  • Monarch sues lawyer over land

The Oloto of Otto and Lagos Mainland, Oba Ganiyu Odesanya has sued his family’s former lawyer and seven others over a disputed 5.708 hectares of land at Oke-Alo, along Ilupeju, Gbagada/Oworonsoki Express Way, Lagos.

In suit No. ID/8383/14, the monarch asked a Lagos High Court in Ikeja, to declare the Oloto Royal Family the owner entitled to a Statutory Right of Occupancy over the land with Survey Plans Nos. FAN/LA/295/2001 and OY295/37/2002/LA.

Listed as first to seventh defendants are Mukaila Olajide Oseni (For himself and on behalf of Adams/Esu Family); Chief Lasisi Arubo (For himself and on behalf of Alase Family); Diya Fatimilehin & Co. and the Lagos State governor.

Others are the state’s Attorney-General & Commissioner for Justice; the Commissioner, Ministry of Housing and Rilwan Dawodu.

In an amended statement of claim dated March 3 and signed by Bolaji Mustapha, the claimant averred that the 5.708 hectares covered by Survey Plan No. LS/D/LKJ 1876 was excised to it by the Lagos State government from their original plot measuring 54.856 hectares.

He said that he was represented by the seventh defendant, Dawodu, in the negotiations for out-of-court settlement initiated by the fourth, fifth and sixth defendants.

The claimant alleged that Dawodu refused to make the Terms of Settlement available to him on the grounds that it had yet to be signed by the other parties, which was later found to be untrue.

He averred that the seventh defendant, purporting to represent the Oloto Royal Family, connived with the first to sixth defendant and gave part of the 5.708 hectares to the first to third defendants.

In an affidavit in support of a motion on notice dated March 3, 2016, deposed to by family’s secretary, Chief Mohammed Akinola, the claimant alleged that the defendants recruited Mobile Policemen and “thugs and bandits armed with guns, cutlasses,” who attacked members of the family in a bid to forcibly erect a signpost “on our land.”

    Oshiomhole: Benin monarch Erediauwa iconic

•Erediauwa epitomised Nigeria’s unity, says Okorocha
    • Olugbu mourns oba •Edo APC aspirant condoles with monarch’s family

Edo State Governor Adams Oshiomhole has said the late Omo N’Oba N’Edo Uku Akpolokpolor, Oba Erediauwa of Benin, was an icon.

A statement by his Chief Press Secretary, Mr. Peter Okhiria, said: “Our attention has been drawn to the use of a word ‘iconoclastic’, instead of ‘iconic’, in a tribute by Governor Adams Oshiomhole to the Oba of Benin. It was a typographical error.

“We ask mischief makers to desist from trivialising the issue at this period of mourning of our great monarch, who has joined his ancestors.”

Also, Imo State Governor Rochas Okorocha yesterday said the late monarch was an epitome of Nigeria’s unity and one of the few traditional rulers, who contributed greatly to the nation’s unity through his actions and utterances.

In a condolence message to Oshiomhole, the Imo governor said the nation would have wanted the monarch to live on and continue his patriotic roles.

In the message by his Chief Press Secretary, Sam Onwuemeodo, the governor said he received the news with shock.

He condoled with Oshiomhole and the Bini on the monarch’s death.

The message read: “No doubt, Oba Erediauwa lived an exemplary life as a traditional ruler and a great leader of his people, so much that his occasional views on national issues were always appreciated.

“The late oba of Benin was one of the few traditional rulers in the country, who contributed immensely to the unity of the nation through their actions and their utterances. The nation would have preferred that he lived to continue his patriotic role.

“It is regrettable the oba died at a time the country needed the patriotic role of people like him to remain united and when his experience would have been most needed.”

Okorocha prayed for the repose of the monarch’s soul and the fortitude for Oshiomhole and those Oba Erediauwa left behind to bear the loss.

Also, the Olugbo of Ugbo Kingdom in Ondo State, Oba Frederick Obateru Akinruntan, has said the passing on of Oba Erediauwa was a great loss to the Bini and Nigerians.

