    Tribunal sacks PDP’s House of Reps member in Imo

    The National and State Houses of Assembly Election Tribunal in Imo State has sacked a member of the House of Representatives, representing Ideato North and South Federal Constituency of Imo State, Ikeagwuonu Ugochinyere of the Peoples Democratic Party (PDP).

    In a judgment a moment ago, a three-member of the tribunal, led by Justice Anthony Akpovi, was unanimous in holding that Ugochinyere was not qualified to have contested the election having emerged from an invalid primary, held outside the constituency.

    The tribunal, which is sitting in Nasarawa state, ordered the Independent National Electoral Commission (INEC) to, within 90 days, conduct a supplementary election in 55 polling units, where the petitioner successfully proved that the election was never held.

    It also barred Ugochinyere (a former spokeswoman of the Coalition of United Political Party – CUPP) and his party, the PDP from participating in the ordered supplementary election, having violated the Electoral Act by conducting an invalid primary election.

    The judgment was on the petition marked: EPT/IM/HR/10/2023 filed by Abazu Chika Benson and the All Progressives Congress (APC).

    The Peoples Democratic Party (PDP) and the Labour Party have rejected the verdict of the Presidential Election Petition Court (PEPC) affirming President Bola Ahmed Tinubu victory at the February 25 poll.

    The PDP decision was conveyed in a statement issued late in the night and signed by the party’s National Publicity Secretary, Debo Ologunagba.

    LP’s rejection was announced in a statement by its National Publicity Secretary, Obiora Ifoh.

    But LP’s factional National Chairman Lamidi Apapa disagreed with party’s position. He hailed the verdict and said that the party’s candidate, Mr. Peter Obi had been on wild goose chase.

    The statement PDP statement reads: “Few moments ago, the PEPC delivered judgment in the petition filed by our party, the PDP and its candidate, Atiku Abubakar against the Independent National Electoral Commission (INEC), the All Progressives Congress (APC) and Senator Bola Ahmed Tinubu over the declaration of the APC and Senator Tinubu as winner of the February 25, 2023 presidential election by INEC.

    “As a party, we have had an initial review of the judgment as delivered by the PEPC and we unequivocally reject the judgement in its entirety.

    “The judgment is against reason, against the facts and evidence presented in court; against the relevant electoral laws, guidelines and regulations as well as the Constitution of the Federal Republic of Nigeria, 1999 (as amended).

    “Indeed, the judgment is generous in technicalities and very short in delivering substantial justice in the matter. The PDP, as a law-abiding political party, will with our lawyers, have a comprehensive review of the judgment and decide on the next line of action within the ambit of the law.”

    In its statement, the LP spokesman said that “justice was not served and it did not reflect the law and the desire of the people.”

    He said that the party’s next line of action would be made known after consulting with its lawyers and studying the certified true copy of the judgement.

    But, the Lamidi Apapa-led faction hailed the judgment by the Justice Haruna Tsammani-led panel.

    Iloh said: “The LP watched with dismay and trepidation the dismissal petitions by the five-man panel of the Presidential Election Petition Court, led by Justice Haruna Tsammani, today and we reject the outcome of the judgment in its entirety because justice was not served and it did not reflect the law and the desire of the people.

    “Nigerians were witnesses to the electoral robbery that took place on February 25, 2023, which was globally condemned but the Tribunal in its wisdom refused to accept the obvious.

    “What is at stake is democracy and we will not relent until the will of the people prevail. We salute the doggedness of our team of lawyers who fearlessly exposed the wrath in our system. We can only weep for democracy in Nigeria, but we refuse to give up on Nigeria.

    “Details of the party’s position will be presented after consultation with our lawyers after the Certified True Copy of the Judgement has been received

    Apapa hails judgment

    The Apapa-led faction said: “As a law abiding party, we accept the verdict, and we are going back to the drawing board to know where we have gone wrong.”

    The faction said it warned Obi not to pursue any case, stressing that the presidential candidate was “chasing a wild goose.”

    In a statement by its National Publicity Secretary, Abayomi Arabambi, the faction said: “It is a shame that the legal team of Mr Peter Obi failed to advise him properly before going to the tribunal.

