    Rivers re-run: PDP wins East, West senatorial seats

    The People’s Democratic Party (PDP) has won both Rivers East and West senatorial seats in last Saturday’s rerun election.

    The Rivers East Senatorial candidate of the People Democratic Party (PDP), Sen. George Sekibo defeated his rival Chief Andrew Uchendu of the All Progressives Congress (APC) to reclaim the senatorial seat, while Osinachukwu Ideozu, won the Rivers West senatorial district election.

    Prof. Orji Onu Okumenkama, who is the Returning Officer for the Rivers East Senatorial District declared the result at Port Harcourt City Local Government Council amidst heavy security.

    Okumenkama said that Sekibo scored 93098 votes to win Uchendu who scored 34193 votes in the senatorial election.

    Ideozu was declared winner with 107,166 votes defeating Otelemaba Amachree of the All Progressives Congress, APC, who polled 48,898 votes.

    Earlier before the result of the Rivers East  was announced there was heavy shooting by security operatives who accompanied the governor of the state, Chief Nyesom Wike to the council headquarters.

    The supporters and some candidates of the PDP in the election including Sekibo had taken over the Port Harcourt City council till the result was announced.

    The PDP said that they were there based on information that the Minister of Transportation was on his way to come and hijack and doctor the result

    Wike, had led hundreds of PDP members including His Chief of Staff, Mr. Emeka Woke, the Attorney General of the State, Emma Aguma, Uche Secondus, Chief Sergeant Awuse to the barricade the area.

    Speaking at the Government House Port Harcourt after the result was declared, Wike, “I thank God for the strength and courage he has given to us in this election. We have really sacrificed. I know that freedom comes with sacrifice.

    “Rivers people were murdered for just a simple legislative election. The federal government came with their might to conquer Rivers State, just because they want to win. They killed people because they want the state.

    “The blood of those people they killed will be on their heads. States that cannot pay their workers salary and cannot carry out meaningful project in their states brought money to rig election in this state.

    “They should be ashamed because they won one but we won two of the senatorial seats. They fought but God said, no way! Do not be intimidated. This will never happen in 2019. They have shown us that there is no democracy in Nigeria if not why not they conduct election the way it is been done in other countries.”

    Edo election: Pre-hearing report to be issued Thursday

    The Edo Election Petition Tribunal says it will issue on Thursday a pre-hearing report on the trial in the petition filed by the Peoples Democratic Party (PDP) and its governorship candidate, Mr Osagie Ize-Iyamu.

    The party and Ize-Iyamu, in their main petition, are challenging the declaration by the Independent National Election Commission (INEC) of Mr Godwin Obaseki of All Progressives Congress (APC) as the winner in the September 28 governorship election in the state.

    The petitioners have named the INEC, Obaseki and the APC as first, second and third respondents respectively in the petition.

    INEC had declared Obaseki winner of the Edo governorship election after he pulled more than 319,483 votes to defeat Ize-Iyamu, his closest rival, who scored a total of over 250,000 votes.

    At the commencement of the pre-trial on Monday, the Justice Ahmed Badamasi-led three- member tribunal adjourned the case to Thursday for the parties to hear all pre-trial motions.
    The tribunal will thereafter issue a comprehensive pre-hearing report on the way and manner the trial should take.

    The tribunal further ruled that the petitioners, on the same Thursday, would take their motion on notice in its order on the variation of inspection of the election materials.

    The petitioners’ counsel, Mr Emmanuel Okala, SAN, had earlier sought the permission of the court to withdraw one of the two motions on the variation of the court’s order for inspection of election materials.

    While striking out one of the petitioners’ motion as requested, the tribunal directed Mr Lateef Fagbemi, SAN, counsel to APC, to file his reply to the petitioner’s motion on notice on the variation on or before Wednesday.

    Earlier, both Okala and Fagbemi, who had unanimously formulated and agreed on issues that should form the fulcrum for the tribunal’s determination, adopted their motions before the tribunal.

    Mr Onyeachi Ikpeazu and Mr Adetunji Oyedepo, both SAN, and lawyers to INEC and Obaseki respectively, also confirmed to the tribunal their acquiesces to the agreement reached and read out before the tribunal by Okala and Fagbemi.

    Makarfi accuses Sheriff of plunging Nigeria into one-party state

    Worried by the comments of the Senator Ali Modu Sheriff faction of the Peoples Democratic Party (PDP) on the internal crisis of the party before the court, the caretaker committee Chairman of the PDP, Senator Ahmed Mohammed Makarfi has accused Sherriff of alleged plans of destroying the integrity of the Judiciary and plunge the nation into a one-party state under the All Progressive Congress (APC).

