In his response, Mutairu objected to the relief being sought by the plaintiff, saying he was still in love with her.

He also denied the allegation of battery and irresponsibility levelled against him by his wife.

  • Court dissolves 10-yr-old marriage over incessant nagging

Mr. Ezekiel Ogundipe, the presiding President of a Mapo Customary Court in Ibadan, on Tuesday dissolved the 10-year-old marriage between one Adeyemi Olopade and his wife, Adenike, over incessant nagging, cruelty and hurling of curses.

Ogundipe held that since the couple had wilfully agreed to part ways, there was nothing the court could do about it.

He consequently dissolved the union between Adeyemi and Adenike in the interest of peace.

The judge also awarded custody of the last two children to Adenike as they were still legal minors.

Ogundipe, however, directed Adeyemi to take custody of the first child and pay N3,000 as monthly feeding allowance for the upkeep of the two children.

The judge added that he would also be responsible for their education and other welfare needs.

Earlier, Adeyemi explained to the court that his wife had in the last 10 years been a problem to the family through her incessant nagging, cruelty and hurling of curses.

”At any slightest disagreement in the home, Adenike packs out of the house and returns whenever she likes.

“She is highly disobedient as she does not take instructions from me.

“Adenike is frequently at logger heads with me; challenging any action I take.

“My lord, the intensity of her cruelty is not only known to me, but to our three children.

“Worst still, Adenike freely hurls curses at me,’’ he said.

Adenike, who did not oppose the divorce suit, declined comment on the issues raised by her husband.

“It is true that Olopade kept to his responsibilities toward the children and I.

“In fact, we are never lacking,” Adenike said.

The News Agency of Nigeria (NAN) reports that Adeyemi, a commercial printer, resides with Adenike at 7, Eyini Street, Orita-Challenge, Ibadan

Man to court: My wife is a thief

A 42-year-old businessman, Livinus Uwa, has told an Igando Customary Court in Lagos that he married a thief.

Uwa made this known when he testified in his divorce petition against his wife, Chineye, on Wednesday in Lagos.

He urged the court to dissolve his four-year-old marriage to Chineye because of her penchant for stealing his money in the wardrobe.

“I married a thief, on severally occasions, my wife stole my money from my wardrobe, rendering me broke. The last time she burgled my room and stole N350, 000.

“I reported the theft at the police station and she confessed to the theft, but the money was not recovered,

“I have reported all her attitudes and stealing habits to both families, they called her but she refused to change,’’ he said.

The petitioner accused his wife, who failed to appear in court after several summonses of abandonment, adding that since they married, Chineye had been appearing and disappearing.

“When she was pregnant, she left the house to an unknown place and came back after she was delivered of the baby.

“She abandoned our baby when she was 10-month-old; I have to engage a baby sitter to take care of her. When the baby was two years, I enrolled her in school and my wife reappeared,’’ he said.

He described his estranged wife as a lazy and dirty woman, adding that “Chineye is lazy, she cannot cook, wash or sweep and I do the house chores.

Uwa pleaded with the court to dissolve the marriage, since he could no longer condone her stealing habits, adding that he was no longer in love with her.

In his judgment, President of the court, Mr Adegboyega Omilola, dissolved the marriage.

Omilola held that it was obvious from available testimony and the respondent’s refusal to appear in court that the marriage had hit the rock.

He said throughout the duration of this case, the respondent refused to honour court summon, adding that the court had no other choice than to dissolve the marriage.

“The marriage between Livinus Uwa and Chineye Uwa is hereby dissolved from today, both parties are no longer husband and wife, they are free to go their separate ways without any hindrances and molestation,’’ Omilola said.

Husband battering: Court dissolves 33-year-old marriage

Unable to withstand further beatings from his wife of 33 years, Emmanuel Osuya , 58, on Wednesday secured a divorce from the battering woman, Abigail.

“My wife wants to kill me, she beats me almost every day with dangerous weapons. On three occasions, she broke my leg, preventing me from going out for days.

“Due to her frequent beating, I got paralysed in 2012 and that made the beating unabated,’’ the News Agency of Nigeria (NAN) quotes Osuya as pleading.

