    Maina: Presidency insists on due process

    The Presidency yesterday said the fate of the Chairman of the Pension Reform Task Team, Mr. Abdulrasheed Maina, could only be dictated by the laid down civil service rule.

    The Senate on Wednesday requested the Presidency to sack Maina from the Federal Civil Service.

    The President, through his Special Adviser on Media and Publicity, Dr. Reuben Abati, denied backing Maina.

    The Senate has the constitutional right to summon anybody since nobody is above the law, Abati said, adding that as a man who believes in the rule of law, the President’s stand is that laid down procedure should be followed in addressing issues.

    According to him, the procedure is that the Head of Service of the Federation that can take a decision concerning a civil servant, according to the civil service rule.

    Abati said: “The Senate has the constitutional power to summon anybody. If such person failed to appear before them, the lawmakers are also empowered to issue warrant of arrest against the person.

    “The President has not in anyway stood in the way of the Senate in inviting Maina. You will recall that the police even declared him wanted.

    “Maina is a civil servant. If he has done something that amounts to a breach of the civil service rule, the appropriate office to do the right thing and ensure that due process is followed is the office of the Head of Service of the Federation.

    “Nobody should suggest that the President is backing Maina. It is not an issue for the President.

    “There are laid down procedures for handling situations like this. The President believes in due process. It is a matter for the civil service to handle. The President does not have to discipline civil servants personally,” Abati said.

    Nigeria vs Ethiopia: Adepoju insists on 100% concentration

    Former Super Eagles midfielder Mutiu Adepoju has advised the Super Eagles to exercise over 100 minutes of concentration in their remaining games if they hope to make maximum impact at the ongoing African Nations Cup holding in South Africa.

    According to the former 3SC playmaker, popularly called the “headmaster” by his admirers, Nigeria remains one of the favourites for the coveted trophy.

    He said: “If the Super Eagles are able to hold on to their goals, there is nothing stopping them from playing up to the last four.

    “I really appreciate the good job Stephen Keshi has done in that team. This is an assemblage of young players with higher percentage of them playing in the Nations Cup for the first time, and they are playing very well.

    “All they need to do now is to develop the ability to hold on to their ball whenever they are leading. This they would be able to do, if they observe absolute concentration all through every game. If they are able to do that, I would tell you that they would play up to the semi finals”.

    On the match against the Ethiopians on Tuesday, the former 3SC General Manager said: “The Super Eagles should be able to take it. They should go all out right from the blast of the whistle, remembering that the game will be a great decider in the group. They should not at any time take the Ethiopians for granted, because having lost their last match, they would be coming all out to make a statement in the competition”.

    The former International however frowned at the level of officiating in the competition so far, saying that penalty awarded to the Zambians in the last match against the Super Eagles remains the worst he has ever seen all through his career, and was an insult to the game of football.

    Speaking in the same vein, a former University of Ibadan Director of Sports Shadrack Adeoti described the Egyptian referee’s penalty call in that match as an aberation.

    The former NUGA President said: “I hope CAF is watching these referees. Their performance in this championship is very much below average, and would rubbish the whole effort being put into the organization of the biennal championship. I think CAF should only be selecting referees that are competent for these types of championships, this is Africa’s own version of the World Cup, all the participating teams should be given fair officiating, and no referee should be allowed to rubbish the game for us”.

    He expressed confidence in the abilities of the Super Eagles to emerge from their group after the last matches on Tuesday. “I am optimistic that the Super Eagles would emerge at the end of Tuesday’s match, and also don’t be surprised, if they eventually came out tops in the group,” he concluded.

    THE Nigeria Football Federation (NFF) has described as fake a certain mystery ‘Super Eagles’ list released by an online football website.

    The purported Nigeria 23-man AFCON team list published Tuesday by mtnfooball.com advertised the exclusion of Battle of Catalonia hero Bright Dike and Ukrainian League’s Brown Ideye.

    The NFF has however warned Nigerians to disregard the list because it is false. The GlassHouse reiterates that the authentic Eagles list will be released after tonight’s friendly against Cape Verde.

