    Kanu broadcast led to killing Gulak, others, witness tells court

    The Federal High Court in Abuja yesterday heard that the broadcasts made by the leader of the proscribed Indigenous People of Biafra (IPOB), Nnamdi Kanu, led to the killing of a former Senior Special Assistant (SSA) to ex-President Goodluck Jonathan, Ahmed Gulak, and others.

    An official of the Department of State Services (DSS) said this as he resumed his testimony as the second prosecution witness in the ongoing terrorism trial of Kanu.

    The witness, who was part of the DSS’ team that investigated the complaint made against Kanu by the then Attorney General of the Federation (AGF), Abubakar Malami, said the defendant’s broadcast also led to the killing of a retired judge, Justice Stanley Nnaji, and an intending military couple, Sergeant Audu Lucas and Private Glory Matthew.

    The witness said Kanu, in one of his broadcasts, ordered his followers to enforce a sit-at-home in all Southeastern states and in the process, many people, who went out of their houses on that day, were killed.

    He said investigation revealed that Sergeant Lucas and Private Matthew were not only killed by those who were enforcing Kanu’s sit-at-home order, but they were also beheaded.

    The witness said the investigation also revealed that before killing Gulak, those enforcing the directive, blamed him (Gulak) for coming out on a day their leader asked people not to go out of their homes.

    He added that Kanu founded IPOB and Eastern Security Network (ESN), which is the armed wing of IPOB, and that he was the leader of both groups.

    “We were also able to establish that he (Kanu) founded Radio Biafra through which he made inciting comments like the killing of police officers and burning of property,” the witness said.

    He added that they also found that Radio Biafra was not registered in Nigeria and that, owing to Kanu’s broadcast, police stations in Cele and Ilasa (both in Lagos) were burnt by his followers.

    The witness said about 100 luxury buses belonging to the Lagos State Government and part of the Murtala Mohammed International Airport in Lagos State were burnt as allegedly directed by Kanu in one of his broadcasts.

    The witness added: “He (Kanu) not only called for the killing of security officers, he called for them to be beheaded, which they (his followers) did.”

    He said their investigation revealed that Kanu’s agitation for Biafra was for the Southeast and parts of Benue and Kogi states to secede from Nigeria, adding that the defendant “called for the establishment of the state of Biafra by any means possible, including war.”

    The video recording of the session where investigators, including the witness, interrogated Kanu and obtained a written statement from him, was played in court.

    The witness identified Kanu in the video as well as two of his lawyers who were with him during the session, including Alloy Ejimakor.

    The interrogation session took place in a convivial atmosphere as Kanu, his lawyers and the DSS official were seen in the video throwing banters and laughing intermittently.

    Kanu also confirmed being the founder and leader of IPOB and ESN in the clip.

    At a point during the interaction, Kanu sought and was granted permission to ease himself. He went into the restroom, returned a moment later, and the interview session continued.

    Kanu said he was not directly involved in the day-to-day running of both organisations (IPOB and ESN), which he said were managed by their states’ coordinators.

    The defendant also said, in the video, that he made broadcasts in respect of the #EndSARS protest and other broadcasts on Radio Biafra.

    He said the protest that took place in Lagos during the #EndSARS protest was outside the Biafran territory and that the destruction witnessed during the protest could not have been a result of his broadcast.

    Kanu said he does not have authority over his members, adding that if he had authority over them, he would not have subscribed to a referendum, but would have just pronounced Biafra into existence.

    In the video, Kanu denied that IPOB is responsible for the violent attacks in some parts of the Southeast and the killings witnessed, adding: “IPOB is a peaceful movement. The IPOB is a non-violent movement.”

    Kanu, who said he facilitated the establishment of ESN, explained that the organisation was necessitated by the killings of the people of the Southeast.

    He added: “If you look at what was happening in our land, that was what gave rise to ESN. If our people cannot go to the farm, and people are killed in their land, do you sit down and do nothing?

    “People can no longer go to the farm; people can no longer carry out their economic activities.”

    Kanu faulted the invasion of his house by soldiers, which he said accounted for why he left the country for fear of being killed.

    He argued that the invasion was unnecessary and also faulted the manner he was arrested in Kenya and brought back to Nigeria.

    After the witness’s examination in chief, lawyer to the defendant, Paul Erokoro (SAN), sought an adjournment for the defence to cross-examine him.

    Justice James Omotosho adjourned till May 14, 21 and 22 for further hearing.

    The Federal Government, on Wednesday, played some of the ”Radio Biafra”’ broadcast and videos made by Nnamdi Kanu, leader of the proscribed Indigenous People of Biafra (IPOB), in open court to establish the allegation of terrorism preferred against him.

