    EFCC re-arraigns Fani-Kayode, Nenadi before new judge

    The Economic and Financial Crimes Commission (EFCC) yesterday re-arraigned former ministers of Aviation and Finance Chief Femi Fani-Kayode and Senator Nenadi Usman for alleged N4.6 billion fraud.

    They pleaded not guilty to the 17-count charge of money laundering.

    The defendants were first arraigned on June 28, last year before Justice Muslim Hassan.

    But on March 16, he recused himself from the case after Fani-Kayode accused him of likely bias.

    The judge transferred the case file to the Chief Judge, Justice Ibrahim Auta, for re-assignment to another judge.

    In asking the court to disqualify himself, Fani-Kayode said Justice Hassan, who worked as Head of Legal at the EFCC before his appointment as a judge, signed the money laundering charge for which Fani-Kayode was previously tried and acquitted by Justice Rita Ofili-Ajumogobia on July 1, 2015.

    Following Justice Hassan’s withdrawal, the case was re-assigned to Justice Rilwan Aikawa and the defendants took their pleas afresh yesterday.

    Justice Aikawa asked the defendants to remain on the bail terms earlier granted them by Justice Hassan.

    Justice Aikawa adjourned until June 7 for ruling and commencement of trial.

    Yoruba youths, under the aegis of Concerned O’oduwa Progressive Youth Assembly, COPYA, have accused former Minister of Aviation, Femi Fani Kayode on trying to destroy President Muhammadu Buhari and his vice, Prof Yemi Osinbajo.

    The group said the verbal attacks on the presidency by Fani-Kayode, a chieftain of the PDP does not show that he is a true Yoruba man, which he claims to be.

    FFK, as Fani is fondly called had in the recent times described as a ‘slave to dark and shameless cabal’ in Aso Rock.

    “We have a Vice President who has been held captive and who is now a slave to some dark, sinister, evil and shameless cabal,” Fani-Kayode once wrote in an article.

    Addressing newsmen in Lagos on Thursday, the national coordinator of COPYA, Kola Salawu, said it was shameful that Fani-kayode who should be supporting his fellow Yroubaman, Osinbajo was hell bent on destroying this administration.

    The group said Fani-Kayode’s campaign is targeted on driving a wedge between the smooth running relationship between Osinbajo and his boss who are currently enjoying the best of relationship.

    Salawu said, “We will specifically address the activities of one Femi Fani-Kayode also known as FFK. You might have known him as the former Minister of Aviation that is currently scurrying from one court to another over cases of graft brought against him by the Economic and Financial Crimes Commission (EFCC).

    “The alleged crimes date as far back as when he was in office as an appointee of the People’s Democratic Party (PDP). He is someone who had the benefit of being in office courtesy of a political party which blatantly stated that “stealing is not corruption”.

    The group further urged Osinbajo to ignore the ethnic drums being beaten by Fani-Kayode and his likes knowing well that such characters are alone in this endeavour.

    “The Acting President must not heed the call for war being chorused by this rubble and must not allow himself to be dragged into dirty politics at the detriment of his spiritual and professional calling as an accomplished Nigerian before venturing into politics.

    “If FFK truly has the interest of the Yoruba race at heart, he should immediately declare a ceasefire on issues pertaining to the President’s health and surrender to the supremacy of Tinubu as the leader of the Yoruba nation as far as Nigerian politics is concerned. He has unequivocally demanded a ceasefire from all peace-loving Yoruba sons and daughters in the media and holding other assets of propaganda.
    “We demand that Femi Fani-Kayode and his likes immediately withdraw the call for war in the interest of the country’s peace and unity.”

    Ex-Aviation minister Fani-Kayode got N26m from ONSA, says witness

    The first prosecution witness in the trial of former Minister of Aviation Chief Femi Fani-Kayode yesterday told Justice John Tsoho of the Federal High Court, Abuja that the Peoples Democratic Party (PDP) chieftain got N26 million from the Office of the National Security Adviser (ONSA).

    The witness, Mr. Victor Ehiabhi, a policeman attached to the Criminal Investigation Department (CID) in the last 13 years, said he was deployed to work with the defendant as his security aide.

    Led in evidence by the prosecution counsel, Mr. Johnson Ojobane, the witness said his duty was secure Fani-Kayode’s family and his properties.

    Ehiabhi, who was told by the prosecution counsel to explain to the court what happened on November 21, 2014, said: “On that fateful day, Chief Femi Fani-Kayode travelled out of town and he told me to be in his house.

    “The domestic staff were around the premises. While he was away, I was at home. The house is located within Aso drive.