    Mtnfootball.com has scooped on Nigeria’s final AFCON squad with Bright Dike and Brown Ideye left out, while Kenneth Omeruo made the cut.

    There are also five players from the Nigeria Premier League – goalkeeper Chigozie Agbim, defenders Godfrey Oboabona and Azubuike Egwuekwe, midfielder Gabriel Reuben as well as forwards Ejide Uzoenyi and Sunday Mba.

    Major League Soccer (MLS) Dike was a major shock after he scored a great goal against Catalonia in a warm-up game last week. So too Dynamo Kiev striker Ideye, who broke his Eagles duck in November in a friendly against Venezuela.

    Nigeria U-20 defender Omeruo, who has impressed with Dutch club ADO Den Haag on loan from Chelsea, made the final cut in only his first call-up to the full international team. Otherwise, coach Stephen Keshi has kept faith with the tried and trusted leading up to this month’s AFCON in South Africa.

    Nigeria will take on fellow 2013 Nations Cup finalists Cape Verde on Wednesday night in their final warm-up game before the biennial tournament. They are due in South Africa on January 16.

    N55m ‘bribe-for-budget scam: ICPC insists on trial of Wabara, others

    The Independent Corrupt Practices and Other Related Offences Commission (ICPC) yesterday insisted at the Supreme Court that a former Senate President, Senator Adolphus Wabara and four others must face trial for alleged N55m bribe-for-budget deal.

    The others are a former Minister of Education, Prof. Fabian Osuji, Senator Ibrahim AbdulAzeez, Senator Azuta Mbata and Garba Matazu.

    Two other suspects (Senators Emmanuel Okpede and Badamosi Maccido) have died and their names struck out of the charge sheet.

    The suspects were arraigned on April 11, 2005 before Justice Hussein Mukhtar of the FCT High Court for allegedly obtaining money to facilitate easy passage of the budget of the Federal Ministry of Education in 2005.

    They were accused of allegedly committing offences contrary to sections 9(1) (a); 17(a); 23(2); 26(1) and punishable under Section 8(1); 9(1) (b); 17(c); 23(3) of the Corrupt Practices and Other Related Offences Act 2000.

    The accused had earlier urged the High Court to quash the charges against them, but Justice Muktar, on November 10, 2005, dismissed the request.

    Three of the suspects (Wabara, AbdulAzeez and Osuji) later went to the Court of Appeal in Abuja challenging the judgment of the High Court.

    On June 2, 2010, the appellate court set the three accused persons free and quashed the 15-count charge brought against them by the ICPC.

    In the judgment delivered by Justice Mary Peter Odili, the court held that the charges were bogus and failed to disclose a prima facie case against the accused.

    Justice Odili also ruled that the charges were frivolous, baseless and lacking in merit and as such cannot be sustained by any prosecution.

    The ICPC, however, headed for the Supreme Court.

    The matter came up for hearing at the apex court yesterday with ICPC insisting on the trial of the accused.

    The prosecution counsel, Chief Niyi Oshe (SAN) and Mr. John Bayeshea (SAN) told the Supreme Court that “it is ridiculous to say no prima facie case was made against the accused because the statement of Prof. Osuji, was enough to establish that they have a case to answer.

    “Prima facie case cannot be equated with proving a case beyond reasonable doubt. At this stage of arraignment, it is too early to assume that there is no case against them.

    “The Court of Appeal went to the extent of treating Sen. Chris Adighije as a tainted witness. But our position is that the court cannot treat anyone as a tainted witness until trial takes place. Accused persons should not be discharged on the basis of preferment of charges.

    “If the position of the Court of Appeal is sustained to the effect that there was no prima facie case against the accused, a combination of these errors will make criminal prosecution almost impossible in this court.

    “The court should let the accused face trial, it should not discharge them on mere preferment of charges.”

    But Osuji, through his counsel, Goddy Uche, said he was an innocent actor because of his love for the country.

    The ex-minister also said: “There is no proof of evidence to link me with the complicity of the offence.”

    The Supreme Court’s five-man panel, led by Justice Ibrahim Tanko Mohammed, fixed judgment for February 22.

    Oteh must go, Senate insists

    TROUBLED times are still ahead for the embattled Director-General, Security and Exchange Commission, Ms Arunma Oteh.