    The broadcast and video documents, which were marked as exhibits, were tendered through the 2nd prosecution witness (PW-2), identified as BBB, before Justice James Omotosho of the Federal High Court in Abuja.

    BBB, who testified behind screen provided by the court, said Kanu admitted making the broadcast and the videos while being led in evidence by FG’s lawyer, Chief Adegboyega Awomolo, SAN.

    One of the radio broadcast made by Kanu on Biafra Radio on Oct. 20, 2020 during #ENDSARS Protest was played in the open court.

    In the live broadcast, Kanu was heard calling on the youth to attack the police officers and soldiers anywhere they were found.

    The IPOB leader, in the broadcast, called on the protesters to ambush the security personnel, snatched their guns and killed them.

    Kanu admitted inciting public against police, says witness

    The Federal High Court in Abuja yesterday heard how the leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, admitted operating an illegal radio station and inciting the public to attack police officers.

    An official of the Department of State Services (DSS) said this while testifying as the second prosecution witness (PW2) in Kanu’s terrorism trial before Justice James Omotosho.

    The witness, identified with the acronym BBB, testified behind a screen. He said Kanu confirmed his activities in his statement.

    Led in evidence by prosecuting lawyer, Adegboyega Awomolo (SAN), BBB said, besides being IPOB leader, Kanu is the founder of the Eastern Security Network (ESN), the armed wing of IPOB.

    The witness said Kanu also operated an illegal radio station, which broadcast on frequencies 102.1 FM and 88.0 FM.

    He said the radio was illegal because it was not licensed by the National Broadcasting Commission (NBC).

    BBB said he was directed in July 2021 to take Kanu’s statement following a letter from the Attorney-General of the Federation (AGF) requesting that the IPOB leader be investigated for terrorism activities.

    The witness said he carried out the assignment in the company of four colleagues.

    He said he handed Kanu the letter from the AGF, which the defendant read and also gave his lawyers to read, following which he requested that Kanu respond to the issues raised in the letter.

    He said that after reading the letter, Kanu volunteered to make a statement in the presence of two of his lawyers, including Alloy Ejimakor.

    The witness said he played some of the broadcast made by the defendant on his radio station (Radio Biafra), including where he called for the attack on police officers and other inciting comments.

    BBB said Kanu admitted to making the broadcast.

    On what Kanu was agitating about, the witness said Kanu wanted the secession of the five Southeast states, part of Kogi and part of Benue states from Nigeria.

    The witness said the defendant’s statement-taking session was recorded on video.

    At that point, Awomolo showed the witness a copy of a disc, which BBB identified as containing the recording of his interaction with Kanu.

    Awomolo then applied to tender the letter from the AGF, the disc and a certificate of compliance.

    But, lead defence counsel Kanu Agabi (SAN), objected, arguing that his team was not served with the AGF’s letter and the video recording.

    Agabi said it was part of the right of the defendant to be given copies of all documents and materials that the prosecution planned to rely on in prosecuting the case.

    Awomolo said he was ready to furnish the defendant with all the necessary documents and materials that the prosecution wishes to rely on.

    Ruling, Justice James Omotosho held that the defence was entitled to all the documents and materials the prosecution planned to rely on.

    The judge ordered the prosecution to, in line with the provision of Section 36 of the Constitution, serve on the defendant all facilities, including documents that it intends to rely on to prosecute the case.

    Justice Omotosho adjourned till May 7 to enable the prosecution to serve the defence with all the necessary documents and for PW2 to continue his testimony.

    Earlier, the PW1, identified as PWAAA, concluded his testimony after being cross-examined by Agabi and re-examined by Awomolo.

    Under cross-examination, the witness said he was not aware that the defendant was charged with 15 counts, but that he was aware that Kanu was charged with inciting others to attack members of the police force.

    PWAAA said: “I was not part of the drafting of the charge, but I am aware that he (the defendant) incited people to kill members of the police force.”

    The witness said he was not aware that the count relating to that allegation was struck out from the charge in an earlier ruling, and that eight out of the 15 counts contained in the original charge were struck out by the court in an earlier ruling.

    Justice Omotosho barred the sister-in-law of the defendant, Mrs. Favour Kanu, from the next three sittings.

    He said the decision was informed by the conduct of the lady, who admitted to live-broadcasting proceedings on social media.

    Before the judge issued the order, he sought to know who Favour was.

    The fair-complexioned lady, dressed in black and sitting beside her husband, rose to her feet and identified herself.

    The judge then ordered her to step forward to the front of the courtroom, which she did.

    Justice Omotosho said he would have cited her for contempt in the face of the court for recording the court’s sitting and broadcasting it.

    Favour said she was streaming live, but did not know that the judge was still sitting.

    She apologised and promised not to do it again.

