  • NASS working to pass bills in nation’s interest, Says Senate Leader

The Senate Leader, Ahmed Lawan, on Friday gave indication that peace has returned to the National Assembly.

According to him, lawmakers are more interested in working for the national interest by passing the relevant bills that would move the nation forward.

Prior to the reconvening of the National Assembly on Tuesday, Lawan had declared at the All Progressives Congress (APC) Convention at the Eagle Square on Saturday night that APC will not allow leadership of the National Assembly run away with its mandate.

While the Deputy Senate President, Ike Ekweremadu has been of the People’s Democratic Party (PDP), the Senate President, Bukola Saraki had recently defected from the APC to the PDP.

But speaking on the crisis with State House correspondents on Friday at the Presidential Villa, Lawan said “I don’t know what informed your view to anticipate crisis but let me tell you that NASS will continue to remain focus on national issues, we must be patriotic, nationalistic, we must put national interest above individual, parochial or partisan interest.

“We definitely have to bury our hatchets for us to work for Nigeria and Nigerians perhaps that might have informed the disappointment of many people that there will be crisis in the National Assembly.

“Let me also say that disagreements are usual, in fact they are very practical components of any parliament, when you have 2 to 3 parties or even within parties you will have views that may differ.

“It is traditional, it is usual for us to disagree maybe this disagreements may crop up and some other issues but for now our focus is on national interest.” he said

Asked if the idea of impeachment has been dropped, he said “The National Assembly is a Nigerian parliament and therefore the best thing to do is to ensure that Nigerians gets a good deal and for now the good deal is for Nigeria to have all those pending request of Mr President approved by the National Assembly.

“I think the national interest for now override any other interest.” he said.

Speaking further on the resumption day, he said “Well you could see from day one, day one Tuesday was not an eventful day because the National Assembly lost a member, a member from Kwara. So traditionally, we normally don’t work on such a day when the death will be officially announced.

“But Wednesday and Thursday witnessed the focus and concentration of members of the National Assembly on the request of Mr President for the funding of INEC for elections to be conducted in 2019 and we passed in the Senate and the House did also.

“We passed the request of Mr President for N189 billion for INEC activities for 2019.On Thursday the committee on appropriation invited the head of the security agencies to come and defend the request that Mr President made on their behalf for funding of their supervisory and oversight roles during the elections in 2019.

“We also had the referral of the request of Mr President approval for foreign loan component of the 2018 appropriation and that is about 2.78 billion dollars eurobond. We have gone full blast consciously, purposely to ensure that Mr President gets what’s he request, we lost time because some of the issues were requested for before we went on our recess.

“But we have also in the Senate passed confirmations of the CBN deputy governor, ICPC governing body and we are determined to continue to do this throughout this period.

“Our intention is to ensure that Mr President doesn’t lack from inactivity of the NASS that whatever he requests, the fundamentals aspects especially will be attended to, this is our determination both as APC senators infact as senate and National Assembly.” he added

  • Excitement greets Buhari’s branded campaign wristbands

The flag bearer of the All Progressives Congress (APC) in the 2019 presidential election, President Muhammadu Buhari, now has new
    campaign wristbands.

The wristbands were shared at The Eagle Square, Abuja venue of the party’s recently held primaries thus highlighting an early start to
    his campaign.

Excitement greeted the distribution of the branded wristbands, as 7,000 APC delegates gathered to endorse Buhari for a second term at the Square on Saturday October 6.

The branded wristbands were distributed by Directors of the Good Governance Ambassadors of Nigeria (GOGAN) and the Buhari Unity Band (BUB) namely, Hajia Zainab Mohammed, Dr. Abayomi Oyekoya and Mr. Yinka Oladunjoye.

A statememnt signed by the Director, Communication and Media, BUB, Dr. Kunle Hamilton, said printed leaflets titled “Ahead 2019 Presidential Election” were also distributed along with the Buhari wristbands.

“GOGAN is committed to the same ideals and will continue to cooperate with our party leadership in ensuring strict implementation of our party manifesto.”

The new wristband, which thousands of people at the APC presidential converge squabbled for, has the inscription, “Buhari for one more term; Nigerians’ 1st Choice” plus APC’s logo. The four versions of the wristband made available at the Eagle Square were in English, Yoruba, Ibo and Hausa.

  • Buhari, Gowon, observe Independence Day parade at Eagle Square

    Saraki, Dogara absent

Against all odds, President Muhammadu Buhari on Monday observed the 58th Independence Day parade at the Eagle Square, Abuja.

