  • 2015: PDP joins legal battle over Jonathan

2015: PDP joins legal battle over Jonathan

Is the ruling Peoples Democratic Party (PDP) planning to field President Goodluck Jonathan in 2015?

This question remained relevant yesterday, with the PDP applying to be joined in a suit challenging the President’s eligibility to contest the election. Dr. Jonathan is yet to speak on his political future.

A PDP card-carrying member and Port Harcourt lawyer, Henry Amadi, is before a Federal High Court, Abuja, contending that Jonathan is no longer eligible to contest in 2015 because, by so doing, he would be spending more than the maximum of two terms of four years envisaged by the 1999 Constitution.

The suit is similar to another filed by a chieftain of the PDP, Mr Cyriacus Njoku, on March 20, 2012 before an Abuja High Court.

Judgment in that suit is pending before Justice Mudashiru Oniyangi.

The respondents in this suit are Jonathan and the Independent National Electoral Commission (INEC).

In the application by its National Legal Adviser, Mr. Kwon Victor, the PDP is urging the court to join it as an interested party because it would be affected by the outcome of the suit.

It is also asking the court to make a consequential order directing the plaintiff to amend his originating processes to reflect PDP as a defendant and cause same to be served on the party.

In the affidavit in support of the application, Kwon argued that from the reliefs sought by the plaintiff, PDP’s right to sponsor Jonathan for the office of the President in the 2015 presidential elections is being challenged.

He averred that ‘’this action cannot be effectually and completely be determined without joining the applicant herein.

“By the very tenor of the reliefs sought the plaintiff, this suit questions the right of the applicant to sponsor one of its members (Jonathan) for the 2015 presidential elections. The applicant herein seek to protect its interest in the present action by this application.

“Having been sponsored by the applicant (PDP) for the 2011 election and Jonathan been a member of the PDP who is capable of being sponsored for the 2015 presidential election, the PDP will directly be affected by the outcome of the decision of this court one way or the other.

Justice Adamu Bello has fixed February 26 to hear the PDP’s application, following the plaintiff’s lawyer C.N.Eke’s intention to oppose the application for joinder.

In his response to the suit, Jonathan had said he would contest in the election, as allowed in the Constitution.

According to him, with the political situation of Nigeria, it is better for him to spend nine years in office than to spend less than the eight years stipulated in the 1999 Constitution.

He spoke through his lawyer, Ade Okeya-Inneh (SAN) in a counter-affidavit.

Jonathan asked the court to dismiss the case for lack of jurisdiction.

According to him, the plaintiff is an ordinary individual who is not qualified to request the court to stop him from contesting the election.

Jonathan said Amadi failed to disclose reasonable cause of action and that the plaintiff’s claim is hypothetical and academic.

Jonathan averred that he took the first oath of office on May 6, 2010 following the death of erstwhile President Umaru Musa Yar’adua.

Amadi is contending that Jonathan is no longer eligible to contest in 2015 because by so doing, he would be spending more than the maximum period of two terms of four years envisaged by the 1999 constitution.

The plaintiff wants the court to direct INEC not to accept Jonathan’s nomination as candidate of the PDP for 2015 because by the oath of allegiance and oath of office he would take, if he wins, will violate the two oaths of allegiance and office stipulated by the 1999 constitution.

The midfielder, who joined Crawley from Everton in 2011, has agreed a three-and-a-half year contract.

Reading manager, Brian McDermott told the club’s official website: “I’m delighted to have signed Hope, we have known all about him for a very long time. Reading said the deal is subject to final ratification of all the paperwork from the football authorities, but they expect that to be a formality.

Despite being born in England, Akpan has declared his intention to represent Nigeria – the country of his parents – at international level.

  • Enyeama joins Eagles in Faro

    Enyeama joins Eagles in Faro

Despite Maccabi Tel Aviv’s request, Nigerian Football Federation (NFF) officials have rejected the club’s call to have Super Eagles goalkeeper, Vincent Enyeama released from his national side’s training grounds where they are preparing for the African Cup of Nations last Tuesday.

