  • Young man’s killing by cop shakes Imo

    The killing of a 25-year-old man by a police sergeant in Imo State has led to the torching of a police station, the intervention of Governor Emeka Ihedioha, and a manhunt for the killer cop. OKODILI NDIDI reports

    In a feat of rage that was never known or ever seen among the people of Otoko in Obowo Council Area of Imo State, hundreds of youths defied the rifle and marched on a police station and razed it to the ground.

    That police station once held in awe by all in the community was desecrated by the rampaging youths who chased the policemen on duty into hiding and opened up the doors for those that were detained in cells.

    The Divisional Police Officer (DPO) was whisked away by officers in the division after the riotous youths attempted to lynch him.

    It was a day the sleepy community will never forget in a hurry. Innocent motorists were not spared the horror that attended the fury of the aggrieved youths.

    Their grievance: a trigger-happy policeman shot and killed one of the youths in the community, Mr. Ikenna Ogbunigwe in cold blood over a disagreement. The youths watched while the victim bled to death. The killer cop shot his way through the crowd and escaped.

    According to an eyewitness account, trouble started when the deceased confronted the police officer over a minor argument at a popular restaurant in the area.

    He said that the police officer pointed the gun at the victim and pulled the trigger, killing the victim on the spot before shooting into the air and escaped.

    In a swift reaction, the Imo State police command has identified the killer cop as Sergeant Okechukwu Nwanefi and subsequently declared him wanted over the death of the 25-year-old man.

    The state Commissioner of Police, Rabiu Ladodo, who visited the scene shortly after the news broke out, said the killer cop abandoned his rifle and ran away.

    He, however, said that the command had declared the fleeing police officer wanted for the unprofessional conduct.

    Ladodo said, “I am at the scene of the incident as I speak to you. The killer police officer has abandoned his rifle and run away. We have recovered the rifle. But let me assure the good people of Imo State that no matter how far he runs, we will find him.

    “I want to commend the leaders of the community for helping us to restore normalcy in the area. The youth have stopped rioting and the whole place is 100 per cent peaceful now”.

    Also commiserating with the family of the deceased, Imo State Governor Emeka Ihedioha, who visited the community, assured that justice will be served.

    Addressing leaders of the community, Ihedioha said, “the officer that provoked this action must be found and brought to book immediately, under no circumstance should a police officer who is supposed to protect the people and maintain peace go to the extent of killing a citizen he is meant to protect.

    “Adequate steps must be taken to forestall this kind of action. We should be cautious because human lives can’t be duplicated; it is the responsibility of anyone that carries arms officially to protect lives and property”.

    The governor noted that from his findings, the victim was not a criminal and so there was no justification for his death.

    He chided the community leaders for allowing the youths take the law into their hands.

    Referring to them, he said, “You have a duty to make available those persons that burnt the police station and made away with guns, it is a crime to steal guns and anybody doing it under the guise of retaliation is a criminal and must face the full wrath of the law”

    He equally mandated the Divisional Police Officer to ensure that all those that escaped from detention during the mayhem are found or be declared wanted.

  • EFCC accuses judge of favouring Saraki, Okorocha

    The Economic and Financial Crimes Commission (EFCC) has accused Justice Taiwo Taiwo of the Federal High Court in Abuja of exhibiting bias in favour of former Senate President, Bukola Saraki and the immediate past Governor of Imo State, Rochas Okorcha, in his handling of the cases they filed.

    The allegation is contained in two fresh motions the EFCC filed before the court, demanding the withdrawal of Justice Taiwo from the two fundamental rights enforcement cases filed by Saraki and Okocha.

    The EFCC said although it did not hope to always win its cases before the judge, the trend of Justice Taiwo’s orders in cases where it was conducting corruption/financial crimes investigations, made it difficult for it (the EFCC) to believe in the judge’s impartiality.

    The commission resorted to filing the fresh motion following the refusal by the court’s Chief Judge, Justice Adamu Kafarati to transfer the cases from Justice Taiwo’s court, as requested by the EFCC in a petition it earlier wrote against the judge.

    The grounds, on which the EFCC based its fresh motions, include that:  “His Lordship while sitting in Ekiti Judicial Division of the Federal High Court had in two previous cases involving former Governor of Ekiti State, Ayo Fayose, Attorney-General of Ekiti State and officials of Ekiti State Government given orders/decisions wherein the 4th respondent/applicant’s statutory powers to investigate economic and financial crimes were curtailed and gagged contrary to the established principles by superior courts.

