    • National Assembly barred from taking over function

The Rivers State House of Assembly has got the nod to perform its legislative functions without let or hindrance.

A Federal High Court sitting in Abuja, Federal Capital Territory (FCT), ordered the lawmakers to hold plenary, pending the determination of the motion on notice.

The court also restrained the Rivers State Government from withholding funds meant for the Assembly and barred the National Assembly from taking over its functions.

Also, the court presided over by Justice J. K. Omotoso restrained the Rivers Government from transferring the clerk, the deputy Clerk and any other employee appointed by the Assembly.

The lawmakers,  led by Speaker Martins Amaewhule, rejected moves by the police to stop them from gaining access to the Assembly complex where they held a valedictory session for their deceased colleague, Denobari Lolo.

Also yesterday, Governor Siminalayi Fubara vowed not to surrender his mandate to what he described as sabotage, intimidation and blackmail.

Agroup, the Movement of Izon Ethnic Nationalities in the Niger Delta (MOSIEND), lamented that enemies were stoking the crisis.

The Abuja court issued the orders restraining the state government, following a suit brought before it by the Assembly and the Speaker.

Defendants in the suit are the National Assembly, the Senate President, the Deputy Senate President, the Senate Majority Leader, the Senate Minority Leader, the Speaker of the House of Representatives, the Deputy Speaker, the House Majority Leader and the House Minority Leader.

Others are the Clerk of the National Assembly, the Governor of Rivers State, the Rivers State Commissioner for Finance, Rivers State Attorney-General, Rivers Civil Service Commission and the Inspector-General of Police.

Ruling on the motion,  Justice Omotosho granted the reliefs sought by the plaintiffs.

The court observed that the affidavit in support of the motion exparte showed that more than two-third or 25 of the 31 members were sitting and transacting business.

The court said:  “Rivers State House of Assembly is a constitutional institution that needs to be preserved pending the determination of the motion on notice”.

Consequently, the court issued an order of interim injunction restraining the first to 14th defendants from taking over the functions of the Rivers State House of Assembly or in any manner assuming the roles and functions or duties of the Assembly, pending the hearing of the motion on notice for interlocutory injunction dated and filed November 29.

The court also issued an order “restraining the 11th to 14th defendants from withholding any amount standing to the credit of the Rivers State House of Assembly in the consolidated revenue fund of Rivers State, including salaries and emoluments due and payable to the Speaker, Deputy Speaker and other members of the first plaintiff as well as to the clerk, deputy Clerk and other members of staff of the House in any manner whatsoever denying the assembly of due fund for running it’s affairs pending the hearing of the motion on notice”.

The court said: “The above orders are made basically on the fact that the 25 members out of 31 Rivers State House of Assembly are sitting and transacting business, therefore, the plaintiff/applicants are hereby ordered to enter to undertake as damages to the tune of N1bn if it is discovered or established that less than 25 members or two-third of Rivers State House of Assembly are not sitting and transacting business as stated in the affidavit to support the motion”.

The court, in the copy of the order signed by its Registrar, Blessing Ugwu, adjourned further hearing till December 7.

    I won’t surrender, says Fubara

Fubara said no amount of intimidation will make him surrender his mandate to serve, protect and advance the fortunes of the state.

He said he will not relinquish the mandate he received from the people due to blackmail, adding that he would follow the path of peace to halt the crisis.

The governor spoke when he declared open the 115 and 116 combined Quarterly General Meeting of Rivers State Council of Traditional Rulers in Port Harcourt.

Fubara reaffirmed his commitment to serve with humility, sincerity of purpose and accountability.

He said: “Although these are trying times, let us not forget that Rivers State is our collective inheritance, presently under my watch, to protect, defend and advance it as the governor.

“I assure you that I will neither fail in this responsibility nor will I surrender our mandate and progress to intimidation, blackmail and deliberate sabotage. I reaffirm my earlier statement and recommit myself to the path of peace as there is nothing to gain in a state of needless crisis.”

Fubara said drastic measures would be taken to strengthen education, healthcare and social services in the state, adding that next year’s budget will address the issues.

He said: “We will also take deliberate steps to unlock the entrepreneurial spirit among our teeming unemployed youths through viable initiatives on skills development, entrepreneurship training and targeted investments in commercial agriculture.”

