    UPDATED: Supreme Court reserves judgment in Tonye Cole’s appeal against Fubara’s election

    The Supreme Court has reserved judgment on the appeal filed by Tonye Cole of the All Progressives Congress (APC) seeking to void the election of Rivers State Governor, Siminalayi Fubara of the Peoples Democratic Party (PDP).

    Cole was the candidate of the APC in the last governorship election in Rivers State, in which the Independent National Electoral Commission (INEC) returned Fubara as the winner.

    On Monday, a five-member panel of the apex court, presided over by Justice Kudirat Kekere-Ekun, after taking final arguments from lawyers to parties, reserved judgment till a later date to be communicated to them.

    Appellants’ lawyer, Jibrin Okutepa (SAN) prayed the court to allow the appeal, set aside the judgment of the Court of Appeal and grant the reliefs sought.

    Emmanuel Ukala (SAN) for Fubara and Joseph Daudu (SAN) for the PDP prayed the court to dismiss the appeal and affirm the earlier judgment of the Court of Appeal.

    Cole and the APC are, by the appeal, seeking to set aside the November 28, 2023 judgment of the Court of Appeal, which affirmed Fubara’s election.

    The appellants are claiming among others, that the election was marred by irregularities, non-compliance with the Electoral Act, and that Fubara did not resign before the election as required by the Constitution.

    They alleged that Fubara continued to sign documents as the Rivers state’s Accountant-General after he was nominated the PDP governorship candidate for the election, allegations the governor has continued to fault.

    The court also dismissed an appeal by the candidate of the Allied People’s Movement (APM) in the election, Innocent Kere after his lawyer applied to withdraw it.

    We are performing as expected, says Fubara

    Rivers state governor, Siminalayi Fubara, has declared that his administration is performing as expected by the people of the state.

    He insisted that his government was addressing critical issues of governance and furthering the development of the state.

    Fubara spoke on Sunday, January 14, at the Thanksgiving and Interdenominational Church Service organized in commemoration of the 2024 Armed Forces Remembrance Day Celebration that was held at St. Cyprian’s Anglican Church, Port Harcourt Township.

     Fubara said that in attending to the duties of governance he prayed to God to grant his administration the grace to perform by meaningfully solving the socioeconomic problems of the people.

    Fubara according to a statement signed by his special assistant, media, Boniface Onyedi, said: “As a government, we are performing.  My prayer is for the Almighty God to grant us the grace to perform in a manner that when we leave office, people will remember us positively, not for negative purposes.”

    The governor, who described the security agencies as having their time to perform on the stage of life, said their quality of service galvanized people to celebrate them.

    He said: “It is not an easy thing for you to be on the stage just like we are today, and after performing people will remember you. So, I am happy that we are all associated with the good performance of the armed forces.

     “There are those, who have performed and gone, there are also those still performing especially the service commanders that are here with us. We also have the ones that are performing at the federal level. But the essence is that we are all performing for one purpose, and that is the unity of Nigeria and the protection of the country.

    “For us as a government, we will continue to give our support, not just to the fallen heroes as we are doing, but to also those who are alive to enable them to continue to defend the integrity of our country,” he added.

    In his sermon, Bishop of the Diocese of Niger Delta, Rt. Rev. Emmanuel Oko-Jaja called on the government, captains of industry, and all Nigerians alike to reflect on, honour, and support members of the military for their various levels of sacrifice in the protection of the territorial sovereignty of Nigeria.

    Bishop Oko-Jaja acknowledged that the positive traits of patriotism, firm belief in the unity of Nigeria, continual selfless sacrifice, commitment to building the nation and uncompromised dedication to duties are enviable qualities that make soldiers worthy of being celebrated.

    • PDP exco visits gov, backs disposition for peace

    Rivers State Governor, Siminialayi Fubara, says he was not coerced to sign or implement  the Presidential Peace Resolution  as being suggested in some quarters.

    Fubara told the state Executive Committee of the Peoples Democratic Party (PDP) during a solidarity  visit to him in Port Harcourt that his acceptance to implement the resolution was borne out of his desire and commitment for peace to  reign in the state.

    He said as a leader, his role is to ensure that there is peace in his domain at all times adding that no true leader would be a party to crisis under his watch.

     He then called on every Rivers son and daughter to join him in ensuring that peace continues to reign in the state.