    “One of the gardeners named Francis called me on phone. He told me that the defendant called him on phone and directed that I should accompany a staff named Esther to the Office of the National Security Adviser at the Villa. Not too long, the defendant called me and he told me the same thing.

    “The domestic driver named Kenneth was directed to drive us to the Villa.

    “While at the Villa, the driver was asked to stay in the compound while I and Esther walked into the building.

    “So, we identified ourselves as personnel of the defendant. The staff in the office asked who is Victor and I told him that I was the one.

    “I was asked to tender my identity card and I did. The man in the office brought out a paper for me to endorse on behalf of the defendant and the large amount of money was written on the document for the defendant.

    “I initially decided not to endorse the document on behalf of the defendant.

    “The man in the office insisted that I am supposed to endorse the document and so I did.

    “The same man in the office gave the money in a Ghana must go bag to I and Esther.”

    He added: “We then took it out of the office and put it in the boot of the car. We departed from the office and headed to the defendant’s house with the money.”

    “At that time, the defendant was not yet back.

    “The defendant called again that I should ensure maximum security within the house until his arrival.

    “On that same day, at about 11pm, the defendant returned from his journey and he acknowledged the money and thanked us for what we did for him.”

    Asked by Ojobane, what happened subsequently and how he got himself involved with the Economic and Financial Crimes Commission (EFCC), he said: “I was invited by the EFCC and when I got there, I was asked whether I had worked with the defendant before and my answer was yes.

    “I was made to write a statement and that I did.”

    Justice Tsoho adjourned till June 6, for cross-examination of the witness and continuation of trial.

    The EFCC, on November 11, 2016, arraigned Fani-Kayode on five-count charges involving alleged diversion of N26 million, which he allegedly received from the then National Security Adviser, Sambo Dasuki, under the guise of payment for contract.

    The ex-minister allegedly received the money from the Office of the National Security Adviser while he was the Director of Media and Publicity in the campaign organisation of ex-President Goodluck Jonathan.

    Amaechi seeks N2b, apology from Fani-Kayode, Fayose’s aide

    Former Aviation Minister Femi Fani-Kayode and Ekiti State Governor Ayodele Fayose’s media aide, Lere Olayinka, may be in for rough legal battles should they fail to retract their posts linking Transport Minister Rotimi Amaechi to the over N15 billion found by the Economic and Financial Crimes Commission (EFCC) in Ikoyi.
    Fani-Kayode has been ordered to within seven days, pay N500 million and apologise for his twitter post on the issue. Olayinka is being asked to pay N750 million for posting on Twitter and Facebook (N750 million), alleging that Amaechi was the owner of the recovered loot and that he had a girlfriend.
    In letters addressed to both men and dated April 14, counsel to Amaechi, Lateef Fagbemi (SAN), said they both knew their claims were false and defamatory.
    According to Fagbemi, the one paragraph comment Fani-Kayode posted through his Twitter handle @realFFK  at 4:16pm, on April 14 was viewed by 316,000 followers, retweeted 1,209 times and made favourite by 434 followers as at 7:15pm same day.
    Fagbemi said Olayinka’s six-paragraph tweets, alleging that Amaechi was the owner of the flat and the money, was viewed by 12,000 followers, retweeted 38 times and made a favourite by nine followers as at 7pm that day.
    The letter to Fani-Kayode stated: “The story as uploaded by you is to your knowledge, blatantly false, malicious and aimed at impeaching the credit of our client, a two – time Speaker of Rivers State House of Assembly, two – time Governor of Rivers State and current Minister of the Federation.
    “Our client neither owns the house where the cash was found nor the cash and your story and claim are unfounded. As a matter of fact, our client does not own any house in Lagos State, talk more of keeping cash in one and your story is preposterous.
    “We observe that as a lawyer, you ought to know that anyone who desires to know who owns any property, especially in a world-class land documentation system like Lagos State, should avail himself of the facilities by conducting a diligent search in the land registry.
    “You intentionally failed to do so as to achieve your malicious aim. For the umpteenth time, let it be known that out client, Rotimi Amaechi has no house anywhere in Lagos.
    “We have our client’s mandate to state to you unequivocally that the said twitter publication constitutes libel, and is defamatory of him as the claim is aimed at impugning our client’s character and credits in the eyes of right thinking Nigerians and foreigners. As a matter of fact, the media has been awash with the news since you made your claim.
    “In view of the foregoing and in the spirit of a second chance, we have our client’s instruction to give you an ultimatum of seven days from the receipt of this letter to issue an apology in five national dailies and on your twitter handle.
    “Your apology, which should be heartfelt, must be a total withdrawal of your claim and its imputation must also contain an expression of deep regret for this unwarranted attack and contain a complete retraction of the false statement of yours.
    “We also demand from you a sum of N500 million as compensation for the malicious and defamatory claim. Please note that the demand may increase with time if you fail to address the situation as expected. Failure to do any of these would be met with stiff legal actions which your defamatory act deserves.”
    Demanding N750million and similar conditions from Olayinka, Fagbemi reminded the former that Amaechi contracted a valid statutory marriage within the Marriage Act, which prescribes a “oneman-onewife” union.
    He said: “Your baseless assertion that our client bought a flat for one Mo Abudu, whom you also claim to be his girlfriend raises the assertion that our client is adulterous and unfaithful to his marital vows. This is disparaging of our client’s nobility and puts into doubt his character as a good family man.
    “Let it be known again that our client Rotimi Amaechi has no girlfriend whatsoever and your story has just been made to tarnish our client’s image and name which he has worked assiduously to build all his life…”
    Reacting to Amaechi’s demand for apology within seven days through his media aide Jude Ndukwe, Fani-Kayode said he has not received any letter from Amaechi’s lawyer.
    He said in a statement: “We have been inundated with calls concerning a threat by Rotimi Amaechi to sue Chief Fani-Kayode for defamation over the 43 million USD issue. We are not losing any sleep over this matter. We have not received any court processes or letters from Ameachi but when we do so our lawyers will respond vigorously and appropiately.”