Fubara urged traditional rulers to be upright, stressing that as royal fathers of integrity, they should not compromise their neutrality.

He also enjoined them to be courageous to speak truth to power to keep their moral authority and legitimacy intact before their people.

Fubara said: “We must all be worried about the plight of our youths, especially those in rural communities, most of whom are poor, neglected and almost forgotten in government’s development plans, policies, and actions.

“As we all know, no human society can progress without peace and security. I will therefore, urge you to continue to work tirelessly for the preservation of peace and security to attract sustainable development to your communities.”

The governor urged the people to have faith in the Renewed Hope agenda of President Bola Ahmed Tinubu at the federal level.

He said President Tinubu has shown determination to pull the nation out of the prevailing economic nightmare and usher in a new era of sustainable economic progress.

The Chairman of Rivers State Council of Traditional Rulers, Ohna Sergeant Chidi Awuse, reiterated the Royal fathers’ support for the governor, saying that he is the best and trusted person to lead the state.

Ohna Awuse urged troublemakers fanning the ember of discord to desist and allow the governor to discharge the functions of his office.

Rivers State Commissioner for Chieftaincy and Community Affairs, Charles Amadi said his ministry will continue to maintain harmonious relationship with the traditional rulers and assist them in discharging  their roles.

    Enemies stoking  crisis, says MOSIEND

MOSIEND attributed the crisis to the enemies of the state, advising them to desist.

Its President-General, Ambassador Kennedy Tonjo-West,  who spoke in Port Harcourt,  said these enemies fuelled the crisis instead of appealing to the gladiators to embrace peace.

Tonjo-West called for peace, tolerance and forgiveness between the two parties, warning that  crisis would only destabilise Rivers.

He said any attempt to keep the state in perpetual crisis would discourage investors and deny the state of its benefits from the Federal Government.

He warned that the crisis could snowball into violent conflicts that can worsen the prevailing  economic woes.

    Drama at valedictory session

There was a mild drama at the Assembly premises as the police attempted to stop the lawmakers from gaining access to the Assembly to hold  a valedictory session in honour Lolo from Khana Constituency 2.

But, the lawmakers resisted the move, insisting that the event should hold inside the Assembly.

Security was beefed up around the complex with over 15 patrol vans of armed policemen deployed in the area.

But after the initial hiccups, the lawmakers were  allowed access to the complex for their  86th session, where they paid tribute to Lolo, who until his demise was the Chairman, House Committee on Environment.

The lawmakers acknowledged the intellectual doggedness and amiable  disposition of Loolo, recalling that he contributed meaningfully at plenaries and committee meetings.

Amaewhule described the deceased  as a lawyer, who  brought  his knowledge of the law to bear on his legislative duties.

He also described him as a humble and easy-going legislator.

Amaewhule recalled that Loolo deputized for him when he was a Majority Leader in the Eighth Assembly, adding that he handled the position with panache.

While describing him as legendary, the speaker who said he would be greatly missed by his colleagues, urged his family to take solace in God.

Fubara, who said he would not relinquish the mandate he received from the people to intimidation and blackmail, insisted that he would follow the path of peace, saying that needless crisis would not benefit the state.

IYC fumes over ‘political attack’ on Fubara

Ijaw Youth Council (IYC) Worldwide has expressed displeasure about perceived “political attacks” on Rivers State Governor Siminalaye Fubara.

In a statement circulated to reporters in Warri, Delta State, yesterday, its spokesman, Amb. Binebai Yerin Princewill, noting that Fubara is an Ijaw son, warned that the IYC would no longer tolerate moves to undermine the governor.

The group urged President Bola Ahmed Tinubu to call the Minister of the Federal Capital Territory (FCT), Nyesom Wike, to order over his alleged involvement in the matter.

The statement also called on the Rivers State House of Assembly to “jettison whatever plot it is hatching against Fubara,” advising the lawmakers to rather work with the governor to bring peace and development to the state.

Asserting that Governor Fubara is “doing everything possible to reposition Rivers State on the global map of development, but has been attacked politically by his predecessor and some undemocratic elements in the state in recent times,” IYC stressed that the Ijaw in Rivers State are not “second-class citizens,” and would not “joke with Fubara’s governorship”, having waited 24 years, while supporting others, to lead the state.