    He expressed gratitude to the generality of the people of the state, particularly youths ,for standing by  him during the political turbulence ,saying that he would continue to pursue the course of peace in the state as no price was too much to pay for peace.

    The party leadership reaffirmed its total support for Fubara in his quest to ensure peace in the state.

    The state PDP Publicity Secretary, Tambari Sydney Gbara said the committee  warned those fanning the embers of war through  derogatory, unguarded and provocative statements to stop forthwith and allow peace to reign.

    Speaking during the visit,  the Acting Chairman of the party, Chukwuemeka Aaron commended the governor for pursuing peace  as demonstrated through his ongoing implementation of the Abuja Peace Accord.

    Aaron called on the people of the state to join in the governor’s peaceful disposition to bring about the needed development in the state.

     He said development could only thrive in a peaceful environment and cautioned those patronising divisions in Rivers.

    He thanked the governor for the N100,000 Christmas bonus to civil servants and other yuletide gifts to the party. 

    He encouraged Fubara to continue in his developmental strides saying that so far the governor had demonstrated capacity to govern the state with the execution of viable people-oriented projects.

    He named some of the projects as  the Port Harcourt Ring Road, Abonema ring road, Elelenwo Internal roads, Bori Internal roads, some roads in Etche, Ogba Egbema and Ahoada as well as the low income housing units, among others.

    Aaron maintained that Fubara was executing live-impacting projects in the state in barely six months in office.

    He further commended the governor for not letting the crises in the state deter him from embarking on programmes and projects designed to add value to the lives of residents in the state.

    He assured the governor that the party would continue to pray for the success of his administration pledging to ensure unity in PDP.

    President Bola Tinubu yesterday held a closed-door meeting with Rivers State Governor Siminalayi Fubara at the Presidential Villa in Abuja.

    The governor arrived the Presidential Villa at 5:35 p.m and headed straight to the President’s office.

    Details of the parley were not divulged to reporters last night.

    But the meeting might not be unconnected with the face-off between the governor and the Federal Capital Territory (FCT) Minister Nyesom Wike over the control of the Peoples Democratic Party (PDP) structure in Rivers State.

    Unlike the last time Fubara was at the State House in Abuja with a delegation of his loyalists for a peace meeting with Wike and the President, the governor was alone yesterday.

    He neither addressed reporters after the meeting nor uttered a word to them before leaving the Aso Villa.

    Rivers Assembly awaits Fubara’s 2024 Budget, others

    Rivers lawmakers yesterday resolved yesterday to notify Governor Siminalayi Fubara of the delay in presenting the state’s Medium Term Expenditure Framework and the 2024 Appropriation Bill to them for consideration and approval.

    The House of Assembly, which held its first plenary in the New Year, also expressed displeasure at the failure of the Auditor-General of the State to submit the 2022 audited account to the legislature.

    The lawmakers, whose names and positions were engraved on their new desks, observed the delay in receiving the budget estimate from the Executive for legislative consideration.  

    Fubara had earlier signed the Appropriation Bill he earlier presented to the Edison Ehie-led four-man lawmakers.

    But part of the resolutions in the Abuja peace accord signed by the governor required him to re-present the bill to a properly-constituted Assembly under Amaewhule’s watch.

    The governor, who said “no price is too much to pay for peace”, has vowed to implement the resolutions reached during the truce brokered by President Bola Ahmed Tinubu between him and the Federal Capital Territory (FCT) Minister, Nyesom Wike.   

    Voting on the matter, the lawmakers unanimously decided to write to the governor and notify him of the delay in presenting the expenditure framework and the 2024 Appropriation Bill in line with the Constitution.

    Citing relevant sections of the 1999 Constitution as amended, Amaewhule insisted that the legislature had the responsibility to receive the report of the state’s audited account.

    Amaewhule, in a statement signed by his Media Aide, Martins Wachukwu, ordered the House Committee on Public Accounts to investigate the reason behind the non-submission of the report.

    The Chairman of the Public Accounts Committee, Major Jack, requested the House to give the committee more time to conduct the probe and submit its report and got three weeks to do so.

    The House also gave First Reading to a Bill seeking to repeal the Rivers State Advertisement and Use of State-owned Property (Prohibition) Law No.7 of 2022.

