    Driver gets N2m bail for church member’s death

    A 25-year-old driver, Saheed Rabiu, was Wednesday granted stiff bail conditions for allegedly causing the death of one Abu Godwin with his pickup truck.

    Rabiu, of No.1 Milkatu Close, Agbado, Ogun State, was Wednesday arraigned by the police before Mr. B. A. Sonuga of a Lagos State Magistrates’ Court in Igbosere, on charges bordering on driving without particulars, reckless and inconsiderate driving and manslaughter.

    Prosecuting Inspector Kenneth Asibor told the court that the defendant committed the offences at about 10pm on January 18, along the Ajah-Epe Expressway, Abijo Town, Ibeju-Lekki.

    He alleged that Abu Godwin of Bloom Church Majeck in Abijo was killed when he was hit by a Toyota Dyna pickup truck driven carelessly and dangerously by the defendant, without vehicle documents.
    The pickup truck’s Registration No. was given as BDG718XG.

    He said that the alleged offences contravened and were punishable under Section 15 A82 No.4; Section 18(1) A84 No.4 and Section 20(1) A85 No.4 of the Lagos State Road Traffic Law, 2012.

    The defendant, pleaded not guilty to all four counts and his lawyer, Mr. Ikechukwu Anioma urged the court to grant him bail on liberal terms.

    Magistrate Sonuga admitted the defendant to bail in the sum of N2 million with two sureties in the like sum, who must provide evidence of tax payment for five years.

    One of the sureties must also be a blood relation with a verifiable address within the court’s jurisdiction.
    The matter was adjourned till February 16, for trial.

    Driver dies, motor boy injured in road crash

    Traffic stood still for hours around Lagos State Secretariat at Alausa, Ikeja, on Saturday when a waste disposal truck collided with a Mercedes Benz 4matic Sport Utility Vehicle (SUV) and a Land Rover.

    The truck driver died on the spot; the motor boy, popularly known as conductor, is lying critically ill at Lagos State University Teaching Hospital (LASUTH).

    He was said to have suffered leg fracture.

    It was gathered that the suction truck marked GGE691, which had just left the Alausa Police Barrack, veered to the other side of the road, following brake failure.

    It ran into the Benz marked FST161BZ and the Land Rover with registration number EKY93DV, which were heading towards the secretariat.

    The vehicles blocked the Secretariat-bound road, leading motorists to take one way to get out of the gridlock.

    Lagos State Traffic Management Authority (LASTMA) officials had a hectic time controlling traffic.

    They later diverted traffic through Governor’s Road to ease the congestion.

    Lagos State Emergency Management Agency (LASEMA) General Manager Michael Akindele yesterday said the motor boy was rushed to LASUTH after the accident.

    “The driver of the truck died on the spot, while the motor boy; an adult male had fracture of the leg. He was immediately taken to LASUTH by Lagos State Ambulance Service (LASAMBUS).

    “The drivers of the two other vehicles escaped unhurt. The situation was caused by brake failure. Drivers need to properly check their vehicles and adhere to safety regulations to prevent unnecessary loss of lives,” he said.

    Court remands driver for alleged rape of teenager

    A Gudu Upper Area Court in the Federal Capital Territory (FCT) on Thursday remanded a 44-year-old driver, Ayodele Obayelu, in prison for alleged rape of an 18-year-old girl.

    Obayelu, a resident of Durumi village, Abuja, was arraigned on a one-count charge of rape.

    The judge, Alhaji Umar Kagarko, remanded Obayelu in prison after he pleaded guilty to the charge of rape.

    Kagarko said Obayelu would be tried summarily because rape was a capital offence.

    He adjourned the case till March 8, for trial.

    The Prosecutor, Urom Out, had told the court that one Ruth Williams of Boloni Guest Inn, Area 8, Abuja, reported the matter at the Garki Police Station on Jan. 10.

    He said the complainant sent her house-help to Obayelu’s place and he took the girl to his house in pretence to buy some things for children and forcefully had carnal knowledge of her.

    “The girl screamed for help and nobody came to her rescue and when Obayelu was done, blood gushed out of girl’s private part.

    “He further threatened the girl not to tell anyone and asked her to wash her private part with water.”

    The prosecutor said the offence contravened Section 283 of the Penal Code.

    Two men, Okechukwu Achinulo, 27, and Ogbuefi Emmanuel, 60, were yesterday remanded by a Lagos State Magistrates’ Court in Igbosere for allegedly being in unlawful possession of firearms.