    Makarfi, who reacted to the press conference by the PDP members of Senator Sherriff faction on Friday, accused them of deliberately “raising insinuations that could affect the judgement pending before the Appeal Court in Port Harcourt and also discrediting the judiciary”, saying that such stance taken by Senator Sheriff and his supporters “could ultimately destroy the judiciary and later plunge Nigeria into a one-party State”.

    According to Makarfi in a statement in Kaduna Saturday, “It is very unfortunate and It is also irresponsible that as it stands today, Dr. Karo of the Modu Sheriff faction addressed a press conference that is arranged with such reckless statement intended to soil the integrity of the entire judiciary, and of a particular court”.

    “I condemned such attitude. But, you see, the leper does not change. You recall that the Sheriff side has made several wide written petitions and allegations against members of the bench in a reckless and ungentlemanly manner, unsubstantiated allegations, all intended to avert the delivery of justice.”

    The PDP chairman, Makarfi argued further, “Equally, they have joined even judges as respondents to cases they have filed before the court. Really, this is against ethics and norms that is known to us. And this ongoing insinuation, all intended to make nonsense of the judiciary, especially in respect of judgements that are yet to be delivered. Insinuating, as if they have already have judgements in their pockets. We truly don’t know watch they intend to achieve by this.”

    “We as caretaker committee of the PDP we have absolute faith and confidence in the judiciary and we know that ultimately justice will be done, the judges cannot be fooled by these antics. We equally believe that as democrats in PDP we will continue to depend on the judiciary as the institution that can protect its own integrity and I believe that they are capable of doing that”.

    Senator Makarfi said, “I urge them to rise up to the challenge and do that. If we destroy judiciary in this country, we will destroy democracy and we will destroy Nigeria. At the sometime, if we destroy judiciary in Nigeria, we will enthrone dictatorship and nobody will be saved. God forbid the day that opposition will be killed in the country and we will end up in the state of a dictatorship. We will stand up against that and we will continue to stand up against such”.

    “The Sherriff faction press conference is pre-emptive of what the court judgment would be. This is not the first time, several times, through social media, even when issues were at the lower courts, they made Perceived and conjectured outcome of court proceedings and in most cases they never got it right. It was at one instance of a particular judge that they got it right. The intention is to erode the integrity of the judiciary,” he said.

    Umahi denies decamping plot

    Ebonyi State Governor, Dave Umahi, has denied speculations that he plans to dump his party, the People’s Democratic Party (PDP).

    He was rumoured to be making final arrangements with his deputy to jointly move to the All Progressives Congress (APC).

    The Ebonyi State Commissioner for Information and State Orientation, Senator Emmanuel Onwe, said that the speculations of the movement was false.

    Stressing that the speculation was the figment of the imagination of those harbouring the rumour, he said that Umahi is going nowhere.

    He said: “There have been speculations as to whether the Governor of Ebonyi State is moving to the APC or whether he is remaining in PDP, and who is going with him and who is not going with him.

    “I want to address this matter hopefully once and for all, for all Nigerians to understand that Governor Umahi is one of the centre pillars of the PDP.

    “And I say that with a very deep conviction from my soul. This is a party on whose platform he has been the state Chairman for four years, a party on whose platform he was the deputy governor for four years and now, governor hopefully for eight years.

    “And anyone speculating about either his commitment or his strength, or his role within the party or any doubt at all about whether he is remaining or decamping, is just dreaming,” he added.

    The former lawmaker also noted that Umahi’s leadership style was one of the qualities that would lead the PDP out of the current challenges bedevilling the party.

    “If the Umahis are not in the PDP, it will completely collapse. And that is why his colleagues and others recognize that he is a man of considerable political wisdom, and knowledge and understanding and can really play the game very well. So, he is not going anywhere.

    “And all those with him, I emphasize that; every single member of his cabinet and those that are the stalwarts of PDP in Ebonyi state are with him 110 percent. Nobody is going anywhere.

    “He has provided the sort of leadership that I think not only is it necessary in Ebonyi to have that sort of leadership, but it is absolutely imperative that in a country, we should have that sort of leadership as well.

    “So, his style is to be emulated and if the APC or any other party for that matter is hoping that Umahi would join them, I think they should not be blamed for wishing to have a very good quality political material indeed,” he stated

    Supreme Court upholds Cross River gov’s election

    …Says court can’t determine party membership

     

    The Supreme Court has upheld the election of Governor Ben Ayade of Cross River State.