    The Bill was sponsored and presented by the Member representing Port Harcourt Constituency II, Tonye Smart Adoki.

    It also, at its 90th legislative sitting, gave First Reading to a Bill seeking to amend the Rivers State Traditional Rulers Law No. 4 of 2015.

    The sponsor of the Bill and Majority Leader, represents Akuku Toru Constituency I, Major Jack, averred it sought to amend some sections of the Principal Law adding that when passed it would make the traditional rulers law to be in tune with current realities.

    Rivers State Governor Siminalayi Fubara has promised to complete the remaining section of the Etche-Igbodo road in Etche Local Government, following outcries by residents.

    The governor, after inspecting the road, observed its deplorable state and vowed to begin work to complete it.

    A statement signed by the governor’s Special Assistant, Media, Boniface Onyedi, said Fubara visited the area yesterday in response to complaints from residents in Umuohie-Igbodo communities.

    The governor was said to have driven on the entire stretch of the bad section to Okpala community of Imo State to assess the condition of the bad section and the level of work required to complete it. He said the past administration did a great job when it reconstructed Etche-Igbodo road and observed that the deplorable section was not completed then and had become a problem for residents and commuters.

    He said: “We got this complaint that a section of the Etche-Igbodo road that was not completed is creating a very big problem for the residents.” 

    “So, I know that the previous administration did a very great job here, so I came myself to see what the problem is and from what I’m seeing here, it’s really a problem. 

    “We, as a government we see what we can do immediately to complete this section so that there will be very easy traffic along this route.

    “It’s really bad, you can see that. I wonder how these people manage during rainy season because if we are in dry season, it is bad this way, then it must be terrible during the rainy season. So we will do something about it immediately.”

    Boyloaf to Fubara: shun sycophants, reconcile with Wike

    Ex-Niger Delta militant leader from Bayelsa State, Chief Ebikabowei Victor-Ben, popularly called ‘General’ Boyloaf, has advised Rivers State Governor Siminalayi Fubara to shun sycophants and pursue true reconciliation with the Minister of the Federal Capital Territory, Chief Nyesom Wike.

    He said despite the perceived support shown to Governor Fubura by some supporters within and outside Rivers State, he should pursue the path of peace and reconciliation with his predecessor for sustainable peace and development of the oil-rich state.

    The ex-militant leader expressed concern about delayed settlement of Rivers crisis.

    He said those fanning the embers of crisis were doing so because of their personal enrichment and interest.

    Boyloaf said: “Those fuelling the crisis will be nowhere near Fubara if something happens to his mandate as Rivers governor. It is too early for the happenings there. One way or another, they should find peace by reconciling their differences.

    “By now, Governor Fubura should ensure that peace reigns in Rivers State. God forbid, if something happens to his mandate, the same sycophants will be the first to abuse and abandon him. He should engage other peace-loving leaders to intervene and ensure true reconciliation is achieved as soon as possible.”

    Boyloaf, one of the major leaders and co-founder of the Movement for the Emancipation of the Niger Delta (MEND) and instrumental in the successful establishment of the Presidential Amnesty Programme (PAP), said Rivers and Niger Delta people know that ex-Governor Nyesom Wike is very important to the region.

    He said: “Wike stood strong in the battle to ensure the Southern Presidency of Asiwaju Bola Ahmed Tinubu when other Niger Delta elders and leaders were fighting for another Fulani man to succeed a Fulani man as President. It is not that Wike does not like the Fulani man, but he fought for true federalism, justice, equity and peace.

    “I want to also urge Governor Fubura to take a cue from the relationship between former Governor Seriake Dickson and Governor Douye Diri of Bayelsa State. The peaceful and harmonious relationship between Dickson and Diri is due to patience, understanding and loyalty. When Dickson supported Diri to become governor with the assistance of the Almighty God, despite all temptations, Diri refused to be drawn into battle with his predecessor.

    “It shows Diri is grateful and loyal, which made Senator Dickson to work openly and vigorously for the second term bid of Diri. It showed they worked for the peace of Bayelsa State and refused to allow sycophants to divide them.”

    Boyloaf cautioned those self-acclaimed pro-Fubura supporters threatening to make Rivers ungovernable if he is removed, saying they are only out for their personal interest and enrichment. 