    “Peter Obi has just gone on a wild goose chase. Imagine the candidate failed to fund the party in order to engage the number of required polling agents. Also, the filing of the witnesses outside the stipulated time has shown that the legal team is a failure.

    “Some of us have been saying that Peter Obi decided to go to the tribunal to justify all the money he collected during the campaign.

    “It’s unfortunate that Obi failed to convince the tribunal about those polling units where he was rigged out. The tribunal also said that he ‘made generic allegations of irregularities against the respondent without specifying the polling units.

    “The petitioners alleged irregularities and will use spreadsheets, inspection reports, and forensic analysis as evidence in the trial. The documents promised by the petitioners were not attached to the petition and served on the respondents.”

    Presenting the two-bedroom bungalow to the Nanny, on behalf of the family, Natasha said: “I ask that you take this two-bedroom house as a token of our deep appreciation for the love and the care you have shown our family.

    “You came into my life 10 years ago as a Nanny but you have grown to be a second mother to my children. You have been through moments with me. Thanks you so much, Damaris, and congratulations.”

    In her remarks, Damaris urged other nannies to be compassionate, honest, and prayerful in carrying out their duties while thanking Natasha and family for their good gesture.

    She said: “I don’t know how to say thank you. This is too big. I pray that all the nannies will be kind and be rewarded like this.

    “Don’t put your eyes in what is not yours. What is yours will surely come to you no matter how long it will take.

    “Don’t maltreat any child. Every child is to be loved, so you love them. Put God first in everything you do. Prayer is the key to everything. I sincerely appreciate this.”

    It was gathered that the two-bedroom bungalow is well-finished with a living room, dining, visitor’s toilet, and car parking lots.

    The politician was said to have been reaching out to less privileged in the country.

    It was also learnt that the PDP chieftain had in 2021 acquired multimillion naira equipment for one Dauda Sheidu, a 40-year-old amputee vulcanizer to make his operations easier and seamless in Kogi state.

    Edo Tribunal dismisses PDP’s petition against APC’s Ihonvbere

    Edo State House of Assembly/National Assembly election petitions tribunal at the Edo High Court, Benin, on Monday, September 4, upheld the election of the representative of Owan constituency in the House of Representatives, Julius Ihonvbere of the All Progressives Congress (APC), from the keenly-contested February 25, 2023 general election.

    The candidate of the Peoples Democratic Party (PDP), Jimoh Iruokhaime Ojeiu, and the governing PDP in Edo, challenged Ihonvbere’s victory, but their petition, with reference number: EPT/ED/HR/03/2023, was unanimously dismissed by the three-member tribunal, consisting of Justice (Prof.) Alero Akeredolu, and Justices O.A. Chijioke and M.U. El-Mainari.

    The Tribunal also agreed with the lead counsel to Ihonvbere, Ehiogie West-Idahosa, SAN, an Abuja-based renowned legal practitioner, that Ojeiu/PDP’s petition failed abysmally, and ought to be dismissed, with punitive cost, in the over two-hour judgment.

    Ojeiu and PDP were the first and second petitioners in the petition.

    The lead counsel to Ojeiu, Rasak Isenalume, later told reporters that his duty as a lawyer was to present the case as it was and back it up with relevant laws, while it would be for the tribunal’s judges to decide.

    He added that he would await further instruction from our client, on the possibility of proceeding to the Court of Appeal.

    The lead counsel to the second respondent (Ihonvbere), West-Idahosa, who was represented by Famous Osawaru, described the judgment as meticulously written, articulately delivered, and a victory for the people of Owan federal constituency.

    West-Idahosa reiterated that the tribunal’s judges dismissed the petition, in view of the inability of the petitioners to prove the allegation of overvoting beyond a reasonable doubt.

    The lead counsel to the first respondent (APC), Victor Asumwan, declared that he and his client were glad with the landmark judgment, which he described as a reaffirmation of the decision of the electorate in the Owan federal constituency, whom he said massively voted for the main opposition APC.