    “One is suit number, FHC/AD/CS/32/2016 between A.G. Of Ekiti State vs. EFCC and 17 Ors, while the other has been upturned by the Court of Appeal in Appeal No. CA/EK/8C/2017 between EFCC V. Mr. Ayodele Fayose & Anor.

    “The 4th respondent/applicant does not expect to always win its cases before this honourable court, but the trend of decisions/orders being made against it by my lord in cases where it is conducting corruption/financial crimes investigations. has made it difficult for it to believe in my lord’s impartiality.

    “The 4th respondent/applicant had petitioned the Chief Judge of the Federal High Court seeking that this matter be re-assigned from my Lord’s court to another court, and the Chief Judge advised that a formal motion be filed to that effect.”

    It faulted the ex parte orders parte directing the respondents in the case, including the EFCC,”to stay all action in connection with the subject matter of this suit, to stay all action in connection with the subject matter of pending the determination of this suit”.

    The commission said the orders had an indefinite life span “since no one can state when the main case can be determined.”

    It added that the orders were in the nature of interlocutory injunction “which ordinarily requires the aderse party to be put on notice”

    The EFCC stated:  “Without considering the merit in the application vis a vis the venue of the alleged violation of the fundamental rights, the court made an interlocutory order without hearing from the respondents applicant.

    “It is well established legal principle that no court has the power to stop the investigative powers of the 4th respondent or any agency established under the laws to investigate crimes.”

    The commission argued that the orders issued by the court on May 9 and May 14, 2019 restrained it from performing its statutory duty.

    Other respondents in both cases the Attorney-General of the Federation (AGF), the Department of State Services (DSS), the Inspector-General of Police (IGP), the Independent Corrupt Practices and other related offences Commission (ICPC) and the Code of Conduct Bureau.

    The EFCC had, in its earlier petition to Justice Kafarati, May 21, 2019, accused Justice Taiwo of being bias against it.

    In the petition, signed by the EFCC’s acting Chairman, Ibrahim Magu, the commission equally complained about the ex parte orders made by Justice Taiwo on May 9 and 14, restraining the commission from continuing its investigations of certain corruption allegations against Saraki, and Okorocha.

    It requested in the petition the re-assignment of the two men’s cases and all other ones involving it in the judge’s docket to another judge of the court.

    It also recalled in the petition how the judge, out of alleged bias while sitting in the Ado-Ekiti Division of the court, gave rulings in favour of a former Governor of Ekiti State, Ayo Fayose.

    In their separate responses, Okorocha and Saraki urged Justice Kafarati to ignore the request by the EFCC, arguing that it was baseless.

    Saraki and Okorocha also contended that the orders made in their favour by the judge were justified owing to the circumstances of alleged harassment by the commission leading to their decision to file the cases in which the judge issued the restraining orders.

    When the cases came up on Thursday, Justice Taiwo drew parties’ attention to the fresh motions by the EFCC,to which lawyers to Saraki and Okorocha sought time to respond to.

    The judge consequently adjourned both cases till September 27, 2019 for the hearing of the motions.

  • Intrigues in states as govs battle to form cabinet

    Twenty-five days after their inauguration, most state governors are yet to constitute their cabinets, keeping their constituents and other stakeholders guessing on who may or may not get the nod. But people are not amused.

    They want the cabinets constituted as early as possible to clear the anxiety created by the current delay.

    Investigation across the states by The Nation showed that several factors are responsible for the delay.

    These include efforts by the governors to pick the best hands they can get; fulfil the promises they made to power blocks and individuals who helped them into office; accommodate as many vested interests as possible; and ensure balance and fairness in the spread of the appointments.

    Governor Emeka Ihedioha of Imo State for instance, will have to find a way of accommodating in his cabinet nominations from the Achike Udenwa, Emmanuel Iwuanyanwu and Kema Chikwe’s camps, all of which played critical roles in events leading to his emergence.

    The different power blocks are locked in a fierce rivalry over appointment into the governor’s cabinet and other positions.

    But the Chief Press Secretary to the governor, Mr. Chibuike Onyeukwu, said there are no ripples over political appointments by the governor.

    Ihedioha, according to him, is not under any form of pressure on appointments.

    “The governor is not under any form of pressure. His appointments so far have shown that he has taken his time to select across party divides, those he felt are capable of pushing the agenda to rebuild Imo State.

