    Court to decide suit over IPOB leader’s whereabouts Dec. 13

     

     

    A Federal High Court in Abuja has scheduled its decision for December 13 in a suit seeking to compel the Chief of Army Staff, Lt.-Gen. Tukur Buaratai to account for the whereabouts of the leader of the proscribed pro-Biafra group, Indigenous People of Biafra (IPOB), Nnamdi Kanu.

    In the suit marked: FHC/ABJ/CS/908/20017 filed in Abuja in Kanu’s name by his lawyer, Ifeanyi Ejiofor, the plaintiff claimed among others, that the soldiers, who allegedly invaded Kanu’s father’s house on September 14 this year, took him away, a claim Buratai denied.

    The trial judge, Justice Binta Nyako chose the date for the court’s decision in the case after entertaining the final submissions from parties yesterday.

    Arguing his client’s case Friday, Ejiofor stated that contrary to Buratai’s denial, the soldiers that stormed Kanu’s father’s house had a direct contact with him on September 14.

    He said the soldiers that were in Kanu’s hometown for ‘Operation Python Dance II’, a military exercise aimed at quelling separatist agitation in the South-East, had the last contact with him.

    He exhibited photographs, which he claimed showed scenes of destruction at Kanu’s house during the purported invasion by the soldiers. He urged the court to “invoke the doctrine of last seen” to compel the Chief of Army Staff to produce Kanu.

    Ejiofor added: “The exhibits before the court point to the fact that the personnel of the respondent (the Chief of Army Staff) had the last contact with the applicant (Kanu). It is clear that the army had the last contact with the applicant.”

    He contended that the grounds, on which the COAS hinged his notice of preliminary objection, to urged the court to decline jurisdiction to hear the suit was unfounded in law.

    Ejiofor said the issue of locus standi raised by the respondent on the basis of speculation that Kanu was dead was of no moment in a suit for an order ofhabeas corpus.

    Responding, lawyer to Buratai, Akinlolu Kehinde (SAN) prayed the court to dismiss the suit on the grounds that it was “riddled with conjecture, speculation, assumption and unfounded opinions”.

    Kehinde said: “We urge your lordship not to spend judicial time on hearing the application on merit and to dismiss it. My lord is not allowed to act on conjecture and speculation which the application is founded on.”

    The Senior Advocate contended that contrary to the plaintiff’s argument, soldiers never had any contact with the IPOB leader.

    Kehinde further contended that the plaintiff was wrong to have initiated the suit via a writ of habeas corpus, because such process could not be deployed, under the law,  by the plaintiff, who is not certain that Kanu was in the custody of the Nigerian Army.

    According to him, “The writ of habeas corpus is only used when it is certain that the applicant is in the custody of the respondent; not in this instance case when the application is speculating that the applicant is the custody of the applicant or that the applicant has not been seen.”

    Citing part of the plaintiff’s affidavit supporting the suit, Kehinde noted that plaintiff admitted that the search for Kanu conducted by family members had not yielded fruit.

    Kehinde added: “That is to buttress the fact that there is no certainty. The army never conceded that he is in their custody and the onus has shifted to and remained with the applicant to prove that he is in their custody.

    “When there is doubt as to the custody of the applicant, the writ of habeas corpus is not applicable.”

    According to Kehinde, the court could only invoke the doctrine of “last seen” in a criminal trial involving murder or culpable homicide whereby the court would impose duty on the accused persons to account for the death of the deceased.

