    UPDATED: Why Supreme Court retained Fubara, Kefas, Aliyu as Rivers, Taraba, Sokoto governors

    The Supreme Court on Thursday, January 25, affirmed the elections of Siminalayi Fubara, Agbu Kefas, and Ahmad Aliyu as governors of Rivers, Taraba, and Sokoto states.

    In three separate judgments, a five-member panel of the apex court held that the appellants failed to establish their claims as required.

    The first judgment was on the appeal by Tonye Cole, who was the candidate of the All Progressives Congress (APC) in Rivers State.

    Cole had, among others, prayed the court to void Fubara’s victory, claiming that the election was marred by corrupt practices, adding that it was not conducted in substantial compliance with provisions of the Electoral Act 2022.

    He also claimed that Fubara did not validly resign his previous position as required by the law before the election was held.

    Cole alleged that Fubara continued to sign documents as the Accountant-General of Rivers State, even after he was nominated as the candidate of the PDP for the governorship election.

    Justice Ibrahim Saulawa, who read the lead judgment of the Supreme Court on Thursday, resolved all four issues identified for determination in the appeal against the appellant.

    Justice Saulawa held that the appeal was devoid of merit, dismissed it and proceeded to affirm the judgment of the Court of Appeal, which earlier upheld Fubara’s election.

    The second judgment was on the appeal by Muhammad Sani Yahaya of the New Nigeria Peoples Party (NNPP), who sought the nullification of Kefas’ election as the Governor of Taraba State.

    Justice Mohammed Lawal Garba, who read the lead judgment, found that the appeal was without merit.

    Justice Garba held that the Court of Appeal was right to have earlier dismissed the appeal on grounds of incomplete record of appeal.

    He noted that the part of the record of appeal that was omitted and not transmitted to the Court of Appeal was crucial and essential for the determination of the case.

    The judge said the omitted part of the record contained the testimonies of polling unit agents called by the appellants at the trial tribunal in support of their claims relating to invalid votes

    Justice Garba held that there was no way the Court of Appeal could have determined issues raised without the omitted records.

    He consequently adjudged the appeal unmeritorious and dismissed it.

    The judgment then affirmed the judgment of the Court of Appeal which upheld Kefas’ election.

    The third judgment was on the appeal by Sa’idu Umar, who was the candidate of the Peoples Democratic Party (PDP,) in the last governorship election in Sokoto State.

    Umar and his party had sought to void Aliyu’s election, claiming that Aliyu and his party, the APC were erroneously declared winners of the election because they did not secure a majority of valid votes cast at the election.

    They alleged other malpractices, including that Aliyu submitted forged academic credentials, that he was not qualified, and that he did not accompany his Form EC9 with an affidavit as required by law.

    In the lead judgment, Justice Tijjani Abubakar resolved all the issues distilled for determination, against the appellants.

    Justice Abubakar held that the appellants failed to prove their claims and proceeded to dismiss the appeal.

    He affirmed the November 27, 2023 judgment of the Court of Appeal, which earlier upheld Aliyu’s election.

    BREAKING: Fubara hails God, Tinubu, Wike for victory at Supreme Court

    Rivers state governor, Siminalayi Fubara, has expressed his gratitude to God, President Bola Tinubu and the minister of Federal Capital Territory (FCT), Nyesom Wike, for his triumph at the Supreme Court.

    The governor declared his resolve to remain committed to the purpose for which he was elected as governor saying nothing would distract his governance.

    Fubara restated his commitment to governance on Thursday while reacting  to the Supreme Court’s affirmation of his election as the governor of the state.

    He said his triumph at the apex court had laid to rest the legal battles that added to the distractions his administration grappled with in the last eight months.

    Fubara expressed gratitude to God for His help and to President Tinubu for his fatherly role concerning the internal crisis and the litigation against his election.

    The governor in a statement signed by his special assistant, media, Boniface Onyedi, also extended gratitude to Wike, whom he described as his “Oga”, for all his support.

    The governor called on everyone to join hands with his administration to build a competitive state that would be reckoned with as truly prosperous in all ramifications.