    “We built a lot of alliances across political parties during the election and the governor, in fulfillment of his promise to run an all-inclusive government, will partner and give all stakeholders a sense of belonging.”

    Appointments already made by Ihedioha include Chief of Staff, Secretary to the State Government, Attorney General, Special Adviser on Media and Chief Press Secretary.

     

    Gbagyi, CAN demand equity in Niger

    The Gbagyi and the Niger State chapter of the Christian Association of Nigeria (CAN) want Governor Abubakar Sani Bello to be fair in his distribution of appointments.

    Various Gbagyi groups say the governor should do the needful by balancing appointments.

    They claim they have been marginalised in the appointments made so far by him.

    The CAN in particular is not impressed by the appointments so far made by Bello.

    The local CAN Chairman, the  Reverend Mathias Echioda,  said the first major political appointments – Secretary to the State Government (SSG), Chief of Staff (CoS), Deputy Chief of Staff and Head of Service (HOS) –by the governor went to Muslims.

    This, he said, was unacceptable and hoped that the interest of Christians would be fully taken care of in the appointment of commissioners.

    He said: “We consider the most recent development as embarrassing. We consider it to be alarming, to be a disappointment.

    “Christians in Niger State participated very well and actively during the primaries, before, during and after the general elections. I can vouch that the level of our participation has never been like any other time in the state.

    “If we were that aggressive, if we were that involving, if we were that sacrificial, if we were that committed, if we were all giving to it as we did and it wasn’t a hidden thing that Christians were generally involved in the election. I know how much Christians overwhelmingly voted for the present administration, we therefore expected that we should have our share of the booty.

    “That is when you talk of the principal offices, at least something should be given to us because this was part of the complaints in the last administration but to our embarrassment, surprise and disappointment, we got to know that the governor has appointed an SSG, COS and HOS and none of whom is a Christian .

    “I can tell you that this is totally unacceptable.

    “We believe that this is equal to political robbery and we will not take that low at all because we contributed to enthroning the present administration. We should also be part of the decision making at the highest level in terms of management, policy formulation and policy implementation.”

    It is not clear yet when the governor is likely to constitute his cabinet.

    Lalong bidding his time, say sources

    Governor Simon Lalong of Plateau State has not made a single appointment since his swearing in for a second term last month, not even his aides.

    Sources told The Nation that the governor is bidding his time.

    It was gathered that about 10 names have been suggested to him by political associates from which to pick his press aides, but up till now, he is yet to decide on who to appoint.

    One source said: “The Gov Lalong  I know is going to base his appointments on trust. Yes, you may be a professional media person but the governor will want to verify how trustworthy you are.

    “The governor was disappointed by some people he trusted during the first term and , this time around, what is of paramount importance to him is trust.

    “The state is not lacking in good men and women, I mean technocrats and professionals, but the governor is looking for those he can trust and those with credibility.

    “This is his last term as governor, and he is being very careful not to bring in appointees that will embarrass government before the anti-graft agencies. The man wants to run a credible government and leave a legacy of credibility.”

    Other sources said the governor has told those recommending people for appointment as commissioners that he knows what he wants after having served as governor for four years already.

    Some of the former commissioners are said to be lobbying to be reappointed.

     

    ‘Abiodun still consulting  in Ogun’

    Governor Dapo Abiodun of Ogun State is said to be still consulting with stakeholders on his cabinet.

    “He is consulting widely. He is working very closely with party leaders and other stakeholders on the list,” an APC source said in Abeokuta.

    “This of course requires patience and diligence. He is not sleeping. He is working very hard on it.”

    Another source said whatever delay may be experienced, is actually due to the determination of the governor to form a broad based administration as promised during the campaign.

    The source said: “Check out all the appointments already made, I can tell you they were all arrived at after wide consultation with and approval of major stakeholders across the state.

    “He is not a governor who wants to do it all alone. He recognizes the place of the party and other organs and he is allowing time and chance for them all to make input into the list. This is why it appears it is being delayed but I can assure you the final output will justify the time spent on it. There is no crisis whatsoever anywhere about it,’ he said.

    The Nation, however, learnt that the governor may send the list of his nominees to the state assembly any moment from now.

    According to a prominent party leader in the state and a former commissioner, following various consultations and inputs, the list may have finally been streamlined to the required number.

    “What we had was a pool of suggestions as the governor allowed for all stakeholders to make input. But I think the governor should send the final list to the assembly soon. He has really worked very hard and diligently to come up with the very best for the state,” the source said.