    Abia State Governor, Okezie Ikpeazu, on Thursday said that it was not his responsibility to produce the leader of the proscribed Indigenous People of Biafra (IPOB), Nnamdi Kanu.
    He spoke with State House journalists after meeting with Vice President Yemi Osinbajo, at the Presidential Villa, Abuja.
    According to him, it was the duty of those that were trained to track people that should give information about the whereabouts of the IPOB leader.
    Stressing that Kanu was his brother, he insisted that the state government does not know his whereabouts.
    He said: “Those who are looking for him may have a better knowledge and have the capacity to determine the location of anyone in Nigeria.
    “There are people who are trained to track people and it is their responsibility, not mine.”
    According to him, the state was trying to set up a committee for the MSME Council and that he was a critical stakeholder in that because Abia state was the SME hub of Nigeria today.
    He said: “The patronage of Made in Nigeria products in Abia is going up.
    Part of the direct fall out of our campaign since the past 24 months is that today some parts of Ariaria market where the shoemaking enterprise is flourishing has enjoyed steady power for three weeks now on a pilot scheme courtesy of the agency in charge of the rural power supply.
    “Beyond that, we are interfacing and having the better relationship with funding agencies now and we were able to attract about N1.3bn or N1.4 billion on direct sales from the made in Aba shoes, made in Abia dresses and all that.
    “And apart from that, the Made in Aba fashion show was held in Abuja and another one was held in New York where they came face to face with world class designers and we did not do badly at all.
    “The made in Nigeria campaign has assumed international dimension.
    On efforts to encourage the local industries, the governor said that having direct sales of N1.4 billion was not a joke and ensuring that there was constant power supply uninterrupted for three weeks which he said was not a mean feat.
    He said exposing them to fairs as far as to New York was not something you sweep under the carpet.
    He said: “Confidence is returned; everybody now places proudly Aba, Proudly Nigeria in his ware. If our youths are happy doing what they are doing then we have started something.
    “We have been working on infrastructure steadily, roads, electricity, security as all of them are part of enablers that will drive our vision going forward.
    “This government has completed about 45 roads and about 25 of those roads are in Aba. We are doing the first flyover in the entire Abia state in Aba and the cement roads we are doing our roads have survived three rainy seasons now and they are standing,” he stated.

    Court orders Abaribe, others to produce Kanu

    The Federal High Court, Abuja on Tuesday ordered Senator Eyninnaya Abaribe, and two others standing as guarantors for the leader of the proscribed Indigenous People of Biafra ( IPOB ), Nnamdi Kanu, to explain his whereabouts.

    It can be recalled that Nnamdi Kanu was granted bail by Justice Binta Nyako on April 24, 2017. However, Kanu did not show up for his trial which was billed to commence on Tuesday.

    However, Kanu’s co-defendants appeared in court.

    Out of the three sureties to Kanu, only Abaribe was present in court with his lawyer. Immanuel Shalum Okabenmabu and Tochukwu Uchendu were not only absent, but did not have legal representations.

    Mr. Ogechi Ogunna, who is the counsel to Abaribe said ‎his client had filed a motion seeking to be discharged as Kanu’s surety.

    The court stressed that Abaribe’s motion to be discharged as Kanu’s surety could not be heard until Nnamdi Kanu appeared in court.

    Justice Nyako presented Abaribe with three (3) options:

    1. Abaribe is to produce Nnamdi Kanu in court before he can apply to be discharged as a surety.
    2. He should be ready to forfeit his N100m bail bond.
    3. Lastly, he should request to be given time to produce the defendant in court.

    In response, Abaribe’s lawyer said that his client was in no position to do any of the above stated conditions.

    He however opted for the third option, which is to be given time to produce the defendant in court, after the judge insisted that his client must opt for one of the options.

    The trial was adjourned till November 20.

    Will Nnamdi Kanu, the leader of the proscribed Indigenous People of Biafra ( IPOB ) be in court today for his trial?

    Nobody could give the answer to this question last night.

    Kanu has not been seen since September 24 when some security agents entered his Afaraukwu, Umuahia home.

    He is facing treason charges along with some members of his group.

    Only Kanu was granted bail on health grounds with Senator Enyinaya Abaribe as one of his sureties.

    Kanu’s lawyer Ifeanyi Ejiofor, told AFP: “Only the army can tell us where he is. Either they arrested him or they killed him.

    “If he is alive, they should bring him to the court on Tuesday (today).”

    Justice ministry spokesman Salihu Othman Isah said whether the trial would go ahead would depend on Kanu’s appearance and the judge.

    “I can’t tell you specifically what will happen,” he added.

    Kanu was first arrested in October 2015 and held in custody until April.

    While Kanu’s brother Emmanuel, claims he was taken away by troops, the military has said its men did not arrest Kanu.

