  • Court dissolves 25-year-old marriage in Ekiti

     

    An Ado-Ekiti Customary Court has dissolved a 25-year-old marriage between Bello Catherine and her husband, Sule.

    The marriage was dissolved on grounds of frequent fighting, regular cursing, threats to life with charms and dangerous objects.

    Catherine, 68, resident of No 5, Orere-Owu, Ajibade street, in Ado-Ekiti, said she had known her husband for 25 years and their union produced three children, who are all married.

    She said the union produced three children, Taye Bello 25, female, Kehinde, 25 and Taye Bello,19, female.

    She said her husband threatened to kill her and he was fond of saying that he would make her father’s house desolate by destroying it.

    Catherine said, he always threatened that he will use charm and waste her life.

    “My husband told me that he knows where I live and that he will come there to behead me with cutlass” she said.

    The petitioner therefore urged the court to separate them, as she does not want to have anything to do with him anymore.

    The President of the Court, Mrs Olayinka Akomolede, ordered that since the respondent had repeatedly shunned the court and vowed never to appear, consequently, dissolved the union.

    Akomolede, ruled that since the respondent has behaved in such a manner that the petitioner could not reasonably be expected to continue living with him and the petitioner has shown a formal act of tiredness, hence separated both parties.

  • Dissolve my 2-year-old marriage, woman tells court

    A middle-aged pregnant woman, Taliatu Alli, on Monday in Iseyin, Oyo State, approached the court seeking the dissolution of her two-year-old marriage over abandonment.

    Taliatu, who claimed to be eight months pregnant, alleged that Alli had been behaving irrationally since she became pregnant.

    “We prayed to have the baby, I’m surprised that Alli has neglected me and the baby.

    “It is also surprising he can become so irresponsible. He comes home only when he wishes. Whenever I asked him for money for anti-natal and other necessary medications he will turn it down,” she told a customary court.

    She added: “He has been punishing me since I became pregnant as if it is a bad thing to be pregnant.

    “I need to move on in life so that people do not think I have a husband when in reality I do not have one.”

    Alli, however, told the court that he could not provide for her needs because he had no money.

    “I know I have not been giving her money as expected but I still give her the little I have and I expect her to understand.

    “The major problem with her is that she is too troublesome,” he said.

    He pleaded with the court not to dissolve the marriage, saying he prefers an amicable resolution of the issues.

    The President of the court, Chief Adelodun Raheem, said the union was still redeemable and ordered the families of the
    estranged couple to intervene.

    He adjourned the case until Sept.14 for report of the settlement.

  • Court dissolves 18-year-old marriage over abandonment

    An Idi-Ogungun Customary Court, Agodi, in Ibadan, on Friday dissolved the 18-year-old marriage between one Fatimo Taiwo, 35, and her husband, Lukman, on ground of abandonment.

    The President of the court, Chief Mukaila Balogun, said the court was left with no option than to dissolve the marriage since the defendant had urged the court to uphold the divorce request of his wife.

    Balogun said that failure of the husband to defend the allegations brought before the court further proved that he had made up his mind to end the union.

    He, therefore, dissolved the marriage and gave custody of the only child of the union to the plaintiff.

    The president ordered the defendant to pay N4,000 monthly allowance for the upkeep of the child.

    Fatimo had prayed the court to order her husband to be responsible for the upkeep of the only child of the union.

    In her testimony before the court on Friday, the plaintiff alleged that her husband was insensitive to her welfare.

    “He preferred spending his money on other women so, I urge the court to separate us and direct him to perform his role as a father of the only child between us,” the plaintiff pleaded.

    Responding, Lukman, 39, said he would not say anything regarding the allegations leveled against him, but urged the court to uphold the request of his wife.

    A 32-year-old businesswoman, Adenike Bolarinwa, has urged an Agege Customary Court, Lagos, to dissolve her eight-year-old loveless marriage, citing sexual harassment and constant battering.

    Adenike, an indigene of Abeokuta, Ogun, told the court on Friday there was no more love between her and the husband, Abiola Bolarinwa.