     

    Serious lobbying on in Cross River

    Many ex-commissioners and other Peoples Democratic Party (PDP) members in Cross River State are going the extra mile to catch the attention of Governor Ben Ayade so that he might consider them for appointment as commissioners.

    While some show up at state functions for them to be noticed by the governor, others engage in charity activities that can give them publicity in the social and traditional media.

    The governor said, while flagging off of the rice wet season planting in Calabar recently, that those to be considered for appointment in his new term would be those who delivered in their polling units in the last general elections.

    This, however, does not exactly exclude those who the governor may have in mind as his party, the Peoples Democratic Party (PDP) generally did well across the state in the elections.

    During his first term, the governor made over 8000 appointments based on his food-on-the table policy: distribution of government funds directly to as many people as possible for the purpose of reducing poverty.

    But sources in the state say the policy may not be adopted this time around.

    “He definitely cannot even afford to employ 8, 000 people. The issue of 30, 000 minimum wage is on ground,” a source said.

    “The local government funds are not going to the state government as it was in the recent past. So, it is going to be difficult going with a large number of appointees and also there are projects littered all over, so he cannot attempt that.

    Besides, he has to take his time to get those who would enable him to achieve something before he leaves office. The time for jamboree is gone and now it would be business.”

    Ayade also  dropped a hint recently that some of the former commissioners “will come back but not in the same ministry.”

    He has retained Mr. Martins Orim as his Chief of Staff and appointed Mr. Godwin Nyiam as Acting Director General of the Department of Public Transportation (DOPT), and Engr. Oxford Egbe as Acting Director General of the Cross River State Development Control Agency.

     

    Clouds hang over composition of Oyo cabinet

    With three parties – African Democratic Congress (ADC), Zenith Labour Party (ZLP) and Social Democratic Party (SDP) – all claiming to have contributed to the victory of PDP’s Seyi Makinde as Oyo State Governor  during the last election, forming a  cabinet so early into his tenure is a huge task for him.

    The power-sharing formula agreed upon was 50 per cent for PDP, 30 for ADC, 15 for ZLP and five percent for SDP. The sharing, according to the agreement, will be at the state and local government levels.

    But upholding the agreement has been tough for Makinde as his PDP members are not dropping their guards at the local government level.

    Although they are fully in support of the formula for cabinet and board appointments, the PDP members and leaders are insisting that it will be impossible to allow non-PDP members to serve as local government chairmen.

    The situation is further compounded by the fact that members of the coalition are not willing to join the PDP. This has made the implementation of the coalition agreement more difficult for the new governor.

    It is unclear if those appointed into the cabinet among coalition members will be willing to join the PDP after a while to guarantee their loyalty and ultimate sustenance of Makinde’s administration.

    Within the next few weeks that the governor will form his cabinet, voters and politicians in the state are watching how Makinde will cross the hurdle. His success or failure in managing the coalition may determine what to expect in the 2023 governorship election in the state.

    I’ll appoint only the best hands, says Ortom

    Governor Samuel Ortom of Benue State says he is now free to pick the best hands as commissioners since he is no longer acting at the behest of any godfather.

    Only last Wednesday, he received the report of the Iyorchia Ayu-led committee on fashioning out how to constitute the next cabinet.

    Ortom claimed that during his first term, the commissioners were foisted on him by godfathers but now he is free from their influence.

    It was gathered that he may ask party leaders at the local government level to nominate three persons for him to choose one.

    PDP leaders torn apart in Delta over nomination for appointments

    All seems not to be well among PDP leaders in most of the local government chapters after Governor Ifeanyi Okowa called for the submission of three names for consideration for political appointments.

    The governor recently sent the names of eight commissioner nominees to the State House of Assembly for screening and approval as members of the Delta State Executive Council.

    Also sent to the Assembly were names of 15 Special Assistants.

    It is expected that more appointments will be made in due course.

    However, party leaders at the local government level are locked in serious battles to get the names of their own loyalists into the list requested by the governor for appointments.

    Some powerful individuals are alleged to have hijacked the process.

    Up for grabs aside the 25 ministries for which commissioners will be appointed and barring the creation of new ones, are positions such as special advisers, senior special assistants and special assistants.

    Also, Okowa is expected to constitute and appoint people to man the various governing boards, commissions, parastatals and agencies in the state.

    Okowa is also being expected to create new offices in his second term to either elevate some of his trusted aides or reappoint them into their former offices.

