Enugu APC chieftains declare support for Mbah amid defection rumours

Foundation members of the All Progressives Congress (APC) in Enugu State have declared their support for Governor Peter Mbah’s entry into the party, dismissing remarks by the Minister of Innovation, Science and Technology, Chief Uche Nnaji, suggesting otherwise.

Speaking on behalf of the group, former director general of Voice of Nigeria (VON), Mr. Osita Okechukwu, said Governor Mbah and his team were “wholeheartedly welcome” in line with APC’s conventions, urging them to ignore what he described as “the rantings” of the minister.

“We are at a loss as to why Chief Nnaji, who himself is a hijacker from the PDP, is chasing away a performing Governor Mbah,” Okechukwu stated. “Our goal is to win the Lion Building for the first time and join 23 other APC states to secure President Bola Ahmed Tinubu’s victory in 2027.”

Okechukwu was reacting to Nnaji’s comments at a meeting in Enugu on Sunday, where the minister challenged anyone seeking to contest the Enugu governorship to join the APC and face the primaries.

The APC chieftain advised Nnaji to focus more on his ministerial duties, claiming there had been no visible achievements in the ministry since his appointment.

“Otherwise, we will not allow Chief Nnaji, who came a distant fourth with 14,575 votes in the governorship election and polled only 4,722 in the 2023 presidential election, to rubbish APC again,” Okechukwu warned.

  • Enugu community protests alleged unauthorised takeover of ancestral land

Enugu community protests alleged unauthorised takeover of ancestral land

Thousands of residents of Umuigbo Amurri autonomous community in Nkanu West Local Government Area of Enugu State have staged a peaceful protest over the alleged forceful takeover of their ancestral land by the council chairman, Hon. John Ogbodo, for the proposed Enugu smart farm project.

The protesters, including women, youths, and the elderly, marched through the village square to Agbani Road, carrying green leaves and placards with inscriptions such as “Umuigbo Amurri, we say no to illegal seizure of our land,” “We support the government of Peter Mbah,” and “We have a place mapped out for smart farm.”

They accused the local government chairman of disregarding community input and encroaching on land already designated for residential development. According to them, a larger and more suitable area had already been earmarked by the community for the smart farm initiative.

The President-General of the town union, Chief Sebastian Onu Okoh, said the community supports Governor Peter Mbah’s agricultural vision, especially as it relates to curbing the menace of Fulani herders, but insisted that the project must not come at the cost of their residential lands or without due consultation.

“For this purpose, we met on April 22 this year and mapped out over 1000 hectares of land in our farm settlement for this purpose. This is a place where Fulani herdsmen with their cattle always destroy our crops. The governor requested 200 hectares of land for this farming, but we gave five times more. We did this in conjunction with the other autonomous communities in the Amurri clan.

“We were surprised to see bulldozers rolling on the farmlands close to where we live and started destroying crops on the farms. Upon inquiry, we were told that the LGA chairman, Hon. John Ogbodo, has taken the place of the government’s smart farm project. We were confused because nobody had approached us for that.

“When our people tried to stop the bulldozers and told them that we had a place bigger than this for that purpose, the LGA chairman sent policemen from Agbani to arrest them on the allegation that they set the bulldozers ablaze. Meanwhile, the is still there working,” he said.

Okoh accused the LGA chairman of using policemen to intimidate and silence the people into submission, lamenting that four members of the community were made to spend 10 days inside a police cell for trying to stop him from destroying their crops.

Another leader in the community and special adviser to the governor of Bayelsa State on special duties, Chief Chinedu Atokwa, queried the motive of the LGA chairman in forcibly taking a piece of land in the community without the people’s consent, lamenting the destruction of crops in the farmland.

The leader of the women of the community, Mrs. Chinyere Ugwu and the youth chairman, Jude Okoh, expressed doubts over the LGA chairman’s intentions, saying a government that had a good thought for its people should have a listening ear rather than destroying their livelihoods.

The community, therefore, appealed to Governor Peter Mbah to intervene and direct the LGA chairman to leave this land for them, as “it is where we have mapped out as a residential layout for our young ones.

They warned that continued encroachment could lead to unrest and called on Governor Mbah to step in and the place be mapped out for smart farming by the community.

Reacting to the allegations, the LGA chairman, Hon. Ogbodo, said the land was properly donated by the community through their traditional ruler and other leaders of Amurri town, adding that the government was a smart farm project for the people of the community.

According to him, the choice of the land by the traditional ruler of the community was because the land had been “lying fallow for over 300 years without any use but only serving as a cover for Fulani herdsmen”.