“IYC will always stand to defend and support Governor Fubara, who has within six months into his administration as governor demonstrated a high level of productivity in the governance of Rivers State. He is handling the state better than he met it.

“We are particularly addressing the press today by calling on His Excellency, the former Governor of Rivers State and now Minister, Federal Capital Territory (FCT) Abuja, Nyesom Wike, to steer clear from Fubara and his administration.

“The entire world knows how Wike administered Rivers State; he cannot claim God over Fubara. He should concentrate on his new office as Minister of FCT. He has done his best in Rivers State, hence he should allow others to do their best in the development of the state.

“It has become imperative we sound this note of warning to Wike because the Ijaw are tired of tolerating his continuous abusive and undermining shenanigans towards the Ijaw people of Nigeria, who have benevolently offered him nothing other than the name and fame he is enjoying politically today.

“He (Wike) started his onslaught on our traditional rulers in Rivers State by referring to them as ‘small boys’, ‘living fake lives’ and moved forward to abuse our revered Ijaw National Congress (INC) and Ijaw Youth Council (IYC) by asking thunder to fire them.

“We as a people will no longer tolerate his unprovoked display of hate and anger toward the Ijaw. It is our advice that Mr. Wike should jettison whatever plans he has to disrupt Fubara’s tenure as governor of Rivers State. Just the way others governed their tenures without any issue, Fubara should be allowed to rule his people peacefully.”

“It is not in the character of council to respond to everyone, but the misguided remarks of Wike against the Ijaw over time have reached a boiling point, hence our response. We are using this medium to caution Wike to respect the Ijaw anywhere in the world. Going forward, we will not accept such disrespectful comments from him,” the statement said.

It urged Governor Fubara to without delay “take full charge of the state.”

Jubilation in Rivers as Fubara signs agreements for construction of 20,000 housing units, spare parts market

There was jubilation in Rivers State at the weekend following the decision of Governor Siminalayi Fubara, to sign memoranda of understanding with two companies to commence the construction of 20,000 low cost housing units and a spare parts market in the state.

The agreement for the development of RIV/TAF City Housing Project on 1000 hectares of land and the spare parts market were signed for Rivers by the state Attorney-General and Commissioner for Justice, Prof. Zacchaeus Adangor.

The Managing Director, Chief Executive Officer, Mr. Mustapha Njie signed for one of the contracting firms, TAF Africa Global.

On the development of a Central Spare Parts Market, Prof. Adangor also signed for the State government while the Chief Executive Officer, Okoh Jeff and Engr. Charles signed for  GOSH Project Limited.

Speaking at the brief ceremony in Government House, Port Harcourt, Fubara charged the two investors to speed up the process for the development of the state.

He said the problem of housing for low income earners in the state remained  a huge concern but was being addressed with the provision of 20,000 units of affordable houses.

Fubara said though people already knew the mantra of his administration, consolidation and continuity, they also needed to understand that it included expanding the existing structure of the current city status.

He said: “We told our people that we are not limited to the vision we inherited, but included expansion, we meant it with all seriousness and you can see with what we have done today. The city will gradually start expanding, and not limited to our present structure.

“I am happy to say this, one of our greatest problems is housing for the low income earners. Our vision as at today, is to provide for those level of people. What we have done is to give our people hope.”

On the spare parts market, Fubara said  during the electioneering campaigns he promised dealers at Ikoku  in Port Harcourt that he would develop a modern market for spare parts to demonstrate his care for them.

It won’t be just a market, it will also bring about a level of development within that axis.”

He charged the investors to ensure immediate commencement of the projects and to carry out the groundbreaking without delay.

Speaking for TAF Africa Global, Mr. Mustapha Njie said a subsidiary of his company called Pricewise Home Nigeria Limited would develop 20,000 housing in phases on the 1000 hectares of land and thanked the governor for the confidence reposed in them to do the project.

Chief Executive Officer of Gosh, Mr. Okoh Jeff assured that they would be dedicated to delivering a central spare part market that would accommodate all traders in that business in one place.

Fubara: I’ll provide jobs for legionnaires’ children

Rivers State Governor Sir. Siminalayi Fubara has promised to provide jobs for legionnaires’ children.