The last time the ceremony held at the Eagles Square was in 2010 under the administration of former President Goodluck Jonathan.

That parade in 2010 was marred by bomb blasts.

Since that year, subsequent independence anniversary parade were held in low key at the forecourt of the Presidential Villa, Abuja.

Buhari, who already made national broadcast marking the 58th independence anniversary at 7am, on Monday broke the jinx and arrived the Eagles Square venue of the parade around 9.30am.

But the Senate President, Bukola Saraki and the Speaker of the House of Representatives, Yakubu Dogara were conspicuously absent at the Eagle Square.

According to the programme circulated to guests, they were listed to arrive the venue by 9.10a.m for the event.

Saraki and Dogara have recently dumped the ruling party, All Progressives Congress (APC) for the Peoples Democratic Party (PDP).

Others who attended the ceremony included Vice President, Yemi Osinbajo, the former Heads of State, Yakubu Gowon, Abdulsalami Abubakar.

Former military leader, Oladipo Diya and cabinet members also attended the parade.

There was inspection of guards by President Buhari, which was followed by march past in slow and quick time.

There was also march past by para-military organisations, agencies and Nigeria Police Force (NPF) mounted troops.

Also on display were military equipment march past on low loaders

Police dogs displaying the trainings they had acquired also thrilled the guests while outriders also displayed their skills.

There was also aerial show by the Nigerian Air Force (NAF).

Recalled that while training for the aerial show, there was two jets crash on Friday, which claimed the life of one pilot and leaving two wounded survivors.

Rounding off the ceremony at the Eagles Square, there were firing of volleys and 21 gun salute by the military personnel.

Before departing the venue, President Buhari signed the 58th Independence anniversary register.

Speaking to journalists at the end of the ceremony, the Minister of Defence, Mansur Dan-Ali, said “You have seen what we displayed today, we are capable of defending this nation.”

The Secretary to the Government of the Federation, Boss Mustapha, noted that the last time independence anniversary was celebrated in full was in 2010.

According to him, a child born seven years would not have idea of how independence anniversary is celebrated in Nigeria.

He said that there is relative calm in the north east and checkmating of banditry in the North West and north central as a result of acquisition of more military equipment under the present administration.

He urged Nigerians to be patient and trust the leadership of President Buhari.

Shortly after Buhari and the dignitaries left the venue, some APC youths wearing black T-shirt took over the arena.

In a procession with the APC flag, they started moving around, singing songs in support of President Buhari towards the 2019 Presidential election.

Trouble however started when somebody, who infiltrated the group, stole the telephone set of one of the youth.

Rather than submit the telephone set when he was caught, he drew out dagger to scare away those who tried to get the telephone set from him.

With the thief’s supporters at the venue backing him, it almost turned to free for all fight.

They ran, pushed and pursued one another around the venue for over 15 minutes.

It got bloody when some of the thief’s gang started throwing stones, which made the youths to run helter skelter around the venue for safety.

One young boy of about 15 years was not too lucky as one of the stones landed on his head.

The boy, who was bleeding profusely, was given first aid treatment by some members of the Nigerian Security and Civil Defence Corps at the venue.

  • Saraki condemns denial of Kwankwaso to use Eagle Square

Senate President Bukola Saraki yesterday condemned alleged last minute cancellation of the approval granted to Senator Rabiu Musa Kwankwaso to use the Eagle Square, Abuja for his presidential declaration

In a statement by his Special Adviser on Media and Publicity, Yusuph Olaniyonu, in Abuja, Saraki said: “Eagle Square belongs to all Nigerians. The cancellation sends a wrong message about the tolerance level in our politics.

“The refusal to allow Senator Kwankwaso use the Eagle Square for his presidential declaration, despite an earlier approval, sends a wrong message about our democracy, particularly the tolerance level in our politics.

“That square belongs to all Nigerians because it was built with public funds. We hope this is not what we will be seeing as we approach the 2019 general election.”

  • APC Convention is a quit notice signal to PDP, Fayose – Presidency

The Presidency says the All Progressive Congress (APC) convention holding at the Eagle Square, Abuja, would be a quit notice signal to the ruling People’s Democratic Party (PDP) in Ekiti State.

The Senior Special Assistant to the President on National Assembly Matters (Senate), Senator Ita Enang, gave the assurance to the News Agency of Nigeria (NAN) at the ongoing convention arena.

Enang, who said he expected a peaceful poll at the convention, said the successful completion of the occasion would also indicate a quit notice to the Ekiti State’s incumbent governor, Ayo Fayose.