    In May, the Presidential Election Petition Tribunal commenced its sitting with various justices presiding over the various petitions concerning the 2023 presidential election.

    Five political parties including the PDP, LP, Action Peoples Party (APP), Allied Peoples Movement (APM) and the Action Alliance (AA) had lodged separate petitions before the tribunal seeking to annul Tinubu’s victory.

    The sitting of the five-man panel of justices is headed by the presiding justice, Justice Haruna Tsammani.

    On the day of the final judgement, the five jurists will deliberate and possibly vote to take a final decision, in case there are disagreements on issues thrown up at trial.

    The decision is, however, not final, as a displeased party can still appeal to the Supreme Court.

    However, many lawyers agree that the Court of Appeal’s decision sets the tone of the final decision of the Supreme Court, either in concurrence or disagreement.

    The judges presiding over the tribunal are:

    2. Justice Stephen Adah – Court of Appeal (Asaba division)

    In this report, The Nation chronicles the profile of five eminent jurists who will deliver the verdict:

    Justice Haruna Simon Tsammani

    Justice Haruna Tsammani was born on November 23, 1959. He hails from Tafawa Balewa LGA of Bauchi State.

    The judge obtained his LL.B degree from Ahmadu Bello University, Zaria in 1982.

    He attended the Nigerian Law School, Lagos for his BL in 1983, and started as a High Court judge in Bauchi State on September 17, 1998.

    He was later elevated to the Court of Appeal on July 16, 2010.

    He is the longest-serving Justice of the Court of Appeal among the five members of the panel. Tsammani has spent half of his 24 years as a judge on the Court of Appeal bench which he was elevated to in July 2010.

    Tsammani delivered one of the judgements of the Court of Appeal in Abuja that affirmed the second term election of Governor Yahaya Bello of Kogi State.

    He also delivered the judgement of the Court of Appeal in Abuja that issued the order restraining the Rivers and Lagos state governments from taking action on their bids to collect Value Added Tax (VAT).

    Justice Stephen Adah

    Justice Stephen Adah who is the presiding Justice of the Asaba Division of the Court of Appeal, was born on June 13, 1957. He hails from Dekina Local Government Area of Kogi State.

    Adah obtained his LL.B degree from Ahmadu Bello University, Zaria, in 1981. He attended the Nigerian Law School, Lagos, for his BL in 1982.

    He was appointed a judge of the Federal High Court on November 12, 1998, and later elevated to the Court of Appeal on November 5, 2012. He served as a member of the three-man panel that granted Obi and Atiku’s motions to serve Tinubu their petitions by substituted means.

    Adah delivered the lead judgement of a three-member panel that affirmed the conviction of a former Plateau State governor, Joshua Dariye, on 16 November 2018. President Muhammadu Buhari would later grant a widely condemned pardon to Dariye alongside a former governor of Taraba, Jolly Nyame, after their conviction and jailing had been affirmed by the Supreme Court.

    Justice Mistura Bolaji-Yusuf

    Justice Misitura Bolaji-Yusuf is the only female member of the five-man panel of the court. She was born on August 7, 1959, and hails from Oyo West LGA of Oyo State.

    The judge obtained her LL.B degree from the Obafemi Awolowo University, Ile-Ife in 1983. She attended the Nigerian Law School the following year for her BL certificate.

    She was appointed a Judge of the High Court of Oyo State on January 30, 1997, and later elevated to the Court of Appeal on March 24, 2014.

    Justice Boloukuoromo Ugo

    At 57, Justice Boloukuoromo Ugo is the youngest among the judges on the panel of the Presidential Election Petition Court. He hails from Kolokuma/Opokua Local Government Area of Bayelsa State.

    Justice Ugo obtained his LL.B degree from the University of Calabar in 1989, before proceeding to the Nigerian Law School in Lagos the following year, for his BL certificate. He was appointed a Judge of the High Court of Bayelsa State on March 21, 2006, and later elevated to the Court of Appeal on March 24, 201

    Justice Abba Mohammed

    Justice Abba Mohammed hails from Kano State. He was born on February 19, 1961.

