    Lawyer floats business school

    •To train 9,000 unemployed youths free

    A Lagos-based lawyer, Barrister Lade Adeyemi, has established a school – Translantic Negotiation School of Business – to train unemployed graduates in business negotiation. The move, according to Adeyemi, is to stem the tide of unemployment in Nigeria.

    When the school eventually takes off, about 9,000 unemployed youth will receive free training, the founder said.

    The school of business is the first African negotiation school established to help the government to realise its Millennium Development Goals. The first quarter of the programme will have 250 graduates across the 36 states of the federation to get training on business negotiation.

    Adeyemi noted that the training expenses would be borne by Lade Adeyemi Business Negotiation Improvement Scholarship for Africa (LABNISA), adding that the school would bring out entrepreneurial skills of the youth.

    He explained that people needed to inculcate the habit of business negotiation, which he defined as a discussion between two or more individuals who seek to find a solution to a common problem that meets their needs and interest.

    The business negotiation programme will, however, be held in Lagos, Abuja and Port Harcourt.

    The School of Business is affiliated to Harvard University Law School and Massachusetts Institute of Technology School of Management. Adeyemi said participants could further their training in the top-rated institutions.

     

  • Funeral for lawyer

    A lawyer, Mr. Taiwo Koffie Sagoe, is dead. He was 85.

    He passed on in his home in Yaba, Lagos, on December 19.

    The late Sagoe, popularly called The Perfect Gentleman, was born in Lagos on June 24, 1927 to Mr. Samuel Quesi Sagoe and Sally (nee Aboyade-Cole). He is survived by a wife, his children, including Ekua and Wale Abudu, Kofi and Toyin Sagoe, Araba and Tunde Morakinyo and eight grand-children.

    A funeral service will be held at the Cathedral Church of Christ, The Marina, Lagos, on December 27.

    Interment will follow at Ikoyi cemetery.

     

  • Gunmen kill lawyer in Taraba

    A lawyer, Aliyu Chiroma, was killed yesterday by unknown gunmen in his home on Palace Way, Jalingo, the Taraba State capital.

    The gunmen reportedly stole his car and mobile telephones.

    The incident occurred at 7pm, his family said.

    Chiroma’s murder is coming a few weeks after a taxi driver was allegedly killed by military men. Besides, nine others were abducted; six of them were killed in Jalingo by unknown gunmen.

    Many of Chiroma’s clients were said to have stormed the lawyer’s home when they heard about his death.

    His relations said they were sitting outside when four strange men entered the house and invited the lawyer to his room for a discussion. They said they presumed the visitors had a business to transact with him.

    But the visitors reportedly shot him several times in the head and left.

    One of Chiroma’s relatives said: “When the gunmen came, we thought they were new patrons looking for his services. We didn’t know they were enemies.

    “They invited the lawyer for a discussion inside his room. The lawyer obliged. But what followed immediately after were gun shots. They shot him several times and left. They went with his car and handsets and collected our phones.”

    Police spokesman Amos Olaoye confirmed the killing.

    He said the police command was investigating the matter.

    Olaoye added: “We have swung into action to investigate it. When an incident of this nature occurs, the police investigate. That is what we are doing right now.

    “However, for the police to succeed in their investigation, people living in the area must make themselves available with useful information.

    “If the people around cooperate with us, we shall track down the culprits.”

    The police said the gunmen may have used sophisticated weapons, including an AK 47, as live ammunition. Used shells were found on the floor of the deceased room.

    MORE missiles were fired yesterday in the battle ignited by the late Dim Chukwuemeka Odumegwu-Ojukwu’s Will.

    His lawyer, Mr. Emeka Onyemelukwe, joined issues with Mr. Emeka Ojukwu Jnr.

    Ojukwu Jnr had disowned the lawyer, saying he was never counsel to the late Ikemba Nnewi and vowed not to respect the Will read by him.

    The Will has generated much controversy since it was read in the High Court of Enugu at the weekend.

    Defending his long-standing relationship with the late Ikemba of Nnewi with documents yesterday, Onyemelukwe said he prepared Ojukwu’s Will in July, 2005 and the CODICIL which gave details of the contents and corrections of what was missing on the original Will, with Ojukwu on July 24, 2009.

    He insisted that the late Biafran warlord had no other Will and that the one read in the court last week was incontestable.

