  • 48 awaiting trial inmates pass WASSCE

    48 awaiting trial inmates of Ikoyi prisons passed the November/December 2013 General Certificate of Examination (GCE) convincingly.

    The Deputy Controller of Prisons, Mr. Emmanuel Bamidele, disclosed this on Monday during a visit to the place by members of the Nigerian Bar Association, Ikeja Branch.

    NBA members were at the prison to present gifts to the inmates as part of activities marking the 2014 Law Week.

    He said the 48 were among the 102 inmates that wrote the examination.

    “When they finally regained their freedom, they can seek admission into any university of their choice, since they are awaiting trial,” deputy controller said.

    He explained that one key objective of the “Rehabilitation, Restoration and Reintegration” (3Rs) programme of the Prison is to provide education opportunities for the inmates so that they can be useful to themselves and the society whenever they regained freedom.

    He disclosed that out of 1,761 inmates in the prison, 186 are convicted while 1,575 are awaiting trial for upwards of between five and 13 years.

    The NBA chairman, Mr. Monday Ubani, raised the hope of the inmates when he disclosed that the Chief Judge of Lagos State, Justice Ayotunde Phillips, would visit the prison soon to release awaiting trial inmates.

    Ubani, who said the NBA is in contact with the chief judge and the Ministry of Justice disclosed that names of those to be released are being compiled.

    “Believe me, this travail would soon be over for some of you when the Chief Judge visits in May,” he said.

    Only true federalism can reduce tensions, says NBA

    THE Nigeria Bar Association (NBA) has stated that the entrenchment of a true federal system of government is the only panacea to reducing tension and other problems confronting the nation.

    The Chairman NBA Ikeja Branch, Mr. Monday Ubani, stated this at a news conference at the weekend to announce activities for the 2014 Law Week of the branch.

    The activities, which commenced Friday April 25, end May 2.

    Ubani stressed the need for resource control by the owner states, saying it is also critical to reducing tensions.

    He said: “We feel strongly that the best system that will reduce tension and create competitiveness and healthy rivalry for the purpose of development is a proper federal system.

    “If this is not agreeable to all citizens, then the country is advised to go their separate ways.”

    He insisted that only a true federal system of government would be conducive and reduce tensions for a multi- ethnic and diverse religious country like Nigeria.

    The NBA chairman stated that Nigeria would be taking a retrogressive step if it subjects the outcome of the ongoing national conference to the National Assembly for considerations.

    He suggested the outcomes should be subjected to a referendum of the people.

    Lawyers joined yesterday the tongue-lashing of the government over the girls’ abduction.

    Nigerian Bar Association (NBA), Ikeja branch Chairman Monday Ubani berated the government’s handling of the Boko Haram insurgency.

    Ubani told reporters that it was least expected of the President to accord priority attention to political rallies at a time the nation was mourning the victims of insurgency.

    He urged governors invited to a security meeting by the Presidency to put their differences aside and ensure that a lasting solution is found to the crisis.

    The NBA chairman counselled President Goodluck Jonathan to lead by action and example, saying it is morally wrong for the President to visit Kano for a political rally while the nation was mourning the victims of the bomb blast at Nyanya in Abuja.

    He also lamented the conflicting figures given by the military of the girls abducted by the terrorists.

    He urged the authorities to ensure the prompt release of the girls.

    Ubani said: “I think the handling of the insurgency crisis by the federal government has not been effective. It has not been effective especially given the fact that there was the abduction of more than 200 school girls by Boko Haram and the bomb blasts where many souls were lost and the president went ahead to attend a rally for his second term bid where he was seen dancing when Nigerians were mourning the dead.

    “That wasn’t a proper way to handle the issue or mourn the victims.

    “Now the military came out and gave conflicting information on the number of those abducted. Up till now, the girls are still in the custody of their abductors”.

    “So, the President’s handling of the security issue is ineffective and I think the all – inclusive meeting of the security forces that involves all the governors should do their utmost to find a lasting solution to this madness.

    “There must be a practical solution to it. Mr President should also strive to lead by example.”