    “They were so numerous. They started to shoot from 200 metres (650 feet) away. People were running for their lives. We had no guns with us,” he told the AFP.

    But a former Abia State Governor Orji Uzor Kalu, said in an interview that Kanu has eloped to the United Kingdom through Malaysia.

    That comment attracted criticism from IPOB and its sympathizers.

    The federal government declared IPOB a “terrorist organisation” after clashes between the security forces and IPOB supporters.

    Members of the group were accused of attacking military checkpoints in Umuahia.

    There was also violence on Aba Road in Port Harcourt, and in Aba where a police post was burnt and a policeman killed by suspected IPOB members.

    The Indigenous People of Biafra (IPOB) has drawn the attention of Nigerians and the entire world to the statement made by the Nigerian Defence Minister General Mansur Dan Ali Rtd on a TV program called Question Time where he admitted sending soldiers to Nnamdi Kanu’s house in Umuahia.
    IPOB through a statement by its media and publicity secretary Emma Powerful said that Dan Ali during the program confirmed that Nigerian Army went in search of Mazi Nnamdi Kanu in his home, having previously denied the involvement of the army in his abduction and disappearance since the invasion of the 14th September 2017.
    The statement reads: “The barefaced lies of the Nigerian Defence Minister General Mansur Dan Ali and that of the Federal government against our leader and organisation is beginning to unravel before the eyes of the world”.
    “By admitting publicly that soldiers were sent to Isiama Afaraukwu Ibeku to look for our leader without any order or warrant from a court of law confirms the contempt in which Nigerian government holds the rule of law and their judicial process.”
    “It is, therefore, incumbent upon civilized nations of the world and organizations alike to ask the APC led Nigerian government why they decided to send armed soldiers to invade Kanu’s residence.
    “Another question that must be asked is why would the government deny this obvious fact when there are incontrovertible proof based on available CCTV evidence that Nigerian soldiers undertook this outrageously murderous raid in a peaceful village that resulted in the disappearance and presumed death of our leader.
    “In the immortal words of Mansur Dan Ali the army ‘went to look for him but he wasn’t there’. This means that the army deliberately ‘went’ and stormed his home.
    “The words to note here is that the army went to look for Kanu, contrary to the lies emanating from the government that Operation Python Dance II was not targeted against IPOB.
    “Since by the admission of the Defence Minister our leader Mazi Nnamdi Kanu was not there during the invasion of his residence, why deny that no invasion took place. This culture of denial, lies and subsequent admission makes it impossible for any neutral observer to believe any word coming out of the mouth of any official of the Buhari regime regarding the issue of IPOB.
    “It is also on record that the Nigerian government, Army and Defence Headquarters Abuja initially denied ever coming near or invading Mazi Nnamdi Kanu’s house in Afaraukwu Ibeku Umuahia Abia State that resulted in the cold-blooded murder of  28 people including that of his two cousins.
    “With these lies upon lies coming from the government over this military invasion, it is therefore reasonably expected to conclude that the army is also lying about not having our leader Mazi Nnamdi Kanu in their custody”.
    “Is the world waiting for Biafrans to pick up arms to demand the release of the body of their leader before they know IPOB is serious about ascertaining what the Nigerian government did with him”.

    Abia State Governor Okezie Ikpeazu said yesterday he is unaware of the whereabouts of leader of Indigenous People of Biafra Nnamdi Kanu.

    Kanu is scheduled to appear in court tomorrow for his case but he has not been seen since September 24 when military men entered his compound. In Afaraukwu, Umuahia.

    Members of his outlawed organization are claiming that the military too him away a claim that has been denied.

    Foremr Abia State Governor Orji Uzor Kalu, said he was reliably told that Kanu had eloped to London through Malaysia.

    Speaking to reporters in Abuja at the weekend, Ikpeazu said:  “I don’t think that is a fair question. I don’t have the capacity to determine where Kanu is. I have never visited him. I have never called him on phone and he has never taken me into confidence as to what he does, where he goes. So, those who are close to him would answer. I don’t have capacity to monitor him to know where he is, maybe journalists, through investigative journalism will know.