NAN reports that the governorship election in the state, which is scheduled to hold on July 14, has the immediate-past Minister of Mines and Steel Development, Kayode Fayemi, as the APC gubernatorial candidate.

”It is a signal to PDP and Ayo Peter Fayose that we have served him quit notice and that he will quit.

”With the strength of APC in the Federal Government at the federal level and the strength of APC in Ekiti State, we will win Ekiti and we will sack PDP from the seat,” Enang said.

He said he expected a fruitful and rancour-free convention.

He urged the winners and losers in the ongoing convention to display a spirit of sportsmanship.

”My words for the winners today, be magnanimous in victory, and for the losers, be also accommodating. Let all those who lose also play into the party, let those who win accommodate those who may not win today,” he said.

Also speaking, the Minister of Communications, Mr Adebayo Shittu, said the convention would go well and come out successful.

”You can see that everybody is happy to be here. We are lucky that we have Muhammadu Buhari as our president; everybody loves him.

”No matter the differences or disagreement in the generality of membership, the president’s position as a beloved leader and mentor is sacrosanct. And I think that will contribute largely to the final successful outcome of this convention,” he said.

  • 2010 Abuja bombing: Court sets March 7 for judgment in Okah’s trial

2010 Abuja bombing: Court sets March 7 for judgment in Okah’s trial

A Federal High Court in Abuja has fixed March 7 this year for judgment in the over seven-year old trial of Charles Okah and Obi Nwabueze.

Okah and Nwabueze are being tried for their alleged complicity in the October 1, 2010 bomb incident at Eagle Square, Abuja, in which about 12 people died and many others were injured.

Justice Gabriel Kolawole chose March 7 for judgment after parties adopted their final written addresses yesterday.

Adopting his address Wednesday, Okah’s lawyer, Emeka Okoroafor argued among others, that the prosecution was unable to lead sufficient evidence to warrant his client’s conviction.

He faulted the evidence led by the prosecution and insisted that it failed to link his client with the alleged offence.

Okoroafor prayed the court to discharge and acquit his client.

Lawyer to Nwanbueze, Oghenevo Otemo argued in similar vein. He contended that the prosecution did not place anything before the court to warrant his client’s conviction.

Otemo accused the prosecution of concealing some relevant materials from the court.

He said his client made different extra-judicial statements voluntarily and that one of such statements was made at the headquarters of the Department of State Services (DSS) on October 18, 2010.

Otemo claimed that the prosecution refused to tender the statement his client made at the DSS headquarters before the court.

The prosecution’s alleged refusal to tender the statement, Otemo argued, amounted to concealment of evidence, which according to him, is against the law.

He urged the court to hold that the statement, which the prosecution allegedly refused to tender, is that which is favourable to the defendant.

Otemo prayed the court to set Nwabueze free.

In a counter-argument, prosecution lawyer, Alex Iziyon (SAN) urged the court to hold that the prosecution has proved its case against the defendants.

He said evidence led by the prosecution conveniently reflected the involvement of the defendants in events leading to the October 1, 2010 bomb incident.

Izinyon, who dwelt extensively on the case against Okah, described him as a schemer and the facilitator of the act of terrorism.

“The first defendant is head, neck and toe deep in the act of terrorism”, Izinyon said.

He said the prosecution has proved beyond reasonable doubt that the defendants were responsible for the 2010 Independence Day multiple bomb blasts in Abuje, which claimed several lives and left several others injured.

Iziyon urged the court to convict the defendants as charged and sentence them accordingly.

Earlier, Justice Kolawole over-ruled the defendants’ objection to the prosecution’s application dated January 29, 2018 for the court’s permission to regularise some of the exhibits it tendered.

The judge, who faulted the defence’s argument against the application, allowed the prosecution to regularise the document on being satisfied that it has paid the necessary penalties.

Okah, Nwabueze, Edmund Ebiware and Tiemkemfa Francis-Osvwo (aka General Gbokos) were initially arraigned before the court on December 7, 2010 in relation to the alleged offence.

Francis-Osvwo later died in prison custody, while Ebiware, who had his trial conducted separately, is serving life sentence upon his conviction in 2013, leaving Okah and Nwabueze to jointly stand trial on a charge marked FHC/ABJ/CR/186/2010.

    PDP Convention: Eagle Square ready

Eagle Square, Abuja, venue of Saturday National Convention of the People’s Democratic Party (PDP) was on Friday adorned with posters of aspirants of various positions to be contested during the exercise.

The News Agency of Nigeria (NAN) reports that the public square, situated on a land measuring about five hectares, was fully draped with PDP colours of red, white, green.