Oba Akinruntan, who described the monarch as a traditional and cultural hero, said he was one of the monarchs, who truly projected the tradition and culture of his people undiluted.

Oba Erediauwa, the Ondo State monarch said, would be remembered as one of the finest and most brilliant traditional rulers in the country, whose opinions always carried weight.

Oba Akinruntan, who chairs the Yoruba Obas Conflict Resolution Committee, said: “Oba Erediauwa is not only brilliant and intelligent, I always admired him as a culture hero. He represented the essence of Bini tradition, which has survived adulteration of modern-day civilisation. He was courageous and spoke the truth, no matter how daunting the environment was. His love for his people was unparalleled and he always held his head high on issues that bordered on the traditional institution.”

Oba Akinruntan noted that Ugbo and the Bini people had an age-long relationship.

He said: “On behalf of the people of Ugbo, I condole with the royal family of Benin Kingdom, the people and government of Edo State and Nigerians for this great loss. Our consolation is that Oba Erediauwa left an indelible legacy, which will remain evergreen in our memory. I pray God to grant him eternal rest as he joins his ancestors.”

Also, a governorship aspirant on the platform of the All Progressives Congress (APC) in the September 10 governorship election in Edo State, Chris Ogiemwonyi, condoled with the family, the people and residents of the state.

In a statement in Benin, the state capital, Ogiemwonyi said: “On behalf of myself and my family, I express my heartfelt condolences to the royal family of the distinguished monarch, patriot and statesman, Omo N’Oba N’Edo Uku Akpolokpolo, Oba Erediauwa of Benin Kingdom. I also commiserate with the Bini on the transition of our great monarch to the world beyond.

“I will miss your wise counsel, generous disposition and expression of love.

“The absence of your physical presence is a great loss to the state and the country and, no doubt, it has created a big vacuum that will be difficult to fill in a hurry.”

Recalling the eventful reign of the monarch, Ogiemwonyi said: “Your 37 year-reign was monumental and peaceful. I pray you reunite with your ancestors and that the Almighty God grants every member of the royal family and the people the wisdom to sustain your worthy legacies.”

  • ‎Obaship tussle: Court dethrones monarch

A Lagos high court sitting in Igbosere Wednesday removed Oba Micheal Gbadebo Onakoya as the traditional ruler and Orijeru of Igboye in Epe Local Government Area.

The court presided by Justice Iyabo Kasali restrained Onakoya from parading himself as the monarch and Orijeru of Igboyeland of Epe Local government.

Justice Kasali gave the order while delivering judgement in a suit filed by representatives of Ewade Ruling House‎ who were contesting the nomination and crowning of the monarch.

Justice Habib Abiru‎, who has now been elevated to  the Court of Appeal, had earlier in 2008 in his judgement in a suit no ID/1472/1992 filed representatives of the Erelu and Osikadewa Ruling Houses dethroned the  embattled monarch from the stool of Orijeru of Igboyeland.

Justice Abiru declined to stay execution of his judgment in a ruling delievered on October 15, 2009 and likewise the trio of Justices C.C. Nweze, R.N. Pemu and F.O. Akinbami of the Court of Appeal on February‎ 27, 2013 in different applications filed by the deposed monarch.

Also in her judgement Wednesday, Justice Kasali declared the nomination of the second defendant, Onakoya, to the stool of Orijeru of Igboye as illegal and of no effect.

Justice Kasali whose judgement lasted one hour forty five minutes granted all the claims of the claimants in the suit filed through their counsel, Tunde Oyende.

‎The trial judge declared that the second defendant (Micheal Gbadebo Onakoya) is not a member of the Ewade Ruling House of Igboye and is not entitled to be nominated to the stool of the Orijeru of Igboye.

The court granted “an order of perpetual injunction restraining‎ the second defendant from parading himself as a member of Ewade Ruling House of the said Igboye or presenting himself for the stool of Orijeru of Igboye on the platform of Ewade Ruling House”.