    Onyemelukwe said: “It was a blatant lie for Emeka Ojukwu Jr to say that he did not know me and that I was not his father’s lawyer. When I was the person that prepared the legal documents for Ojukwu’s commercial property at No 26, Sokoto Road, Onitsha, yielding millions of naira, which Emeka Jr is managing and collecting rent and was the lawyer that handled Ojukwu’s case against the Federal Government from the High Court to the Supreme Court.

    “I was also the Master of Ceremony (MC) when Emeka Jr. wedded the daughter of the late Chief Cyprian Ekwensi at the Holy Ghost Cathedral, Enugu. The reception was held at Nike Lake Hotel, with Justice Iguh, formerly of the Supreme Court, as the chairman of that wedding.

    “Before Ojukwu’s Will was read last week, I was the one that sent text messages to all the parties concerned, including Emeka Jr.

    “I got his two telephone numbers from Mr. Val Nwosu, the late Ojukwu’s nephew. The text reads: The Will of your late father will be read on Friday, 20th November, 2012 at the Probate Registry at the Enugu High Court. Kindly inform Okigbo and Mi Mi (Ojukwu’s other children).

    “I also sent the text to Ebele, who is the late Ojukwu’s daughter from Stella Onyeador, Mark Ezemba, who was Ojukwu’s best man during his wedding with Bianca. So, the pretence by Emeka that he was not informed about the reading of the Will did not hold water.

    “His claim that I was not his father’s lawyer is also not true. On 24th July, 2009, I was the person that registered the power of attorney for the late Ojukwu for the property at No 7 Forest Crescent, Enugu.

    “ I am also in possession of the Certificate of Occupancy (C of O) of the late Ojukwu’s landed property contained in the Will.

    “There were even other documents which Ojukwu gave me. In the Will, which I prepared with Ojukwu, the following persons were named as Ojukwu’s children: Tenni Hamman (daughter), Chukwuemeka Odumegwu Ojukwu (son), Mmegha Odumegwu Ojukwu (daughter), Okigbo Odumegwu Ojukwu (son), Ebele Odumegwu Ojukwu (daughter) Chineme Odumegwu Ojukwu (son), Afam Odumegwu Ojukwu (son) and Nwachukwu Odumegwu Ojukwu (son).”

    The lawyer also debunked the insinuation that Ojukwu’s widow, Bianca, had pre-knowledge of the contents of the Will before it was read.

    He said: “What I knew was that Ojukwu asked Bianca to bring all the documents when I was going to prepare the Will and anytime we were writing the Will, I was doing it with Ojukwu in his library at the Forest Crescent in Enugu.”

    Onyemelukwe said he was shocked by the late Ikemba’s decision to Will the mansion at Nnewi to Emeka Jr because, according to him, it was Bianca who pressurised her late husband to build a house in Nnewi.

    The lawyer said: “That was when Ojukwu was managing toll gates during the regime of Abacha and the person managing it for Ojukwu was asked to design and build the house at Nnewi.

    “Before then, Ojukwu’s bungalow had burnt down and Ezeigbo had no place to stay whenever he came to Nnewi.”

    He claimed that Ojukwu Jnr. benefited so much from his late father.

    The lawyer said the Sokoto Street lock-up shops, consisting of more than 30 stalls under the mangement of Emeka and yielding millions of naira, was not included in the controversial Will.

    Directors of Ojukwu Transport Limited (OTL) also kicked agaisnt the inclusion of Ambassador Bianca Ojukwu on the board.

    They described the widow as a joker who has no stake in the company.

    Their contention is that the OTL, owned by their late father and grandfather, the late Louis Odumegwu-Ojukwu was a different entity from the late Ikemba’s private property.

    They added that Bianca cannot claim the company as the controversial Will had conferred on her the trusteeship of the company.

    Mr. Ifeukwu Ojukwu, one of OTL’s directors, yesterday told reporters on the telephone from Boston, United States that “Bianca was neither a trustee member nor a director of OTL.

    According to him, it is good to note that OTL was a different property from the belongings of the late Ikemba and that the directorship cannot be transferred through a Will.

    The Boston-based Ifeukwu reportedly said: “I just came back to Nigeria two weeks ago where I attended a meeting of OTL directors and Bianca was not there and she is not even a member of the directors. So she can not lay claim to that.”