As at 6.45 p.m., Public Address System engineers and their television stations counterparts were busy installing and testing their equipment at strategic locations to ensure effective courage of the event.

Security personnel have already been deployed to the venue and they were seen at different position in the 5,106-sitting capacity venue.

Some officials of the organising committee of the convention were seen conducting last minute inspection of the venue.

Some persons who refused to identify themselves took positions in a spot at the venue in a manner suggesting that they are likely to spend the night there ahead of the convention.

The persons brandished PDP membership cards but were suspected to have come from outside Abuja and may not be delegates.

  • Independence Day bombing: Appeal Court upholds life sentence for Ebiware

Independence Day bombing: Appeal Court upholds life sentence for Ebiware

…Affirms the sentencing of a woman to death by hanging

The Court of Appeal in Abuja has upheld the conviction and life sentence handed to Edmond Ebiware over his complicity in the October 1, 2010 bomb explosion around Eagle Square in Abuja which left about 12 people dead and several others injured.

In a unanimous judgment of a panel of three, the appellate court resolved the two issues, identified for resolution, in favour of the state, listed as respondent, and dismissed the appeal by Ebiware.

In a separate judgment, the court affirmed the sentencing of 31-year-old Ozioma Azoryeme to death by hanging following her conviction for the murder of a female child of about two years old.

Ebiware, accused of withholding information about alleged plot by Henry Okah to cause bomb explosion in Abuja, was initially charged, with three persons, including Charles Okah on an eight-count charge filed on January 11, 2011 before the Federal High Court, Abuja.

On May 3, 2012, the trial judge, Justice Gabriel Kolawole granted Ebiware’s application to be tried separately from the three others.

At the end of the trial, Justice Kolawole, in a judgment on January 25, 2013 convicted Ebiware and sentenced him to life imprisonment, subject to parole after 32 years from the date of the convict’s arrest on October 15, 2010, a decision he appealed.

In a lead judgment delivered on July 25, 2017 by Justice Mohammed Mustapha, a copy of which The Nation sighted Monday, it was held that the trial court was in order in its findings and conclusions in the Ebiware case.

On whether the prosecution proved the charges against the appellant beyond reasonable doubt, Justice Mustapha held that, by the evidence led, the prosecution proved the guilt of the defendant/appellant.

Justice Mustapha said: “Contrary to the contention of the learned counsel for the appellant, conviction under Section 40(b) of the Criminal Code does not require linkage with other accused person(s), the operative word is ‘knowledge of intention,’ and failure to report to the categories of persons listed therein.

@The appellant, from evidence at trial, not only knew, but failed to report. The findings of the trial court are beyond reproach in this regard.”

On Ebiware’s contention that the sentence of life imprisonment was too harsh, Justice Mustapha held that, considering the impact of the bomb explosion and its impact, the sentence handed by Justice Kolawole to the appellant was justifiable.

He said: “I did say earlier that the question of whether the sentence is harsh or not is subjective, because it depends on who is at the receiving side; this is because at the end of the day, when all is said and done, neither life imprisonment nor any sentence can be regarded as sufficient punishment for an action that leads to loss of innocent lives in this grand scale.

“This is not withstanding the fact that the accused had remained in prison custody, married with children or chose not to waste precious time by opting for a separate trial from other co-accused,” Justice Mustapha said.

Justices Tani Yusuf Hassan and Abubakar Datti Yahaya, who were on the panel, agreed with the lead judgment in the Ebiware case.

On the appeal by Azoryeme, Justice Yahaya, in a lead judgment delivered on August 2, 2017, resolved the two issues, identified for determination, against the appellant and dismissed the appeal for lacking in merit.

As against the appellant contention that there were insufficient to warrant her conviction, Justice Yahaya held that the prosecution effectively discharged the burden of proving, beyond reasonable doubt, the guilt of the appellant for the offence od culpable homicide punishable with death, for with which she was charged.

On whether the trial court was right not to have upheld the appellant’s defence of insanity, Justice Yahaya upheld the position of the trial court, to the effect that the claim of insanity was not only an afterthought, it was not supported by credible material evidence, in the form of medical reports.

Justices Tani Yusuf Hassan and Muhammed Mustapha agreed with Justice Yahaya’s lead judgment.

Azoryeme was arraigned in 2011 in a charge marked: NSHC/SD/IC/2011, before a High Court of Niger State in Suleja for the killing, on June 12, 2010, of Chinonye Timothy (a child of about two years old).

The trial court, in a judgment on September 30, 2014 found her guilty and sentenced her to death by hanging.
