    Anambra: Supreme court dismisses Ekunife’s appeal

    The Supreme Court on Friday dismissed an appeal by Senator Uche Ekunife challenging the nullification of her election to represent Anambra Central Senatorial District in the Senate.

    The Anambra State Election Petition Tribunal and the Court of Appeal in Awka had nullified the election which she purportedly won in the 2015 general elections under the platform of the Peoples Democratic Party (PDP).

    The Court of Appeal had affirmed the order of the tribunal for a fresh conduct of the election.

    However, before the repeat of the election as ordered by the court, Ekwunife on Jan. 8, 2016, defected to the All Progressives Congress (APC).

    Her attempt to pick the ticket of her new political party to contest the re-run poll failed as older members of the party kicked against it, contending that she had to wait for her turn. Delivering judgment on the appeal, Justice Amina Augie held that the Supreme Court had no jurisdiction to entertain disputes emanating from the conduct of National Assembly elections.

    Augie said that Section 246(3) of the 1999 Constitution empowered the Court of Appeal to be the terminal point of all disputes emanating from State and Federal legislative elections.

    “The apex court lacks jurisdiction to hear and determine Ekunife’s appeal in the circumstance.

    “Looking closely at the wordings of Section 246 (3), it is clear that the decision of the Court of Appeal is final. This court is completely bereft of jurisdiction to entertain the appeal.

    “Once the court of appeal delivers its judgment on a National Assembly Election Petition appeal, the judgment becomes final.

    “For the umpteenth time, the Constitution does not approve of the apex court to entertain this appeal no matter how cleverly it has been framed,’’ Augie held.

    She said that the objections raised by Chief Victor Umeh of the All Progressive Grand Alliance (APGA), who was Ekunife’s challenger at the lower courts, were apt.

    “Umeh’s preliminary objections to Ekunife’s appeal succeeded as this court lacks jurisdiction to hear this appeal on its merits. The appeal is struck out,’’ she said.

    Earlier, Augie had in a ruling rejected an appeal by Ekwunife for reinstatement as PDP candidate to contest the senatorial election.

    Augie held that the appellant lost the legitimacy to demand such benefit when she and the PDP were barred from participating in the election.

    Dr Alex Izinyon (SAN), counsel to Ekunife, had urged the court to reinstate his client to her seat in the Senate.

    He had also urged the court to hold that the decision of the tribunal amounted to nullity as it dealt with issues of nomination and sponsorship which were not within its jurisdiction to determine.

    Chief Patrick Ikweato (SAN), counsel to Umeh and APGA, countered Izinyon’s submission, urging the court to dismiss the appeal as it lacked jurisdiction to entertain it.

    Ikweato argued that the appeal was an abuse of court process, adding that Section 246 (3) of the Constitution made the Court of Appeal as the final court to handle the matter.

    He said that Ekunife was no longer a member of the PDP after she defected to APC, where she contested the party primary and lost.

    Ikweato also said that PDP had obtained the judgment of a Federal High Court where Ekunife’s membership of the party was stripped.

    He maintained that the Court of Appeal’s decision which upheld the tribunal’s judgment stemmed from the fact that the appellant was not qualified.

    Speaking to newsmen after the court session, Ekunife expressed displeasure over the decision of the court.

    On his part, Umeh described the decision of the court as a victory for democracy and the rule of law.

    He said that the Independent National Electoral Commission (INEC) must immediately rise to the occasion and fix a date for the senatorial election.

    Umeh further said the people of Anambra Central Senatorial District had suffered from a long period of non-representation at the senate.

    Edo: Tribunal says subpoenaed witnesses can testify for PDP

    The Edo Election Petition Tribunal sitting in Benin, on Wednesday held that all subpoenaed witnesses could testify before it for the People’s Democratic Party (PDP) and Osagie Ize-Iyamu, its candidate in the Sept. 28, governorship election.