    The Rivers State chapter of the All Progressives Congress (APC) has blasted the state Governor, Nyesom Wike; his Ekiti State counterpart, Ayodele Fayose; and a former Minister of Aviation, Femi Fani-Kayode, for linking the recovered $43 million to Minister of Transportation, Rotimi Amaechi.

    The party in a statement issued by its Chairman, Chief Davies Ikanya, through his Senior Special Assistant on Media and Public Affairs, Chief Eze Chukwuemeka Eze, described the accusation as mischievous, wicked, diabolical, evil and a desperate attempt to run down an innocent man.

    It insisted that the minister’s only crime was that he led the APC to defeat a party that was priding itself as the largest political party in Africa.

    Rivers APC berated Wike and his “inglorious co-travellers” for attempting to denigrate and disparage Amaechi over the $43 million saga.

    It said: “It is very sad and unfortunate that over two years that Rt. Hon. Chibuike Rotimi Amaechi led APC to dust PDP in the 2015 general elections, the PDP leaders, up till date, have refused to forgive Amaechi for disgracing them out of power and salvaging our nation from a system whose corruptive tendency is not only contagious, but legendary.

    “It is on record that apart from the Abuja residence of Amaechi, he has no other single plot of land in any part of this country. So, linking him to the ownership of the contentious Ikoyi estate and the huge sum of money found in it are nothing but an invidious plot to give a dog a bad name in order to hang it.

    “It is sad and shameful that a frustrated and disgraceful group with Wike and Fayose as the key actors should attempt to tarnish the hard-earned reputation of Amaechi, just because he collaborated with other patriotic Nigerians to oust a regime that is now exposed as the most corrupt ever in the history of Nigeria.

    “We sincerely sympathise with Wike, Fayose and Fani-Kayode in this failed plot, which has once again exposed them for their lowly type of life, even as we wish to remind them that one day, we all shall stand before God Almighty to give account of the type of politics people like them are promoting in Nigeria, devoid of integrity and ideology.

    “It has become very obvious that Wike and Fayose now derive pleasure from mentioning Amaechi’s name whenever any negative thing happens, in order to remain relevant and revive their dwindling political fortunes.

    “Instead of Wike and Fayose to face the myriad of problems they have created for themselves, PDP and their states, they prefer to preoccupy themselves with how to drag the name of Amaechi into every imaginable controversy. Their thinking is that by pulling down Amaechi, PDP will come back to power in 2019 to continue with their looting spree and destruction of our economy.

    “They (Wike and Fayose) truly deserve sympathy, because they are living in a fool’s paradise, as Nigerians are now wiser and will never entrust their fate in the hands of wicked and shameless looters like Wike and his co-travellers.”

    Fani-Kayode,a chieftain of the Peoples Democratic Party (PDP) appeared to have fired the first salvo when he alleged on Twitter that the money and the Ikoyi apartment where the Economic and Financial Crimes Commission (EFCC) found the money belonged to Amaechi.

    He soon found an also took to  Twitter and said:“Just hearing with one ear that Amaechi may have link to the House.”

    Amaechi’s spokesman,David Iyofor replied the two accusers immediately.