    The mother of two, who resides at Obawole, Okeira in Aguda-Ogba area of Lagos, said: “My husband constantly beats me and no longer cares for me and our children.’’

    The woman, who described her husband as irresponsible, said he often demanded sex amid harassment and blackmail.

    “He calls me unprintable names in the presence of the children.

    “My husband often makes uncomplimentary utterances about me while forcefully having sex with me; he calls me a harlot,” she said.

    The petitioner accused her husband of threatening her life, adding that he had turned her into a punching bag.

    “I had to run away from the house when it became unbearable.

    “There was a time my husband beat me severely and l was in coma for three days and admitted in the hospital for weeks.

    “He is irresponsible, I want the court to separate us as I am no longer interested in the union.’’

    She asked the court to grant the custody of their children to her.

    The News Agency of Nigeria (NAN) reports that the woman was fighting back tears in his passionate plea to the court to dissolve the marriage.

    “I want to live comfortably and in peace.”

    The respondent, Abiola, a surveyor, however, denied the allegations, describing his wife as wayward and arrogant.

    “My wife is stubborn, rude and has no respect for me as her husband.’’

    The 38-year-old husband, however, told the court: “I still love her; I do not want the marriage dissolved.

    “l promise to resolve whatever disagreement and conflicts we are facing.”

    The court’s President, Mrs Ibironke Elabor, who advised the estranged couple to keep the peace, adjourned the case until March 1 for the Alternative Dispute Resolution (ADR) to take over the case.

    Wife seeks divorce over husband’s laziness, lack of love

    A house wife, Joke, has asked an Agege Customary Court, Lagos, to dissolve her 26-year-old marriage to her 54-year-old husband, Azeez Isiaka, over alleged lack of love, laziness and acts of irresponsibility.

    Joke, a civil servant, in her petition for divorce, said that her unemployed husband had refused to seek new employment since he lost his job years ago.

    She told the court that his husband had become insensitive to the family welfare because of his joblessness.

    “My husband does not beat me, but l go through psychological and verbal abuse in his hands every day.

    “He is not appreciative of all my endeavours, embarrasses me at will and `talks down at me even in the public.”

    ” The emotional stress is unbearable; l pray the court to separate us so that I can live comfortably.

    “He is lazy and frustrated, thereby transferring his aggression to everybody around him,” she said.

    The respondent, who did not object to the application for dissolution of the 26 years old marriage, did not also deny the applicant’s allegations.

    He told the court that he stopped contributing to the welfare of the children’s upkeep three years ago because he had not job, adding that the petitioner was free to re-marry.

    The court’s President, Mrs. Ibironke Elabor, who advised the estranged couple to keep the peace, adjourned the suit until Feb. 20, for alternative dispute resolution.

    Husband to court: My wife is a devil

    Worried by the wife’s defiant posture, a civil engineer, Kazeem Azeez, on Friday pleaded with a Mapo Customary Court in Ibadan to dissolve his 10-year-old marriage to his wife, Fatimoh.

    “My Lord, little did I know that I was inviting the devil into my house when I married Fatimoh 10 years ago.

    “As soon as she got into my house as a wife, Fatimoh, started showing the stuff she is made of by tormenting and fighting me
    and my first wife.

    “In fact, nobody in this court can stop her anytime she is ready to fight. As I speak My Lord, Fatimoh has already driven out
    my first wife with her children,” Azeez, who lives at Ayegun-Olomi area of Ibadan, told the court.

    Apart from fighting him all the time, Azeez said Fatimoh, had also caused disharmony in the family.

    “I have sworn not to have anything to do with her again because she is threatening my life and she is highly disobedient and
    unwilling to take instructions from me.”

    Fatimoh, however, objected to the dissolution of the marriage and denied the allegations made against her.

    She said:“My Lord, it is true that Kazeem and I have had some misunderstandings and he is largely responsible for the misunderstandings.

    “My husband, Kazeem, says he does not want me to be pregnant again; he enjoys having sex with me but does not want to hear
    that I am  pregnant.