    The Chief Justice of Nigeria, Aloma Mukhtar; Speaker, House of the Representatives, Aminu Tambuwal and Lagos State governor Babatunde Fashola (SAN) are among the dignitaries expected at the eight Nigerian Bar Association Section on Business Law (SBL) Annual Conference, to be held at the Eko Hotel and Suites, Lagos, from May 25-27.

    The Chairman of the Conference Planning Committee (CPC) Mr. Seni Adio in a chat with The Nation said: “The forthcoming Conference of the SBL is billed to build on and surpass the programming and attendance of previous conferences hence, in part, the over-arching theme that was selected for this year’s Conference coming on the heels of the 2015 General Elections.”

    Mr. Adio stated that the conference programme is “topical, insightful and exceptionally qualitative” and will be indelible in the minds of participants for many moons to come. The theme is: ”Exemplary Governance – Enhancing Economic Development in Nigeria”. There will be a welcome cocktail on the evening of May 25 and the opening ceremony will be on May 26 followed by plenary and break-out sessions on May 26 and 27.

    Adio said: “Regarding the theme for this years’ Conference, part of the thinking had to do with the fact that it is imperative to take stock in order to re-calibrate and build on the successes that the polity has achieved thus far and equally important, to address topical issues that require urgent attention in order to, amongst other things, sustain economic growth and foster a peaceful and stable polity

    He said: “Put another way, issues of good governance cut across law, business, politics, economics and security – all towards enhancing a strong and exceedingly viable Nigeria

    “We ought to stop thinking and working in silos, the time has come for us to appreciatethat these different spheres are interwoven and this explains why the SBL chose the theme and planned the Conference with international and indigenous subject matter experts as presenters, facilitators and moderators.

    “As you may be aware, the SBL has about 21 different Committees covering different areas of law, such as Banking and Finance, Capital Markets, Intellectual Property, Consumer Protection and Products Liability, Insurance, Sports and Entertainment, Tourism, Alternative Dispute Resolution, and Aviation. This year,in addition to the three plenary sessions, about 8-12 Committees will conduct break-out sessions on key topics that should not be missed.”

    NBA Presidential aspirants woo Eastern Bar Forum

    Four Senior Advocates of Nigeria (SANs) aspiring for the Presidency of Nigerian Bar Association (NBA) have sought the support of the Eastern Bar Forum (EBF), made up lawyers of Igbo extraction.

    The aspirants are Augustine Alegeh, Deacon Dele Adesina, Chief Adeniyi Akintola and Mrs Funke Adekoya.

    During the forum’s meeting in Eket, Akwa Ibom State, the aspirants praised EBF’s leadership.

    Alegeh said the Mid-West Bar Forum, to which he belongs, has modelled itself, its leadership and meetings after the EBF.

    “We took the EBF constitution, studied it and modelled our own constitution after it,” Alegeh said.

    He attended the meeting with about 24 NBA branch chairmen from the North. While some branch chairmen came with their secretaries, others sent their secretaries.

    Adesina, in his goodwill message, said: “EBF is first among equals because you see democracy in action. EBF is really holding the banner of democracy very high and this is worthy of emulation.”

    He praised the vision of the forum’s founding fathers: “Vision drives passion, a visionless individual is a dead person, unless you run a vision as if your life depends on it, you cannot accomplish it,” he said.

    Adesina said he attended the meeting to be part of the what was happening in the EBF.

    He commended the NBA leadership for setting agenda for the ongoing national conference because, according to him, the business of law-making is that of lawyers.

    “My prayer is that one day, a lawyer will become the President of this country,” he said.

    Adesina was accompanied to the meeting by the chairman of NBA Ikeja branch, Mr. Monday Ubani, chairman NBA Ondo branch, Mr. Kunle Adetuwubo, chairman NBA Ikere Ekiti branch, Hon Bunmi Olugbade, among others.

    Akintola frowned at a situation where lawyers talk like politicians outside the courterooms. He stated that such talks should be reserved for the courtrooms.

    “I came to this meeting as a mark of respect for EBF, I came in the company of my followers from Kaduna, Kano, Lagos and Ikeja,” he said.