    The court, in a unanimous judgment by a five-man panel, dismissed an appeal raised by a lawyer, Joe Agi (SAN) against an earlier decision of the Court of Appeal, which upheld Ayade’s election.

    Agi had participated in the governorship primary of the People’s Democratic Party (PDP) on December 8, 2014, from which Ayade emerged as the party’s candidate for the 2015 election.

    Agi later challenged Ayade’s victory in the primary and his eventual victory at the election, raising issues of age and party membership.

    It was Agi’s contention at the trial court that Ayade was not a valid member of the PDP, as at when he participated in the primary, because he allegedly defaulted in his dues.

    Agi also queried Ayade’s candidacy on the ground that he falsified his age.

    He claimed that Ayade falsely represented his date of birth in his nomination form submitted to the Independent National Electoral Commission (INEC) and other records as March 2, 1968 and March 2, 1969.

    He sought Ayade’s disqualification on those grounds, and prayed the court to among others, disqualify Ayade and void his election.

    The Federal High Court, Abuja dismissed the suit for lacking in merit. Agi appealed to the Court of Appeal in Abuja, which, in a judgment on February 5, 2016, also dismissed the appeal, a decision Agi later appealed to the Supreme Court.

    Justice Clara Ogunbiyi, who read the lead judgement of the Supreme Court Friday, said it was not the responsibility of the court to determine who is a member of a political party.

    The Judge said political parties are like voluntary association and that the issue of determining who is a member is internal to the political party.

    She said since there were evidences that the PDP cleared Ayade to contest election as its candidate, it was not for the court to begin to inquire how the party arrived at its decision.

    On the issue of age, Justice Ogunbiyi said since the discrepancies noted in Ayade’s documents were not intended to circumvent the constitutional requirement of 35 years (for a person ruling for governorship position), they were immaterial.

    She noted that age falsification was criminal offence, which needed to be adequately proved by the person making such allegation.

    Justice Ogunbiyi said the status of a person’s membership of a political party was not “justiciable,” and that since the party, through its state Secretary, confirmed at the trial court that Ayade had paid all his dues and that he remained a member of the party, the court could not hold otherwise.

    She said: “The pertinent question to pose is that who between the appellant (Agi) and the first respondent (the PDP) has the vires to decide who is a member of the party.”

    The judge noted that contrary to Agi’s submission, the endorsement of the word “cleared” on Ayade’s membership card, was sufficient to show that he (Ayade) had paid all necessary dues as stipulated in section 8(10) of PDP’s constitution.

    She noted that as provided under paragraph 48 of the of the PDP’s Guideline for Primary Election 2014, the party’s National Executive Committee’s (NEC’s) decision, conveyed by the state chapter of the party, to the effect that Ayade was a member of the party, was final and binding on all aspirants, who participated in the December 8, 2014 primary.

    Justice Ogunbiyi said: “As I earlier said, a political party is a voluntary association and its decision is binding on its members even if it is deemed unreasonable.The decision of the party on issue like this is final.

    “The court will not substitute its will with that of the voluntary association, whether it is reasonable or unreasonable.”

    Justice Ogunbiyi, who noted the allegation of age falsification “is rooted” in criminality, said Agi failed to prove his allegation that Ayade falsified his age beyond reasonable doubt as required by law.

    The judge said for age falsification to serve as a disqualifying factor for any person contesting for the office of governor, it must be proved that it was done with the intention to meet the minimum age of 35 years, which is the constitutional requirement for any person seeking to occupy the office of governor.

    Justice Ogunbiyi said that neither of disputed the dates of birth (March 2, 1968 and March 2, 1969), which placed the age of the governor at either 45 or 46 as of the time he was nominated by the PDP to run for the office of the governor, conferred any undue advantage on him.

    “The second respondent (Ayade) was said to have stated his date of birth in his nomination form to INEC as March 2, 1968.

    “That means that he was 46 years old as of the time he was nominated and that was 11 years above the constitutional requirement of 35 years.

    “By March 2, 1969, the second respondent would have been 45 years old as of the time he was sponsored by the first respondent (the PDP).

    “He would still have been 10 years above the constitutional requirement age of 35 years for office of the governor.

    “The appellant has failed to prove the intention of the second respondent to circumvent the law in order to ensure his compliance with constitutional age requirement,” Justice Ogunbiyi said.

    The judge noted that sections 14(b) and 15(2) of the PDP’s constitution and Section 31(2),(5) and (6) of the Electoral Act (which provide for the disqualification of any aspirant seeking political office) were to ensure compliance with the requirement on mandatory age for the office of the governor under section 177(b) and section 182(1) of the Constitution.