    He obtained his LL.B degree from the Institute of Administration, Ahmadu Bello University, Zaria in 1984, before proceeding to the Nigerian Law School in Lagos the following year, for his BL Certificate in 1985.

    Justice Mohammed was appointed a judge of the Federal Capital Territory (FCT) High Court in 2010.

    After serving for about 10 years, he was promoted to the Court of Appeal on June 28, 2021. He was the Chairman of the Nasarawa State Governorship Election Tribunal in 2019.

    • Obaseki: election reaffirms our dominance

    Edo State Independent Electoral Commission (EDSIEC), led by Justice James Oyomire (rtd.), has released the results of Saturday’s local government election, with candidates of the Peoples Democratic Party (PDP) winning all the 18 chairmanship seats.

    EDSIEC’s spokesman, Albert Eguaoje, said this yesterday in Benin.

    Seven political parties registered to participate in the election, but Action Alliance (AA), Allied Peoples Movement (APM), Accord (A) and African Democratic Congress (ADC), later collapsed their structures for PDP. 

    The three political parties that participated in the election were PDP, the All Progressives Congress (APC), and Labour Party (LP). 

    Edo Chairman of APC, Col. David Imuse (rtd.), however, described the poll as a scam and a charade.

    LP members in Edo peacefully protested the election, while the three candidates of the Benin municipal councils: Egor, Ikpoba-Okha and Oredo announced on Saturday, their withdrawal from the poll, over irregularities.

    LP’s chairmanship candidate in Oredo Local Government, Daniel-Ero Onaghise, said the poll was massively rigged by PDP’s members and leaders.

    Edo State Governor Godwin Obaseki has said the “impressive performance” of the candidates of PDP in Saturday’s local government election shows the party’s dominance.

    He spoke yesterday to reporters at the Diocese of Benin (Anglican Communion), St. Peter’s Anglican Church, during the 15th memorial thanksgiving service of his father, the late Pa Roland Oni Obaseki.

    The governor, who was elated by the outcome of the election, stressed that Edo residents were democratically- mature, as no violence was recorded during the exercise.

    He said: “We have a situation room where we monitored the election process across the state. I want to thank the people. You can see that we are democratically-mature in Edo State, in terms of the way the election was conducted.

    “I was surprised at the diligence of EDSIEC. I went round and saw the number of polling units mounted by EDSIEC, and the electoral officers in the three metropolitan local governments, and it was quite impressive. The turnout was fair as expected, and it shows that we can conduct elections without disrupting economic and social activities.

    “The people voted and went about their activities. Overall, I believe we have done well. It was a free and fair election. The mass participation and dominance of PDP in the state was exhibited during the poll.”

    Obaseki said he had not seen an election that had not been challenged, reiterating that even elections in the USA were challenged.

    Ex-Taraba PDP chairman is dead

    Former chairman, Peoples Democratic Party (PDP), Taraba State chapter and a governorship aspirant in the last general elections, Victor Bala Kona, is dead. He died in Abuja after an illness.

     A family source reportedly said Kona had been in a London hospital for treatment following “a complicated heart problem” and returned to Nigeria only last Wednesday.

     His health was said to have worsened again on Friday last week and was rushed to an Abuja hospital where he passed away in the early hours of today, Sunday.

     The PDPin Taraba has confirmed Kona’s death and expressed their sadness over the incident.

     In a statement, the party spokesman, Andeta’rang Irammae, said the death was a “colossal” loss to the party. “The People’s Democratic Party, Taraba State chapter is deeply saddened by news of the death of its former chairman Chief Victor Bala Kona (Garkuwan Bakundi), which occurred early on August 27, 2023  in Abuja.

     “The late Chief Victor Bala Kona (Garkuwan Bakundi) was chairman of the Party from March 2012 to August 2020, during which he worked tirelessly for the growth and sustained leadership streak of the party in the state.

      “His loss at this time of our political journey is sad and colossal as the government and party that he had assiduously worked for would have continued to benefit from his fountain of wisdom and knowledge.

     “May God grant us all the fortitude and succour to bear his absence and grant the party his replacement,” the statement read.