    He said: “About an hour ago, the Supreme Court revalidated our mandate in the election. It is a victory for the entire State.

    “It is important for us to note that we need this victory to consolidate the purpose of governance. Prior, we have had a few distractions here and there.” 

    “And the good news that came to us this morning is a refreshing  strength that will encourage us to continue the good works in governance.

    “We have a dream of making it a highly competitive State that will measure, if not up to Lagos but close to becoming like Lagos. We can only achieve this in an atmosphere of peace.

    “So I am calling on everyone, not just on our internal issue but those members from other parties, the issue is settled, come and let’s build the Rivers State of our dream.

    “We will continue to protect and provide the basic needs of governance to everyone who is doing business and who lives in Rivers State.

    “We would address our State very soon on the victory, but for now, let everybody be happy that one elephant is out of the road, the other one, by God’s help, will be resolved amicably and the family will be one.”

    The Supreme Court has affirmed the election of Siminalayi Fubara of the Peoples Democratic Party (PDP) as Rivers Governor.

    In unanimous judgment on Thursday, a five-member panel of the court held that the appeal by Tonye Cole of the All Progressives Congress (APc) was unmeritorious.

    In the lead judgment, Justice Ibrahim Saulawa held that Cole and the APC failed to prove their case with suffencient evidence.

    Justice Saulawa resolved all the four issues identified for determination in the appeal against the appellants’.

    Fubara ready for partnership, says SSG

    Secretary to the Rivers State Government (SSG), Dr. Tammy Danagogo, has said Governor Siminalayi Fubara is friendly and ready to collaborate with other federal agencies for optimum service delivery.

    He spoke when he received the new Comptroller of Immigration in Rivers State, CIS Mohammed Sadiq, the new Comptroller of Immigration, Rivers Marine Command, CIS Bashir Mohammed Lawal and members of their team in his office yesterday.

    He said: “Wherever it is necessary to support the Immigration Service, His Excellency, Governor Fubara, will certainly do so. Just recently, he supported the Immigration Service with the hosting of the Blue Economy Workshop to unravel new avenues to boost the economy of the state and bring new practices in immigration and blue economy.”

    The SSG said Fubara had also provided for the State Immigration Command, a second passport issuing office, which, he said, was a bigger edifice with modern facilities for quick passport issuance.

    He said: “I appeal that you ensure the two offices run simultaneously so that our people will have the opportunity of enjoying these services in real time.”

    CIS Sadiq said the visit was to appreciate Rivers government’s support to the NIS and to familiarise themselves with the SSG.

    “We have enjoyed many things and we are short of words to appreciate what we have seen. We are here to further seek support and assistance from the government,” he said.”

    Court voids Rivers N800b 2024 budget

    A Federal High Court in Abuja yesterday nullified the passage of  Rivers State’s N800 billion 2024 budget by five members of the House of Assembly.

    The court described the bill’s passage by the five lawmakers,  led by Ehie Edison, as an aberration and illegality.

    It consequently ordered Governor Siminalayi Fubara to represent the budget to the  Martins  Amaewhule-led Assembly.   

    However, the verdict drew mixed reactions from stakeholders in the state.

    While some civil society organisations (CSOs)  called on  Fubara not to re-present the budget, the state chapter of the All Progressives Congress(APC) said it should be represented in the interest of the people and the state.

    The judgment delivered by Justice James Omotosho was on a suit filed by the 27 members of the Assembly loyal to former governor of the state and Federal Capital Territory Minister Nyesom Wike. 

    Listed as defendants of the suit marked FHC/ABJ/CS/1613/2023  are the National Assembly, the Senate, the House of Representatives and the Clerk to the National Assembly.  

    Others include   Fubara, Edison,  the  Rivers State Civil Service Commission and the  Inspector-General of Police(IGP).

    Justice  Omotosho had while ruling on an ex-parte motion by the   27 legislators issued an interim order restraining Fubara and his agents from obstructing the pro-Wike legislators from carrying out their constitutional duties.

    He also restrained the governor from removing/redeploying the Clerk of the Assembly and withholding funds meant for the Assembly, pending the determination of the substantive suit.

    The judge extended the order on December 7 when the parties returned to court.