    It was learnt that the recent attack on a PDP faithful in Sapele, Mr. Godfrey Igbise, by thugs allegedly loyal to a former aide may not be unconnected with the fight for appointive positions.

    Another ex-commissioner is said to have incurred the wrath of youths in his locality for allegedly nominating himself for reappointment and hijacking the other slots.

    The Nation learnt that many local council areas across the state are experiencing upheavals from PDP loyalists who believe they worked for the governor’s reelection and deserve appointive position.

    But in a recent outing, Okowa assured party men that more appointments will be made, adding that appointments will be done equitably.

    He said, “I thank God that we have made some appointments recently; we are doing what is right, many more appointments will be done and I promise Deltans that I will be equitable, fair and just in the appointments we are going to make; going forward, we believe and rely on the guidance of God.”

    “More appointments will be made, we ask for the continuous partnership and prayers of all Deltans.”

    Responding to a question, Delta PDP Chairman, Kingsley Esiso, said while he is not aware of the allegations that party men are nominating themselves for appointments, it is not strange that many are keen to get into government.

    He said the state PDP will look into any Ward where such issues crop up, adding that if there are issues in a few wards in 270 wards, it will be wrong to say there is a crisis.

    His words, “I am not aware of such allegations, so I cannot respond to what I am not aware of. We have said that each ward should nominate three persons. Any ward where we have issues the members will protest.

    “If there is a protest we will look into it. Is it not natural? When we called for the list, it is an open list. We did not specify any condition for nominees.”

    Esiso maintained that with 270 wards there was bound to be issues in a few wards for which internal mechanism within the PDP exist to deal with.

    He assured Deltans to expect the release of nominees stressing that with the inauguration of the Delta State Assembly, the list will soon be made public.

    Aniocha North PDP chairman, Prince Victor Egbune, also denied pressure from any quarter to influence appointments saying,” I am not aware of any such thing; nobody from Government House has asked me to forward any name. So, I cannot comment. Perhaps, you should forward your questions to the PDP at the state level”.

     ‘Oyetola working on strong foundation first’

    The Osun State Supervisor for Information, Mr. Lani Baderinwa, says Governor Gboyega Oyetola has been trying to ensure a strong foundation first before constituting his cabinet.

    Baderinwa, in a telephone interview, said: “In the past few months, the governor concentrated more on  the state House of Assembly and the National Assembly elections because of the importance and constitutional roles of their members to the executive arm of government. And to the glory of God, the ruling party in the state, the All Progressives Congress, has the majority figure of 23, out of the 26-member Assembly.

    “Also, in the last few months, Governor Oyetola has been trying to integrate the state into the federal government programmes. For instance, his frequent visits to Abuja to draw the attention of the Federal Government to Osun are already yielding good results in solid minerals.

    “And now that he has achieved giving his administration a strong footing to make him forge ahead and deliver on his campaign promise the next to in line is the formation of the cabinet to work with him to deliver the dividends  of democracy to the people of the state.”

    Baderinwa, who enjoined the people to exercise patient with the governor, assured that they will not be disappointed with the caliber of people to be in the cabinet because “Oyetola as an experienced public officer and a distinguished technocrat is well positioned to lead the state.”

    El-Rufai in full control in Kaduna

    Governor Nasir El-Rufai of Kaduna State is also still working on the composition of his cabinet.

    But unlike some of his fellow governors, he is not coming under pressure from party stalwarts.

    Sources said El-Rufai is fully in control of his government and the party at the state level, and has the exclusive right to appoint his cabinet members.

    It was gathered that some of the commissioners who performed creditably well during the first term may be reappointed.

    Same goes for some Special Advisers and Special Assistants.

    Bickering over cabinet reconstitution in Ondo

    Although Governor Rotimi Akeredolu of Ondo State has a cabinet in place, he caused a stir last week when he fired three commissioners for what observers called irreconcilable differences.

    Dropped were Prince Solagbade Amodeni, Ministry of Physical Planning and Urban Development; Taofiq Abdulsalam, Works and Infrastructures; and Alhaji Ismaila Olurimisi, Ministry of Culture.

    He thereafter nominated  Mrs. Yetunde Adeyanju, Mrs Titilayo Adeyemi, Mr Temitayo Oluwatuyi (Tukana) and Mr. Akindotun Owanikin as commissioners .

    Their names have been forwarded to the State House of Assembly for confirmation.

    An APC stakeholder said the governor did not make wide consultation before picking his new commissioners.

