  • Kashamu rejects Adebutu-led PDP Presidential Campaign Organisation

The governorship candidate of the Peoples Democratic Party (PDP) in Ogun State, Senator Buruji Kashamu, on Wednesday rejected the purported constitution of another PDP Presidential Campaign Organisation (PDP PCO) for the state being chaired a member of the House of Representatives, Honourable Oladipupo Adebutu.

Kashamu described the composition of the new body as fake.

In a statement issued in Ijebu-Igbo, Ogun State, Kashamu, who is the Senator representing Ogun East Senatorial District at the Senate, said the authentic PDP PCO, which he heads as the Chairman, was inaugurated by the lawful Engr. Adebayo Dayo-led State Executive of the PDP on the 28th of November, 2018.

He said his choice as the Chairman of the PDP PCO in Ogun State was informed by the fact that he is the party’s governorship candidate with a solid structure and functional offices across the state.

The statement reads in part: “The purported inauguration of another PDP PCO by the dissident group within the Ogun State PDP is most unfortunate. One is surprised that this is coming at a time well-meaning stakeholders are preaching reconciliation, peace and unity.

“As a lawmaker, he should not portray himself as a lawbreaker. The only PDP Chairman known to the law and major stakeholders within the Ogun State PDP is Engr. Adebayo Dayo.

“Engr. Dayo, as the State Chairman of the PDP, presided over the State Congress where the governorship candidate of our party was elected in line with Section 25(1) of the Peoples Democratic Party Constitution 2017 (as amended) which states: ‘There shall be a State Party Congress which shall consist of: The State Chairman who shall be the Chairman.

“Section 25(2C) states further: ‘The function of the State Congress shall be to: (c) Elect Governorship candidates of the Party’, among others.”

“Having emerged in line with the provisions of the Constitution of our great party, I am the governorship candidate known to the party, the law and INEC. It was in line with the decisions and guidelines released by the party that the governorship candidates should head the PDP PCO in their respective states that the party stakeholders chose me to lead the campaign in Ogun State.

“So, any other person parading himself as the Chairman of the PDP PCO in Ogun State is an impostor and should be ignored.”

Kashamu urged the security agencies and the national leadership of the party to call Adebutu to order before his importunate actions plunge the party and Ogun state into unnecessary chaos and crisis.

He also urged the national leadership of the party to be neutral wherever there were issues between contending interests within a political party.

“The national leadership should be a father-to-all wherever there is a dispute between contending groups or forces within the party and not take side with one against the other since we are all members of the same family.

“But, even as members of the same family, we have our right to life and to live. The father cannot attempt to kill one child for the other and expect that the child will not fight for its life or assume that the law will not take its course if the child is killed by the father. That is why we say the supreme power of the party is not absolute,” Kashamu added.

  • Kashamu preaches hope

SENATOR representing Ogun East Buruji Kashamu, has urged the citizens not to allow the hope that heralds the new year and new beginning to dim as the year goes by.

In a new year message, Kashamu, who is Ogun State People’s Democratic Party (PDP) governorship candidate, said: “It is a new year. It signifies a new beginning and a fresh start; full of hope for a brighter and better tomorrow. Let us not allow the hope that heralds the New Year and new beginning to dim as the Year goes by.

“Together, we can achieve so much if we keep hope alive in the Year 2019 and beyond. There is perhaps no better time to be hopeful for a better tomorrow than now.

“As we go into the elections in about 46 days, we need to be hopeful that the process and the end that we seek shall guarantee a better tomorrow for us and the succeeding generations.

“For me and my team, we are committed to the task of taking Ogun State to greater heights through transparency, inclusiveness and renewal.”

  • Appeal Court ruling: I remain PDP’s Ogun candidate, says Kashamu

The senator representing Ogun East, Buruji Kashamu, yesterday dismissed reports that he had been ousted as the governorship candidate of the Peoples Democratic Party (PDP) in Ogun State.