    Magistrate O. Kusanu ordered that Achinulo, a driver, and Emmanuel, a security consultant, be remanded pending legal advice from the office of Director of Public Prosecution (DPP).

    Achinulo and Emmanuel are facing a four-count charge of conspiracy, stealing, receiving stolen property and unlawful possession of prohibited firearms.

    Prosecuting police Sergeant Innocent Odugbo told the court that the defendants and others still at large, allegedly conspired to commit the offence in February, 2015.

    He claimed that Achinulo stole three Jojeff double-barrelled guns and seven Jojeff pump-action guns valued at N2million, all property of one Ezebunwa Donatus.

    The prosecutor also alleged that Emmanuel received five of the prohibited guns valued at N800,000 from Achinulo, without a licence.

    The defendants’ pleas were not taken. The case was adjourned till February 24.

    Driver, guard remanded for unlawful possession of guns

    Two men, Okechukwu Achinulo, 27, and Ogbuefi Emmanuel, 60, were Wednesday remanded by a Lagos State Magistrates’ Court in Igbosere for allegedly being ‎in unlawful possession of firearms.

    Magistrate O. Kusanu (Mrs.) ordered that Achinulo, a driver, and Emmanuel, a security consultant, be committed to custody pending legal advice from the office of the Lagos State Director of Public Prosecution (DPP).

    Achinulo, a resident of No. 1 Amudalabu Street, Ikotun Egbe and Emmanuel, of No. 15 Sarah Fagboyode Street, Asamu Estate, Ejigbo, are facing a four-count charge of conspiracy, stealing, receiving stolen property and unlawful possession of prohibited firearms preferred against them by the police.

    Prosecuting Sergeant Innocent Odugbo told the court that at about 10:15am sometime in February, 2015 in Ikotun, the defendants and others still at large, allegedly conspired to commit the offences.

    He claimed that Achinulo stole three Jojeff double-barreled guns and seven Jojeff pump-action guns valued at N2million, all property of one Ezebunwa Donatus.

    The prosecutor also alleged that Emmanuel ‎received five of the prohibited guns valued at N800,000 from Achinulo, without a license from the Inspector-General of Police.

    He added that the offences are punishable under Sections 409, 285, 326 and 28 (b) (1) of the Firearms Act Cap 146 Laws of the Federation of Nigeria 2004.

    The defendants’ pleas were, however, not taken and the case was adjourned till February 24.

    The Jigawa Command of the Federal Road Safety Commission (FRSC) on Monday said six students and a driver died in an auto crash involving a Toyota bus with Reg. No. 41A 05 YB on Gaya-Kano road.

    Mr Zayyanu Ibrahim, the Public Relations Officer of the command, told newsmen in Dutse that the accident occurred at about 12: 55 p.m. on Sunday.

    Ibrahim said the accident happened when the driver of the bus lost control at Zangon Buji village in Dutse Local Government Area.

    He said that the bus was conveying Exchange students of Unity Schools from Damaturu, Yobe, to Abuja.

    The said four of the victims died on the spot, while the rest died on Monday at the Rasheed Shekoni Specialists Hospital, Dutse.

    According to the public relations officer, 16 others who sustained various degree of injury were receiving treatment at the Dutse General Hospital and the Rasheed Shekoni Specialists Hospital.

    He advised motorists to desist from speeding under whatever circumstances.

    A middle-aged commercial bus driver has been hacked to death in a riot between tipper drivers and members of the National Union of Road Transport Workers (NURTW) in Oyo State.

    It was gathered that the NURTW members were protesting the death of one of their colleagues.

    The riot started on Sunday night at a party in Omi Adio motor park and continued till Monday night.

    Over 10 vehicles travelling on the Ibadan-Abeokuta Expressway were damaged.

    Sources said the riot was the aftermath of an accident involving a truck in which three persons, including a bus driver and a baby, died two weeks ago.

    It was gathered that the truck driver was sighted at the Sunday party and was challenged by some NURTW members.

    In the ensuing fight, one of  the bus drivers was killed.

    Some youths and thugs  joined in the fracas, wielding weapons, such as iron rods, cutlasses, clubs and knives.

    Men of the state security outfit Operation Burst and a team of anti-riot policemen from Iyaganku Police Station were drafted to the scene of the violence.

    Women from the popular Omi Market ran away.