    Agabi pleaded with the judge not to sanction the woman, but Justice Omotosho insisted that the lady must vacate the courtroom, which she promptly did.

    The Department of State Services (DSS) said it arrested the leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, in a hotel in Lagos after he secretly entered the country in 2015.

    The first prosecution witness in Kanu’s terrorism trial, whose identity was shielded for security reasons, testified behind a screen while being led in evidence by the prosecuting lawyer, Adegboyega Awomolo (SAN).

    Identified as PWAAA, the witness, a DSS operative, said his agency, acting on intelligence, deployed an eight-man team of operatives to a hotel in Ikeja on October 15, 2015, where Kanu was arrested during a room-to-room search.

    The witness said the operatives opted for a room-to-room search because Kanu’s name was not on the hotel’s record.

    PWAAA said the operatives discovered he checked in with another native name.

    Items recovered from him include IPOB pamphlets, IPOB complementary cards, laptops, IPADs, microphones, microphone stands, flash drives, power adaptors for mixers, various brands of phones, perfumes, ATM cards, and a wristwatch, among others.

    The items, brought to court in four suites, were displayed and admitted as exhibits by Justice James Omotosho.

    The witness told the court that the interrogation of Kanu was recorded and that he admitted to being the founder and leader of IPOB.

    He added that the defendant admitted to establishing and operating Radio Biafra and that he did not register it with the National Broadcasting Commission (NBC).

    The video of Kanu’s interrogation was played in court while the statement he made on October 15, 2015, was read out.

    In the video, Kanu admitted setting up Radio Biafra in London and not registering it with the NBC “because there was no need for it”.

    He stated he was fighting for the emancipation of the people of Southeast, Southsouth and parts of Benue and Kogi.

    Kanu claimed that freedom fighting was not a crime anywhere, including in Nigeria, but a fundamental right.

    The IPOB leader also claimed not to be involved in violence.

    Before proceedings began, the court granted a request by the Federal Government for prosecution witnesses to testify behind a screen and with their faces masked.

    Awomolo told the court that the measure was necessary to safeguard the identities of the operatives.

    “Given the sensitive nature of their roles and the security risks involved, it is imperative that these witnesses be allowed to testify anonymously,” he said.

    Lead counsel to the defence, Kanu Agabi (SAN), did not oppose the motion.

    Justice Omotosho agreed with the prosecution and granted the application as prayed.

    The judge also pruned the number of persons who applied to observe the trial to 20, mostly family members.

    Over 30 persons applied to be in court as observers, among them, the convener of “Take it Back Movement”, Omoyele Sowore, who was denied.

    Justice Omotosho adjourned till Friday for the cross-examination of the witness.

    The Department of State Services (DSS) on Tuesday, disclosed the strategy it deployed to apprehend the self acclaimed leader of the proscribed Indigenous People of Biafra (IPOB), Nnamdi Kanu when he allegedly stole into the country in 2015.

    The first prosecution witness in Kanu’s trial for terrorism, gave details of how the arrest took place even when the IPOB leader allegedly attempted to conceal his identity.

    The witness, whose identity was shielded for security reason, testified behind a screen provided by the court, was led in evidence by the prosecuting lawyer, Adegboyega Awomolo (SAN).

    Identified with a combination of letters – PWAAA – the witness, an operative of the DSS, said his agency, acting on intelligence, deployed an eight-man operatives to a hotel in Ikeja, Lagos on October 15, 2015 where Kanu was arrested during a room to room search. 

    The witness said that the operatives, deployed for the assessment, opted for a room-to-room search option because Kanu’s name was not reflected on the hotel’s manifest.

    The witness said the option adopted made it possible for Kanu to be arrested.

    Following his arrest, the witness said, the operatives discovered he used his native name to secure his residence in the hotel.

    The witness said many items , including IPOB pamphlets, IPOB complementary cards, laptops, IPADS, microphones, microphone stand, flash drives, power adaptor for mixers, various brands of phones, perfumes, ATM cards, wrist watch, among others were recovered in Kanu’s hotel room and documented via video recording.

    The items were brought to court on Monday by the prosecution in four suites.

    They were displayed in the open court and subsequently admitted as exhibits by the trial judge, Justice James Omotosho.

    The witness told the court that the interrogation of Kanu was video recorded.

    The witness, a male, told the court that Kanu admitted to be the founder and leader of IPOB. 

    He added that the defendant admitted establishing, operating Radio Biafra and that he did not register the radio station with NBC in Nigeria. 

    The video recording of Kanu’s interrogation was played in court while the statement he made to interrogators on October 15, 2015 has also been read in court.

    In the video, Kanu admitted establishment of Radio Biafra in London, registered in London. 