    Umuahia South: PDP shifts power to youths

    The Peoples Democratic Party (PDP) stakeholders in Umuahia South Local Government Area of Abia said that they had shifted power to the youths in the area.

    A former Umuahia South PDP transition Committee Chairman, Chief Charles Ekwueme, made this known at a rally in Amakama-olokoro, Umuahia South Local Government of Abia on Thursday.

    Abia will hold its council election on Dec. 17.

    The state government did not conduct council poll in the past eight years of the administration of former Gov. Theodore Orji.

    “It is the turn of the youths to lead the council in all elective positions. We, the elders of the party have decided that power must shift to the youth.

    “The party elders and well-meaning stakeholders at its primaries elected Mr Obioma Ezeogbulafor, a youth, to pilot the affairs of the council.

    “The old brigades have stepped aside for the youth to take over the stage and reign of governance in the council area,” Ekwueme said at the opening of the party campaign.

    The PDP local government Chairman, Mr Ngozi Okezie, said that the elders vacated power to enable the youths, contribute their quota in the governance of the council.

    Okezie called on them to rally support for the party’s candidate by voting for him in the forthcoming election, to realise the agitation for power shift to the youth.

    He said that Gov. Okezie Ikpeazu was resolute on conducting the poll, and reiterated that “your vote is your power; we come to beg you to give to PDP because your vote must count”.

    The party’s chairmanship candidate, Ezeogbulafor told the people that “he is in the race to serve the people”.

    Ezeogbulafor gave the people and the elders the assurance that he would work assiduously to ensure that youth’s agitation for power shift was justified.

    He appealed to the elders to keep their doors open to counsel and correct the youths whenever they erred in administering the council area.

    The candidate also appealed to youths to support the elders and stakeholders’ initiative by voting         en-masse for PDP.

    “We the youths are the ones at the receiving end during elections. They engage us in ballot snatching and other electoral violence on peanut and dump us after the poll.

    “I want to beg you to resist being used this time around. Those who engage us will never use their own children.

    “They send them abroad to study and use you as their enthronement toll,” Ezeogbulafor said.

    The candidate, who in conjunction with Okezie handed over the party’s flags to the councillorship candidates in Amakama and Old Umuahia wards, promised to transform the council to one of the best in the state.

    “I will, base on available resources, meet the needs of the various wards in my bid to make Umuahia South one of the best local governments in Abia and in the country,” he said.

    Ezeogbulafor is the second son of former National Chairman of PDP, Prince Vincent Ogbulafor.

    Just about one month after three workers of Isiala Ngwa North council area reportedly lost their lives during the People’s Democratic Party (PDP) chairmanship primaries in the area, tragedy was on Wednesday averted in Abia State as supporters of the PDP and All Progressive Congress (APC), were said to have clashed at Mgboko Obete community in Obingwa council area of the state.

    Reports have it that the PDP were on a campaign tour in the area when yet-to-be identified persons embarked on destroying posters belonging to the chairmanship and councillorship candidates of the APC in the Obingwa LGA, leading to a free for all which ensued between the loyalists and supporters of the respective party candidates.

    Narrating his ordeal to newsmen, the APC Councillorship candidate for Ward six, Obingwa council area, Chinonso Friday who claimed to have been injured in the attack, accused the PDP of hiring thugs to destroy his campaign posters and some residents of the area for questioning their actions.

    According to him,” The PDP came on a campaign tour in my community but instead of going for what they came for, they chose to destroy APC campaign posters. When residents of the community confronted them, they attacked them with dangerous weapons. As at now, over 20 residents of my community are receiving medical attention as a result of the injuries they sustained in the attack.  If I had not restrained APC supporters from retaliating, many people would have lost their lives. I reported the incident to the Police, the PDP to allow peaceful elections.”

    However, a chieftain of the PDP who was in the campaign tour, but preferred anonymity, denied that his party destroyed APC posters, and accused APC supporters of instigating trouble.

    Abia Police spokesman, ASP Ogbonnaya Nta could not be reached as the time of filing this report even as reports from the area have it that normalcy is gradually returning to the area.

    PDP congratulates Adonye on his victory at the Appeal Court

    The Peoples Democratic Party (PDP), has congratulated Mr Diri Adonye on his victory at the Appeal Court, Abuja.

    Adonye is the party’s candidate in the March 19 state constituency re-run election in Opobo/Nkoro state constituency of Rivers.

    The party’s congratulatory message was issued by Chinwe Nnorom, Head of PDP Publicity Division for the National Publicity Secretary, on Friday in Abuja.

