was no violence during the elections, as against the testimony of the petitioner.

    The court, in a unanimous decision, therefore, agreed that all 32 witnesses brought about by the petitioner could not concurrently give enough evidence that would truncate the election.

    The presiding judge said while delivering judgement that he wondered how all the witnesses of the petitioner arrived at their various polling units at the same time and witnessed over-voting at all the units but could not recognise their results sheets. As such, he said their evidence could not stand.