He said the government meant well for the people and urged the protesters to accept the project the way other communities had accepted their own.

A can of worms opened for the native doctor when a chilling discovery was made after a young girl was abducted on Monday by two men while she was accompanying her father to the farm.

According to a source, the assailants used deception to carry out the abduction.

“The little girl was walking with her father to the farm on Monday when two men riding on a motorcycle stopped and pretended that their motorcycle had developed faults.

“One of the men told the father of the little girl to help them with his cutlass to use and fix the fault in the motorcycle, which the man obliged. They said the fault would require pushing the bike and begged him to help. It was in this process that one of the men grabbed the girl and jumped onto the motorcycle, and they zoomed off.

  • Court reverses lawyer’s conviction

    Court reverses lawyer’s conviction

An Enugu State High Court has set aside the conviction and one-year jail sentence of a legal practitioner, Chidiebere F. Agbo, who was found guilty by a Magistrate Court of giving false information to the police.

Justice Kenneth Okpe held that His Worship, D. K. Ekoh of Magistrate Court Grade 1 erred in law by relying on the prosecution’s evidence without considering the totality of evidence, including that of the defence.

The judge also ordered the refund of the N25,000 fine earlier paid by the appellant as an option in place of the custodial sentence.

Delivering judgment in the appeal marked NO: CM/824C/2017 and Eà/5CA/2021, Justice Okpe held:

“The Prosecution did not prove the elements of giving false information beyond a reasonable doubt nor prove that there was an intent by the accused to give an information knowing it to be false.

“The Honourable Court took the wrong view by relying solely on the evidence of the Prosecution rather than evaluating the totality of the evidence before the Court, including the evidence of the defence.”

The Magistrate Court had on November 18, 2020, convicted Agbo on two counts and sentenced him to one year in prison on each count, with an option of N25,000 fine on each.

The sentences were to run concurrently.

Dissatisfied, Agbo filed a notice of appeal on two grounds: that the decision was erroneous in law and that it was unreasonable based on the evidence presented.

With the court’s permission, he later filed an amended notice, introducing an additional ground, among others.

The appeal was delayed due to a judicial strike, which affected the timely compilation of the record by the Magistrate Court Registrar. The High Court later granted leave to amend the appellant’s brief and extend the time for filing.

Agbo, who held a Power of Attorney from Dr. Kevin Ochin regarding a parcel of land at Airport Road, Enugu, had deployed workers to the land, which led to a dispute.

Then Enugu East Local Government Chairman, Prince Cornelius Nnaji, halted the workers’ activities, claiming the land was part of a community lease agreement dating back to 1976.

Agbo subsequently petitioned the Commissioner of Police, accusing Nnaji of harassment and abuse of office. The police dismissed the allegations as unfounded and charged Agbo with giving false information.

At the trial, the prosecution presented three witnesses, while the defence called five. He was convicted, prompting the appeal.

Though the respondent’s counsel argued that one of the grounds of appeal was vague and that issues on sentencing were not raised in the lower court, Justice Okpe held otherwise.

“The court erred in law in finding the Appellant guilty in all the counts of the charge even when the Prosecution did not prove his case beyond a reasonable doubt as required by law.”

He further stated: “The view of this Court is that this is a valid ground of appeal and the law is trite that one valid ground of appeal can sustain an appeal.

“This court will therefore resolve this issue in favour of the appellant. With this resolution, the conviction and sentences of the appellant are liable to be set aside.

“But before I do that, let me determine the issue of whether the lower court was correct in its failure to take into consideration the provisions of the Administration of Criminal Justice Law of Enugu State 2017 in the matter of sentencing.”

Justice Okpe agreed with the appellant’s counsel that a custodial sentence was inappropriate for a non-violent offence.

He cited relevant sections of the Administration of Criminal Justice Law of Enugu State 2017, including Sections 391, 392, 420, 455, 469, and 489, which provide for alternatives to imprisonment.

In response to the respondent’s argument that the fine option constituted a non-custodial sentence, Justice Okpe clarified: “Let me correct a misconception by counsel for the respondent that the issue of sentence passed must have been canvassed and determined in the judgment before it can be raised as an issue on appeal.

“It is not clear to this court the stage of the proceedings at the lower court when the issue of sentence will be canvassed.

“This is because the sentence will be pronounced after allocutus, which is the last contribution by counsel for the accused person. And once a sentence is passed, the court becomes functus officio.”