    The Appeal Court on Dec. 1 reversed the Ruling of the Election Petition Tribunal and upheld Adonye’s election into Opobo/Nkoro State Constituency of Rivers.

    The Special Appeal Panel justices led by Justice Ibrahim Saulawa unanimously nullified the Certificate of Return issued by INEC to Mr Andrew Miller of the All Progressives Congress (APC).

    The court ordered INEC to immediately issue a new Certificate of Return to Adonye.

    Andoye’s election was also upheld by the Election Petition Tribunal.

    Nnorom noted that the `joyful mood’ of well-meaning democrats following the Court of Appeal judgment had once again, confirmed that the party is popular in Rivers and in Nigeria.

    He added that the celebration of the people indicated that Andoye is popular in his constituency.

    “To this end, we again congratulate the Judiciary for upholding the democratic tenet of the majority mandate freely given.

    “We urge the Court to continue defending its constitutional role in the defence of the rule of law in Nigeria as a sure way of sustaining our nascent democracy.

    “We admonish INEC to stop forthwith from taking sides in the conduct of elections in the country and maintain its statutory responsibility of an unbiased Umpire,” Nnorom added.

    268, 942 people eligible to vote in Lagos bye-election – INEC

    The Independent National Electoral Commission (INEC) has said that only 268, 942 of the 340, 634 registered voters in Ifako/Ijaiye Federal Constituency in Lagos can vote in Saturday’s bye election in the constituency.
    Mr Clement Oha, The Administrative Secretary of INEC in the state, said that only 268,942 registered voters in the constituency possessed Permanent Voter’s Cards (PVCs).

    Oha spoke to Journalists on the sidelines of a stakeholders’ forum organised by the commission with political parties involved in the election.

    Oha said: “Only 268, 942 eligible voters have in their possession PVCs to exercise their voting right on Saturday election.

    “We are no longer distributing PVCs; only these people will be allowed to vote. We want to beg people who have no business with the exercise to steer clear.”
    He noted that some voters who had PVCs might have relocated from the constituency while some might have died.

    Oha said that INEC was ready for the poll, and urged voters to arrive at their polling units early.
    He said that accreditation and voting would commence simultaneously at 8a.m.

    The official said that INEC would conduct a free, fair and transparent poll.

    Oha urged politicians and their supporters to be peaceful before, during and after the poll.

    He said that the constituency had 335 polling units and 687 voting points, urging party agents to cooperate with INEC for a successful poll.

    Six political parties are to contest in the poll, they are: Action Alliance (AA), Alliance for Democracy (AD), African Democratic Party (ADC), All Progressives Congress (APC), Peoples Democratic Party (PDP) and Social Democratic Party (SDP).

    The bye-election resulted from the death of Mr Elijah Adewale, who represented the constituency in the House of Representatives.

    Adewale died in Abuja on July 20.

    Ondo PDP suspends, Poroye, Jimoh Ibrahim’s running mate, others

    The Ahmed Markafi faction of the People’s Democratic Party (PDP) in Ondo State Tuesday suspended the factional State chairman of the party, Mr. Biyi Poroye and 21 others.

    Poroye, is from the Ali Modu Sheriff’s faction.

    The party also suspended Mr. Ebenezer Alabi, who was the running mate of Mr. Jimoh Ibrahim.

    But in a statement issued and signed by the State Publicity Secretary of PDP, Mr. Banji Okunomo, shortly after the party State Working Committee (SWC) meeting did not include Jimoh Ibrahim among those suspended.

    The embattled party members were suspended due to their alleged anti-party activities in the just concluded November 26, governorship election in the state.

    Others were, Dennis Alonge, Johnson Alabi, Dr. Olu Ogunye, Senator Meroyi, Mrs. Yemi Ajonibode, Musa Megida, Isaac Alase, Sola Ebiseni, Ademola Genty, Prof. Yemisi Akinyemiju and Dare Emiola.

    Others include Yemisi Akinmade, Ade Adebawore, Bakkitta Bello, Adegboruwa Taiwo, Omowole Oluwagbehinmi, Gbamila Ogunji, Abiye Ademoyegun, and Dara Akinbo.

    The party said its decision was in line with Section 57 of the constitution of the party and the inherent task conferred on the State Working Committee of the party.

    The statement reads, “by the virtue of the Court of Appeal judgment, Biyi Poroye did not only seize to be executive as he claimed, but they have also turned out to be ordinary members of the party.”

    The party spokesman, Okunomo also said the suspended members are expected to appear before the disciplinary committee of the party on Monday December 5, 2016.