    Justice Ahmed Badamasi, Chairman of the three-member tribunal, who read the ruling, said that the petitioners were in other to have invited subpoenaed witnesses to testify in the petition before the tribunal.

    The petitioners are challenging the declaration by the Independent National Election Commission (INEC), Mr Godwin Obaseki as winner of the election.

    The petitioners named the INEC, Obaseki and the APC as first, second and third respondents respectively in the petition.

    INEC had declared Obaseki winner of the Edo governorship election after he polled 319,483 votes to defeat Ize-Iyamu, his closest rival, who scored 250,000 votes.

    At the resumed hearing on Monday, all respondents’ counsel objected to the petitioners’ counsel, Mr Kehinde Eleja, (SAN), request to allow one Mr Oviosu Enas, subpoenaed by the tribunal to testify in the case.

    Delivering its ruling, the tribunal held that the petitioners were in order to have called subpoenaed witnesses to testify on their behalf, since they expressly gave the indication in their statement of claim.

    Moreso “when it is also contained in the tribunal’s pre-trial order that subpoenaed witnesses can be called to testify, ’’ Badamasi said.

    The tribunal chairman ruled that subpoenaed witnesses were competent witnesses especially when the respondents were also put on notice.

    “We will be seen to be blowing hot and cold if we refuse to allow the witness testimony. The respondents’ objection is therefore lacking in merit and is dismissed as incompetent,’’ he ruled.

    Meanwhile, the tribunal has reserved ruling till Thursday to decide whether or not to allow ballot papers used for the Sept. 28 governorship election in four local government council areas to be presented as exhibits.

    While Mr. Ahmed Salman, INEC administrative officer, on Tuesday, produced bags of “Ghana must go’ in court containing used ballot papers for Egor, Akoko-Edo, Etsako-East and Estako-West, respectively on subpoena, the respondents, however, opposed their admissibility in court.

    Mr Onyinye Anunonye, Mr Ken Mozia and Mr Rotimi Ogunesho, both SANs, and counsel to IINEC, Obaseki and APC respectively, argued that the mode of its presentation in court ran foul of the electoral act.

    They urged the tribunal not to admit the ballot papers as exhibit and recounted as prayed by the petitioners.

    But Mr Yusuf Ali, SAN, and counsel to the petitioners, urged the tribunal to discountenance the respondents’ applications, describing them as interlopers and busy bodies, saying their applications were irrelevant and tendentious.

    A witness of the Peoples’ Democratic Party (PDP) and Pastor Osagie Ize-Iyamu in the on-going hearing of the Edo State Election Petition Tribunal sitting in Benin City, Mr. Jonathan Ogie Alohan has confessed to have cobbled together uncertified documents to prepare his witness adoption statement, which he swore under oath.

    This is as Alohan, the witness, testified to have signed the result sheet in error”.

    Alohan, who claimed to have voted in the September 28, 2016 gubernatorial election said there was no accreditation, but added that, “I signed the result sheet after the election. I signed in error”.

    The witness further said he was not interested in non-accreditation when he examined the voters register. He said, “I was not looking for any ticking when I examined the voters’ register”.

    He agreed that the court certified true copies of INEC documents used for the election on the 20th of October 2016 but that a chart (table) was provided in his witness deposition, which arrived at with documents he obtained from his party immediately after the election and were not certified.

    According to him, “I was not looking for any ticking when I was examining the voters register, but I signed the result sheet before the APC agent. I was the first person to sign the result sheet before the APC agent. I signed in error.

    In the same vein, another witness of the PDP and Osagie Ize-Iyamu, Mr. Edo-Esamah Samuel said he was not in court to complain about improper accounting of ballot papers.

    He said under cross-examination that, “No, I did not complain that used and unused ballot papers fell short. It is not correct”. This statement contradicted the deposition he earlier made to the court under oath.

    Continuing, he said, “I voted in unit 4, Olua Primary School, Uselu. Out of the 19 units in my ward, I cannot remember how many units I am challenging”.