An Igando Customary Court in Lagos dissolved the marriage, as its president, Mr Adegboyega Omilola said he was convinced that the couple could no longer live together as the petitioner insisted on divorce after several interventions.

“The court has no choice than to dissolve the union in spite of the fact that the wife still claims she loves her husband.

“The couple can no longer stay together because the marriage has broken down totally: both parties are no longer husband and wife, they are free to go their separate ways,” Omilola ruled.

Osuya, a retired civil servant, had approached the court to dissolve his 33-year-old marriage over alleged battering by his wife.

Osuya said that Abigail, with whom he had five children, was always threatening his life through battering, and that he was afraid she might kill him one day.

Osuya also accused his wife of turning his children against him, thereby making them to hate him.

“Abigail succeeded in creating enmity between me and my children, she tells them false and damaging stories about me in order for them to hate me.

“So, my children only care for her by sending her money and other items every month, without extending their love to me. They always ignore me as if I do not exist,’’ the battered husband said.

The petitioner also described his wife as a thief that was always stealing his money, rendering him financially broke.

He said it became so bad that he could no more keep money at home because of his wife’s penchant for stealing.

“She is not always satisfied with the money I give her, in spite of the fact that my children always send her money every month,’’ the petitioner said.

Osuya added that Abigail also starved him of food and sex.

He appealed to the court to dissolve the marriage, saying that “I am no longer interested in the marriage, I don’t want to die now, more so that I am out of love’’.

The respondent also said that she had never stolen her husband’s money.

The mother of five added that she used to cook for her husband whenever he gave her money for food.

She begged the court not to grant her husband’s prayer that she was still in love with him.

Court dissolves 10 months marriage over sex starvation

A Lugbe Grade 1 Area Court, Abuja, on Thursday dissolved 10 months marriage between Usman Aisha and her husband, Ibrahim for starving the wife of sex.

In his judgment, the judge, Mr Garba Ogbede, said that the marriage had broken down irretrievably and efforts to reconcile them proved abortive.

“Since both parties consented to the dissolution of their marriage, this court has no choice than to dissolve the marriage.

“The couple can no longer stay together because the marriage has broken down totally; both parties are no longer husband and wife, they are free to go their separate ways.

“Both parties are to keep the peace all the time; any violation of the order should be reported to the police for redress,” Ogbede held.

Aisha of Aco Estate, Airport Road, Abuja, had approached the court for dissolution of the marriage because Ibrahim refused to satisfy her during love making.

She said that she spend one month with Ibrahim after their marriage and he always arose her but refused to satisfy her when making love to her.

“ I pleaded so bitterly to him to satisfy me but he refused to change,’’ She said.

Aisha said that whenever she called him so that they could sit and discuss the issue, he would threaten to beat her.

She said that she had reported the matter to both parents but nothing changed.

“I intentionally left our house for months after he refused to change but he never care to look for me.

“Though when I was with him for one month, he feeds me well, but when it comes to sex matters it will turn to fight. I am a woman and I have feelings for him.

“He has failed in his matrimonial obligations, I am totally fed up, please sir, separate us. I am no more interested in the marriage,’’ Aisha added.

She begged the court to dissolve the marriage because she did not want to offend God and to enable her move on with her life.

Ibrahim denied all the allegations but conceded to the dissolution of the marriage because he was also fed up with the union.

“I take good care of her and provide all she wants. Please my Lord, do as she wishes, I have tried my best to settle with her but all my effort prove abortive. I am also fed up,’’ he said.

  • Court dissolves 33-yr-old marriage over threat to life

Court dissolves 33-yr-old marriage over threat to life

A Mapo Customary Court in Ibadan on Tuesday dissolved a 33-year-old marriage over the claim of threat to life made by a retired civil servant, Mr Jimoh Babatunde, against his wife, Jelilat.

Babatunde told the court presided over by Mr. Henric Agbaje that Jelilat had made two attempts on his life and had even confessed to killing one of their four children.

“My lord, Jelilat confessed to have killed one of our four children in order to eventually eliminate me for reasons which I cannot actually tell.