Kashamu said he remained the party’s candidate, despite a December 18 judgment of the Court of Appeal in Ibadan, the Oyo State capital, which set aside an order by the Federal High Court, Abeokuta, the Ogun State capital, which favoured Kashamu’s faction of the party.

The senator averred that he had appealed the judgment because of his belief that the appellate court erred.

Reacting to Tuesday’s judgment, Kashamu’s lawyer Ifeoma Esom said: “His (Kashamu’s) candidature is predicated on the judgment of Justice I. N. Buba of the Lagos Division of the Federal High Court. That judgment is still subsisting and there is no appeal whatsoever against that judgment.”

Addressing reporters yesterday, Kashamu added: “The Court of Appeal said in its judgment that the matter before it was not a pre-election matter. Hence, it could not have pronounced on the nomination of candidates, let alone sack me or anyone else for that matter.

“That was not the prayers of the PDP and its officers, who are the appellants in the matter. So, such a prayer could not have been granted.”

The senator averred that some people “erroneously said the Independent National Electoral Commission (INEC) accepted our list of candidates for the 2019 general elections based on the interlocutory orders of the Federal High Court, Abeokuta, which have now been set aside; then, our nomination as candidates of the Ogun State PDP has been nullified”.

Kashamu added: “That cannot be true because the Lagos Division of the Federal High Court had a full and final judgment delivered on June 24, 2016.

“Not satisfied, the other group appealed. On May 4, 2017, the appeal was dismissed. Still not satisfied, they asked the Court of Appeal to relist the appeal.

“Again, on July 11, 2018, the Lagos Division of the Court of Appeal, in a well-considered ruling, held that the appeal remained dismissed.

“It is the refusal of the Court of Appeal to relist the appeal that is now pending at the Supreme Court.”

According to him, the two orders granted by the Federal High Court, Abeokuta, were made in a judgment enforcement proceeding.

He said: “The first was in relation to the National Convention held between October 5 and 6, 2018. The second order was for INEC to accept, process and publish our list of candidates for the 2019 general elections. “Clearly, the request to set aside the orders of the Federal High Court, Abeokuta, has been overtaken by events.

“The national convention has come and gone. INEC has also complied with the orders of court and the subsisting judgments.

“So, how does the decision setting aside the orders of the Federal High Court affect us?”

According to him, INEC “has since communicated its decision to recognise and deal ONLY with the Adebayo Dayo-led Ogun State PDP exco to the national leadership of our party.

“On October 25, a letter written by INEC emphatically stated that its decision to accept the list of candidates submitted by the Adebayo Dayo-led exco was predicated on three court suits. It is only the interlocutory orders in the suit that were set aside.

“The full and final judgments in the two suits in favour of the Adebayo Dayo-led Ogun State PDP exco are yet to be set aside.

“It should also be pointed out that based on the judgments in the two suits in favour of the Adebayo Dayo-led Ogun State PDP exco, INEC, in a letter dated April 12, 2018, informed the PDP of the commission’s compliance with the two judgments of the Federal High Court.”

Kashamu took a swipe at the PDP national headquarters for taking sides in the internal crisis in Ogun State chapter of the party.

According to him, what the party should have done was to mediate between the feuding parties with a view to finding a lasting solution to the crisis.

The senator noted that if the party was interested in winning in the state, it should be seen working to bring the feuding parties together, rather than take sides with one against the other.

  • Appeal Court ruling: I remain PDP’s Ogun candidate – Kashamu

The Senator representing Ogun East Chief Buruji Kashamu on Thursday dismissed media reports that he had been ousted as the governorship candidate of the Peoples Democratic Party (PDP) in Ogun State.

Kashamu said he remains the party’s candidate despite a December 18 judgment of the Court of Appeal in Ibadan, which set aside an order by the Federal High Court, Abeokuta, that was favourable to Kashamu’s faction of the party.

The lawmaker added that he had appealed the judgment because of his belief that the appellate court erred.

Reacting immediately after Tuesday’s judgment Kashamu’s counsel, Ifeoma Esom, said: “His (Kashamu’s) candidature is predicated on the judgment of Justice I. N. Buba of the Lagos Division of the Federal High Court. That judgment is still subsisting and there is no appeal whatsoever against that judgment.”