Concluding, Justice Okpe held: “Overall, I believe that the appeal is partially successful; therefore, the conviction and sentences imposed by the trial court on the Appellant on November 18, 2020, are hereby set aside.

“In their place, I enter a verdict of not guilty in Charge No. CME/824C/2017. Consequently, the accused, now Appellant, Chidiebere F. Agbo, is hereby discharged and acquitted. Finally, I order that any money paid by the Appellant as an option for his custodial sentences be refunded to him.”

  • JUST IN: Enugu LP Rep member, 1000 others defect to APC

JUST IN: Enugu LP Rep member, 1000 others defect to APC

The All Progressives Congress (APC) in Enugu State have received the member representing Udi/Ezeagu federal constituency, in the House of Representatives, Hon. Sunday Umeha, to the party.

Umeha, who was elected into the National Assembly on the platform of Labour Party (LP), announced his defection to the ruling APC during a mini-rally at Ibagwa-Aka, in Igboeze South local government area, weekend.

At the event, a business mogul and financier of Labour Party in Igboeze South local government area, Chief Joshua Ogbonna popularly called “Father Father” led more than 1000 members of the party, including the local government structures of the party, into the APC.

Speaking on why he attended the APC rally, which was outside his own constituency of Udi/Ezeagu, Umeha said it was in solidarity with his friend, Chief Ogbonna, disclosing that another rally that would officially usher him into APC would still come up in matter of days in his local government area, Ezeagu.

The lawmaker however announced that he had already resigned from the Labour Party and registered with APC at his Ward, even as he cited the intractable division within the ranks of his former party (LP) at the national and state levels as one of the reasons for his dumping the party for APC.

Umeha, who is now the first APC member to occupy elective position in the state since its inception in 2014, said his decision to join the ruling party was also “because of the need to connect to the centre and bring our people closer because there are a lot of advantages in plugging to the center.”

He said that the APC has served the interest of Igbos better than the PDP at the federal level, citing the Enugu-Onitsha Expressway, Enugu-Port-Harcourt Expressway and the 2nd Nigeria Bridge as some of the landmark projects the current ruling party has executed in Igbo land.

The Leader of APC in Enugu state and Minister of Innovation, Science and Technology, Chief Uche Nnaji, represented by his governorship running mate during the 2023 general elections, Barr George Ogara, said he was elated by the influx of credible and grassroots persons into the APC in the state.

“It’s indeed time for us to come together to retrieve power from those who have been using it to oppress the people. What is happening here today, the sheer number of defectors has not happened elsewhere in the state before. I urge all of us to remain steadfast because all of us shall be the beneficiaries when victory is achieved,” he said.

Speaking while receiving the defectors, the Enugu State Chairman of APC, Barr Ugochukwu Agballah, said the party was getting primed to take over Enugu’s seat of power, the Lion Building, from the Peoples Democratic Party (PDP) in 2027.

Agballah stated that PDP’s dominance of governance of the state for 26 years has only brought tears, anguish and sorrow to the people with high taxations, land grabbing, and demolitions of people’s means of livelihood for the purpose of building motor parks, which ordinarily should be the responsibility of local governments.

He thanked a chieftain of the party from Nsukka local government area, Barr Peter Okonkwo for donating Enugu North Senatorial Zonal Campaign Office to the party and facilitating the collapse of LP structure in Igboeze South LGA.

“Peter Okonkwo is equipped for the redemption of Enugu state and we will not shy away from that task,” he said.

Agballah noted that the defection was unprecedented in the history of decampment in Enugu state since the 2023 general elections, where an entire LGA and wards executive members led by the LP local government Chairmanship candidate in the last LGA election are all declaring for APC.

“It is a total collapse of structure. Today I hand over to you the symbol of our party, our flag; I hand you the broom, which is an insignia of our party and with this broom we are going to sweep in good governance in Enugu state, with this broom we are going to sweep away the reactionary forces that have held our people hostage for 26 years. With this broom we are going to bring back democracy in Enugu state.

“I want to say it here and I want to say it loud and clear to all doubting Thomases, that APC Enugu state is poised to take over the government of Enugu come 2027.”

In his remarks on behalf of other defectors from Ibagwa-Aka local government area, Chief Joshua Ogbonna recounted efforts made by opponents to stop them from defecting to APC; including seizing the buses they hired to convey the people to the venue which made them to resort to using commercial motorcyclists.

“We are more than 1000 that defected to APC today. I’m telling you that work begins today in Igboeze South local government area; it will be ward to ward movement. I’m assuring you that Igboeze South will not come last,” he posited.