    His father told me that (Emeka Jnr.) is his first son and the head of the family in the event of his death. So, whatever he decides to do, we are behind him and we will support him.”

    The Will read last Friday by counsel to the late Ikemba of Nnewi, Odimegwu Ojukwu, has continued to generate controversy in the state as his lawyer Mr. Emeka Onyemelukwe said on Monday that one of the late war lord’s son, Emeka Ojukwu Jr. lied with his claim that he (Onyemelukwe) was not his father’s lawyer.

    Ojukwu Jr. had dismissed the Will, saying that it was not his father’s own and vowed not to obey it.

    He also claimed that he was not aware of who Onyemelukwe was, describing the Will read at the Enugu High Court as fake.

    However, backing his long standing relationship with the late Ojukwu with documents, Onyemelukwe said he prepared the late Biafran leader’s Will in July 2005.

    He insisted that Ojukwu had no other Will and that the one read in court last week was incontestable.

    Our lawyer of the week, Prof. Demola Popoola is a former Dean Faculty of Law, Obafemi Awolowo University, Ile-Ife. Prof. Popoola, popularly called the pope by his admirers, is an academic per excellence and a man of high intellectual precosity and stature. Last week, he delivered the late Prof Jadeshola Akande memorial lecture organised by the Nigerian Institute of Advanced Legal Studies ( NIALS) at its Akoka, Unilag Campus. Giving the citation of this erudite scholar of Comparative constitutional law and Jurisprudence, the Institute Director of Studies, Prof. Lanre Fagbohun said: “To some people, he is Ademola Popoola, to some others, he is the enigma, to some other group, he is Igi-Iwe, a name given to him by the highly cerebral and respected Justice Kayode Eso. Several others refer to him as the pope while to so many others, he is the professor of professors. I know him by all these sobriquets, thus, I see myself as distinctly qualified to present his citation. I sincerely thank the Director-General for giving me this opportunity”.

    “When you talk of Prof Popoola, you are talking of a man incredible productivity and performance, you are talking of a man who is focused, dedicated and disciplined, you are talking of a man whose inspiration is contagious, you are making reference to a man whose enthusiasm is a propeller of progress, wisdom and accomplishments. A man with charity in his heart; a man who is honest and forthright, a man in whom humor, humility and civility thrives; and a man whose impeccable good manners, dutifulness and brilliance is acknowledged by all by all as legendary. Surely, in relation to Nigeria and issues pertaining to emergency power and constitutionalism, the Nigerian Institute of Advanced Legal Studies could not have made a better choice than professor Ademola Popoola to deliver a lecture in honor of an astute woman of substance, who worked her heart out in good cause, for humanity.

    Popoola, Distinguished Jurist Awardee of the National Association of Democratic Lawyers (NADL) is a Professor in International and Comparative Public Law, Faculty of Law, Obafemi Awolowo University, Ile-Ife. He has previously served as the Dean, Faculty of Law (2004 – 2012); Vice-Dean of the Faculty, (1995); Head, Department of International Law (1991-2004) and Editor-in-Chief and Head of the Law Reporting Unit (1988 to 1991 and 2004 to 2012).

    He has been a member of the University Senate for 21 years (1991 – Date). He is currently member of the University Governing Council (2009 – 2003). Between 2004 – 2012, he served on the Council of Legal Education, and some of its important committees like the Board of Studies, the Appointments, Promotion and Disciplinary Board and the Physical Development Committee. He was also on the Governing Council of the Nigerian Institute of Advanced Legal Studies and its Appointments and Promotion Commitee (2008 to 2011). He was an Assessor to the NUC – sponsored Nigerian Universities Doctoral Theses Award (NUDTA) and Resource Person to the National Judicial Institute (NJI).

    He is a Member of the Special Working Group (SWG) on the Implementation of the Rome Statute of the International Criminal Court (I.C.C) in Nigeria; Member of the Committee on the Update of the Laws of the Federation; Member of the Editorial Board of the All-Nigeria Law Reports (ANLR); and Member, Editorial Board, JUSTICE (International Journal of the Federal Ministry of Justice).

    A multiple prizeman in his school days, Popoola was the recipient of the Chief FRA Williams’ Award for the best performance in Legal-Drafting and Conveyancing in the Nigerian Bar Final Examinations (1981).