    Akintola stated that the EBF is the oldest forum in the NBA and has demonstrated purposeful leadership.

    He urged the forum to continue to maintain the old tradition of the bar, adding that a lawyer should talk in court and not on the pages of newspapers.

    Akintola urged the EBF to continue its leadership style.

    Adekoya, in her good will massage, said she had the privilege of participating in the EBF capacity building programmes in the past and knows that enhancing legal knowledge is part of EBF agenda.

    Having participated as a resource persons in EBF workshop and seminar last year, she advised the EBF to focus on issues of the rule of law.

    She was accompanied to the meeting by the chairman of NBA Lagos branch, Mr. Alex Muoka, Chukwuma Ezeala, Afam Ofomata Ofomus and Amaka Aneke, among others.

    Mr. Matthias Schuwa brought goodwill message from Mr. Steve Abar, a General Secretary aspirant.

    Other aspirants at the meeting include: Mrs. Chinwe Nwadike, Aniche Barth Okoye, Afam Osigwe, while national officers present included Joyce Oduah, Paul Ebial. Afam Obi, Kelvin Ejelonu, U.F.O. Nnaemeka and John Austin Unachukwu

    NBA President, Okey Wali (SAN) joked that the meeting was more like a National Executive Council (NEC) gathering.

    He praised EBF chairman Ogbonna Igwenyi for leading by example.

    According to him, the EBF had been massively supportive of his administration and had been like its pillar.

    Speaking after the meeting, Igwenyi said: “The meeting is one to be remembered for so many reasons. It provided an opportunity for some of our colleagues who are eying one national office or the other to come and say one thing or the other to us by way of goodwill massages even though the electoral time table has not been rolled out for them to commence their campaigns.

    “They came in their numbers and we interracted with them. I believe that the meeting had achieved the purpose for which it was convened.”

    Ex-NBA scribe faults Ondo govt over disruption of carnival

    AKURE-based lawyer and rights activist, Mr. Charles Titiloye, has condemned the alleged disruption of the Akure Youth Carnival by the Ondo State Government and the Police on Thursday in Akure, the state capital.

    Titiloye, who is the former Secretary of the Nigerian Bar Association (NBA) Akure branch, faulted the claim by the state government that a disturbing security report at its disposal led to its directive to the Police to abort the rally.

    With thus action, according to Titiloye, the fundamental human rights of the youth to peaceful assembly had been infringed upon by the government.

    The activist described as shameful and primitive the orgy of violence resulting from confrontation between the youth and the Police.

    He maintained that the aggrieved youth who complained to have spent over N18million to organise the event must be compensated by the state government.

    Titiloye argued, “The Ondo state Government must encourage youths who despite the massive unemployment in the country organised this cultural carnival rather than engage in criminal acts of terrorism and kidnapping which have threatened the existence of this nation to its foundation.”

    NBA mourns ex-Law School Chief Jegede

    The Nigerian Bar Association(NBA) has expressed shock at the death of  former Director-General of the Nigerian Law School, Chief John Kayode Jegede (SAN).

    The association described the late Jegede  was  a seasoned educationist  and administrator who did his best to uplift educational standards at the Nigerian Law School

    A statement signed by the President of NBA, Mr. Okey Wali (SAN) reads in part: “Mr. Kayode Jegede, SAN as a very good man, gentle, humble, soft spoken and very unassuming.  He thought law of evidence at the Nigerian Law School as a lecturer/secretary of the Council of Legal Education.

    “I also had the privilege of working closely with him as a representative of the Nigerian Bar Association during his tenure as the Director General of the Nigerian Law School.  He was a quintessential administrator and the history of the Nigerian Law School and indeed the legal profession in Nigeria can never be complete without the name of Mr. Jegede (SAN).

    I give the condolences of the Nigerian Bar Association to his family and may his gentle soul rest in peace.  Amen.

  • Killing of lawyers: Police has case to answer – NBA

    The Warri Branch of the Nigerian Bar Association (NBA) has expressed suspicion over the involvement of the Delta state police command in the alleged assassination of two of their members about two weeks ago.