    But, while the order subsisted, Fubara presented the budget that the five lawmakers loyal to him passed. The governor also prevented the pro-Wike legislators from sitting by demolishing a part of the Assembly complex and withholding funds for legislative functions.

    Delivering judgment yesterday,  Justice Omotosho held that the five lawmakers’ passage of the budget and other actions taken while the  November 30   order subsisted amounted to nullity.

    He said Fubara acted like a tyrant in the manner the   Assembly complex was partially demolished and funds for legislative activities withheld.

    The judge issued an order restraining Fubara from frustrating   the Assembly-led by Amaewhule from sitting or interfering in its activities.

    He also described as unlawful, Fubara’s redeployment of the Clerk and Deputy Clerk out of the   Assembly, stating that the action amounted to an affront on separation of power.

    Justice Omotosho ordered the Clerk and the Deputy Clerk to resume office immediately and unhindered.

    Apart from also asking Fubara to promptly release all monies standing to the credit of the Assembly, he ordered the  IGP   to immediately deploy his operatives to the Assembly complex.

    The judge also barred the National Assembly from taking over the  Assembly or accepting or treating any request by  Fubara on any matter affecting the Legislature.

    Protesting CSOs ask Fubara not to represent budget

    Immediately after the judgment, some civil society organisations converged at the entrance of the Government House in Port Harcourt and advised the governor against representing the budget. 

    The placard-carrying members also asked the governor not to recognise Amaewhule as  Speaker.  

    Their leader,    Enefa Georgewill, said Fubara will not succumb to the pressure to further desecrate the 1999 Constitution by carrying out the remaining items in the peace accord.

    Georgewill argued that representing the already signed budget would amount to disregarding the Constitution and an invitation to anarchy. 

    Rivers APC hails judgment

    APC welcomed the verdict, saying it provides the governor with a new window to represent the budget.

    It argued that the budget was never presented in the first instance because the Ehie-led group did not meet the 1/3  statutory requirement of forming a quorum to conduct a Legislative business.

    “The budget was presented in error. There is no way four Assembly Members will be sitting as an Assembly when the law stipulated one-third, which is about 10 members. So it means that the Assembly never met, and for the Governor to take such a risk amounts to putting something on nothing,’’ said the APC Chairman Tony Okocha.

    Okocha added: “The  decision of the Federal High Court, which also stopped the Governor from interfering with the affairs of the Rivers State House of Assembly, is in order and is welcomed by us.”

    “Today’s(yesterday) decision of the Federal High Court is a victory for the people of Rivers State, as it has cleared the way for the governor to present the budget properly. “

    Justice James of the Federal High Court Abuja has nullified the N800 billion budget passed by the Edison Ehie-led faction of the Rivers Assembly signed into law by Governor Siminalayi Fubara.

    The court also upheld the suit filed by the Assembly and Speaker Martin Amaewhule, against Fubara, which sought an order of injunction restraining the governor from frustrating the Assembly under his leadership as speaker, among others.

    Rivers Assembly threatens to shun Fubara’s correspondences

    Members of the Rivers State House of Assembly have threatened to stop receiving/treating correspondences from Governor Siminalayi Fubara’s office.

    The threat followed observation of disrespectful behaviour of Government House workers to letters and messages from the assembly.

    Speaker Martin Amaewhule made the observation at plenary yesterday.

    The lawmakers unanimously agreed to shun Fubara’s messages “if the workers continue in the ill manners.”

    The assembly had asked the nine commissioner-nominees, who re-appeared before it yesterday for screening and confirmation, to take a bow and go.

    The nominees appeared during plenary at the new hallowed chamber of the House located in the Legislative Quarters, off PH/Aba Expressway, Port Harcourt.

    Amaewhule read the letter written to the House by Governor Fubara, requesting the screening and confirmation of the nominees as commissioners.

    The letter, which was reportedly dated December 11, 2023, had rested the earlier speculation that surrounded the list of nominees when it emerged from the House.

    The list was earlier dismissed in some quarters as a political gimmick, following doubts about whether the request was made by the governor or not.