    The Balogun of Omi, Chief Mukaila Adebayo (alias Mokas), called on the commissioner of Police to ensure there was peace in the town.

    Police spokesman Adekunle Ajisebutu described the incident as a minor accident between a tipper driver and a commercial motorcycle operator, whose motorcycle was crushed by the tipper driver.

    “As a result, there were skirmishes but the matter was later resolved amicably on Monday. There was no death,” he said.

    Tragedy struck penultimate Friday in Ado Ekiti, the Ekiti State capital after a tipper driver, Azeez Ismaila, beat his wife, Odunayo, to death.

    The incident occurred at the residence of the couple at Oke Ureje area along Polytechnic Road, Ado Ekiti.

    The couple hails from Ado Ekiti.

    It was learnt that Ismaila attempted to secretly bury the body of his 27-year-old wife in the night in an attempt to cover up his track.

    The Nation gathered that the suspect who was said to be in his 30s was arrested by men of the Odo -Ado Police Division.

    The deceased had three children for her husband and her last born is said to be six- month- old.

    The suspect was alleged to have subjected his late wife to constant beating for giving him only female children

    He was said have descended on the deceased a few hours after having his dinner.

    Odunayo was said to have prepared pounded yam for her husband and rice for herself before the family went to bed.

    She was said to have lost the money Ismaila gave to her to prepare food for the household after which she went back to collect another sum.

    Neighbours of the couple, who were said to be used to hearing the screams of the deceased anytime her husband beats her up, said they heard her screamed few minutes to midnight.

    Ismaila was said to have brought Odunayo’s corpse to his father’s house at Oke Bola area of Ado Ekiti where he allegedly dug a grave to bury her without the knowledge of her family.

    Father of the deceased, Ojo Ajewole, who spoke with The Nation at his residence in Ado Ekiti said Ismaila’s attempt to secretly bury his wife shocked him and other members of the family.

    He explained that his daughter was never sick adding that she reportedly foamed from her mouth while blood gushed out of her ears.

    Ajewole said: “We insisted that her body should be taken to the mortuary, when we got wind that he wanted to secretly bury her corpse. He claimed that she took ill but I queried why I was never informed when she was laid up as they want me to believe. Nobody will believe his story because of the scars on my daughter’s body.

    “We want justice and the Police must get to the root of this matter, there should be no cover up at all”.

    The accused was charged to an Ado Magistrate’s Court on Wednesday for murder.

    The presiding magistrate, Idowu Aiyenimo, however ordered the accused be remanded in prison custody pending legal advice from the office of the Directorate of Public Prosecutions.

    Emure-Ile community near Owo, Ondo State, was in sad mood last Saturday as the remains of Chief Samuel Ojo Adewale, an illustrious son of the community and erstwhile Chief Technologist of Obafemi Awolowo University (OAU), Ile-Ife, Osun State, were interred amid tears.

    Adewale was knocked down by a 33,000-litre tanker trailer believe to  belong to major oil marketing company, Total, a few weeks to his 70th birthday. The said trailer was said to have been driven by a motor boy who was learning driving at the time the accident occurred.

    Until his death, the late Adewale was said to have worked as a special marshal with the Osun Sector Command of the Federal Road Safety Corps. More than 500 marshals of the FRSC and scores of Adewale’s former colleagues at OAU, where he retired in 2007 after serving in the Department of Physiology and Pharmacology for 29 years, were among the numerous sympathisers that thronged Our Saviour’s Anglican Church, Emure-Ile, to pay the deceased Baba Ijo of the church their last respects.

    Eyewitness account

    Ironically, his death was said to have resulted from reckless use of the highway, a phenomenon he had campaigned vigorously against as a special marshal. On June 3, a tanker with registration number FFA 678 XA, bearing the logo of TOTAL and loaded with 33,000 litres of petrol, was said to have veered off its lane at Ipetu-Ijesa, a border town between Ondo and Osun States, crushing Adewale to death. Parts of his body were said to have been spilled on the road at the section where Owena Market is located.

    The deceased’s widow, Mrs. Olumide Adewale, said she was returning with her husband from his Emure-Ile home town to their base in Ile- Ife when the accident occurred.

    She said: “There were only two of us in the Volvo car with registration number FFE 40 AA. We were coming from Emure-Ile, Owo, where we had gone to celebrate the Ero (age grade) Festival, which he had been taking part in since 2007.

