  • Court quashes criminal summons issued by magistrate against Okpebholo

Court quashes criminal summons issued by magistrate against Okpebholo

An Abuja High Court  on Friday, quashed a criminal summon issued on Sept. 12 by an a magistrates’ court against Sen. Monday Okpebholo over alleged certificate forgery.

Justice Charles Agbaza, in a judgment, also voided the entire proceedings before Magistrate Abubakar Mukhtar of a Wuse Magistrate Court in Abuja on grounds that the summon was issued in excess of his jurisdiction and error of law.

Justice Agbaza agreed with Okpebholo that the entire proceedings and the criminal summons were illegal, unconstitutional and in violation of his fundamental human right to fair hearing as guaranteed under Section 36 of the 1999 Constitution (as amended).

The News Agency of Nigeria (NAN) reports that Okpebholo, who is the governor-elect in the Sept 21 Edo governorship election, had, through his counsel, Andrew Emwanta, dragged Mr Honesty Aginbatse amd Mukhtar before the court as 1st and 2nd respondents.

The development followed the criminal summons by Magistrate Mukhtar on Sept. 12, directing Okpebholo to.apoear in court on Sept. 20, the eve of the governorship poll in Edo, over an alleged false statement on his date of birth brought against him by Aginbatse, an Indigene of the state.

The Okpebholo, the APC candidate in the election, was ordered to appear before the court at 12 noon.

He was accused of claiming conflicting dates of birth in his nomination forms submitted to the Independent National Electoral Commission (INEC) to contest the election.

Against the backdrop, Emwanta filed an originating summons before the FCT High Court marked: CV/4589/2024, seeking an order of certiorari to bring into the court for the purpose of being quashed, the entire proceedings and criminal summons issued on Sept. 12 by Mukhtar at the instance of Aginbatse.

The lawyer, in motion dated and filed on Oct. 21, argued that the action was instituted to prevent Okpebholo from presenting himself as a candidate in the Sept. 21 poll and to disqualify him on false grounds.

He also sought a declaration that the entire proceedings and criminal summons was illegal, unconstitutional and in violation of his client’s fundamental human right to fair hearing guaranteed by the law.

He equally sought an order of prohibition, prohibiting the magistrate from further proceeding with the case number: CR/W22/816/2024 instigated by Aginbatse.

In the affidavit in support of the motion, Emwanta averred that Okpebholo “on March 31,2022, deposed to an affidavit to correct the mistake in his date of birth (written as Aug. 29, 1972 on his June 2008 WASSCE Certificate.

He also averred that Okpebholo on his permanent voters card had Aug. 1, 1977, as his date of birth instead of Aug. 29, 1970, which is his correct date of birth), before the Commissioner for Oaths in the Registry of this Honourable Court.”

He said Okpebholo also deposed to an Affidavit of Regularisation of Personal Particulars at the Supreme Court of Nigeria Registry on July 26, stating the facts and correcting the aforementioned mistake in his date of birth in both his WASSCE Certificate and Personal Voters Card (PVC) issued by INEC.

The lawyer said his client further made a declaration via a Deed of Regularisation of Personal Particulars and sworn to before the Commissioner for Oaths at the Supreme Court’s Registry on July 26, among other steps taken by the governor-elect.

Emwanta argued that the magistrate lacked jurisdiction to entertain such matter being a pre-election matter, under Section 29 of which the law confers jurisdiction on the Federal High Court.

But Aginbatse, in a 16-paragraph counter affidavit filed by his lawyer  Raymond Azinye, urged the court to dismiss the application.

On his part, Mukhtar, who was the 2nd respondent, neither filed any process nor represented in court.

Delivering his judgment , Justice Agbaza agreed with Emwanta that the magistrate ought to have considered the exhibits presented by Okpebholo before issuing such order.

He cited previous Supreme Court decision in Osita Nwosu and Imo State Environmental Protection Agency to back his ruling.

The judge, who also agreed with the lawyer on other grounds, barred the magistrate from further proceedings on the case.

He was, however, of the view that the magistrate had a discretion to fix a hearing date of a matter before him.

I didn’t seek for Chinese loan, Okpebholo hits Obaseki

Edo Governor-Elect Senator Monday Okpebholo on Sunday took a swipe on the outgoing administration of Governor Godwin Obaseki in over media reports attributed to its agents about purported plans to secure $45 million loan from the Chinese Government.

In a statement by Okpebholo’s media aide, Godspower Inegbe in Abuja, the Governor-Elect urged Obaseki to use the remaining days in office to reflect on his mismanagement of the State in the last eight years rather than spreading unfounded rumours.