    Kanu also admitted not registering the radio station with NBC because there was no need for it. 

    In the statement, he admitted fighting for emancipation of the people of South East, South South and parts of Benue and Kogi. 

    He claimed that freedom fighting, which he said he was involved in, is not a crime in any part of the world, including Nigeria because it is a fundamental right. 

    Kanu equally claimed not to be involved in any violence because he has not been linked with any one.

    At the conclusion of the witness’s testimony, Justice Omotosho adjourned till May 2 for the defence team, led by Kanu Agabi (SAN), to cross examine the witness.

    The Federal High Court in Abuja on Tuesday, adjourned the trial of Nnamdi Kanu, leader of the prescribed Indigenous People of Biafra (IPOB), until Friday for cross examination of the Federal Government’s witness.

    Justice James Omotosho adjourned the case after the FG’s counsel, Chief Adegboyega Awomolo, SAN, led the first prosecution witness, identified as PWAAA, in evidence and was discharged from witness box.

    The News Agency of Nigeria (NAN) reports that the witness, a Department of State Service (DSS) operative, who gave his evidence behind protective shield, tendered documentary evidence against the IPOB leader.

    The evidence were tendered through Awomolo and marked as exhibits by the judge after Kanu’s lawyer, Chief Kanu Agabi, SAN, did not object to the application.

    The witness told the court that he had served for about 18 years and that he was assigned with some team members to arrest Kanu at the Golden Tulip Hotel in Lagos.

    In the evidence presented before the court, a video recording of Kanu’s interrogation by DSS operatives was played in the open court and the statement he made on Oct. 15, 2015 was also read, where he admitted establishing Radio Biafra in London and also registered in London.

    In the statement equally read out in the open court by the witness, Kanu said he was interrogated by the DSS without the presence of his lawyer as required by law.

    The IPOB leader, in the documentary evidence, admitted not registering the radio station with the National Broadcasting Commission (NBC) because he felt there was no need for it.

    In his statement, he admitted fighting for emancipation of the people of South East, South South and parts of Benue and Kogi.

    Kanu, who stated that freedom fighting is not a crime in any part of the world, including Nigeria, said it is a fundamental right.

    He claimed not to be involved in any violence because he had not been linked with any.

    Four suite cases recovered from Kanu in his hotel room in 2015 were also brought to the courtroom and displayed.

    The suite cases contained personal belongings of the defendant especially the Biafra Radio equipment.

    Kanu’s lawyer, Agabi, did not object to tendering them and Justice Omotosho admitted and marked them as exhibits in the trial.

    A Federal High Court in Abuja has acceded to the request by the prosecution for its witnesses be shielded in the terrorism trial of self acclaimed leader of the proscribed Indigenous People of Biafra (IPOB), Nnamdi Kanu. 

    Justice James Omotosho granted the permission on Tuesday while ruling in an ex-parte application filed by the prosecuting lawyer, Adegboyega Solomon (SAN).

    While arguing the application, Awomolo said the identities of the witnesses needed to be protected for security reasons. 

    He noted that the case against Kanu borders on terrorism and therefore, there was the need to protect the witnesses. 

    Awomolo also requested that the the witnesses’ names be shielded from the public for the general reasons of security. 

    Defence lawyer, Kanu Agabi )SAN) did not object to the prosecution’s application.

    Agabi however, requested for similar cooperation from the prosecution when the defendant’s bail application is being considered.

    Meanwhile, the prosecution has opened its case by calling its first witness, identified as PWAAA, who is currently in the witness box.

    Indigenous People of Biafra (IPOB) leader Mazi Nnamdi Kanu has added four Senior Advocates of Nigeria (SANs) to his defence team.

    The additions bring the number of SANs on the team to six.

    In addition to Chief Kanu Agabi (SAN) and Uchenna Njoku (SAN), the new SANs are Prof Onyechi Ikpeazu, Emeka Etiaba, Mela Audu Nunghe and Dr. Joseph Akubo.

    They will all be in court today as well as on May 2 and 6 as Kanu’s trial continues.

    A member of Kanu’s legal team, Aloy Ejimakor, provided the update via his verified X handle @AloyEjimakor.

    The Federal Government on March 21 re-arraigned Kanu before Justice James Omotosho on a fresh seven-count charge bordering on terrorism.

    Kanu apologised for his February 10 verbal attack on Justice Binta Nyako, who recused herself from the case.

    The IPOB leader said Justice Nyako “did not deserve the unjust attack.”

    He tendered his apologies through Agabi,  a former Attorney General of the Federation and Justice Minister.

    The SAN attributed Kanu’s outburst to anger and urged everyone to forgive him.

    “He has been angry for a long time and therefore he should not have spoken when he was angry,” Agabi said.