    He queried the nomination of Mrs. Yetunde Adeyanju, who was described as a newcomer to the APC.

    Mrs. Adeyanju served former Governor Mimiko first as Special Adviser (SA) and later as Commissioner, a position she occupied till few days to 2016 election.

  • Federal Cabinet: Imo APC chieftains advise Buhari

    AS the Muhammadu Buhari-led federal government continues its search for the right candidates to constitute the much awaited federal cabinet, chieftains of Imo State All Progressives Congress (APC) are currently lobbying for the candidate that would represent the state even as they blame each other for the failure of the party in the last governorship election. Dr. Chuks Osuji, a political scientist, administrator and author, in a statement entitled, “Imo Ministerial Slot: For whom the bell tolls,” made available at the weekend, argues that Madumere seems to be the most likely candidate from Imo State for a ministerial position.

    “All things considered, it is likely that Senator Hope Uzodimma may be asked to submit a list. If he is asked to do so, knowing how the mind of Hope Uzodimma works, he is more than likely to submit a list containing his name, first, Prince Eze Madumere – second, T.O.E Ekechi etc,. Knowing the temperamental chemistry of Adams Oshiomhole, he would not look at that list twice; because, he would weigh so many things in mind. It stands to be reasoned that Sen. Uzodimma was given the governorship ticket which he performed very poorly, coming a distant fourth place position.

    “Secondly, the immediate past minister, Prof. Anthony Anwuka, is from Orlu zone. So there can be no rationale for considering Uzodimma for ministerial position and other concomitant reasons which may not promote the Senator’s aspiration for ministerial appointment. In addition, if one raised the issue that the current Imo governor is from Owerri zone, such argument will be automatically shut down because both Madumere and Governor Ihedioha are not of the same political party,” he said.

    Another APC chieftain in the state, Nze Stanley Onuoha, who made a case for Madumere, also blamed Uzodinma for the party’s failure in the state when he said: “there is no way APC would have succeeded with the level of lack of seriousness on the part of the APC governorship candidate who literarily did not campaign in Okigwe zone. He was not just ready. It was the more you look the less you see. We must look at the leadership of the party for us to move ahead.”

    But Chief Ukachukwu Nwulu, a grassroots leader, would not hear of it that Uzodinma is being blamed by his party members for what happed to APC in the last elections. “Senator Uzodinma tried his best under the situation we found ourselves. It is only fair that he is compensated now by the APC-led federal government,” he said. Hon. Felix Adiele, one of the leaders of APC in Owerri Municipal however believes the blame should instead be on the former governor. “Okorocha in pursuance of his goal of building a political dynasty takes the greater percentage of the blame but our unfortunate candidate, Senator Uzodinma sealed the failure,” he said.

     

  • Imo gets caretaker committees

    Imo State Governor Emeka Ihedioha on Wednesday inaugurated Interim Management Committees for the 27 local government areas.

    The appointment takes immediate effect, according to a statement by the governor’s Chief Press Secretary, Chibuike Onyeukwu.

    Ihedioha had earlier suspended all elected chairmen and councillors in line with the recommendations of the House of Assembly.

    Meanwhile three lawmakers elected on the platform of the All Progressives Grand Alliance (APGA) have defected to the People’s Democratic Party (PDP).

    The lawmakers – Chyna Iwuanyanwu (Nwangele), Chidi Ogbunikpa (Okigwe) and Onyemaechi Njoku (Ihitte Uboma) – said their defection was to enable them serve their constituents better.

    The speaker, Chiji Collins, read their letters of defections during the plenary.

    Following their defections, APGA now has just one seat in House of Assembly.

  • Ihedioha suspends Imo council chairmen

    Imo State Governor Emeka Ihedioha has suspended chairmen, vice chairmen, councillors and political appointees of the local governments for six months.

    The suspension is contained in the instrument signed by the Governor, pursuant to the recommendation made to him by the Imo State House of Assembly.

    This is in pursuant also, to the provisions of Sections 4, 5, and 6 of the Local Government Administration (Amendment) law, 2019 and S.73(3) of Imo State Local Government Administration Law No 15 of 2000 (as amended) and all other laws enabling him.

    He set up Interim Management Committees to manage the affairs of each Local Government.

    Consequently, the Directors of Administration and General Services(DAGS)  of each Local Government have been directed to take over management, pending the confirmation of  Interim Management Committees by the State Assembly.

    He also removed  the chairman and members of the Imo State Independent Electoral Commission (ISIEC).