    Expressing the association’s suspicion at a press briefing in Warri on Tuesday to condemn the killing of Horace Eguono Dafiaghor and Samuel Ekwuaghanju, two members of the Warri branch, the NBA tasked the Inspector General of Police to investigate the matter.

    Meanwhile, the Delta state police command has declared five persons, including the notorious Kelvin Oniarah of Kokori village, who now stands trial for crimes including kidnapping, in Abuja, wanted for the killing of the two lawyers.

    The NBA branch, which also said it would be petitioning the National Human Rights Commission (NHRC), said the death of the lawyers, happening on the same day the suspects they were defending were also killed in questionable circumstances was too much for a coincidence.

    Speaking at the briefing, chairman of the branch, Ben Oji, said “I saw the release by the CP. It is very unfortunate they came up with such statements even before commencement of investigation. From the scenario of this case, while it was in court and the death of one of the suspects in police custody, the police have questions to answer. Investigation must start from them.

    “Incidentally, when two of our colleagues were killed the bodies we understood were discovered by policemen guiding the location. So, we can say that the bodies were discovered. But in case of the suspect, he died in police custody, so the policemen should answer for what transpired and what happened.

    “If we are convinced as we are that the two incidents are related, then tackling the killing of the suspect will be in a way involve unraveling the murder of our colleagues. So, the police cannot at this stage where, to my mind, possibilities are still on board come out to absolve self of blame. Let them go and conduct investigation first”, the association said.

    Meanwhile, the Delta state police command, in another press statement signed by the state’s Commissioner of Police, Ikechukwu Aduba, has declared five persons wanted in connection with the killing of the two members of the Warri branch of the NBA; Dafioghor and Ekwughanju.

    According to the statement, the wanted persons belonged in a gang of criminals found out to be responsible for several criminal activities, which had been under investigations for a while.

    “This most dreadful and bloodletting gang, earlier led by Kelvin of Kokori now standing trial at Abuja and one Jonathan Okoli also known as GSM, currently in our custody; from evidence at our disposal have been responsible for series of armed robberies and kidnapping escapades that occurred within Delta state for the past two years,” the statement said.

    Find our members’ killers, says NBA

    The Warri branch of the Nigerian Bar Association (NBA) has called for an investigation into the assassination of two of its members,Horace Eguono Dafiaghor and Samuel Ekwuaghanju, last Thursday.

    The NBA, in a statement by its Chairman, Ben Oji and Publicity Secretary S.G. Ediagbonuvie, urged the police to arrest the perpetrators.

    Dafiaghor and Ekwuaghanju were attacked on their way to the State High Court in Ozoro, where they were defending a kidnap suspect, who was alleged to have kidnapped the son of Ovuzorie Macaulay, the Secretary to Delta State Government.

    The NBA statement said Dafiaghor had repeatedly complained of threats to his life.

    “We call on the police to carry out an investigation and unravel the circumstances leading to the deaths of our colleagues.

    “On our part, we shall do all that is necessary to ensure that justice is served. We owe this to our departed colleagues,” the statement said.

    The forthcoming Conference of the Nigerian Bar Association (NBA) Section on Business Law (BSL) will address serious socio-economic and political issues affecting the country, secretary of its Governing Council Mr. Olu Akpata has said.

    The conference, according to him, starts from May 25 and ends on May-27, at the Eko Hotel and Suites, Victoria Island, Lagos.

    Its theme is: ”Exemplary governance – enhancing economic development in Nigeria”.

    Akpata said: “This theme is influenced by the fact that the conference is being held in the penultimate year to Nigeria’s general elections and thus presents a unique opportunity for stakeholders to address the imperatives of exemplary governance as a platform for enhancing economic development in the country.”

    Since its inception in 2004, the NBA – SBL Business Law Conference has remained a converging point for policy formulators, regulators and industry practitioners with deliberations at the various editions of the conference. The deliberations cover diverse areas of  legal practice such as banking, finance and insolvency, infrastructure and power. Other ares are capital markets, mergers, acquisitions and corporate restructurings, competition law, travel, hospitality and tourism, sports and entertainment, intellectual property, arbitration and ADR, energy, natural resources, environment, and aviation.“