    Fani-Kayode dismissed as fake,suggestions that the money belonged to the NIA.

    He said: “The $43 million is Rotimi Amaechi’s. He owns the flat it was found in too.NIA story is fake news! NIA does not keep cash in Minister’s flats!”

    Amaechi’s aide Iyofor would not let the accuser get away with it.

    He said: “FAKE NEWS. Show us the title documents with Amaechi’s name as the owner or shut up. When normal pepl talk, this one also wants to talk. SMH.”

  • Judge withdraws from Nenadi, Fani-Kayode’s trial

    Justice Muslim Hassan of the Federal High Court in Lagos on Thursday withdrew from adjudicating the trial of former Minister of State for Finance, Senator Nenadi Usman and former Minister of Aviation, Chief Femi Fani-Kayode.

    He declined jurisdiction and transferred the case file to the Chief Judge, Justice Ibrahim Auta, for re-assignment to another judge.

    The judge directed the defendants, who are on bail, to await the CJ’s directive.

    When the case is re-assigned, the defendants will be re-arraigned and the trial will begin afresh.

    The Economic and Financial Crimes Commission (EFCC) arraigned the defendants on a 17-count charge of laundering about N4.6billion, to which they pleaded not guilty.

    The prosecution called only one witness, but defence counsel refused to cross-examine him because they had pending applications challenging the court’s jurisdiction.

    Usman and Fani-Kayode were charge along with former National Chairman of the Association of Local Government of Nigeria (ALGON) and ex-Chairman of Kagarko Local Government Area of Kaduna State, Mr. Yusuf Danjuma and a company, Jointrust Dimentions Nigeria Limited.

    Usman prayed the court to allow her to be tried separately from Fani-Kayode and for her trial to be transferred from Lagos to Abuja for convenience.

    The ex-minister also said she needed to travel abroad to treat breast cancer.

    Fani-Kayode asked the judge to disqualify himself from adjudicating on the case.

    He contended that Justice Hassan, who worked as Head of Legal at the EFCC before his appointment as a judge, signed the money laundering charge for which Fani-Kayode was previously tried and acquitted by Justice Rita Ofili-Ajumobia on July 1, 2015.

    Ruling on the applications on Thursday, Justice Hassan said even though Fani-Kayode did not present any evidence of bias against him, he would exercise “caution” by returning the case file to the CJ.

    Plans by the prosecution to open trial in the alleged N26 million fraud case against former Aviation Minister Femi Fani-Kayode failed yesterday as its prosecution failed to turn up in court.
    The Economic and Financial Crimes Commission (EFCC) started the case late last year when it filed a five-count charge against Fani-Kayode before the Federal High Court in Abuja.
    The EFCC accused Fani-Kayode of diverting N26 million allegedly received from the Office of the National Security Adviser while Sambo Dasuki was in office.
    It also accused him of handing the N26 million without going through financial institution as required under the Money Laundering Act.
    When parties got to court yesterday, everyone expected the prosecution to open trial by calling its first witness, but prosecuting lawyer, Jonson Ojogbane, stunned all when he expressed surprise about his witnesses’ absence.
    Ojogbane told that court he was surprised that his witnesses did not turn up for the day’s proceedings.
    He said he had expected to meet them in court, but was surprised the witnesses were nowhere to be found.
    He said in view of the development, he was left with no option than to appeal to the court to grant an adjournment to a later date to enable him investigate what went wrong.
    Defence lawyer Ahmed Raji, who did not object to Ojogbane’s request for adjournment, said the prosecution’s witnesses failure to attend court might have been because the prosecution failed to make the necessary arrangements.
    Trial judge, Justice John Tsoho, adjourned till April 7 for the prosecution to open its case.

    Former Minister of State of Finance Senator Nenadi Usman yesterday prayed the Federal High Court in Lagos to order her tried separately rather than with his co-accused, former Minister of Aviation Chief Femi Fani-Kayode.

    The Economic and Financial Crimes Commission (EFCC) arraigned them on a 17-count charge of laundering about N4.6 billion.

    They pleaded not guilty.

    They were charged with former National Chairman of the Association of Local Government of Nigeria (ALGON) and ex-Chairman of Kagarko Local Government Area of Kaduna State, Mr. Yusuf Danjuma and a company, Jointrust Dimentions Nigeria Limited.

    Usman prayed the court to allow her to be tried separately from Fani-Kayode and that her trial be transferred from Lagos to Abuja for convenience.

    Arguing the application yesterday, her lawyer Abiodun Owoniko (SAN) said: “The issue of venue of a criminal trial is governed by the nature of the offence and the place it was committed.”