    At the University of Ife where he obtained his first degree, he was the recipient of the Faculty of Law Prize for the best overall result in the LLB Part IV Examinations; the Justice C. O. Madarikan Prize for the best all-round performance in the final LLB Examinations, and the Nigerian Amicable Assurance Prize for the best student in the Law of Insurance in the LLB degree Examinations. He also had the Best Overall Result in the LLM Examinations with Distinctions in Administrative Law, Law of International Institutions and the Research Essay. He has had other recognitions including the Teslim Elias Gold medal of Excellence of the Nigerian Association of Law Teachers, The Nigerian Society of International Law Merit Award as well as recognitions by the International Biographical Centre, (IBC) Cambridge, United Kingdom, the American Biographical Centre (A.B.C), North Carolina, USA and his community. He has been invited to present Export Opinion on Issues of Law before her Majesty’s High Court of Justice in London.

    He is External Examiner in Law at the LLB, LLM and Ph.D levels to several Universities across the country as well as External Assessor for Professorial appointments in others. At Ife, he has successfully supervised a total of Eighteen Ph.D candidates, Twenty MPhil candidates and over 400 LLM students.

    He was also involved in the design, and has taught 35 courses mainly in the areas of International Economic and Business Laws, Comparative Public Law and Legal Theory at the postgraduate level.

    He has served or is currently serving on the editorial boards of several Law Journals, including the Nigerian Bar Journal, Olabisi Onabanjo University Law Journal; University of Ado Ekiti Law Review, Usmanu Danfolio University Law Journal; Nigerian Journal of African Law (UK), NIALS Journal of Environmental Law and Nigerian Law Journal.

    He is Editorial Consultant to the Supreme Court of Nigeria Quarterly Law Report. Member, International Advisory Board of ACCESS TO JUSTICE; Chairman, Board of Trustees, Citizens’ Assistance Centre, IKORODU; Director of Publications, Nigerian Society of International Law (NSIL); Member of the American Studies Association of Nigeria (ASAN); a Trustee of the Nigerian Association of Law Teacher (NALT); Chairperson of the Academic Staff Union of Universities (ASUU) Committee on Review of the 1999 Constitution and a People’s Constitution (work in progress); and Editor-in-Chief of the Obafemi Awolowo University Law Journal. Member of the Oyo State Law Review Committee which produced the Revised Laws of Oyo State and the Osun State Law Revision Committee which produced The Laws of Osun State (2002).

    A widely travelled person and prolific writer, Prof Popoola has to his credit, four Edited Books; 80 publications in national and international journals and reputable books, as well as over 250 papers presented at national and international conferences and seminars/workshops.

    He is a devout Christian and committed family man.

    Describing what it is to have Demola Popoola as a friend, the Director-General, Professor Epiphany Azinge (SAN), stated:

    “When the Pope is your friend, it is like a pillar on your porch. He will fortify you with knowledge when you need to supplement your wisdom; stand-by to comfort and hold you up when you are in need; and thoroughly convince and persuade others o your unique qualities when the need arises. No distance or place or potential risk of time can keep the Pope away from doing his duties as a friend once he has persuaded himself of your worth. But when the Pope is angry, and you are at the receiving end … God help you”.

  • Lawyer to Mimiko: beg Tinubu

    AN Akure lawyer, Mr. Morakinyo Ogele, yesterday urged Governor Olusegun Mimiko to apologise to former Lagos State Governor, Asiwaju Bola Ahmed Tinubu.

    He added that he should ask for forgiveness for lying that he did not receive moral and financial assistance from the Action Congress of Nigeria (ACN) National Leader.

    Ogele enjoined Mimiko to visit the graves of the late Chiefs Adekunle Ajasin and Adebayo Adefarati in company with those he described as “credible Yoruba leaders” to seek forgiveness for betraying them during their time.

    He said it was obvious that Asiwaju Tinubu spent a fortune to assist Mimiko reclaim his mandate from the Peoples Democratic Party (PDP).

    The lawyer, who spoke with The Nation in Akure, said Mimiko has a culture of deceit and betrayal.

    He said: “The news credited to Governor Mimiko that Asiwaju Tinubu did not give him any money shows that he is an ungrateful person. It is an open secret that Asiwaju Tinubu raised a team of lawyers to prosecute election petitions in Osun, Ekiti and Edo states. The same legal team stood for Mimiko to reclaim his undeserved mandate.