     Also, Taraba State Governor, Agbu Kefas, described the loss as “a painful one”.

     A statement by spokesman to the governor, Emmanuel Bello, Kefas said: “We didn’t only lose a political icon but a father and a consummate family man. Hon. Victor Bala Kona’s place in our history is one that is assured and would be respected at all times. His death came at a time his wealth of experience and knowledge would be most needed”.

      Similarly, a former House of Representatives member, Jafaru Yakubu (PDP-Taraba), expressed shock over the demise of Kona.

    Yakubu, who represented Bali/Gassol Federal Constituency at the National Assembly, said  the party would miss his wealth of experience in party mobilisation evidently in the sustainability of PDP’s victory in the state.

    Nasarawa Tribunal: PDP plots to get power through backdoor, says Governor Sule

    Governor Abdullahi Sule of Nasarawa state has closed his case in the petition filed by the Peoples Democratic Party (PDP) governorship candidate, David Umbugadu, in the proceedings that run up to 6pm on Saturday.

    Umbugadu filed a petition challenging the validity of the governorship election conducted on Saturday, March 18, that declared Abdullahi Sule the winner of the election, before the governorship Election Petition Tribunal in Lafia.

    However, Governor Sule’s legal team, headed by Senior Advocate of Nigeria (SAN), Wole Olanikpekun, countered the PDP petition by calling 21 witnesses that testified in support of Governor Sule that the March 18th Governorship election was free and fair. 

    Almost all the 21 witnesses told the tribunal that votes cast in favour of Governor Sule of the APC were shortchanged by the PDP in the various polling units, and wards across the state, noting that PDP actually plotted to gain power through the backdoor with illegitimate votes. 

    At the continuation of proceedings at the tribunal on Saturday, Governor Sule, through his counsel, presented additional seven witnesses in addition to the previous seven who testified on oath, to widespread non-collation of valid APC votes during the governorship election, applied to close his defence.

    The witnesses who came from Nasarawa, Kokona, Wamba and Toto Local Government Areas, confirmed that both Abdullahi Sule and the APC, were shortchanged with their votes improperly collated at various ward and local government collation centres.

    Adamu Ibrahim Otto, who hails from Nasarawa Local Government Area, confirmed before the tribunal that election held peacefully in his Odu/Kadu electoral ward, RW46 and that officials of INEC authenticated voters using the BVAS machine. Otto also confirmed that after casting his vote at his Apaku Polling Unit with Code 018, the Presiding Officer uploaded the scanned copy of the polling unit results on the IREV. 

    He said his only problem was that the vote of his political party, the APC was reduced and the vote of PDP was increased at the point of entering the results on Form EC8B.

    The witness confirmed that, the APC was shortchanged in three polling units, Apaku with Polling Unit Code 018, RW26,  Andrew Wayo with Polling Unit Code 010, RW 27 and Odu/Kadu with Polling Unit Code 005, RW28, all in Kana/Onda/Apawu ward registration area of Nasarawa Local Government Area.

    According to Otto, APC scored 101 votes, PDP 14 at the Apaku polling unit however results at the Kana/Onda/Apawu ward collation centre showed that APC got 72 votes while PDP has 44.

    Similarly, at RW27, APC scored 193, with PDP having 32 but at the ward collation crntre, the result showed APC scored 115, while PDP has 32. Also, at RW28, APC scored 66, while PDP got 42 but results from the ward collation centre showed APC scored 32 while PDP got 76.

    Counsel for the second respondent, Wole Olanikpekun SAN who was represented by Dr. Mubarak Adekilekun then applied to close their defense, following which the Chairman of the tribunal, Justice Ezekiel Ajayi adjourned hearing till Wednesday next week for the APC to open its defense.

    A former chairman of Taraba state chapter of the Peoples Democratic Party (PDP) and governorship aspirant during the 2023 elections, Victor Bala Kona, reportedly died in Abuja after an illness.

    A family source disclosed that Kona had been in a London hospital for treatment following “a complicated heart problem” and returned to Nigeria on Wednesday last week.

    The state PDP had confirmed the death of Kona and expressed sadness over the incident.