    The Senate insisted that she must be relieved of her job, saying President Goodluck Jonathan is on his own by retaining Oteh.

    In a statement by its Committee on Capital Market, the Senate aligned with the resolution of the House of Representatives that the SEC chief be sacked.

    The statement reads:”You will recall that the House, few months ago, set up an Ad-Hoc Committee, which investigated the near collapse of the Nigerian Capital Market.

    “Consequently, the House passed a resolution based on the report that the President should sack the Director-General (SEC), Ms. Aruma Oteh.

    “The House further resolved that should the President fail to comply with its resolution, the House would cease to accord any recognition to the SEC DG.

    “You are also aware that instead of complying with that resolution, the SEC DG was reinstated in flagrant disregard of the resolution.

    “Again, on resumption from recess last month, the House reaffirmed its earlier resolution and gave a 14-day ultimatum for compliance. Till date that ultimatum has been ignored.

    “Furthermore, since Ms. Oteh’s resumption of duty, there have been protests against her administrative style.

    “Rather than seek amity with the workforce, she has continued with the same style for which the Presidential Review Committee indicted her.

    “Specifically, the workers have accused her of high-handedness, sole administrator-ship, intimidation, insensitivity, malice and vengeance.

    “Consequently, the Senate Committee on Capital Market, at its meeting on September 26, considering this and other matters at the Commission, resolved to support the position of the House that Ms Oteh be removed forthwith.

    “The Committee also resolved to have nothing to do with Ms. Aruma Oteh for as long as she remains at the helm of affairs at the SEC.”

  • Okene killings: IGP insists on probe of fresh lead

    The Inspector-General of Police (IGP), M.D. Abubakar, has called for a probe following fresh clues available to the police on the killing of Deeper Life Bible Church members in Okene, Kogi State.

    It was learnt that the IGP is not yet convinced on a recommendation in the preliminary report that some key suspects, especially former local government chairmen, should be released on bail.

    The three major suspects-Yahaya Karaku (ex-Okene LGA chairman), Abubakar Zuberu (ex-Okehi LGA chairman) and Momoh Jimoh, currently detained at the Force Criminal Investigation Department (FCID), have initiated legal action to compel the IGP to release them on bail.

    The killing of 17 members of the church was carried out on August 6.

    Since the killing, police have arrested 18 suspects, including the former council chairmen and a key suspect, Abdulmannan Obadeki, who was arrested in Owo, Ondo State.

    Investigation by our correspondent showed that the FCID has submitted a preliminary report, which recommended the release of the former local government chairmen.

    The same report identified some fresh clues which require further investigation.

    A source, who spoke in confidence, said: “The preliminary report was submitted about three weeks ago but the IGP, who is a crack detective, believes that the fresh lead must be probed before any of the suspects can be granted bail.

    “As I am talking to you, the IGP is on top of the situation. He wants the investigators to get to the root of the killings.

    “It is the view of the IGP and his team that all sides to the case must be probed instead of the team jumping into conclusion that the murder might not have political undertones.

    “The antecedent of some of the suspects, especially their involvement in political violence, made the IGP to insist on investigation of fresh clues.

    “Some of these investigators have been shuttling between Abuja and Lokoja. The target is to get to the root of the murder.”

    Responding to a question, the source said: “The Nigeria Police is not in a hurry to release the former local government chairmen because more information are being gathered on their activities.

    “This investigation is not personal, but we have been directed by the IGP to ensure a thorough job.”

    Asked if the probe was not taking a long time, the source added: “It pays to do a better job than a sordid one. We are aware of the expectations of the public.”

    The police source confirmed that Yahaya Karaku (ex-Okene LGA chairman) and Abubakar Zuberu (ex-Okehi LGA chairman) have asked a High Court to compel the IGP to release them on bail.

    But the source said: “The allegations border on criminal matters and investigation is on. In their application in court, they are seeking the enforcement of their fundamental human rights.

    “If there is a definite pronouncement or order from the court, the police will honour it. So far, we have not got any at all.”

    As at 6.13pm yesterday, police spokesman Frank Mba was yet to pick his calls.