    “There is no doubt that Tinubu must have paid the professional fees for the legal team he raised.”

    He also brought a forensic expert to support the prosecution of election petitions in the four states.

    “Asiwaju Tinubu must have paid the forensic expert a professional fee worth millions and must have been responsible for his hotel accommodation, transportation and other logistics.

    “Apart from this, Tinubu gave him a bullet-proof Sport Utility Vehicle (SUV) worth millions of naira when he lamented that some people attempted to assassinate him in Ondo State.

    “During the inauguration of his administration at the Sports Stadium, Akure, Asiwaju Tinubu led a team of Yoruba leaders to the ceremony. He equally sponsored the inauguration with millions of naira.

    “Any river that forgets its source will become dry.

    “If Papa Ajasin and Adefarati were alive today, they would have told the whole world about their experience with Governor Mimiko.

    “Adaba FM became the mouthpiece of Mimiko during his trying period. He placed adverts without paying a kobo. He now sees the radio station as his number one enemy.

    “Mimiko should seek the assistance of the likes of Chief Reuben Fasoranti and Agbi to apologise to Tinubu.”

    Lawyer: Mimiko on journey to nowhere

    A London-based lawyer and chieftain of the Action Congress of Nigeria (ACN), Nathaniel Adojutelegan, yesterday said Governor Olusegun Mimiko’s second term ambition is a journey to nowhere.

    The lawyer denied the rumour of his alleged romance with the ruling Labour Party (LP).

    He said Mimiko would fail in the October 20 election.

    Adojutelegan, who is a solicitor of the Supreme Court of England and Wales, hails from Arigidi-Akoko, in Akoko North West.

    The ACN chieftain said the rumour of his defection plan to the LP came from Mimiko, following his refusal to heed the governor’s plea to defect to the ruling party.

    He said the governor, on September 11, sent a delegation, led by Deputy Governor Ali Olanusi and a monarch, from Akoko to meet with him in London onhis planned defection to LP.

    The ACN chieftain said despite the pressure on him by the deputy governor, he refused to join the LP.

    Adojutelegan said: “I told the state government delegation that I am a committed member of ACN and that only death can make me part with the progressive party.

    “I am a committed member of ACN and only death can separate me from the party. I belong to the progressives and I believe so much in the programmes and leadership of the party.

    “I have told Governor Mimiko’s emissaries that they should steer clear from me. I have told them the kind of person and politician I am. I am using this medium again to warn them to stop spreading rumours that may dent my reputation.”

    The lawyer urged ACN members to remain committed and avoid jeopardising the interest of the party.

    Mr Steve Ononye is a former Assistant Financial Secretary of the Nigerian Bar  Association (NBA). He speaks on his expectations from the new NBA leadership, the proposed N5000 banknote and how to achieve speedier court process in the new legal year. Legal Editor JOHN AUSTIN UNACHUKWU met him.