During an interaction with journalists on Thursday, Kashamu added: “The Court of Appeal said in its judgment that the matter before it was not a pre-election matter.

“Hence, it could not have pronounced on the nomination of candidates, let alone sacking me or anyone for that matter.

“That was not the prayers of the PDP and its officers who are the appellants in the matter and so such a prayer could not have been granted.”

He explained that some people had “erroneously said that the Independent National Electoral Commission (INEC) accepted our list of candidates for the 2019 general election based on the interlocutory orders of the Federal High Court, Abeokuta, which have now been set aside, then our nomination as candidates of the Ogun State PDP has been nullified.

According to him, the two orders granted by the Federal High Court, Abeokuta, in Suit No. FHC/AB/CS/114/2018 were made in a judgment enforcement proceedings.

It is only the interlocutory orders in FHC/AB/CS/114/2018 that were set aside.

  • Breaking: Appeal Court sacks Kashamu, others as Ogun PDP candidates

The Ibadan Division of the Appeal Court, on Tuesday December 18, 2018 sacked Senator Buruji Kashamu and other ‘candidates’ in the Adebayo Dayo-led faction of the Ogun State PDP.

The three-man appeal panel set aside the judgment of a Federal High Court in Abeokuta which threw up Kashamu and his factional members as the authentic PDP candidates.

The panel headed by Justice A. B. Bada, resolved the four issues raised for determination in the appeal in favour of the PDP, saying the appellants were not properly served in the case at the lower court which breached their rights to fair hearing.

Both Justices Bada and N. Okoronkwo agreed with Justice H. S. Samani who read the lead judgment.

The judgment is expected to have removed the cloud over governorship candidates of Hon. Oladipupo Adebutu and the National Assembly and Ogun State House of Assembly candidates for the 2019 election.

The PDP had dragged the Adedayo Bayo-led faction to the appellate court to challenge the lower court judgment which threw up its candidates.

They prayed the court to set aside the judgment on the grounds that they were not properly served before judgment was delivered and that the lower court judge was wrong in his judgment.

  • We will ensure even development of Ogun, says Kashamu

The governorship candidate of the Peoples Democratic Party (PDP) in Ogun State, Senator Buruji Kashamu, has promised to ensure even development of the state, if elected next year.

Kashamu made the promise while hosting leaders of Community Development Associations (CDAs) in the state who visited him at his campaign office in Ijebu-Igbo.

He said: “If we win the election, we are going to ensure that every part of the state is developed. We shall not develop any part at the expense of others.”

Lauding the efforts of the CDAs to develop their communities, Kashamu assured that his administration would take community development seriously.

“We shall not just concentrate on the urban centres; rather, we shall ensure that the rural areas are also developed to improve life and living for rural dwellers,” he said.

The PDP candidate, who praised the effort of past governors as well as the current one in developing the state, noted that progress is incremental.

He said: “All our past leaders and even the current governors have done well. Chief Segun Osoba tried his best to improve the state. When Otunba Gbenga Daniel got into the saddle, he raised the bar. Senator Ibikunle Amosun has also raised the bar. They have all done very well. But what I want to assure the people of Ogun State is that we shall take the state to greater heights.

“Despite all that our past leaders have done, there is room for improvement in education, healthcare delivery, infrastructure, rural development and social welfare. We have identified all the areas that need intervention and as soon as we assume office, we shall hit the ground running.”

Kashamu said he and his team had painstakingly put together a policy manual that would guide his administration in improving the lot of the state and its people.

  • Court affirms reversal of Kashamu, others’ suspension by PDP

•Party’s power to discipline erring members upheld

A High Court of the Federal Capital Territory (FCT) in Apo, Abuja, has insisted on its reversal of the Peoples Democratic Party’s (PDP’s) expulsion of Senator Buruji Kashamu and some other members of the party.

Delivering judgment yesterday, Justice Valentine Ashi averred that although the PDP, by its constitution, has the power to reprimand or take disciplinary measures against erring members, including to bar or expel such members, but it must observe due process while exercising such power.