Okpebholo said agents of the outgoing administration in the State claimed that his visit to the Chinese Ambassador to Nigeria at the behest of the diplomat was part of moves to negotiate a loan on behalf of the State.

He said as Governor-Elect, he lacks the constitutional powers to execute any functions on behalf of the State until he officially assumes office and wonders why Obaseki’s handlers will resort to blackmail

The statement reads: “We wish to draw the attention of the general public to the mischievous publication, which is speculating that the winner of the 21st November governorship election in Edo state, Senator Monday Okpebholo was in talks with a Chinese agency to obtain a loan of $45.21 million to execute the construction of three flyovers in Benin city.

“We are constrained to put the record straight. The Governor-elect, Senator Monday Okpebholo, on invitation, was in the office of the Chinese Ambassador to Nigeria in Abuja when the photograph they are now sharing on internet was taken. The Governor-elect was not on a mission to sign any Memorandum of Understanding (MoU) with the China-Exim Bank for loan as dubiously claimed in the said publication.

“Understandably, as Governor-elect, Senator Okpebholo, is not in any official capacity to obtain any loan on behalf of the State, rather, he is working on how to offset the numerous loans obtained by the outgoing administration without any correlating development.

“The Governor-elect, being a realist, will not build his administration on MOUs, and neither will he become another MoU Governor of Edo State.

“The agents of the outgoing administration and members of the defeated PDP that are spreading false rumours about the Governor-elect should focus on the transition process, which in any case they are working tirelessly to truncate

“The Governor-elect will not take advice from those who have failed and mortgaged the future of Edo people over the past 7 years. The Governor-elect will not be a looter of public funds as Governor of Edo state. Rather, he will judiciously manage the resources that belong to Edo people to develop Edo State.

“Instead of resorting to the promotion of lies and falsehoods, we expect the mischief makers to apologize to the good people of the State while undergoing penance for their atrocities. We expect them to confess their sins and seek forgiveness from the people of Edo State, whom they have traumatized financially, mentally, and otherwise in the past 7 years!”

Edo transition teams hold joint inaugural meeting to facilitate smooth handover

The transition team of Edo State Governor, Godwin Obaseki, of the Peoples Democratic Party (PDP), and that of the Governor-elect, Senator Monday Okpebholo, of the All Progressives Congress (APC), yesterday held joint inaugural meeting to facilitate smooth handover on November 12.

Okpebholo won the September 21 governorship election, although the victory is being challenged at the election petitions tribunal in Edo by PDP and five other political parties.

The inaugural meeting took place at the John Odigie-Oyegun Public Service Academy (JOOPSA) in the Government Reservation Area (GRA), Benin.

Edo Commissioner for Communication and Orientation, Chris Nehikhare, while speaking at the inaugural meeting, disclosed that the primary objective of the joint session of the transition teams was to ensure seamless handover of power.

According to him, “We look forward to the collaborative efforts of all members in ensuring a seamless transition.”

The Chairman of the Edo Joint Transition Committee, Joseph Eboigbe, who is also the Secretary to the State Government (SSG), reiterated that the Edo government put the transition committee in place in July 2024.

Chairman of Edo governor-elect’s transition team, Dr. Pius Odubu, a former deputy governor of the state, also urged members of the joint committee to work assiduously to ensure that documents, both hard and soft copies, were provided to give details, for the incoming administration to take off.

Odubu stated that his team looked forward to working with Edo government’s committee, but cautioned against any attempt to hide valuable data and pieces of information.

Edo Governor-elect Okpebholo decries looting of govt properties, last-minute loans

Edo State Governor-Elect Monday Okpebholo has raised the alarm over an alleged massive looting of government funds and properties by officials of the outgoing administration.

In a statement last night in Abuja, Okpebholo wrote: “With a great shock, we regret the widespread reports of looting of government funds and properties by officials of the outgoing administration from the Government House in Benin City.

“It is sad that barely one month to handover, the outgoing administration of Governor Godwin Obaseki is still allegedly obtaining loans from banks and other financial institutions under very shady headings.

“We are also aware of the massive looting and vandalisation of properties, including vehicles, furniture, gadgets, household utensils and even carpets from offices and residences of the Edo State Government.

“This unacceptable behaviour undermines the trust and faith of our citizens in those entrusted to serve them in the past eight years.”

The governor-elect urged relevant authorities, including the Economic and Financial Crimes Commission (EFCC), the Police, and the Department of State Services (DSS) “to investigate the allegations thoroughly and ensure that those found guilty are held accountable while protecting Government House and offices from vandals”.