    He said the Supreme Court held in the case of Rhoda vs FRN that offence that was committed in Kano could not be tried in Abuja.

    Owonikoko said her client’s application was based on the grounds of Usman’s health condition, the fact she lives in Abuja and therefore has to travel to Lagos each time the case comes u, and the fact that most of the witnesses were based in Abuja where the alleged offence was committed.

    “She spends a day traveling from Abuja to Lagos, spends another day for the trial and the third day returning to Abuja; all at her expense when all her accounts have been frozen. That is a most unbearable hardship.

    “On the issue of convenience of forum, the end of justice will be served if this case is taken to where the offence was allegedly committed. The fact that arraignment has taken place does not mean the case cannot be transferred,” Owonikoko said.

    Urging the court to separate Usman’s trial from Fani-Kayode’s, the senior advocate said only one of the 17-count charge dealt with conspiracy.

    “All alleged conspirators need not be charged in one case, and there will be no consequence if they are tried separately,” he said.

    Opposing the application, EFCC’s lawyer Rotimi Oyedepo said the chief judge could not exercise his powers to transfer a case where the prosecution had called its first witness.

    Besides, he said 13 of the listed 17 witness live in Lagos, adding that the law cited by Owonikoko did not apply to the case.

    “Severing the charge will mean duplicating evidence before different courts. I urge your lordship to refuse this application,” he said.

    Fani-Kayode’s lawyer Norrison Quakers (SAN) moved the former minister’s application asking the judge to disqualify himself from adjudicating the case.

    He contended that Justice Muslim Hassan, who worked as head of Legal at the EFCC before his appointment as a judge, signed the money laundering charge for which Fani-Kayode was previously tried and acquitted by Justice Rita Ofili-Ajumobia on July 1, 2015.

    Quakers said: “The court is not constituted to guarantee the second defendant fair hearing, and the venue is also not convenient. I urge the court to recuse itself from trying the second defendant. Once the issue of bias is raised, the court must recuse itself.

    “Having been a prosecutor and having had the responsibility of evaluating the facts leading to the institution of a charge, and for which he was subsequently discharged, and less than a year after, a fresh charge is now being instituted against the officer who prepared the charge…”

    Quakers said while judges ought to operate as if they were blindfolded, like the lady justice, “the blindfold is sometimes removed on primordial sentiments”.

    Oyedepo opposed the application, saying although Justice Hassan signed the charge as Head of EFCC’s Legal Department, the case was prepared and prosecuted by an external counsel, Mr. Festus Keyamo.

    “At no time did the judge feature in the trial. We (EFCC) were also extremely scolded by your lordship when the applicant was re-arrested in court in relation to another matter.

    “Nothing has been placed before my lord to justify the likelihood of bias. This application is only intended to whip up sentiments and paint the court in bad light.

    “It is not for any party to decide the judge that will adjudicate on his case. I urge the court to dismiss the application.”

    Justice Hassan adjourned until March 16 for ruling.

    Former Minister of Aviation Chief Femi Fani-Kayode, yesterday described members of the Peoples Democratic Party (PDP) seeking support for Ali Modu Sheriff as “naive and misguided”.

    In a statement, he said: “Those that say that they will work with Ali Modu Sheriff are misguided and naive.

    “Worse still anyone that calls for members of the PDP to rally behind him and recognise him as our National Chairman is a simpleton and a fool.

    “I say this because the man is evil: he is an agent of destruction and no good can come out of him. I was the first to see him for what he was and “I said so publicly.

    “Then came the PDP Ministers Forum who also stood their ground. At first no-one believed us until eventually 90 per cent of our party members lined up behind those of us that opposed Sheriff and that supported Makarfi.

    “I read his insulting comments about Fayose and Wike and I laughed. Are these not the very same people that brought him in the first place and convinced others in the PDP Governors Forum to support him?

    “Now he has finished using them to get what he wanted he is insulting them and saying that they must be kicked out of the party and dealt with.

    “I say shame on him because that will never happen. Fayose particularly has proved his worth to Nigeria and Wike has stood firm and strong in defence of his people and state. They are both lions and I am proud to stand with them and Makarfi.

    “Sheriff is nothing but a traitor who is biting the fingers that fed him. Fayose is one million times the man he is. As a matter of fact so are almost all the governors and other party leaders. Sheriff comes nowhere near any of us in any shape or form.

    “This is a man whose fundamental purpose and ambition in life is to sell the PDP down the river and to help the ruling APC and the Buhari government to destroy us and win the presidential election in 2019.