    This is following a resolution supported by two-thirds majority of the State Assembly rendered on 6th June, 2019 seeking their removal from office.

    The action is also in accordance with the provisions of S.7(1) of the Imo State Independent Electoral Commission Law and all other extant laws of the State.

    The Commission will be reconstituted in due course to put in place the machinery for conducting a credible election into the local governments.

    The Governor further directed that these officers handover to the most senior civil servant in the Commission.

    The governor also dissolved all statutory boards, corporations, agencies and parastatals.  This is in line with relevant enabling laws of the state.

    A statement by his Chief Press Secretary Chibuike Onyeukwu directed the chairmen and sacked to handover to the most senior civil servant in their various establishments.

  • Generator fume kills six in Imo

    Six persons have been reported dead and about 30 others on danger list after inhaling generator fume. They had attended a wedding in Umuomumu, Mbaitoli Local Government Area of Imo State.

    The victims were evacuated from the celebrant’s house unconscious.

    Police spokesman Orlando Ikeokwu said: “About 08.00hrs of today, one Herbert Uzoegbu reported that his brother Raymond Uzoegbu, hosted the traditional wedding of his daughter on June 9, which lasted till late in the night. He went to check on his brother this morning (yesterday) about 07.00hrs, only to discover that they were still indoors; he knocked but no one answered.

    “He broke into the house and discovered that everyone in the house was unconscious. He then alerted the police and a team, led by the Divisional Police Officer, Godwin Udom, arrived at the scene and evacuated the victims to the hospital, where it was discovered that six had died and about 23 were unconscious”.

    According to him, the Commissioner of Police, Rabiu Ladodo, has ordered an investigation into the incident to unravel the misery behind the tragedy.

  • Ihedioha appoints Attorney-General, others

    Imo State Governor, Emeka Ihedioha, has appointed Ndukwe Nnawuchi, a Senior Advocate of Nigeria (SAN), as Attorney General and Commissioner for Justice.

    Also appointed were Pascal Madu as Chief Technical Adviser and Raymond Nkemdirim as Special Adviser on Security.

    Nnawuchi is a member of International Bar Association, Commonwealth Bar Association. He has acted as external solicitor and legal adviser to leading public and private bodies.

    The appointments according to a statement signed by the Chief Press Secretary to the governor, Mr. Chibuike Onyeukwu,  takes immediate effect.

    The statement added that, “in line with the provisions of the 1999 Constitution, Nnawuchi has been screened and confirmed by the State House of Assembly. His Excellency is confident that they will bring their vast experiences to bear in their respective positions”.

     

  • Robbery suspect killed, three others injured in gun duel with Police

    A robbery suspect was on Friday killed during a gun battle with the Police in Orji area of Owerri, the Imo State capital. Three other members of the gang reportedly escaped with bullet wounds.

    It was gathered that the four-man gang had trailed, a clergyman, Pastor G.E Nsofor of Holiness Evangelist Church Amankuta Mbieri, who had gone to bank to withdraw some money.

    After noticing that he was being trailed, the pastor reportedly ran towards a nearby police station and raised the alarm.

    Undaunted by the pastor’s move, the robbers swooped on him, snatched the bag containing the money and fled.

    They were however given a hot chase by men of the Orji Police Station and in an ensuing gun battle, one of the armed robbers was gunned down while others escaped with gunshot wounds.

    Confirming the incident, the state’s Police Public Relations Officer,  SP Orlando Ikeokwu, said, “Today being the 07/06/2019 at Orji, opposite the police station at approximately 14:39 hrs, the Orji Divisional Police operatives led by  the Divisional Police Officer, DPO, had a gun duel with hoodlums. As a result, one of the armed robbers was gunned down.

    “It is important to note that one Pastor G.E Nsofor ‘m’ 60 years old from Holiness Evangelist Church Amankuta Mbieri had gone to UBA Bank Nwaorubi Mbaitoli   to cash in #200,000 cheque. Immediately, he left the bank he was trailed by armed robbers on motorcycles.

    “Upon noticing their actions, he sped off and stopped by the police station. Unrelenting by the proximity to police station, he was ordered by the armed robbers to bring his money. They collected his bag.

    “The policemen on duty who were on red alert informed the DPO who immediately led a manhunt on the hoodlums and as fate would have it, out of the four, one was gunned down while three fled with bullet injuries. The unidentified robber was rushed to hospital where he was pronounced dead by the doctor on duty.