    What are your expectations from the current leadership of the NBA?
    The NBA as you know is the umbrella that covers all the Lawyers in Nigeria and we hold same in utmost candor and respect. May I congratulate the new President of the NBA Okey Wali SAN and other members of the executive because it is without doubt that the Nigerian Lawyers in sincere recognition of their priceless contributions towards a better and more progressive NBA feels it honour-bound to elect them to various positions in the NBA Exco. I know without a flicker of doubt that the leadership of the NBA will in a humble, but forthright and honest manner steer the affairs of the NBA. I believe that as the President of NBA proceed to saddle the responsibility of the office, he will bring to bear his wealth of experience and impress the same in the discharge of this great and challenging national assignment.
    How best should NBA engage the government?
    I have confidence in the leadership of the NBA and it is indubitable that the entire members of the Bar that entrusted the leadership of the Bar on Okey Wali SAN are convinced enough about his ability and suitability to steer the leadership of the NBA. The NBA at this threshold will do well by engaging the government of Nigeria in a constructive dialogue on the meaning, scope and relevance of its rule of law. Without any doubt, the rule of law agenda of President Goodluck Jonathan requires clarification and sustained examination. The leadership of the Bar must therefore ensure that the rule of law agenda move beyond the realms of theory to concrete deliverables for the people of Nigeria. Achieving this requires sustained campaign around issues of respect for human rights, independence of the Judiciary and enhancing access to justice. All these and more I am confident that the leadership of the Bar is better equipped and competent enough to achieve.
    What role should it play as regards good governance?
    I trust the leadership of the Bar and believe the Bar will collectively and individually champion the case of democracy and good governance in our country especially this time we are facing a serious insecurity problem in the country. I pray that during the tenure of Okey Wali, SAN as the NBA President, the NBA will witness and achieve new and greater height.
    There is so much worry about the introduction of N5,000 notes. What is your view about this?
    The NBA has spoken its mind on this issue and I think that is my view and the view of other right thinking lawyers in the society.
    What is the view of the NBA in that respect?
    The NBA has resolved that the planned introduction of the N5,000.00 currency note is a shallow, poorly thought-out hare brained initiative by the Central Bank, which will devaluate the Naira, diminish the lives of Nigerians and push corruption and money laundering to new unimaginable heights. The argument of the Central Bank of Nigeria that this innovation will not promote inflation does not hold water. It will certainly promote inflation and devalue the Naira wholesale.
    How will this policy affect Nigerians?
    This measure I strongly believe will affect the lives of Nigerians in many ways. This plan by the CBN will rather distract Nigerians from the pressing national dilemma of insecurity and corruption. The problem we have in this country is not the introduction of N5,000 currency, one wonders how the introduction of five thousand Naira Note will help to put food on the tables of millions of Nigerians who cannot afford to feed themselves daily. It will rather worsen their condition. I don’t know what is wrong with Nigeria.
    New legal year has just started. What new improvements do you expect in our legal system?
    There is need to improve on some of our laws so that it will be in line with the current trends in the world.There is also need to harmonize all the High Court rules in Nigeria and may be to unify them to make the practice of law less cumbersome. There is need to improve on the caliber of persons being appointed as judges. For instance persons of integrity, who are knowledgeable in law. With particular reference to Anambra State where I practice, there is need to appoint more judges at the High Court of Anambra State. In our various courts in Anambra State we still experience congestion of cases. There is need to appoint more judges to help decongest the cases and improve the quality of judgment being delivered by the judges in the State. We have a serious problem in Anambra State with particular reference to Onitsha High Court where some Courts have over 20 cases to handle in a day. We need at least nothing less than 20 new Judges in Anambra State.
    You mean a judge has over 20 cases in a day to handle?
    This is no joke, Lawyers in Anambra State have a serious problem, if you are not a senior Advocate or a very senior Lawyer in the State especially in Onitsha High Court, you may spend the whole day in Court without achieving anything. I seriously urge the Anambra State Governor to play his own part to see that more Judges are appointed in Anambra State and he should take it seriously. I do not know why Governor Peter Obi of Anambra State believes that all is well with the Anambra State Judiciary. Something need to be done in that respect this new legal year.
    What office are you vying for in NBA Onitsha Branch, and what is your programme?
    Well, I am vying for the office of the Secretary of the Onitsha Branch of the NBA.  I have informed members of Onitsha Branch about my welfare package for members and I do not wish to say more. I believe I will serve the members of Onitsha Branch well because I have the experience.

    Lawyer earns asset recovery certification

    Former Nigerian Bar Association (NBA) General-Secretary Ibrahim Mark has been awarded the Certified Specialist in Asset Recovery (CSAR) certification.
    The International Association for Asset Recovery (IAAR) said Mark, of the City Law Firm, Abuja, is among the select group to pass the rigorous CSAR certification examination.
    IAAR said in a statement that the CSAR credential is earned by individuals who pass the rigorous four-hour examination that provides a tough and objective measure of mastering the challenging field of international asset recovery.
    “For the successful candidates, the CSAR designation is a powerful evidence of highly specialised expertise that is recogised and welcomed by law firms, corporations, courts, peers, government agencies and clients,” said the President and founder of IAAR and a former federal prosecutor, Charles Intriago.
    The certification programme is administered by the IAAR, the premier membership organisation of professionals in the field worldwide.
    IAAR said the credential is an assurance to employers, colleagues and clients that a CSAR holder is serious about increasing the sums recovered from fraudsters and financial criminals following the fall of their criminal empires.
    The exam was said to have been assembled over an eight-month period by a team of 40 leading international asset recovery professionals under the guidance of an independent psychometric firm.
    It is to ensure that the certification was technically sound and legally defensible.