    He added:  “Governor Fubura must not be deceived. If the fight continues and he is removed, there will not be any more network to his phone, because those agitating and making empty threats will abandon him and go to the next person.”

    “The late former Governor Diepreye Solomon Peter Alamieyeseigha (DSP) was removed from office and the heavens did not fall, but everybody moved on to support former Governor Goodluck Jonathan as Governor, before he eventually became President.” 

    On the repeated attempts by some politicians to turn the Rivers crisis into an ethnic battle, Boyloaf said their attempts were shameful and unfortunate, noting that Wike had proved himself to be more of an Ijaw man by actions, than many Ijaw elders and leaders, given his disposition to the empowerment and development of Ijaw sons and daughters.

    Fubara hails Army for tackling insecurity 

    Rivers State Governor Siminalayi Fubara has hailed the Army for tackling insecurity in the country.

    He said civilian-military cooperation remained the surest way to foster and strengthen a healthy society.

    Fubara spoke at the weekend during the 6 Division Combined West African Social Activities (WASA) at the 29 Battalion Parade Ground, Port Harcourt Barracks.

    The governor, represented by the Secretary to the State Government (SSG), Dr. Tammy Danagogo, said WASA was ideal in strengthening regimentation and promotion of family values in the Army.

    He said: “Let me take this opportunity to commend the officers and soldiers of this division for your sacrificial contributions in the maintenance of peace and order in Rivers State.

    “The state will continue to support and collaborate with the Army in all its activities. Be assured of our full support in all your operations.

    “The cultural displays and performances witnessed here today are clear testimonies of the diversity and strength of Nigeria as a nation. 

    “As you begin your activities for 2024, it is my hope that you will approach these activities with renewed zeal, vigour and commitment.”

    Explaining the reason for the WASA, the General Officer Commanding (GOC), 6 Division, Nigerian Army, Maj. Gen. Jamil Abdussalam, said it was established to strengthen relationship and social interactions among officers, their families and to display cultural heritage.

     He added that the 2023 training activities were designed to sharpen the capacity of officers and obtain positive gains.

    He said: “In the course of the year, we were able to make 112 arrests, destroy 233 illegal refineries and recover over 356 arms and ammunition. 

    “We will continue to contentiously perform our constitutional roles to defend democratic values in the country. I enjoin you all to remain dedicated and focused in the discharge of our collective responsibility.”

    Fubara picked to seal Rivers unity, says Wike

    Governor Siminalayi Fubara was fielded as Peoples Democratic Party (PDP) candidate in last year’s general election to foster unity in Rivers State, Federal Capital Territory (FCT) Minister Nyesom Wike said yesterday.

    He explained that the decision was taken by him and other elders of the state to ensure harmony and sense of belonging to all the sections of the state.

    Wike said if he had nominated a politician from his native Ikwerre ethnic group as successor, nobody would have stopped him, adding that he jettisoned personal interest in favour of unity and progress of the state.

    The former governor spoke at a luncheon he organised in Port Harcourt to mark the New Year.

    At the reception, party elders, former commissioners and other chieftains reiterated their confidence in Wike’s leadership.

    However, Fubara and his supporters were not at the event.

    The former minister recalled that to pave the way for Fubara, who hails from the riverine area, he had to prevail on other aspirants, including former PDP chairman, Bro. Felix Obuah, to drop his ambition.

    Wike said to avoid acrimony within his political family, he bought the forms for the PDP aspirants, including the governor.

    He recalled that he invited Obuah, a frontrunner for the governorship poll, to his house and asked him to quit the race and become the Director-General for the campaign, stressing that he made a  sacrifice.

    Hailing Obuah for his loyalty, he also recalled that he still resolved to stand firm with him, despite the seizure of his property by his predecessor.

    Wike said: “Felix Obuah was in my team as chairman of the party. My predecessor seized Obua’s property; everything he owned, land, schools and hotels. The wife cried to him, but he told his wife, ‘don’t worry, if it is the will of God, there is nothing you can do. He stood firm. They took everything he had.

    “He was one of the frontrunners in 2023 governorship election. I told him in my house to step down; that he won’t run. He looked at me, but I say you won’t run. He said if that was what I am saying that he won’t run. But I say you will be DG, go and campaign for that election.  I say you must be DG and he said if that is what you want, I will go and do it. And he did it. I see all kinds of things going on. They are talking evil about him. But he is here and he will still be here.