    He said that the bag of the victim and a locally made revolver pistol with two live ammunitions were recovered.

     

  • Court faults INEC’s refusal to issue Okorocha Certificate of Return as senator-elect

    The Federal High Court in Abuja has faulted the decision by the Independent National Electoral Commission (INEC) to withhold the Certificate of Return due to the immediate-past governor of Imo State, Rochas Okorocha, who was declared winner of the last election in Imo West Senatorial District.

    In a judgment on Friday, Justice Okon Abiday ordered INEC to immediately issue Okorocha with the Certificate of Return.

    The judgment was on a suit by Okorocha, in which he challenged the propriety of the decision by INEC to withhold the Certificate of Return even after the Returning Officer for the election declared Okorcha winner of the February 23, 2019 election.

    Justice Abang, who upheld the argument by Okorocha’s lawyer, Kehinde Ogunwumiju (SAN), that since his client was declared winner of the election, INEC lacked the power or legal authority to review the declaration, described INEC’s action as lawless and arbitrary.

    The judge faulted INEC’s claim that it withheld the Certificate of Return on the grounds that its Returning Officer, who announced the result, complained that he declared the election results under duress.

    Justice Abang said it is only an election tribunal that has the power to review whether the results were declared under duress.

    The judge added: ”Once a declaration of the results has been made, that decision is final and can only be reviewed by the election petition tribunal and not by INEC.

    “Therefore, it is mandatory for INEC to include the name of the plaintiff as the winner of the election to the Orlu Senatorial District.

    “Once the declaration is made under section 68(c) of the Electoral Act, INEC has become functus officio (has completed its responsibility) and INEC has no lawful authority to withhold the Certificate of Return for any reason whatsoever.

    “Therefore the issue of duress is unknown to both the Electoral Act and the Constitution

    “The court can see clearly, in the plaintiff’s Exhibit C, the reason why the 1st defendant (INEC) refused to publish the name of the plaintiff on its website as one of the winners of the senatorial elections held on February 23, 2019.

    “It is unlawful for INEC that was supposed to be neutral and independent as its name suggests, to sit in judgment in its own case and come to the conclusion that that the Returning Officer declared the results under duress and refused to issue him the Certificate of Return.

    “Neither the 1999 Constitution, the Electoral Act 2010 nor any other law for that matter confers judicial power on INEC to come to the conclusion that the plaintiff was declared under duress.

    “Under section 68 of the Electoral Act, once a declaration is made, the declaration becomes final and can only be reviewed by the election petition tribunal.

    “INEC has no lawful authority under the  Constitution or the Electoral Act to withhold the plaintiff’s Certificate of Return after it has declared him the winner of the election.

    “If indeed, it is true that the Returning Officer made the declaration under duress, it is not for the defendants who lost in the election to proceed to the election tribunal to challenge the election under section 138 of the Electoral Act.

    “Under the Electoral Act, INEC has no authority to decide to withhold the Certificate of Return on the basis that the results were declared under duress.

    “It is only the tribunal that will hear all parties and based on evidence before it will come to its conclusion,” the judge said.

    Justice Abang was also of the view that Okorocha remained elected,  subject to the outcome of the ongoing proceedings of the election tribunal, where the election outcome was being challenged.

    He said: ”It is not lawful for INEC to take the law into its hands by refusing to issue Certificate of Return to the plaintiff. There is no law that supports the unlawful decision of INEC.

    “INEC ought not to have been personal in the matter. In this country, INEC has men and women of integrity, I am surprised that they acted in this manner.

    “The plaintiff was declared the winner of the election. INEC has not, in his counter-affidavit, suggested that the plaintiff did not win the election.

    “INEC did not declare the election as inconclusive. INEC did not declare that the election was won by any other person.

    “There will be constitutional crisis if INEC’s decision is allowed to stand. There can be no vacuum on the seat of the Imo West Senatorial District in the Senate.

    “INEC shall forthwith publish and circulate the name of the plaintiff as the senator-elect representing Orlu Imo West Senatorial District.

    “It is hereby ordered that INEC shall forthwith issue certificate of return as the senator-elect representing representing Orlu/Imo West Senatorial District,” the judge said.

    Justice Abang ordered INEC to pay Okorocha N200,000 as cost, while the other seven defendants in the case are to also pay Okorocha N100,000 each.

    Earlier in the judgment, Justice Abang rejected the objection INEC and the other defendants raised against the suit.