    After the Speaker had read the letter, the Majority Leader, Major Jack, moved a motion appealing to the House to allow the nominees take a bow and go.

    Jack argued that since the nominees were screened and confirmed earlier, there was no need to repeat the exercise.

    The motion was supported by the Deputy Speaker, Dumle Maol, and the House asked the nominees to take a bow and go.

    With the screening and confirmation completed, it was learnt that the nominees may be sworn in and assigned their initial portfolios before the end of the week.

    Fubara inaugurates 16 new perm secretaries in Rivers

    Rivers state governor, Siminalayi Fubara has sworn in 16 new permanent secretaries for the state’s civil service.

    Inaugurating the permanent secretaries at the Executive Chamber of the Government House in Port Harcourt on Tuesday, January 16, Fubara urged them to avoid politics in discharging their duties to enable the civil service to operate professionally.

    The governor said the beneficiaries were chosen based on their competence in their various ministries noting that they could be trusted to offer greater service to the State.

     Fubara observed that most ministries were without proper administrative heads with some of them playing supervisory roles.

    He asked the permanent secretaries to deploy their positions in charting a proper course for the service and doing the right things always.

    The governor promised to provide a conducive environment that would enhance their productivity adding that his administration had promised Rivers people better welfare with thriving security.

    He said: “It is not just being lucky to be among the ones that are chosen to be permanent secretaries at this critical time of our government but living up to it. Know that it is not just an appointment, that after two or three months, your faces will start to change but to see it as a call to duty.

    “We have a lot to do for our people and your responsibility as permanent secretaries is so much. We have a lot of ministries that are not manned by adequate authority for a while now.

    “That is the reason why we have to appoint this number so that all the ministries will have administrative heads pending when they will have political heads.  So, we are doing this because we want to chart a proper course for this government.”

    The governor directed the Head of the Rivers State Civil Service, Dr. George Nwaeke to hand over official cars to the 16 newly sworn-in permanent secretaries.

    The permanent secretaries are, Hebron Wisdom, Dede Sampson Friday, Briggs Atemea Karibo, Nyempe Gregory, Ndah Emmanuel, Ngochindo James Epobari, Ishmael Tomonialadieokuma and Wakama Boma A. George.

    Others were Nweke Onyeche Kelvin, Okereuku Alwell Chinedum, Ndukue Patrick, Ichemati Maxwell Mbadiwe, Iwarilama-Brown Invingi Sabina, Ogolo Maurice Eric, Kejeh Ruhuoma Chinedu and Jacob Fayeofori Francis.

    Supreme Court reserves judgment in Tonye Cole’s challenge of Fubara’s victory

    The Supreme Court has reserved judgment on the appeal filed by Tonye Cole of the All Progressives Congress (APC) seeking to void the election of Rivers State Governor Siminalayi Fubara of the Peoples Democratic Party (PDP).

    The Independent National Electoral Commission (INEC) had declared Fubara winner of the March 18 governorship election.

    A five-member panel of the apex court, presided over by Justice Kudirat Kekere-Ekun, after taking final arguments from lawyers to parties, yesterday reserved judgment till a later date to be communicated to them.

    Appellants’ lawyer, Jibrin Okutepa (SAN), prayed the court to allow the appeal, set aside the judgment of the Court of Appeal, and grant the reliefs sought.

    Lawyer to Fubara, Mr. Emmanuel Ukala (SAN), and that of PDP, Mr. Joseph Daudu (SAN), prayed the court to dismiss the appeal and affirm the earlier judgment of the Court of Appeal.

    Cole and the APC are, by the appeal, seeking to set aside the November 28, 2023 judgment of the Court of Appeal, which affirmed Fubara’s election.

    The appellants are claiming, among others, that the election was marred by irregularities, non-compliance with the Electoral Act, and that Fubara did not resign before the election as required by the Constitution.

    They also alleged that Fubara continued to sign documents as the Rivers State’s Accountant-General after his nomination as the PDP governorship candidate for the election, allegations the governor has continued to deny.

    The court also dismissed an appeal by the candidate of the Allied People’s Movement (APM) in the election, Innocent Kere, after his lawyer applied to withdraw it.