    “It was on June 3. When we got to Owena Market, he packed completely off the road to buy some yams for the people at home. I even told him that the yam would be expensive because they were usually brought in from Abuja, but he went while I remained in the car.

    “As he came back and opened the car door, the truck veered from the other side of the road and knocked him down. It ran over him and dragged him along until it ran into a container shop that also fell on the vehicle I was seated in. By the time sympathisers managed to drag me out of the car, my clothes were torn, my ribs were broken and my legs were fractured. The Volvo car was also badly damaged.

    “I could not stand up, but I managed to call the Road Safety. Some oncoming vehicles were also affected. I was later told that some other people also died.

    “The young boy who drove the vehicle was said to be learning driving with the actual driver of the trailer seated beside him. I later managed to call my brother-in-law and my son and his wife who are medical doctors.

    “The FRSC officials came and I was rushed to the Casualty Ward of  the Wesley Hospital and later to the Obafemi Awolowo University Teaching Hospital, Ile-Ife where I was admitted for three weeks.

    “When I sighted my husband’s corpse after three weeks, I broke into tears. All his internal organs were packed in a bowl, whereas they had earlier told me that he was receiving treatment in another ward of the hospital where I was admitted, but I could not go to see him because I could not walk.

    “The trailer is still at Ipetu-Ijesa Police Station.”

    Asked what the last words of his husband were, she said: “I saw him being pressed down by the front tyre of the trailer and he was shouting, ‘Oh my God! Oh my God!’  Those were his last words. I believe that was when his stomach burst. You needed to see the ugly sight.”

    She recalled that she too could have been killed if she had entered the market with her deceased husband. “I had actually loosened my seat belt and was about to come down, but he said I should wait. If I had gone with him, the trailer could have killed the two of us,” she said.

    The late Adewale’s son and OAU lecturer, Ayodele, recalled that he was in the lecture room with his Electrical Engineering students on June 3 when he got a phone call from one Mrs. Ojo that his parents were involved in an accident.

    “The woman works at OAUTH (Obafemi Awolowo University Teaching Hospita) Ile-Ife. Of course, I knew that my parents would be coming to Ife after they had travelled home. I drove down to Ilesha and asked what went wrong,

    “When I got to Wesley Hospital about 20 minutes later, some Road Safety corps members came and I saw my mum seated in the back of their vehicle and was being taken to the emergency hall.

    “Unfortunately, I saw them going to the morgue again and I suspected that my father had died. I followed them and later went to my mum to help them stabilise her and then took her to Ile-Ife for better treatment.

    “The following morning, my medical doctor brother and I drove to Ipetu-Ijesa to see what had happened and also retrieve my parents’ personal effects. It was here that one of the people, who witnessed the scene and took photographs with their cell phones, showed me how the front tyre of the tanker trailer rested on my father’s waist.

    “I asked my younger brother to take the pictures of the scene. After an hour, I saw a towing van going to the front of the TOTAL truck with 33,0000 litres of premium motor spirit (PMS) and was about to tow the vehicle. I resisted and an argument followed.

    “I started calling my brothers who are medical doctors and our lawyer. I now waited to see the driver of the truck to give an explanation, but a young man came and said that the vehicle belonged to TOTAL and they would like to empty its contents because they would be losing money. I was furious.

    “When they saw that we were upset, they went to the police station to tell the police to come and plead with us. These men were about 32, 33 years of age. When they came with the police, saying they were sorry, I told them that they should arrange to see the family.

    “The DTO came up to plead with us to allow them take away the vehicle to avoid more accidents and prevent irate mob from burning down the truck. I heeded their plea because I am a simple man.

    “We all rode down to Ipetu-Ijesa Police Station where the police told me that I should assume that my father died a natural death; that I should take it as his fate. This annoyed me the more. They thought they were talking to fools.

    “They said that the trailer was loaded with 33,000 litres of PMS and that somebody could smoke a cigarette by its side and cause a disaster or some hoodlums could siphon the contents. And if left there, they would be losing money on a daily basis.

    “In fact, some boys had earlier come and wanted to set it ablaze but I pleaded with them not to. They pleaded to take it away from the road and I accepted. On that note, I allowed them to take the contents and move the truck away from the road to avoid another accident.

    “I also removed all my parents’ personal effects from the Volvo car and left it at the police station.