The judge also gave an order of perpetual injunction restraining all the other defendants from recognising the second defendant as a member of Ewade Ruling House of Igboye”.

The claimants in the suit are Alhaji M.A. Q‎uadri, Chief Dauda Kadiri and Mrs. Oladipe Otunowo for themselves and as representatives of Osekelu branch of Ewade Ruling House.

Others are Chief Gbenro Otunowo, Mr. Yemisi Adegboyega and Mrs. Adeleke Ogunnubi, for themselves and as representatives of Okuyemi/Okuboyejo branch of Ewade Ruling House.

The defendants, aside from the second defendants, are Head of the Ewade Ruling House, Otunba Abdulwasiu Musa-Adebamowo‎, Lagos State Government and Attorney General of Lagos State.

Justice Kasali dismissed the 35 point averments of the second defendant contained in his amended statement of defence and counter claims filed through his counsel, ‎Babatunnde Oshilaja.

The trial judge also described as fraudulent, the documents used by the deposed monarch for his nomination, selection and subsequent recognition by government‎ for the stool of Orijeru of Igboyeland.

She agreed that the claimants were not aware of nor participated in the meetings purportedly held by the Ewade Ruling House‎ in August, 1991which culminated in his unlawful nomination.

She also agreed with the claimant’s that they were not aware of the presentation of the second defendant to the state government who is the third defendant.

“The members of Ewade Ruling House only became aware of the true but hidden and secret fact that the second defendant had assumed the stool‎ of Igboye, before he was deposed, on the platform of Ewade Ruling House when they saw the letter ref. EP. 181/134 dated 26th February, 2003 addressed to the second defendant “in care of Ewade Ruling House” in the course of downloading processes in suit ID/1472/92: Adesida Vs Lagos State Government which was decided on 15th October, 2008 by this Honourable court”.

Justice Kasali identified three issues for the determination of the court: whether or not the claimants have locus standi to institute the action; whether, if the first issue is in the positive, the claimants have proved their case to be entitled to the judgement of the court; and ‎if the first issue is in the negative, whether the second defendant proved his counter-claim before the court.

On the first issue, the court held that the claimants have locus standi to institute the action based on the various evidences before the court.

The trial judge, on the second issue, held‎ there is overwhelming evidence that the second defendant is not a member of the Ewade Ruling House but from the Erelu Ruling House.

Justice Kasali noted that while the claimants have been able to prove that the second defendant is not from their Ruling House, the second defendant has not been able to discharge the burden of proving that he is from Ewade Ruling House.

She emphasised that the burden of proving a case rest on the claimant whose evidence must be credible and rest on his pleadings.

The judge said she had seen the declaration on sucession to the stool of Orijeru of Igboye and based on the submissions made by counsels, the court relied on the document and restated that the second defendant is not entitled to be nominated to the stool of the Orijeru on the platform of Ewade Ruling House‎.

She said: “the claimants’ case succeeds. The counter-claims failed and is therefore dismissed in its entirety. All the other defendants also perpetually restrained”.

‎Justice Kasali said it was necessary for trial courts to take a stand against illegality and ensure that justice is done at all times.

Meanwhile, the embattled monarch’s appeal against his dethronement by Justice Abiru, now elevated to the Court of Appeal, is pending before the Lagos division‎ of the court.

Monarch hails Ugwuanyi for release of 76 farmers from detention

The traditional ruler of Ugwuleshi community in Awgu Local Government Area of Enugu State, Igwe Godwin Nwobi, has hailed Governor Ifeanyi Ugwuanyi for ensuring the release of 76 farmers from prison custody.

The farmers were granted bail on Friday by an Umuahia Magistrate’s Court, following an altercation between them and some Fulani herdsmen, which led to their arrest and arraignment.

The monarch said the farmers safely united with their families and loved ones after getting bail.

He urged the Federal Government to resolve the perennial confrontation between the Fulani herdsmen and indigenous farmers over the grazing of cattle on farmlands.

Igwe Nwobi, who spoke on behalf of the residents and political stakeholders, said the cattle had always led to the destruction of crops.