    “Anytime I told him that I missed my period, Kazeem will quarrel with me and that is the major problem between us.

    ““I don’t fight or beat his first wife except that she usually looks for my trouble.

    “However, my lord, please give me a chance to correct my bad attitudes and I promise that within the next few weeks or months, my husband will have cause to tell you good news about me.”

    While admonishing Fatimoh, the President of the court, Mr Ademola Odunade asked her to do everything within humanly possible to bring the first wife back to the family.

    “I can assure you that as soon as you make amends, your husband, Kazeem, will be happy and he will settle this matter amicably.”

    Odunade adjourned the case until Sept. 26 for continuation of trial.

    Court in Ibadan dissolves 14-year old marriage

    A Mapo Customary Court in Ibadan, on Friday dissolved the 14-year old marriage between one Kafayat Lawal and her husband, Wasiu Lawal.

    The court dissolved the marriage over man’s starvation of the woman and his inability to fend for her physical and material needs.

    The President of the court, Mr Ademola Odunade, said that the marriage was dissolved because the duo agreed to separate.

    “We cannot force any relationship on spouses especially if it is their will to separate.
    “Therefore, in the interest of peaceful coexistence, the union between Kafayat and Wasiu has ceased to be henceforth.

    “Kafayat shall take custody of the four children produced by the union and Wasiu shall pay N10,000 monthly as feeding allowance for the upkeep of the four children,” he said.

    Ademola ordered that the man should also be responsible for the children’s education and other welfare.

    The president further ordered Wasiu to give N3,000 to his former wife to enable her to park her belongings away.

    Earlier, the complainant had told the court that her husband was irresponsible and heartless.
    “Wasiu has never been responsible for my physical and material needs as well as those of the children.

    “In fact, the children and I had to live from hand to mouth because he provided us with nothing, she said.

    The complainant said that when she became critically ill, Wasiu did not pay attention to her but took her for a nonentity.

    The respondent, however, blamed the woman’s parents for “ruining” the marriage and accepted that they be divorced.

    “My lord, I opt for separation in order to have a new lease of life. But I must let the court know that Kafayat’s parents did everything to destroy our togetherness.

    “I will not forget to add that Kafayat herself has been unfaithful to me as she is into extra-marital affairs. I am equally frustrated over the whole episode,” he said.

     

  • Court dissolves 21-year-old marriage over wife’s infidelity, alcoholism

    The Mapo Customary Court in Ibadan, on Friday dissolved a 21-year-old between one Idowu Iyanda and his wife Florence over the wife’s infidelity and alcoholism.

    Mr Ademola Odunade, President of the court ruled that the marriage was dissolved due to irreconcilable differences between the couple.

    “When wives refuse to keep to dos and don’ts binding a union, the result is usually tragic and bring about break up such as what is currently taking place.

    “In the interest of peaceful coexistence, the union between Idowu and Florence has ceased to be henceforth.

    “Custody of the four children produced by the union is granted to Idowu.

    “Idowu shall pay N3, 000 to Florence to enable her move out her property from the house,” the Arbitrator said.

    Earlier, Idowu , a carpenter  had told the court that his wife Florence, was an unrepentant prostitute and alcoholic.

    “My lord, when I entered into the union with Florence in 1996, I never knew that I was making a very terrible mistake for choosing her as a life partner.

    “She is never to be trusted for a single moment in terms of fidelity as Florence has made herself a public tap where all sorts of men of easy virtue fetch water.

    “My lord, times without number, I have caught her with men and I have warned her against the adulterous act.

    “For the sake of emphasis my lord, our fourth and last child is a sickle cell patient, my own Genotype is AA, Florence is AS, how did our last child become an SS.

    “Worst still, Florence is an addicted alcohol consumer. In fact, she still consumed one last night, this is the bottle my lord.

    “When she was complaining that she wanted to be riding a car, despite the fact that I don’t drive, I bought a car.

    “We agreed that she will be driving the car, carrying me to and from my workshop.

    “One day, Florence carried me to a particular point and abandoned me in the car and went her way.