    While confirming that the information he deposed to in the court cannot be relied on, he said, “I agree my name and signature are on exhibit PO 4 (17). I have adopted my witness statement. I read my witness statement before adopting it”.

    The managing director and chief executive officer of Peace Mass Transit Limited, Chief Maduka Onyishi said he left Peoples Democratic Party (PDP) for All Progressives Congress (APC) because of the former’s impunity and undemocratic tendencies.
    Onyishi who formally registered in APC at the just concluded registration exercise said he frowned at the situation where one person in the state would single-handedly dictate who to contest election or not.
    The transport magnet spoke to reporters in Enugu yesterday on his defection from PDP to APC.
    According to him, it was only the APC that can afford him the opportunity to serve the society because of its democratic and transparency antecedents.
    Onyishi said he was in politics to render service to the society and not to contest positions whether elective or appointive.
    “I have watched and studied the APC and found out that there is nothing like impunity or imposition of candidates. APC is the party where you queue up and cast your vote for your preferred candidate,” the transport magnet explained.
    He praised the Muhammadu Buhari led APC Federal government for its forthright and focused direction it is giving the country.
    He admonished Nigerians to give their total support to Buhari whom he posited, has the interest of the common Nigerian at heart.
    He said: “I have the convincing belief that Buhari will actually re-engineer this country for good. My admiration for him dates back to 1984 when he introduced the War Against Indiscipline (WAI). Buhari’s war against indiscipline then made me to be self-disciplined up till today.
    ‎”Today he has waged war against corruption. He is the only Nigerian leader who has the courage to confront corrupt politicians. Corruption is what is holding down Nigeria today. And President Muhammadu Buhari, I believe is equal to the task.”
    Onyishi was also of the view that before 2019, the APC would be the predominant party in the South East with the influx of array of political bigwigs from the zone that are joining it.
    “PDP is gone in this zone. The party shot itself down by the way it practices strange democracy where imposition takes the place of election. If you challenge the master’s voice, then you are done for,” he stressed.

    Senator Andy Uba defects to APC

    Sen. Andy Uba, representing Anambra South Senatorial zone under the platform of the People’s Democratic Party (PDP), has defected to the All Progressives Congress (APC).

    Uba disclosed this at a news briefing on Wednesday in his home country, Uga, Aguata Local Government Area of the state.

    The lawmaker said that he joined the APC at the ongoing registration of party members in the state.

    According to him, APC has ideology and focus which he needed to tap into to provide quality representation to his constituents.

    Uba further said that he joined the APC because of other personalities in the party with sound ideas and whom he looked up to in politics.

    He listed some of the personalities to include the Minister of Labour and Employment, Sen. Chris Ngige, and APC National Auditor, Chief George Muoghalu.

    Uba stressed that with such caliber of people, the party would take the state to enviable heights.

    The senator said he would be very effective in serving the yearnings of his people more now that he was in APC and urged other Igbo politicians to join the bandwagon.

    The registration of senator Uba had doused speculations of his defection to APC which had been on for many weeks in the state.

    S/West PDP hails judgement sacking Fayose’s men from exco

    The Southwest Zonal Chapter of the People’s Democratic Party (PDP) has welcomed an Ado Ekiti Federal High Court judgment which sacked the factional exco loyal to Governor Ayo Fayose saying the verdict has signaled an end to impunity, abuse of party constitution and one-man dictatorship in Ekiti State chapter.

    The PDP National Vice Chairman (Southwest), Makanjuola Ogundipe, said the zonal leadership of the party wholeheartedly welcomed the judgment which he said would reposition the Ekiti chapter and make the platform attractive to politicians and electorate ahead of the next elections.

    The Court had on Tuesday sacked the Gboyega Oguntuase-led exco loyal to Fayose and ordered the Independent National Electoral Commission (INEC) to recognize and conduct official business with the Williams Ajayi-led exco which instituted the case.