The monarch noted that a lasting solution would ensure an end to the clashes and promote peace among the villagers and Fulani herdsmen.

On Ugwuanyi’s efforts at calming frayed nerves and reducing tension on the matter, Igwe Nwobi said the governor’s intervention made it possible for the farmers to be granted bail for their freedom.

He said: “I am happy that they are back. I thank the Government of Enugu State for its efforts in making sure that my subjects come back. I appreciate the efforts of Governor Ugwuanyi, who visited my community over this matter. That shows he is a man of the people. We pray God to grant him wisdom to continue to pilot the affairs of Enugu State. I also thank my community for their understanding.”

The member representing Awgu South Constituency in the House of Assembly, Nelson Uduji, said the residents went through arduous tasks to get the bail for the 76 farmers.

  • Head of kingmakers disowns Delta’s 15-year-old monarch

HEAD of the kingmakers (Onishe) of Ubulu-Uku Kingdom, Delta State, Chief Emma Ejiofor, has disowned the town’s new monarch,Agbogidi Chukwuka Noah Akaeze I.

The monarch, 15, succeeded his father, the late Edward Akaeze Ofulue III, who was murdered by suspected Fulani herdsmen two months ago.

Ejiofor described him as a “government-appointed self-styled king” and his late father  a “usurper”.

Chief Ejiofor, who spoke with reporters in Asaba yesterday, said: “I am the alter-ego of Ubulu-Uku traditional council. It is the Onishe that has the powers to crown or dethrone the king. The late Akaeze is a usurper. I did not crown him. If you go through the edict which makes my office, you will see that I did not also crown the boy that was politically-manipulated into office.”

According to Chief Ejiofor, the nine-man Council of Chiefs (Umuezim), which customarily select a new king, were sidelined.

“I won’t dance to my grave on the altar of mediocrity. What is a 15-year-old boy doing in Government House? That is to tell you it was a political manipulation. By all standards, the boy is still a minor. If I dance to their side, the gods will strike me.

“The young man came from London and his father was interred that day. He was crowned same day. He was taken to the council chairman the following day. The third day, they took him to the governor and he returned to the United Kingdom the next day. These things were done to tell you that some persons schemed to cover up for their traditional rascality,” Chief Ejiofor said.

He denounced claims that he was suspended by the late monarch, maintaining: “Who was not crowned a king cannot suspend a traditional title holder. The late Akaeze has no powers to suspend me for not accepting his self-styled installation.”

  • Stop parading yourself as monarch, lawmakers tell Olukere

Stop parading yourself as monarch, lawmakers tell Olukere

•’It’s the hand of Esau, voice of Jacob’

Ekiti State House of Assembly lawmaker, in a dramatic twist yesterday, advised the Olukere of Ikere-Ekiti, Oba Ganiyu Obasoyin, to stop parading himself as a traditional ruler.

This is coming a week after the House gave him audience on the controversy surrounding his non-recognition.

The House through its Committee on Public Petition chaired by Mrs. Titilayo Owolabi-Akerele and Committee on Chieftaincy Matters led by Badejo Anifowose had received evidence from Olukere to substantiate his claim to kingship.

The lawmakers had invited the Olukere in a bid to ensure that peace reigns in the troubled community, where riot erupted over destruction of his billboard on February 3 under the alleged supervision of Governor Ayo Fayose.

Obasoyin, who is locked in a supremacy tussle with the Ogoga of Ikere-Ekiti, Oba Adejimi Adu, contended that his position as an Oba has been validated by the 1933 Intelligence Report, among other documents.

The lawmakers in a resolution yesterday which was contained in a statement by the House Committee Chairman on Information, Gboyega Aribisogan, urged Obasoyin “to be decorous in his pursuit of recognition so as not to undermine the peace currently reining in the state.”

The resolutions were made under Matters of Urgent Public Importance at the plenary led by the Speaker Kola Oluwawole where the lawmakers accused the Olukere of “embarrassing the state government” in pursuit of recognition for his stool.