    “Those who open their mouth to talk.don’t know anything. I was the one who paid for the forms for anybody who wanted to run for elections as governor, House of Assembly and National Assembly. Let one person raise his hand and said he bought forms.

    “We say we are all family members, no need for acrimony. Don’t spend your money, we will agree on who will run. The day we took the final decision, the chairman of elders council nearly collapsed. He is here. OCJ was there, Awuse was there. Omehia was there.

    “He nearly collapsed. Why? He wanted a governor from the riverine area. When I looked at him, I say why would I allow this old man to just die. I say let’s not create the impression that there are people who want to monopolise power.

    “Let’s allow everybody to be part of it because we belong to one Rivers State. If I had wanted, nobody would have stopped me. Nobody had what it takes to even near me.

    “And to God be the glory, I don’t regret what I did and I will never regret what I did because I want the unity of this state for us to forge ahead. If I wanted Ikwerre man, nobody would have stopped me.”

    Wike insisted that he was interested in playing politics of unity. recalling that when he visited the Southsouth Chairman of the All Progressives Congress (APC), Victor Giadom, he went there with PDP leaders.

    He said: “The politics we play in this state is the politics of unity of Rivers State, not party. When I visited Victor Giadom, I went with all PDP leaders. Today, he is here with all APC leaders. Membership of party is not on radio or television. So, all of us must make Rivers State to move forward”.

    Wike said he was disposed to the peace agreement initiated by President Bola Tinubu, charging the stakeholders to implement it without conditions.

    Emphasising that he would never disobey the President, he commended the House of Assembly for immediately implementing its own side of the resolutions.

    He said: “I want to make one confession to you. I work with Mr. President and there is no way I can disobey Mr. President. It is not possible. The mere fact that Mr. President calls you and said look, allow peace here, there is no way I can disobey Mr. President.

    “I may not be happy in all resolutions, but if Mr. President calls for peace, who are you to say you don’t want peace?  I will not attach any condition to what Mr. President wants from me. I will not do it.

    “So, I must obey Mr. President. I must do everything humanly possible to see that the peace arrangement is achieved in Rivers. That is what is required and I am going to do that.”

    The minister apologized to people especially his friends, who obeyed his decisions, but were hurt by them.

    He said: “I am not perfect. I won’t say every decision I take I am right. I am human and I may take decision that may not be palatable with everybody. I accept it and if it turns out to be bad, forgive me.

    “Let’s move forward for the interest of the state. That is important. I took the decision and you listened to me. I want you to also listen to me now. Let’s accept what Mr. President has said. It is for the interest of Rivers and for Nigeria in general.”

    “It may not be the best, but there is no option. Mr. President took a lot of risk to give me minister of FCT. People protested, but he stood firm. If he could do that, you too should accept his decision.

    “When we came back from Abuja, within the next 48 hours, the Speaker and his people took the decision to obey Mr. President without attaching any condition. I thank Mr. Speaker and other members for respecting Mr. President.

    “Whether you are APC or PDP or you don’t belong to any of the parties, we owe a duty to give Mr. President support to move this country forward. Some people said I betrayed PDP. I never betrayed PDP. We stood firm and told Nigerians we won’t do this if this is not done. So, the issue of betrayal doesn’t arise”.

    The minister said he learnt from President Tinubu, who once taught him that betrayal and politics are mother and father.

    He recalled how Edo State Governor Godwin Obaseki betrayed the agreements they had to pave the way for his second term.

    Wike said: “It is not everything you invest that you will reap. Even, established companies crumble. You cannot say I did this, but I am not benefitting. God knows why it happens the way it happens. What is important in life is to give God the glory that you are alive to see what is happening.

    “When a man is dead, he doesn’t know what is happening. You will be able to advise your children and your friends. When the heat was on in Edo. This young man was a frontrunner in Edo governorship election.

    “PDP leaders came to me in Port Harcourt from 6pm to 6am the next day. I told the young man with Dan Orbih to withdraw and not to run for governor. He was crying and we agreed on what will be given to their group.

    “He was to be refunded the money he spent and to get four commissioners, but not one was kept. We said okay, you would run for Senate in the next election. But not one was kept .