Warning the outgoing government officials to desist from their alleged looting, Okpebholo added: “Banks and other financial institutions are by this notice cautioned to desist from any dealings that will undermine the finances of the state, especially giving out of loans to government at this period of transition.

“The Accountant General of Edo State is hereby advised to uphold the principle of integrity in his duty, as the only act that will put his name in gold. There will be dire consequences for any act of impunity and stealing by any person or institution found wanting in this regard.”

The governor-elect said his incoming administration would continue to monitor the situation until the last day of the outgoing administration.

Edo Governor-elect raises the alarm over alleged looting

Less than one month to the handover of power in Edo State, the Governor-Elect,  Senator Monday Okpebholo, has raised the alarm over an alleged massive looting of government funds and properties by officials of the outgoing administration.

Okpebholo in a statement in Abuja on Wednesday night, accused the Governor Godwin Obaseki-led administration of taking unscrupulous loans from banks and other financial institutions while government officials were also feasting on properties including vehicles, furniture and rice, looting them with careless abandon.

The statement reads: “With great shock, we regret the widespread reports of looting of government funds and properties by officials of the out-going administration from the Government House, Benin City.

“It is sad that barely one month to handover, the out-going administration of Governor Godwin Obaseki is still allegedly obtaining loans from banks and other financial institutions under very shady headings.

  • Okpebholo’s victory expands APC frontiers, brightens Tinubu’s 2027 prospects

Okpebholo’s victory expands APC frontiers, brightens Tinubu’s 2027 prospects

    • By Simon Ebegbulem

The recent victory of the All Progressives Congress (APC) in the off-cycle governorship election in Edo State was made possible because of the untiring efforts of some notable party chieftains such as Senator Adams Oshiomhole and the Progressives Governors Forum (PGF) led by Governor Hope Uzodimma. It was for the purpose of expanding the party’s frontiers and making it one of first choice by Nigerians.

President Bola Ahmed Tinubu acknowledged the role of Senator Oshiomhole and the progressive governors at a meeting with the leadership of the party in Abuja recently, where the governor-elect and the deputy governor-elect, Monday Okpebholo and Dennis Idahosa, were presented their Certificates of Return. At the meeting, the President hailed the role played by Oshiomhole and Uzodimma during the election. He also urged the party leadership and membership to remain united and focused on achieving the Renewed Hope Agenda.

He said: “Never mind the noise makers. I do a lot of statistical sampling and results. When you hear politicians saying ‘all politics are local’, you must respect that notion.

Try as it may, the People’s Democratic Party’s (PDP) baseless attempts to exonerate itself from the hardship confronting Nigerians, the effects of which President Tinubu has frontally taken on to reverse, via the Renewed Hope Agenda, will ever be to the utter shame and regret of the PDP.

As the gains of the re-engineering matrix of the administration bear more fruits in the not-distant future, the true meaning of the fabled 60-year-rule of the PDP and the juggernauts that touted it, including former Vice President Atiku Abubakar, would dawn on Nigerians. They planned to put Nigerians under perpetual and everlasting bondage, misery and suffering.

Nigerians are now wiser, and nothing encapsulates this more than the APC’s victory in Edo State that brought a well-deserving end to the Godwin Obaseki eight years of maladministration and back into the fold of the forward-looking APC.

Under the leadership of the APC led by President Tinubu, Edo State would be salvaged and brought back into the APC fold. Governor Uzodimma has been beckoned to lead other progressive governors in ensuring the mission is accomplished, applying all democratic principles. The Imo State governor is one of the silent heroes who worked day and night to make this come to reality and once again ensure that democracy flourishes in Edo and its dividends cascade down to the people, under the leadership of Governor-elect Okpebholo, beginning November 12 and beyond.

Governor Uzodimma, fondly called Onwa by teeming supporters and admirers, has democratic antecedents that predate his emergence as Imo State governor in 2020. A former member of the upper legislative chamber of the National Assembly, he, not unlike President Tinubu, who he holds in the highest of regards and esteem, has joined in expanding the frontiers of the party, ensuring notable spread across the Niger and far beyond the Heartland State (Imo), where he has continued to endear the ruling party to all and sundry.

With sterling performance in Imo, which has rubbed off on Ndi Imo at the federal level, through appointments, added to the glaring federal presence in the state and coupled with his administration’s unsurpassed infrastructural and economic development strides, Governor Uzodimma has continued to garner accolades from far and wide, several of which has translated into more recognition and added responsibilities.