According to the statement, Leader of Business,  Akinyele Olatunji, raised the matter that sometime last week, the Olukere came to this House of Assembly with a petition seeking for recognition as a traditional ruler (Oba) as well as a staff of office.

“It is unfortunate that this Olukere that is seeking recognition from Ekiti State Government is still going here and there to embarrass this present government.

“He should stop parading himself as an Oba. He has to wait for his petition to be heard.

“According to history and as represented by the Morgan Commission, no other Olukere has been confirmed as an oba by any Ekiti State Government. The only recognised Oba in Ikere-Ekiti is the Ogoga,” he submitted.

In his contribution,  Akinleye Ekundayo said “the petitioner should not allow anybody to push him”.”

Chairman of the House Committee on Health, Samuel Omotoso, also said; “for anyone to be called an Oba, the history and records must be able to tell.”

He condemned the way the petitioner presented himself when he came with his petition and warned that anyone who wished to come to the House with a petition should comport themselves and desist from storming the House with drummers, singing and dancing.

The House, however, said it was ready to listen to all petitioners, while advising Obasoyin to tender unreserved apology to the Ekiti State Government.

Oluwawole said: “This is a House with high sense of decency. Anyone that wants to submit petition should do it with an equally high sense of decency; not with drumming and dancing.

“This place is not a fanfare venue. This House is not opposing any petition. But they have to be brought within ambit of the law; under an atmosphere of peace. That is when we can serve and perform our duties.

“Olukere should maintain peace in that community. Ogoga is the only recognised oba by Ekiti State government right now.”

But the Olukere described the House’s resolution as “unbelievable and saddening.”

Obasoyin, who claimed that the lawmakers were being “teleguided” by Governor Ayo Fayose, expressed regrets that the lawmakers arrived at the resolution when the process was yet to be completed.

He expressed surprise that it was the House that invited him and promised to invite the other side (the Ogoga) and officials of the Bureau of Chieftaincy Affairs before arriving at a conclusion.

The monarch described the Assembly’s latest position as “feeling the hand of Esau and hearing the voice of Jacob”.

“This is akin to feeling the hand of Esau and hearing the voice of Jacob. These are House members representing the people, they wrote to me to come and defend my petition and they never gave me any condition.

“I will continue to appeal to my people to allow peace to reign in Ikere because we have God on our side. I will come out with a comprehensive reaction as soon as I arrive the state.”

  • Monarch urges govt to provide school, hospital

Monarch urges govt to provide school, hospital

The Oniba of Iba, His Royal Highness (HRH) Oba Goriola Oseni has appealed to Governor Ambode to establish public secondary school and hospital for residents of the community. The monarch made the appeal during his 40th coronation anniversary.

Though he said his four decades on the throne were fraught with several challenges, Oba Oseni feels fulfilled.

He regretted that one of his greatest challenges as a traditional ruler is the numerous litigations in which his throne was enmeshed and which affected the finances of the monarchy.

Oba Oseni lamented the millions of Naira that lawyers took from him every year as legal fees in order to defend his community.

This development, the monarch lamented, was due to what he called his predecessor’s lack of education; a situation that made him to enter into certain agreements which later became an albatross to his monarchy.

“It’s good for people to be educated. If my predecessors were educated, I wouldn’t have been facing these challenges now. For instance, how can our customary tenant claim to be land owners? Do you expect me to fold my arms and watch? It might interest you to know that some of them wanted to install themselves as Oba in Awori land.

“Many years back when I ascended the throne, lawyers could charge you N50, 000 or thereabout. But you get a case and approach a lawyer today, your bill runs into millions. I have won some of the cases and I believe God would assist me to win others,” he said.

Looking back, the monarch is grateful to his Creator for helping him to weather the storm.

“Unease lies the head that wears the crown! I faced a lot of problems but with the help of Almighty Father, I conquered everything. Some people who were installed as kings died after two or four years on the throne; but here we are today. If anybody had said I would still be alive, I would have doubted it,” he said.