He vowed that his administration would meet the expectations of people looking forward to enjoying improved personal economy in a peaceful environment.

Fubara spoke yesterday at the 2024 Armed Forces Emblem Appeal Fund Launching, held at the Banquet Hall of Government House in Port Harcourt.

He said without hope, it would be difficult for anybody to find any reason to live with optimism, adding that he found President Bola Ahmed Tinubu’s Renewed Hope Agenda instructive because it was aimed at restoring the lost hope in people by improving the national economy.

He said: “For us as a government, we believe, understand and also appreciate that the only thing that keeps a man going is when he has hope. When you don’t have hope as a human being, you are gone.

“The government of today did not make a mistake by naming their mantra, ‘Renewed Hope Agenda’. This hope is what we as a government will not take away from you. Rather, we will give you everything to see that there is hope.”

Fubara thanked the war veterans, both fallen and living, for making invaluable sacrifices that had kept the country united.

He recalled that as a child of a soldier, his late mother used to benefit from such welfare donations made on Armed Forces Remembrance Day.

The governor on behalf of the state government launched the emblem with N30million and promised to also redeem previous financial grants made to them.

Secretary to the State Government (SSG), Dr. Tammy Danagogo, said war veterans, fallen and living, had shown greater love in defending the territorial sovereignty of Nigeria and ensured that its citizenry lived in peace.

He asked for reciprocal gesture to the patriots by the citizens through support that would cushion their pains and lift members of the deceased families.

He said: “We, therefore, beseech your support now and always, so that the labours of these selfless

compatriots shall not be in vain. So that those fighting for us, right now, will be inspired.

“I invite you all to donate to the cause of these veterans, their widows and families. If you can give cash, let it create impact. If you can offer prayers, let it be effective. If it is job, let it be sustaining. But by all means, donate for the families of these forgotten patriots.”

    • Appellate court affirms Agbu as Taraba governor

The Appeal Court sitting in Lagos has affirmed the election of Rivers State Governor Siminalayi Fubara of the Peoples Democratic Party (PDP) in the March 18 governorship poll.

In a unanimous decision, the court dismissed four separate appeals filed by Tonye Cole of the All Progressive Congress (APC), Beatrice Itubo of Labour Party (LP), Innocent Ekwu of the Allied People’s Movement (APM), and Lulu Briggs Dumo of Accord Party (A).

In the lead judgment, Justice Olabode Adegbehingbe held that all the appellants failed to prove the allegation of non-compliance with the Electoral Act against Fubara.

The court faulted the Governorship Election Petitions Tribunal for dismissing Cole’s appeal on the ground that the APC that sponsored him had withdrawn its petition against Fubara’s victory.

The court also held that the fact that APC withdrew its petition against Fubara’s victory did not prevent Cole from pursuing his appeal.

The Independent National Electoral Commission (INEC) had declared Fubara, who polled 302,614 votes, the winner of the election.

Cole came second with 95,274 votes, while the Social Democratic Party (SDP) candidate, Senator Magnus Abe, and Itubo came a distant third and fourth with 46,981 and 22,224 votes.

Not satisfied with the declaration of Fubara as the winner of the election, Itubo, Cole and Ekwu filed petitions before the tribunal challenging the result.

Delivering judgment on Cole’s appeal, Justice Adegbehingbe held that APC and Cole did not file a joint appeal, adding that a political party cannot compel its candidate to file an appeal, neither could a candidate compel a political party to do the same.

Also, the Court of Appeal sitting in Abuja has dismissed the appeal of Sani Yahaya of the New Nigeria Peoples Party (NNPP) challenging the election of the Peoples Democratic Party (PDP) candidate, Kefas Agbu, as governor of Taraba State.

Yahaya and his party had challenged the result of the March 18 governorship election on the grounds of non-compliance with the Electoral Act.

The NNPP candidate also alleged that Agbu did not score the majority of lawful votes cast.

But delivering judgment yesterday, the appellate court held that the reliefs sought by the NNPP candidate were inconsistent, having faulted the outcome of the polls on grounds of non-compliance with the Electoral Act, yet praying the court to declare him the winner of the same election.

In a unanimous decision, the court dismissed the appeal of the NNPP for lacking in merit as did the tribunal on September 30.