    He expressed concerns that some sections in the country cannot trust the Igbo in the South East to occupy certain strategic positions in the country.

    According to him, this feeling of distrust was unfounded, stressing that the Igbo have sufficiently demonstrated love and faith in the corporate existence of Nigeria more than any other ethnic group.

    Tracing the roots of the pervasive misgivings towards the South East to the civil war experiences, Ikpeazu said the Igbo have since put the nasty experiences behind them by registering their presence in every part of the country.

    “The post war experience is that everybody started receding and then we started moving everywhere. Then at the end of the day, our people are beginning to feel that we are not being trusted enough with certain strategic positions despite the fact that we have demonstrated in particular times that we love Nigeria more than anybody, we have faith in this country more than anybody,” the governor said.

    Ikpeazu said the agitations are mainly fueled by inequalities and feelings of unfair treatments.

    The governor said, “Fundamentally speaking, I think that if the questions we ask in this country today are whether there are inequalities, there are gaps, there are people who don’t feel that they have been fairly treated, either as an individual or as a family or as a geopolitical zone, the answer is yes.

    “There is agitation in the North East, there is a agitation in the South West and of course there is agitation in the South South. But I dare say that there is no other ethnic group in this country that has as much faith in Nigeria as a country, one united country than the people of the South East.

    “That is why they are in Sambisa. You can count how many big businesses belonging to the South Westerners that are in Aba. You can count how many big businesses belonging to the people from the North East, North West, North Central that you can find in Owerri. You cannot find a four storey building belonging to somebody from the North East anywhere in the South East.

    “But if you go to Kano, you don’t count three hotels before you count that of somebody from the South East. What it means is that we are the people that have demonstrated faith in a united Nigeria”.

    He traced the creation of IPOB to bottled up discontents among a section of the youths in the Southeast.

    Ikpeazu revealed that Igbo political and cultural leaders had to intervene at this point and that they engaged Kanu through the Ohanaeze and the South East governors.

    This, according to him, was for the purposes of exploring alternative approach to the agitation through intellectual presentations with the view to confronting the Federal Government with sound arguments.“

    Lethal weapons, including petrol bombs and one double-barrel gun, were recovered during Sunday’s raid of the Afaraukwu, Umuahia’s home of Indigenous People of Biafra (IPOB) leader Nnamdi Kanu, the police claimed yesterday. IPOB is banned.

    Abia State Commissioner of Police Anthony Ogbizi said the items were recovered during a joint operation by security personnel.

    He said the petrol bombs were found in buckets.

    Also found, according to the police chief, were incriminating documents and letters concerning IPOB’s activities.

    He said the raid was carried out after an intelligence report regarding the continued activities of some members of the group.

    Ogbizi said: “We recovered many of Biafra’s insignia, staff of office and some of those items are being analysed.”

    The police boss said a suspected member of IPOB was being held.

    He said the team also discovered the telephone numbers of the group’s zonal coordinators, adding that all the communications between the leadership of the group and their collaborators would be thoroughly analysed.

    Ogbizi said a Biafran flag was also found hanging on a telecommunications mast in the area.

    According to him, the police will ask the Nigeria Communications Commission (NCC) to sanction any telecommunication company that allowed its mast to be used to hoist Biafran flags.

    He said the activities of IPOB in the Southeast were “stirring insurrection” and that security agencies would not fold their arms and watch the group foment violence.

    He said members of the group allegedly set ablaze a police station and a van  in Aba. A military patrol team attacked in Umuahia.

    Ogbizi said similar joint operations would be carried out intermittently in Kanu’s residence, anytime the police received intelligence reports that offensive weapons were brought to the place.

    He said that it was wrong to say that the military was taking over the duties of the police. The action, in his view, should be seen as a synergy between the two organisations to check security challenges.

    Ogbizi said that he would not hesitate to invite the army anytime the security situation in the state grew beyond the capacity of the police.

    Ogbizi said this on Thursday during an interaction with newsmen in Umuahia, adding that the items were recovered during a joint operation by security personnel in the state.