“Secondly, she put some stuff into my food recently to hypnotise and make me be in servitude to her,’’ the petitioner said.

He said that his estranged wife had also tarnished his image and made him a laughing stock in their area.

Babatunde also described Jelilat as insolent, disobedient and lacked any care for him and his children.

“I did all I could to change her for the better by talking to her and reporting her to her parents, but nothing came out of it.

“Now, she wants to sniff life out of me,” Babatunde said.

However, Jelilat opposed the dissolution of the marriage and denied the allegations made by her husband.

The respondent said that if the marriage was dissolved, she had nowhere to go and desired to remain the mother of her children in her matrimonial home.

Jelilat pleaded with the court not to dissolve the union and promised to turn a new leaf.

Ruling on the divorce petition, Agbaje held that it was clear that the relationship between Jimoh and Jelilat had turned sour and was irreconcilable.

“The court frowns at any case of threat to life as the one currently been witnessed.

“It is abundantly clear that there is something cruel about Jelilat’s disposition, otherwise, no man would want to part ways with a 33-year-old union.

“In the interest of peaceful coexistence, the court has put an end to the union between both of you.

“Jelilat shall take custody of the last child aged eight years old and Babatunde shall pay N12, 000 for accommodation and an addition N5,000 for the movement of Jelilat’s belongings,” he said.

Court saves 30-year-old marriage from collapse

An Igando Customary Court in Lagos on Tuesday saved a 30-year-old marriage between Mr Sarafa Hassan and his wife Waliat from collapsing.

The president of the court, Mr Adegboyega Omilola, reconciled the couple, instead of dissolving the union, after the couple went through a series of counseling sessions.

While striking out the case, Omilola admonished the couple to maintain peace always.

“I urge you both to go home and continue in love and peace,’’ he said.

Mr. Sarafa Hassan, 60, a welder, had filed a suit for the dissolution of his 30-year-old marriage, claiming that his wife was always threatening to kill him.

“I received the tip off from a reliable source, warning me not to go home that my wife had set a trap for me to paralyse me, and a few minutes later, my wife called me several times to come home but I refused.

“She always hit me with dangerous weapons; she vowed to terminate my life and because of her threats, I ran away from the house I built and started sleeping in my shop.

“I have severally reported her to her family who always begged me to exercise patience that she will change but she never did,’’ he said.

The petitioner said that when he could no longer bear the situation, he married another woman to love and care for him, but that Waliat was also threatening his new wife.

“She always calls my new wife to tell her that she will become a widow soon,’’ he said.

He accused his wife of infidelity, alleging that she was having an affair with a landlord living on their street.

The husband described his wife as a thief that she was always stealing from him.

However, Mrs Waliat Hassan, a 49-year-old trader, denied all the allegations.

She said that she had never threatened to kill her husband nor has she attacked him with any dangerous weapons.

“How will I attempt to kill the father of my children? I can’t do that because it is my children that will suffer,’’ she said.

The mother of five denied dating the man her husband accused her of having an affair with, saying that she had been faithful to her husband since their marriage.
Waliat also denied threatening to kill the man’s other wife, adding that she only told her husband not to bring the woman to their house.

She begged the court not to grant her husband’s wish for the dissolution of the marriage, insisting that she still loved him.

She told the court that Wasiu “is the type that keeps malice and gets easily provoked at the slightest provocation.

The petitioner said that Wasiu always over-reacted on minor issues and changed his attitude “whenever he is provoked’’.

She told the court that her husband “talks too much and blames someone else for his mistakes when he is wrong’’.

The petitioner said that their marriage was contracted in 2011 and had produced a male child.

“I want an end to this relationship because my husband is not ready to change and takes no correction,” Kaosarat pleaded.

Wasiu, however, objected to the prayer of his wife, saying he still had interest in the marriage.

“My wife always does things that arouse my anger which usually force me to react and at times stop talking to her to avoid more troubles.”

Wasiu promised to change his ways and begged the court for another date to enable them settle out of court.

The Presiding Judge, Mr Yusuf Abdulkareem, adjourned the case to March 28 for a report of settlement or continuation of hearing.