As a result Enyeama will miss the club’s next match with Kiryat Shmona and with the Israeli transfer window only opening on the 9th of January, Maccabi’s recent international signing from Swedish side Obrero, Tomer Chencinski, will not yet be available to take Enyeama’s place in the squad. A goalkeeper from the youth side will be brought up to the first team for the match to ensure adequate defence.

Enyeama’s first match with Nigerians will be on the 21st of January against Burkina Faso. Four days later they will play Zambia and on the 29th Ethiopia. If his side win the competition, Maccabi Tel Aviv’s goalkeeper will return from South Africa with Nigeria’s first championship since 1994. Enyeama will be helped in this effort by fellow Nigerians in the Israel Premier League, Juwon Oshaniwa from M.S. Ashdod and the Hapoel Beer Sheva goalkeeper Augustine Ejide.

  • Nwordu joins Heartland

    Nwordu joins Heartland

Supersport.com learnt that the former Enugu Rangers’ man has signed for a season in Owerri on Friday.

Nwordu said the move is a dream come true as well as a huge challenge to his career.

“I’ve moved to Heartland for the new season. I actually signed the contract paper on Friday, the package is a huge improvement compared with where I came from and the team is well organised. I’m happy with the movement to the Owerri-based side

“The package could have been bigger but for my previous side, Ocean Boys, it affects one’s bargaining strength and limits to the extent one can complain. I have to start from there, work harder and prove myself once again in all aspect of the game both on and off the pitch,” he said to supersport.com.

The former Sharks’ centre-back said winning the league shield is the value he hopes to bring to the Naze Millionaires’ camp.

“The entire State wants the Premier League title as the Federation Cup title seems to hold no attraction any longer having won it back-to-back. I share in their belief that it must be the league shield, it’s challenging and I think with the quality of players I met on ground it won’t be a tall order. Heartland have recruited the best of attackers in the land, competition will be stiff and that will surely bring out the best in us,” said the former Nasarawa United defender.

Heartland finished last season on 51 points from 36 matches and will hoist the nation’s flag in the 2013 CAF Confederation Cup.

  • Dougie Freedman joins Bolton

    Dougie Freedman joins Bolton

Dougie Freedman has left Crystal Palace and become the new manager of Bolton, the London club have confirmed.

Freedman, 38, was given permission to talk to Wanderers on Monday afternoon after a U-turn from Palace, who had initially refused to allow contact hours earlier.

And Bolton have wasted little time coming to an agreement with the 38-year-old, with Palace breaking the news via an official statement.

“Crystal Palace Football Club can confirm that first-team manager Dougie Freedman has joined Bolton Wanderers,” read the statement on the club’s website.

“The board of the club would like to put on record their thanks to Dougie for all his efforts over the past couple of years and their disappointment over the events of the past few days.

“The search for a replacement starts immediately.

“The team at tonight’s game against Barnsley will be taken by assistant manager Lennie Lawrence and first-team coach Curtis Fleming.”

Freedman succeeds fellow Scot Owen Coyle at the Reebok Stadium after Coyle was sacked on October 9.

Having been unable to keep Bolton in the Barclays Premier League last term, Coyle presided over just three wins from the club’s opening 11 games in all competitions this season.

Caretaker manager Jimmy Phillips duly took charge of Saturday’s 3-2 home win over Bristol City as the Trotters showed spirit to come back from two goals down.

But the rumour mill was already in full swing over the weekend and Bolton chairman Phil Gartside made his move for Freedman on Sunday.

The former Palace striker was named Eagles manager on a permanent basis in January 2011 and led the club to a League Cup semi-final last season.

His credentials have continued to rise this term with Palace currently riding high in fourth place in the npower Championship and on an eight-match unbeaten run, which included a 1-0 win at Bolton on September 29.