One of the monarch’s greatest achievements is the unprecedented development which the ancient town has experienced. The monarch recalled that Iba Kingdom is diametrically different from the ‘jungle’ it once was when he mounted the throne.

“I’m happy about the development of Iba. In 1975 when I was called back home, one could not have access to this area. Who are you coming to meet in Iba apart from the indigenes and the isoko palm wine tappers that I met here when I came?

“I was living in Ajegunle then. You had to enter the bus from Ajegunle, get off at Iyana-Oba and trek down here.

“During the dry season, we would cut palm leaves and lay them on the ground; during rainy season, it was always terrible. But see the way things are now; various small-scale factories littering everywhere, hotels, private schools, LASU, our LCDA is also here.

“When I celebrated my 35th year on the throne five years ago, I appealed to the state government to fix certain roads, and I’m grateful that ex-Governor Babatunde Fashola did very well, with the exception of Ijagemo and Ijododo. But I’m sure that by the grace of God, it will be done this time.

On his regrets in the past 40 years, Oba Oseni said there were none.

Everything he ever did was based on his conviction as he always consulted God before taking any action.

He said: “I have nothing to regret since the beginning of my reign. In 1976 a year after I was installed as king, the followers of my fathers and my predecessors instituted a case against me. I was less than six months on the throne then, but some of the good works I did before I returned home, gave me lots of courage.

“Somebody must be God-fearing and I believe in my God; that is why I still insist I have no regrets,” he said.

Many of his contemporaries and subject understand Oba Oniba on his principled stance on issues. He is not the one to be easily tantalised with cash.

On principles, Oba Oseni said: “I have principles. “Once I the Oniba of Iba, says ‘no’, everybody within my domain and beyond knows I will maintain that stance. You cannot convince me with money. I know I’m not rich but I can never be tempted with money to do things against my principle.”

He noted that the immediate past chairman of the Iba LCDA had already acquired a parcel of land in the community for the proposed school.

“Unfortunately, the Ojo Military Cantonment has acquired most of our lands. We are also contemplating a general hospital but where do we site it? So, we are appealing to government to cede a part of the land acquired by Fashola before he left office as governor so that we can build a hospital there.

  • Monarch urges residents to protect power installations

The Gomo of Kuje Area Council of the Federal Capital Territory (FCT), Alhaji Jibrin Tanko has called on the residents to protect power installations in the area.

Tanko, who spoke at a meeting of officials of the Abuja Electricity Distribution Company (AEDC) with electricity consumers in the area, urged the residents to see the protection of power installation as a collective responsibility.

The monarch also called on traditional rulers in the area to advise their subjects on the importance of protecting the installation, adding that power supply to the area had improved remarkably.

The paramount ruler also called on the officials of AEDC to sustain and build on the improvement recorded in electricity supply, urging them to put their subjects under watch to ensure that not only power installation were protected, but also other government facilities.

“We are supposed to contribute our quota in the policing of power installations in our various communities. As electricity consumers, we must ensure that we report suspicious movement around installations within our neighbourhood.

“We must avoid tampering with power installations because, if we have knowledge of it, we do not have control over it,” he said.

Also speaking, a Regional Manager with AEDC, Mr Ihezue Mohammed expressed dissatisfaction over poor response of electricity consumers in Kuje to payment of bills.

Mohammed stated that Kuje Business office was performing for less than 45 per cent due to nonpayment of bills, adding that out of the monthly target of N60m, the office only generating N29m.

He noted that the meeting was to sensitize electricity consumers on the business trend of AEDC and identify areas where the company could improve on its services.

“AEDC must break even to remain in business and as consumers, you must acknowledge the fact that there is already invest from private hands in the power sector.

“To sustain the already improved supply to Kuje and avoid going back to the period of blackout, we must ensure that we pay our bills promptly. Kuje is expanding and there is need for AEDC to expand its facilities to avoid over stretching of our facilities,” he said.

Some of the residents who spoke to Abuja Review stated that there have been significant improvements in power supply to the area, however called for upgrade of electricity facilities and proper education of AEDC markers to avoid persistent harassment of residents.