    Speaking in Ado Ekiti on Wednesday on the heels of the court verdict which took the control of the state structure from Fayose, Ogundipe hailed the court for doing justice and rescuing it from the stranglehold of the governor whom he accused of sending prominent leaders and members away from the party.

    Ogundipe said the Judiciary has once again demonstrated an uncommon courage and never allow “those intoxicated with transient power” to pocket it adding that “this arm of government has been the saving grace of the nation’s democracy.”

    The zonal party boss who claimed that Fayose has turned himself to an “emperor” in Ekiti PDP alleged that the governor wrote a list of the exco of his faction in his sitting room and masterminded parallel congresses where he imposed his stooges most of who left for Labour Party (LP) with him before returning in 2014.

    Ogundipe said: “We wholeheartedly welcome this judgment; it is a judgment for the people, judgment for the rule of law, judgment against imposition, judgment against impunity and judgment against dictatorial tendencies of one man.

    “We want this judgment to transcend to every part of the Southwest for our party to move forward and teach people like Fayose some lessons that there is no room for impunity, lawlessness and abuse of power in our party again.

    “Here is a governor who will never respect the constitution of our party; the congress guidelines say that we should go and conduct congresses in our various wards and in his own case, he produced a list from his own sitting room but in our case, we went to the streets and brought our party men to the congresses to vote.

    “Fayose doesn’t respect the rule of law and that is why he has used his power to prevent the swearing-in of Toyin Obayemi as a member of the House of Assembly contrary to the judgment of the court by resorting to delay tactics.”

    Ogundipe who was the state party chairman when Fayose won the 2014 governorship poll said many PDP chieftains within and outside Ekiti are now regretting their support for the governor as he chased some out of the party while others who could not leave have been sidelined.

    He said further: “Fayose has selfisihly sent away everybody that contributed to his emergence as governor. Some of us who were part of the process had warned that Fayose was coming to exhibit a winner-takes-all attitude in PDP in Ekiti.

    “Fayose told us that he was a changed man and the question I want to ask is that can anybody see any change in him? In my own judgment, he was getting worse and that was why we were skeptical supporting him because it would do our party no good but the truth has come out now.

    “When you find a leader who does not trust any follower, that kind of leader should not be trusted. We want to thank the Judiciary for coming to the rescue of our party in Ekiti and we believe that this judgment will help our party to move forward.”

    • Says APC, Sylva planning to create confusion

    The Bayelsa State Government, on Tuesday, dismissed a speculation of an ongoing review of a Supreme Court’s judgement in the governorship electoral case between the incumbent Governor Seriake Dickson and Chief Timipre Sylva.

    The state has been unsettled by a widespread rumour that the apex court was about reviewing the judgement, which was delivered in favour of Dickson, the candidate of the Peoples Democratic Party (PDP) in the concluded poll.

    Promoters of the speculation were said to be basking in unfounded claims that the review was designed by the court to overrule itself in favour of Sylva, the candidate of the All Progressives Congress (APC), an order his swearing-in on Thursday.

    Following the development, the government in a statement signed by the Commissioner for Information, Mr Jonathan Obuebite, described the speculation as a complete falsehood.

    Obuebite said: “Our attention has been drawn to rumours making the rounds that the candidate of the All Progressives Congress (APC) in the last governorship election, Chief Timipre Sylva is due to be sworn in this Thursday based on a phantom Supreme Court decision.

    “Ordinarily we would have ignored this latest falsehood and chicanery by the APC but because it is intended to throw the state into confusion and undermine the current peace, we are unequivocally clearing the air.

    “First we want to dismiss the strange story as it is a complete fiction that exists only in the dubious imagination of the originators. It has become very clear that the APC and it’s agents feed fat on deceit.