    “In addition, she no longer perform any of her conjugal rites and she quarrels with me all the time.

    “Florence is a highly disobedient wife and she has even vowed to eliminate me from the surface of the earth.

    “She poisoned the drinking water at home with the intention that I will drink it, but I got to know and refused to take the water,” Idowu said.

    Florence, a hair dresser, who could not deny most of the allegations, however, pleaded with the court to save her marriage.

    She said that she was not ready to part ways with Idowu because they both achieved greatness together.

    “My lord, it is true that I consume alcohol, but it is only during cold weather.

    “I wonder why Idowu is rejecting the paternity of our last child. I don’t know why he is an SS,” Florence said.

    The News Agency of Nigeria (NAN) reports that the couple  resides at Alegun-Oleyo area of Ibadan.

     

  • Court upholds marriage dissolution

    An Ikeja High Court has upheld the dissolution of a 15-year-old marriage between a Lagos businessman, Kingsley Onyenobi and his wife, Chioma.

    Last year, an Agege Grade A Customary Court, headed by Mr. Phillip Williams, dissolved the marriage between because of irreconcilable differences.

    Mr Williams held that the allegation of infidelity levelled against Chioma by her husband, Kingsley was enough ground to dissolve the marriage.

    He said the two marriage certificates tendered by the respondent to prove that her marriage was contracted under the Marriage Act were discovered to be fake.

    The court, however, asked parties to maintain the status quo on the custody of the children since it had no jurisdiction to make any pronouncement in that regard.

    Dissatisfied, Chioma approached the high court to reverse the judgment.

    In her motion, she contended that the Agege Customary Court lacked the power to dissolve her marriage, which she insisted was contracted under the Marriage Act.

    She also asked the court to reverse the  order made by the customary court with regard to her children’s custody.

    Onyenobi, however, countered his wife’s averments, insisting that their marriage was contracted under traditional laws.

    He insisted that the Agege Customary Court had the power to dissolve the marriage.

    In his judgment, Justice Kazeem Alogba upheld the customary court’s decision.

    Accordimg to Alogba, there was no evidence to prove appellant‘s claims  that her marriage was contracted under the Act.

    The judge noted that the mere fact that a marriage was conducted in a church and a marriage certificate issued does not prove that such marriage was conducted under the Marriage Act.

    The judge, however, held that the lower court overreached its powers by making a pronouncement with regards to children’s custody. He directed that the custody issue be referred to the family court.

    My wife beats me at will – Man tells court

    A retiree, Taofeek Giwa, Friday pleaded with an Idi-Ogungun Customary Court, Agodi-Ibadan, to dissolve his seven-year-old marriage with Abiodun Omotayo, on the ground that the respondent routinely beats  him.

    Giwa who recently retired from the Nigerian Prisons Service, on June 9, filed a suit, seeking dissolution of the marriage.

    In his testimony, the petitioner said Omotayo had turned him to a punching bag,using her  huge stature to oppress and harass him.

    “She beats me on any slight provocation, I dare not correct her mistake,” he said.

    “In fact she is in the habit of tearing my cloth.

    “My lord, the worst she did recently was that she poisoned my meal in an attempt to kill me and I am not ready to die yet.

    “I plead with the court to separate us to avoid untimely death so that I can take care of my children and enjoy the fruits of my labour.

    “This is because I just retired from active service to my country and I want to enjoy the fruit of my labour.’’ Giwa said.

    Omotayo in her defence, denied all the allegations, but told the court that the petitioner was the one who used to pursue her with machete.

    She agreed with the divorce request, saying she was tired of living with the plaintiff because of his adulterous life.

    She, however, prayed the court to grant him custody of the only child of the marriage for proper upbringing.

    President of the court, Mukaila Balogun, dissolved the marriage and gave the custody of the only child to the respondent.

    Balogun further ordered the plaintiff to pay N3, 000 monthly allowance to the defendant for the maintenance of the child.

    He appealed to both parties to maintain peace and jointly take care of the only child of the marriage