    “But the next thing was blackmail that Wike wants to control this. But you didn’t know Wike wants to control when you came and held a meeting with me from 6pm to 6am. It was all about blackmail. That is what you see in politics.

    “You must have shock absorbers. President Tinubu told me when we were meeting that politics and betrayal are the same mother and father. If you don’t want to be betrayed, don’t enter politics.

    “So, prepare yourself that it will happen. I am fully prepared because I know it is one of the things President Tinubu taught me. I am laying this foundation so that some of you who are worried should not be. That is life for you. You must prepare yourself to know that these things happen. I have preached and continue to preach for the unity and for the peace in this state”.

    Wike mentioned names of people in the audience who stood firmly with him, saying that he had never betrayed them.

    Speaking on the Southsouth Chairman of PDP, he said: “God used Dan Orbih  to give us the structure of the party to run for the governorship election. God used him. And I will never in my life, it doesn’t matter the circumstances, deny him.

    “Why am I going this far? It is to let you know that I don’t abandon people who had stood for me. I may not do what you exactly want me to do, but I will never betray you”.

    On why the Rivers crisis escalated, Wike said: ” Ask people why this matter came to this level. When people went and plotted the removal of the Speaker, you think we will fold our hands to remove speaker?

    “We will start with you first. You want to humiliate us to remove Speaker? They said I should go and talk to the assembly men and I said why. They said you brought them. But I said so, these ones will listen to me, but you you won’t listen. They said chairmen of councils don’t respect anybody. But I said how, why won’t they respect anybody? People plotting evil and nobody wants to talk.

    “We must make impact on people lives. Whatever position you find yourself, make impact. Forget about these people who cannot face me to fight me. I consumed them before and I will continue to consume them. Show them the way. Follow man that knows the way”.

    We must support Tinubu, says Ortom

    Former Benue State Governor Samuel Ortom, who spoke for the “G5,” said they were happy that Tinubu becale President.

    He said the aim of the G5 was to actualise Southern Presidency, adding the group has obligations to support the president.

    Ortom thanked Tinubu for choosing to work with Wike, based on his capacity.

    He said: “The last administration took Nigeria from top to bottom. Nigeria was taken 50 years backward. President Tinubu needs time to take Nigeria from bottom to the top.”

    Ortom called on people fanning the embers of crisis in Rivers State to stop and allow the state to remain in peace and unity.

    The Speaker of the House of Assembly, Martins Amaewhule, and  24 other lawmakers who defected from the PDP to the All Progressives Congress (APC) were presen at the ceremony.

    Also at the event were former Enugu State Governor Ifeanyi Ugwuanyi, Prof. Zacchaeus Adangor, George-Kelly Alabo andother commissioners in Wike’s camp, who resigned from the State Executive Council, the Chairman of Port Harcourt Local Government Area, Allwell Ihunda, Senator Barinada Mpigi from Rivers South East, Kelechi Nwogu from Etche/Omuma Federal Constituency, ex-Speaker of Rivers Assembly, Awaji Igbani and Senator Allwell Nyesom.

    Also present were Victor Giadom, Orbih, OCJ. Okocha, Sergeant Awuse, Kingsley Chinda, Desmond Akawor, Felix Obuah among others.

    Alabo, who spoke for the ex-commissioners, pledged allegiance to Wike, saying:“We stand with you in every circumstance.”

    He said Wike delivered Fubara from the riverine and dry areas after may years of agitation.

    Alabo said:  “As a principled politician, we believe that every river that forgets its source runs dry.

    “You pulled your machinery and told all generals to go to the trenches and go to work and deliver this candidate, whether we like this candidate or not.

    “We moved to the field and delivered the result. Your Excellency, that same machinery is still alive.”

    Alabo commended Tinubu for his intervention in the crisis in the state, saying his position was satisfactory.

    Giadom said a band of prayer warriors has been set up to pray for Wike to defect to the APC.

    The Chairman of Rivers Elders’ Council, Chief Ferdinand Alabrarah, who  told Wike that all his structures were intact, condemned ethnic politics in Rivers.

    He said: “You are detribalised and your legacies will endure for generations to come. The elders will continue to be with you and support you”.

    Orbih said Wike kept PDP intact in Rivers and the country, describing him as an ambassador of the party.

    He added: “There is nothing we cannot do to advance the course of nation building. It is not about PDP, but Nigeria.”