    “The landmark judgment of the Supreme court on November 8, 2016, was very clear in affirming the election of Governor Henry Seriake Dickson.  All seven justices that sat on the case were unanimous in their judgment and we have copies of it especially the lead judgment”.

    The commissioner said the promoters of the report were trying to woo gullible Bayelsans to gather somewhere and give a historic welcome to Sylva “who is planning to visit the state openly for the first time after he was roundly defeated”.

    “Their intent is also to attract cheap publicity through the planned stage managed reception and at the end‎ tell Sylva that he is still on ground when in actual fact he is not.

    “Thirdly, having exposed the reason for the rumour we call on security agents in the state to go after those behind it and ensure they are dealt with accordingly. This way the peace of the state will be maintained and never again will anyone or group ‎attempt to carryout such mischief.

    “We also call on Bayelsans not to allow themselves to be used by cohorts of Sylva for what is completely nugatory.  Any call to gather anywhere including the Port Harcourt International Airport should be completely ignored.

    “Lastly we want to emphasis that as a government that has sworn to protect the lives, property and integrity of her people, no amount of political brinkmanship‎ and unbridled offensive cum attack will make us poignant and distract us from our mandate, which is the thrust we have with our people”, he said.

    N400m fraud: Metuh tells court to subpoena Dasuki as witness

    A former National Publicity Secretary of the People’s Democratic Party (PDP), Olisa Metuh, has asked the Federal High Court, Abuja, to subpoena former National Security Adviser, Sambo Dasuki, to testify in his trial.

    At the resumed hearing on Wednesday, Counsel to Metuh, Mr Emeka Etiaba (SAN), reminded the judge, Justice Okon Abang, of a pending subpoena before the court to invite Dasuki as the next witness.

    Abang, however, advised that both the defence and prosecuting counsel liaise with the authority holding Dasuki to release him to appear in court.

    He said that it was only after the defence and prosecution had approached the relevant authority and the authority refused to release Dasuki to them that they should come back to him.

    Counsel to the second defendant Tochukwukwu Onwugbufor (SAN) however said it was the duty of the court to issue a subpoena to anyone to appear in court.

    The defence team filed the subpoena on Dec. 2, 2016.

    It was premised on the grounds that since the allegation against Metuh revolved around Dasuki, it was important for Dasuki to be a witness in the matter.

    Meanwhile, following the stalling of the case on Tuesday due to the ill-health of Metuh, the defence, at today’s sitting presented a medical report from the National Hospital with details of his health condition.

    The defence team told the court that Metuh was unable to appear in court because he was admitted at the National Hospital for complications arising from spinal cord injuries.

    Etiaba said that the medical experts handling the defendant’s ailment were unable to give the specific date for his full recovery due to the nature of the ailment.

    He asked the court for a three-week adjournment for the defendant to recuperate and also seek further medical attention.

    Onwugbufor, for his part, told the court that he had seen the medical report and that he was suffering the same ailment as the defendant.

    He said he was able to get the right medical care only in London, and urged the court to look at the defendant’s case with compassion since his condition was even more critical than his.

    According to him, what Metuh is suffering is excruciating and requires expert attention to ensure full recovery.

    Prosecuting counsel, Mr Sylvanus Tahir, said that he was not opposed to an adjournment, adding that the prosecution sympathised with the defence and wished the defendant quick recovery.

    “We have been served with the medical report of the defendant and we have little or nothing to say since the record speaks for itself. All we can say is that we extend our sympathy to the defence.

    “With regards to the request for a three-week adjournment, we are taking them by their word since the medical report did not give an indication about how soon the defendant will be discharged.

    “It only says his management will continue until he gets well and I am not opposed to the adjournment,’’ Tahir said.

    Abang adjourned continuation of hearing in the matter till Feb. 21 and Feb. 24.

    Abia LG polls: PDP wins all 17 councils

    The Abia State Independent Electoral Commission has announced the results of Wednesday’s local government elections, with the Peoples Democratic Party (PDP) winning the 17 councils.