The PDP, earlier this year, announced its expulsion of Senator Kashamu (Ogun East and now the party’s governorship candidate in the state) and the state Chairman, Adebayo Dayo, through a letter, dated August 1.

But in a ruling on October 10, Justice Ashi set aside the expulsion and held that purported expulsion was unlawful.

The judge held that it was done in flagrant disobedience of a subsisting order of the court made on December 7, last year, which was restated on January 9, directing parties not to do anything to jeopardise the hearing of the pending case brought against Kashamu, Dayo and two others by the PDP.

The judge delivered the verdict in a suit in which the party prayed the court to, among others, hold that it has the power to discipline its erring members.

Justice Ashi recalled that he earlier set aside the defendants’ suspension on the grounds that it was done without due process and during the pendency of the suit.

The judge granted the first two prayers by the plaintiff, which relate to its power to reprimand erring members, but added that granting them did not reverse the court’s earlier decision voiding the expulsion.

He said: “The decision to suspend the defendants was nullified because it was taken during the pendency of the suit, which suspension this court had reversed in an earlier ruling.

“That the plaintiff’s first and second reliefs succeed is not to say that the ruling has been reversed. Parties are to revert to the status quo before the suspension. The plaintiff is at liberty to exercise its disciplinary powers, but with due process.”

He declined to pronounce judgment on the plaintiff’s other reliefs, including the prayers for restraining injunctions against the defendants to prevent them from taking steps to disrupt the PDP’s non-elective convention last held by the party.

The judge said the reliefs were no longer virile because they had been overtaken by event, since the convention had been held.

  • I’m authentic Ogun PDP governorship candidate, says Kashamu

•·Senator is a clown, says PDP

The senator representing Ogun East, Buruji Kashamu, yesterday insisted that he is the authentic candidate of the Peoples Democratic Party (PDP) in the state.

He urged the party’s National Chairman Uche Secondus not to elevate party supremacy above the Judiciary.

Kashamu said he and his running mate, Dr. Reuben Abati, are the candidates of the people for the governorship poll in Ogun State.

He said the ticket was the expressed wishes of the people, which, he added, was equally affirmed by the courts.

The senator, who stated this while addressing thousands of party supporters in Ijebu-Igbo, the headquarters of Ijebu North Local Government Area, after he was unveiled by the Dayo Bayo-led arm of the Ogun State PDP as the party’s governorship candidate, admitted that the party is supreme but “it is not superior to the Judiciary”.

According to him, nobody should continue to act in contempt of the teeming members, leaders, elders of the party and the courts in the name of “party supremacy”.

Kashamu, who also extended his hands of fellowship to every member of the party – the agreeable and disagreeable ones – assured of his readiness, ability and willingness to work with everyone in the overall interest of the PDP.

He said: “Politics is like a game of chess: it is full of intrigues, ups and downs. But the mammoth crowd you have seen here says it all. We would not be distracted. We are focused on our Mission of Taking Ogun State to Greater Heights.

“I am a grassroots politician; a proud Ijebu man and a good citizen of Ogun State who is loved by the people.

“By the grace of the Almighty Allah, I am an entrepreneur; an employer of labour with several years of experience in business and human resources management.

“In 2015, when I contested to represent the good people of Ogun East Senatorial District, I promised selfless representation. That is what I have given.

“And there is no better proof than the over 90 projects we have attracted to various parts of Ogun East Senatorial District. They are the firsts among equals. No one has that record in our senatorial district.

“As you are aware, I have also touched many lives and communities outside Ogun East and Ogun State through the Omoilu Foundation.

“This aspiration affords me yet another opportunity to continue to touch lives in diverse ways and on a bigger plane.

“Since government is a continuum, I believe we would continue from where the current government stops and, together, we would take our dear Ogun State to greater heights.

“As presented by my running mate, Dr. Reuben Abati, we have a blueprint that outlines our programmes and policies, if you vote us as your governor and deputy governor on March 2, 2019. Will you vote for us?…”

But the PDP yesterday described Kashamu as a clown who is desperate to destabilise the party.