     

    Twists to the story

    “But later at the police station, the story changed. The DTO started singing another song. He told the truck driver and his apprentice to relax; that he would settle it. This shocked me to the marrow. I was surprised that a Nigerian policeman would say this and it made me to lose confidence in him. Since then, the case has been on.

    “While I was agitating that they should not take away the truck, a man who identified himself as a senior official of TOTAL, came to inspect the scene of the accident.

    “I went up to him and he said he was sent to ascertain what had happened. His personal assistant was taking down notes. He gave me his number and I was shocked when he said that the truck on which TOTAL was inscribed actually did not belong to TOTAL but one Mr. Ufot.

    “Later, they said it was owned by Real Gold Company. But I don’t want to know Real Gold or Ufot.

    “We will soon go to court. But you know that the courts have not been working for some time. When they resume, we will file our case as we have contacted our lawyer.

    “What pained us most is the way and manner the owners of the truck and the police are treating the case; that nothing will happen. Imagine a Nigerian police officer conniving with suspects that killed over 10 people.”

    The first born of the deceased, Dr. Abiodun Adewale, a medical doctor at the Federal Medical Centre, Owo, Ondo State, also accused the police of trying to compromise its investigation.

    Dr. Adewale, who claimed that the man who drove the truck was an apprentice and that the vehicle’s particulars had expired, said: “The DTO wrote ‘brake failure’ and I asked him whether he could prove it. I asked whether he had called the VIO to inspect it. How can you be sitting here under a tree, writing in a relaxed mood and saying it is brake failure?

    “Let’s ask a sincere question. The driver was going straight and had brake failure. There was a ditch but he did not go there. It was brake failure that made him to swerve?”

    However, the Corporate Affairs Manager of Total Nigeria  Plc, Albert Mabuyaku, who confirmed that the  truck which killed the deceased, belongs to a  transporter with the company, denied that the driver was an apprentice.

    He said: “That information is not correct; the driver was trained in our transport school in Ibadan, Oyo State, and has  a valid driver’s licence.”

    Mabuyaku also told The Nation that the transporter was already talking with the aggrieved family.

    According to him, “The family is making a claim of N6 million, whereas she (transporter) is offering N2 million, which the family is not willing to accept.  I know that they are talking.”

    The Police Public Relations Officer in Osun State, Mrs. Folasade Odoro, said the allegations against the police were not true. She said the police was not a Vehicle Inspection Officer (VIO) to determine the state of the truck as at the time of the auto crash.

    According to her: “What the police can do in this situation is to recommend the case to the Director of Public Prosecution (DPP) for advice and with the police investigation and the VIO report, the case can be charged to court.”

    She disclosed that the suspect (the errant driver) had been charged to court for dangerous driving, causing the death of people and causing damage to property. She also said that the case the last time it came up in court was adjourned till September 29 for further hearing, while the case file had been sent to to DPP for legal advice.

    Driver arraigned for absconding with employer’s bus

    The Police on Thursday arraigned a 33-year-old driver, Musiliu Musa, in an Ikeja Magistrates’ Court, for allegedly absconding with his employer’s bus, valued at N850, 000.

    Musa, of no fixed address is standing trail on a one-count charge of stealing.

    The prosecutor, Sgt. Kehinde Olatunde, told the court that the accused committed the offence on April 24, at Oregun, Lagos.

    Olatunde said the Ford bus belonged to one Mr. Anthony Osas.

    “The accused bolted with his employer’s bus to an unknown destination,’’ he said.

    The prosecutor said that the accused was employed in March but disappeared with the bus in April.

    “The complainant gave the accused his bus which was registered to ply Ojota to Ikeja area of Lagos.

    “The accused, who only worked for a month took the bus in the morning as usual and disappeared with it into thin air, all efforts made to locate the accused and the bus proved unsuccessful,’’ he said.

    “The complainant received information that the bus was seen in Sagamu in Ogun, he got there and saw the bus, but it was damaged beyond repairs.

    “The complainant was told by the residents of that area that the driver of the bus was over-speeding and had an accident.

    “The accused was later arrested after four-month of his disappearance,’’ the prosecutor said.

    The offence, Olatunde said, contravened Section 285 of the Criminal Law of Lagos State, 2011.

    Section 285 prescribes a three- year jail term as penalty for offenders.

    The accused pleaded not guilty to the charge and was granted bail in the sum of N200, 000 with two sureties in like sum.

    The Magistrate, Mr. Aka Bashorun, adjourned the case till Sept. 21 for mention.