    He said that the petrol bombs were found in buckets and incriminating documents and letters, concerning IPOB’s activities and plans, were also recovered during the raid.

    He said that the raid was carried out based on an intelligence report, regarding the continued activities of some members of the group.

    Protesters urge UK to release Nnamdi Kanu for trial

    PROTESTERS on the platform of Advocates of Social Justice for All (ASJA) have urged the United Kingdom to release the leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, to face trial in Nigeria.

    ASJA Executive Director Patriot Asogo Venantius Torkuma?, who led the protest, vowed to occupy the UK High Commission daily until Kanu is produced by the British authorities.

    The protesters, numbering over 1000, defied the downpour in Abuja.

    Torkuma said: “The ASJA is here today in fulfilment of its earlier demand that the United Kingdom, through its High Commission, produce the leader of the terrorist group, the IPOB, Nnamdi Kanu, whom we have now reliably verified to have escaped to London through the active collaboration of his second country.

    “We had clearly stated that we shall occupy this High Commission if the UK fails to produce Kanu.

    “Our stance was informed by the knowledge that the UK was instrumental to the escape of the terrorist leader, only for it to turn around to ask Nigerian authorities for clarification on the state and status of Kanu.

    “Because Nnamdi Kanu holds dual citizenship of Nigeria and the United Kingdom, we do not refute the High Commission’s right to inquire about its ‘citizen’ so to speak.

    “But we do have issues with what the High Commission did in the period preceding when Kanu’s IPOB was declared a terrorist organisation and what it did afterwards. It smacks of the worst case of double standard possible.”

    ASJA accused the UK government of having no problem with its citizen peddling hate speech and directing IPOB members to bomb innocent citizens in Delta State, burn a police station and kill a policeman in Abia State, attack troops on official assignment, rape women, extort traders, rob and kidnap Nigerians for ransom.

    The organisation said at no time did the UK, through its High Commission, call Kanu to order.

    A civil society organisation, Advocates of Social Justice for All (ASJA) has called on the Government of the United Kingdom to release the leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, to face his trial in the country.

    Last month, a Federal High Court in Abuja declared IPOB a terrorist organization after the federal government proscribed it and approached the court for an order to decare IPOB a terror group.

    Shortly after IPOB was outlawed, its leader, Kanu, disappeared.

    It was however speculated that he might have fled to the UK.

    The Nigerian Government is unhappy that despite the overwhelming evidence that Kanu is now in the U.K, the Bristish High Commission is feigning ignorance and also demanding for his whereabout.

    Patriot Asogo Venantius Torkuma‎, the ASJA Executive Director who led the protest vowed to occupy the UK high commission daily until Kanu is produced by the Uk authorities.

    The protesters numbering over 1000 defied the heavy down pour in Abuja and demanded for his extradition back to the country to face charges.

    “The Advocates of Social Justice for All is here today in fulfilment of its earlier demand that the United Kingdom, through its High Commission produce the leader of the terrorist group, the Indigenous People of Biafra (IPoB), Nnamdi Kanu, whom we have now reliably verified to have escaped to London through the active collaboration of his second country.

    “We had clearly stated that we shall occupy this High Commission if the UK fails to produce Kanu.

    ” Our stance was informed by the knowledge that the UK was instrumental to the escape of the terrorist leader only for it to turn around to ask Nigerian authorities for clarification on the state and status of Kanu.

    “Because Nnamdi Kanu holds dual citizenship of Nigeria and the United Kingdom, we do not refute the High Commission’s right to inquire about its “citizen” so to speak.

    “But we do have issues with what the High Commission did in the period preceding when Kanu’s IPoB was declared a terrorist organization and what it did afterwards. It smacks of the worst case of double standard possible”.

    The organisation said at no time did the UK, through its High Commission call Kanu to order.

    Torkuma‎, “It did not see this time as a period to negotiate for him to return to London as its citizen to go peddle his terrorism there. But it had the resources to provide emergency travel documents for the IPoB leader the moment a Nigerian Federal High Court ruled that he leads a terrorist organization. They colluded with other terrorist to ferret him away under the cover of darkness only to turn around to ask the Nigerian government to account for his whereabouts.