A statement by its spokesman Kola Ologbondiyan described as the height of ridicule, the senator’s purported presentation of himself as Ogun State governorship candidate of the party.

Last week, the PDP presented its governorship flag for Ogun State to a House of Representatives member, Mr Ladi Adebutu, recognising him as the party’s candidate for the state.

The statement said: “Senator Buruji, in his forced hallucination, has failed to realise that Nigerians, particularly the voters in Ogun State, have seen through his antics; they know that he is not the PDP governorship candidate in Ogun State; they know that he has a pact with the All Progressives Congress (APC) to destabilise the PDP; they also know that he is a clown on a journey to nowhere.

“Nigerians are aware that Senator Buruji never purchased PDP nomination form; never participated in our governorship primary or in any process related to nomination of governorship candidate of our party or any position whatsoever.

“Those using Senator Buruji as their agent have turned him into an object of public ridicule, particularly in his charade of organising a rally to hand a fake flag to himself.

“The PDP, therefore, urges the people of Ogun State to completely disregard Senator Buruji as a clown and continue in their support for the PDP governorship candidate, Ladi Adebutu, who is already coasting to victory.”

“This is your sure ticket for Taking Ogun State to Greater Heights. The Adebayo Dayo-led Ogun State Exco is the only authentic and legally recognised PDP structure in the state. The people have spoken; the courts have affirmed it and the Independent National Electoral Commission (INEC) has complied.

“Truly, the party is supreme. But it is not superior to the Judiciary. People cannot continue to act in contempt of the teeming members, leaders and elders of the party and the courts – all in the name of ‘party supremacy’.

“At some point, like in saner climes, the Judiciary must intervene and rein in those acting in utter disregard of our party’s constitution and the laws of the land. That is what has happened in our case.

“The national leadership of our party supervised and approved the congresses that produced the Adebayo Dayo-led State Exco in 2016.

“There have been several court judgments that affirmed the validity of the State Exco under the leadership of Adebayo Dayo.

“In the build-up to the 2019 general elections, congresses were conducted by the Dayo-led State Exco, in line with Section 25 (1) of the PDP Constitution (as amended in 2017), which states that ‘There shall be a State Party Congress which shall consist of: (a) The State Chairman, who shall be the Chairman’. Section 25 (2c) states further, ‘The functions of the State Congress shall be to: (c) Elect governorship candidates of the Party’.

“That is all we have done. So, if anyone decides to go and collect a flag in an office in Abuja, it does not bother us. They say they are the candidates of the party.

“We say we are the candidates of the people and the Rule of Law. As the governorship candidate of the PDP in Ogun State, I extend my hands of fellowship to all and sundry. I am ready, able and willing to work with everyone in the overall interest of our party.

“My dear good people of Ogun State, I am your son, your servant and a true representative of the people. I am willing, ready and able to serve you. I urge you to elect me, Alaanu Mekunnu (Benefactor of the Poor) as your governor. Mine will be a people-oriented government.”

  • Kashamu to Secondus: I’m not APC’s agent

The Peoples Democratic Party (PDP) governorship candidate in Ogun State, Buruji Kashamu, has faulted the party’s National Chairman, Uche Secondus, for describing him as an All Progressives Congress (APC) agent.

In a statement yesterday, Kashamu said his actions were to ensure his rights were protected.

The statement reads: “I write with reference to the statement credited to the National Chairman of the PDP, Prince Uche Secondus, with regards to the nomination forms wherein he made some criminal imputations, describing me as an agent of the APC. I am nobody’s agent. Like Secondus, I am only fighting for my rights and the rights of my teeming supporters in the PDP.

“My initial reaction was to ignore the statement as an outburst made in a fit of momentary anger. As the National Chairman of an opposition and pan-Nigeria political party, Prince Secondus is supposed to be a leader and the alter ego of the PDP. Thus, there is a presupposition that he would project the best that PDP represents.