Into his first tenure in office, colleagues from the ruling party, in recognition of his leadership qualities made Uzodimma the chairman of the Progressives Governors’ Forum. Even before he came into office, President Tinubu had chosen to work with him, by charging him with a sensitive assignment, which he has delivered on. In the process, the APC has gained and continues to add into its fold, a windfall of notable opposition figures joining the ruling party at the centre in the Southeast geo-political zone.

The landmark APC victory in Edo was made possible by the unrelenting efforts of Oshiomhole and Uzodimma. Right from the beginning, the Imo State governor has been in the thick of the battle to rightfully return Edo State to the fold, working assiduously with others, including the leader of the APC in Edo State, Senator Oshiomhole, a former two-term governor, to make this manifest. It is, therefore, no surprise that following the Independent National Electoral Commission’s (INEC) declaration of Senator Monday Okpebholo as the winner of the September 21 election, congratulatory messages have been pouring in from far and near.

Uzodimma, being a loyal party leader, may not understand what he and others have achieved in getting Edo back to the APC fold. But, observers of Edo politics are in a position to understand. After Comrade Oshiomhole left the Nigeria Labour Congress (NLC) as its president, people from all walks of life, advised him to contest for the highest office in the land, the presidency. But Oshiomhole opted to run for the governorship after the Edo people persuaded him to come and lead them out of the PDP conundrum. That was how Oshiomhole joined the governorship race in 2007, under the umbrella of the then Action Congress (AC), in alliance with the Labour movement.

However, he was rigged out by the PDP, and the Edo people cried foul. The current president mobilised resources for Oshiomhole and recruited forensic experts who deployed the most modern techniques, including recounting the ballot papers used for the election. That was how, on March 20, 2008, the Edo State Election Petition Tribunal nullified the election of Prof. Oserheimen Osunbor and declared Oshiomhole the authentic winner. On November 11, 2008, the Court of Appeal upheld the ruling of the state election petition tribunal, declaring Oshiomhole the winner.

Therefore, Governor Obaseki made one of his too numerous blunders, when he and his cohorts came with their usual rhetoric that, “Edo no be Lagos”. Sadly, after the efforts made by the now President Tinubu and Oshiomhole to bring Edo into the APC, Governor Obaseki, who was handed the ticket of the party by the latter, against all odds, took the state back to the PDP, to the chagrin of many, including President Tinubu and Oshiomhole.

It is, therefore, understood why President Tinubu deployed his political ally in the Southeast, the political strategist, Governor Uzodimma, to return Edo to the APC fold. Uzodimma did just that, applying all democratic tenets. He campaigned for the party within the Igbo community in Edo, by reminding them of all the anti-democratic actions of Governor Obaseki, including his refusal to swear in 14 elected members of the Edo House of Assembly. He rallied fellow governors to ensure that the dream of Mr President was achieved in Edo.

By reclaiming Edo State to the APC, Governor Uzodimma is already galvanizing support for President Tinubu’s 2027 second-term bid, which is well expected, clearing all hurdles and expanding the political horizon of the APC ahead of 2027. Today, the Imo governor has been described as the “Lion” of the Southeast. As chairman of the Southeast Governors Forum, Uzodimma has been able to propagate the Renewed Hope Agenda of President Tinubu, and today the Southeast is witnessing the influx of people into the APC.

The APC National Chairman, Dr Abdullahi Ganduje, while congratulating Senator Okpebholo, commended the political sagacity of Uzodimma and other progressive governors. “We look forward to a prosperous new chapter for Edo State,” Ganduje said.

There were wild jubilations in the ancient kingdom of Benin, when the Returning Officer for the Edo State governorship election and Vice-Chancellor, Federal University of Technology (FUT), Minna, Niger State, Prof. Faruk Adamu Kuta, declared Senator Monday Okpebholo of the APC as the winner of the keenly-contested election at 9:26 p.m. on Sunday, September 22. He announced that Okpebholo, representing the Edo Central Senatorial District, secured 291,667 votes to defeat the PDP candidate, Dr Asue Ighodalo, who got 247,274 votes.

The Labour Party’s (LP) Olumide Akpata, former President of the Nigerian Bar Association (NBA), came a distant third, securing 22,763 votes. This declaration has ended Obaseki’s plot to keep Edo under the stranglehold of the PDP. Thanks to Governor Uzodimma whose superior political dexterity rescued the state from that stranglehold. President Tinubu can now relax that his APC has made a major in-road into the South-south ahead of 2027.