    The News Agency of Nigeria (NAN) reports that the Chairman of the commission, retired Justice Igbozurike Akomas, announced the results in the early hours of Thursday at the commission’s premises in Umuahia.

    Four political parties – the PDP, All Progressives Grand Alliance (APGA), All Progressive Congress (APC) and Labour Party (LP) participated in the polls.

    The PDP scored 19,303 votes in Isialangwa South local government, where no other party fielded candidates.

    In Obingwa, the PDP polled 61,000 votes as against APC’s 1,350 votes while the PDP also polled 22,180 votes in Ukwa West with the APC and APGA scoring 3,450 votes and 2,105 votes respectively.

    In Isiala Ngwa North, the PDP scored 22,180 while APC had 6,843 and APGA 3,399.

    In Arochukwu, the PDP scored 17, 906, APC scored 51 votes and APGA polled 8,551 votes.

    Also in Bende, the PDP polled 30,300 votes while APC polled 3,000 votes and APGA scored 9,014 votes.

    The PDP polled 37,309 in Osisioma while APC and APGA polled 10,262 votes and 11,339 votes respectively.

    In Umuahia North, the PDP polled 72,981, APC scored 2,311 and APGA polled 5,891.

    Also in Isuikwuato, the PDP scored 18,719 votes, APC 2,747 votes while APGA scored 4,621.

    The PDP polled 12,675 votes in Ukwa East, APGA scored 3,729 votes while APC scored eight votes.

    The PDP also scored 33,580 votes in Ummunnochi while APC polled 2,802 votes.

    In Aba South, the PDP polled 33,580 votes, APC scored 7,015 votes and APGA polled 4,003 votes.

    The PDP polled 17,630 votes in Ikwuano while APC and APGA polled 1806 votes and 6101 votes respectively.

    In Aba North, the APC scored 5,321 votes, APGA scored 2,978 votes and PDP got 48,805 votes.

    The PDP also polled 19,831 votes in Umuahia South to defeat LP, APGA and APC which polled 445 votes, 6,221 votes and 4443 votes respectively.

    In Ugwunagbo, the PDP polled 31,118 votes while LP and APGA polled 190 votes and 5,005 votes respectively.

    The chairman said that the results of the councillorship poll would be announced at a later date.

    Meanwhile, the APC and APGA have reacted to the outcome of the polls, describing the exercise as a sham.

    The Secretary of APGA, Mr Sunday Onukwubiri, told NAN on the telephone that “there was no election anywhere in the state’’.

    Onukwubiri said that the results were not acceptable to the party.

    In a similar vein, the Publicity Secretary of APC, Mr Benedict Godson, discredited the results, saying that it was predetermined and did not reflect the true wishes of the Abia electorate.

    Reacting to the complaints by the opposition parties, Akomas charged them to seek redress in the tribunal.

    A Former lawmaker representing Kokona/Keffi/Karu Federal Constituency in Nasarawa state, Alhaji Ahmed Wadada, on Monday, dumped the People’s Democratic Party (PDP) for  the All Progressives Congress (APC) .

    Wadada, who served two terms under the platform of PDP from 2003 to 2011, was received by the APC chairman of his Tudun Kofa ward, Tanko Sodangi,in Keffi town of Keffi Local Government area of the state.

    Speaking shortly after his defection, Wadada said he decided to join the APC as a result of the disunity in his former party and the concern he had for his people.

    “What made me to leave PDP is the concern for my people and lack of unity in PDP; PDP is not united, hence the need for me to dump PDP for APC,” he said.

    He called on the people to live in peace and respect one another, irrespective of their ethnic, religion and political affiliation for the overall development of the country.

    Also speaking at the occasion, Mr.Tanko Sodangi, APC chairman of Tudun Kofa expressed happiness over Wadada’s defection to APC and assured him of equal treatment.

    He said that the defection of Wadada would add value to the party at ward, local government and state levels.