“It is not for him to continue carry on as a serial contemnor through consistent disobedience of subsisting court judgments under the guise of party supremacy. He cannot continue to act as if the party is not guided by its own constitution and the Constitution of the Federal Republic of Nigeria.

“It is surprising that while the leaders and elders of the party as well as its presidential candidate who believe in the Rule of Law have advised the national leadership of our party to toe the path of honour, Secondus and his co-travellers decided to go the inglorious way of impunity and disregard for constituted authorities – in a desperate bid to accomplish the mercenary job they have been paid to do.

“By their conduct, they are telling Nigerians and members of the PDP that the party belongs to them and they can do whatever pleases them. They are saying they are the Alpha and Omega of the party, and that they are more powerful than the Constitution of the Federal Republic of Nigeria. They have always done this to people. But, I want to make it abundantly clear that on behalf of all the cheated and oppressed members of the party, we will fight for our rights till the last.

“I urge the Judiciary, the Legislature and the Executive arms of government to take cognisance of the happenings in the PDP as they relate to the Ogun State PDP issue. It is not about me or my supporters. It is about our democracy and respect for the Rule of Law which are being endangered by the activities of Secondus and his ilk.

“Our respectable and well-meaning leaders and elders must also rise up to the occasion and deal with these gangsters who do not believe in the Rule of Law but the rule of might and money. More than anyone else, they are the ones bring the party into disrepute by their actions. Truly, I am not bigger than the party, just as Secondus is not bigger than the law. Even the Party is not bigger than the law. But, I know my rights and will always fight for my rights. Secondus and his co-travellers cannot be protecting their own legacies and be destroying other people’s legacies.

“He said somebody printed forms, sold the forms and screened himself, describing such actions as criminal. While not holding brief for the State PDP, I am aware that the PDP is one.

“Let me also add that there is nowhere in our Party’s Constitution or the Electoral Act where the collection of nomination forms from the national headquarters of a political party is made a condition precedent to validating a candidate’s nomination. All you are required to do is to signify interest, hold congresses at designated centres and forward the name of the candidates with the highest number of votes to the electoral body. It is the Independent National Electoral Commission (INEC) that issues the nomination forms that is known to law. Any other form by the party is for administrative convenience. It is NOT statutory.”

The statement added: “Section 25 (1) of the PDP Constitution (as amended in 2017) states: ‘There shall be a State Party Congress which shall consist of: (a) The State Chairman who shall be the Chairman.’ Section 25 (2c) states further: ‘The functions of the State Congress shall be to: (c) Elect governorship candidates of the party.’

“There is a subsisting court judgment that has resolved the issue of who is the State Chairman of the PDP in Ogun State and restrained the Party from removing him until he serves out his four year tenure as guaranteed by our Party’s Constitution. It was the State Chair

  • Kashamu to run as Ogun PDP governorship candidate

Senator Buruji Kashamu has agreed to fly the flag of the Peoples Democratic Party (PDP) in Ogun State in next year’s governorship election.

This followed a visit to the businessman and senator representing Ogun East by the party’s state leadership.

Kashamu promised to make a formal declaration at a later date.

The party chieftains, led by the state chairman, Chief Adebayo Dayo, said they visited Kashamu to persuade him to be PDP’s governorship candidate following the voluntary withdrawal of the erstwhile candidate, Leke Shittu, from the race.

Dayo said: “Shittu heeded the call of the party’s elders and withdrew from the race to make way for Senator Kashamu, who we believe is fit and proper for the race. We pleaded with him and he agreed with us.

“We want to thank Senator Kashamu for offering himself for this service. He has done quite a lot for the party and the people. We are sure that with him as the candidate, the race to Oke Mosan will be a mission accomplished for the party.”

Kashamu thanked the party leaders and elders for the visit and the offer.

The senator promised not to disappoint them.

He said: “I have to accept this offer because I have received representations from various people and groups calling on me to run for the post of governor.

“I have been called upon by many traditional rulers, the good people of Ijebu land, our friends in Remo, Ogun Central and Ogun West, to join the governorship race…”
