    JUST IN: Edo CJ constitutes another panel to investigate Shaibu

    Edo Chief Judge Justice Daniel Okungbowa has constituted another seven-member panel to investigate allegations against Edo Deputy Governor Comrade Philip Shaibu.

    The allegations were contained in the March 6, 2024 impeachment notice by the 24-member Assembly.

    Chief Registrar of Edo High Court, Mr. B. O. Osawaru, in a statement on Monday with reference number: CR/4837/Vol. I1/131, informed the panel would still be headed by Justice S.A. Omonua (rtd.)

    Osawaru also explained constituting the panel was in line with Section 188 (5) of the 1999 Constitution of the Federal Republic of Nigeria (as amended).

    The other members of the new panel are: Prof. Theresa Akpoghome, Oghogho Ayodele Oviasu, Dr. Andrew Oliha, Idris Abdulkareen, President Aighokhian, and Mariam Erakhoba Ilavbare.

    On March 22, the Chief Registrar, in a statement, gave names of the other members of the panel as Profs. Violet Aigbokhaebo, Boniface Onomion Edegbai and Theresa Akpoghome, as well as Dr. Andrew Oliha, and Messrs. Oghogho Ayodele Oviasu and Idris Abdulkareen.

    Edo lawmakers, on March 19, through a resolution by 19 of the 24 members, directed the Chief Judge to constitute the seven-member panel.

    Shaibu, at the Federal High Court (FHC), Abuja, through an ex-parte motion, urged the court to restrain Assembly, the Chief Judge and Governor Godwin Obaseki from taking further action on the impeachment process, pending the determination of the substantive matter.

    The motion, which was filed on March 18 by Edo Deputy Governor’s lead counsel, Prof. Oladoyin Awoyale, equally joined Edo government, Speaker and Clerk of the state’s House of Assembly, the Director-General of the Department of State Services (DSS) and the Inspector-General of the Police (IGP).
    FHC Abuja presided over by Justice James Omotoso directed that all parties be put on notice, and granted the requested substituted service, with the matter adjourned till April 15, 2024, for further hearing.

    Obaseki, a chieftain of the Peoples Democratic Party (PDP), is backing a Lagos-based lawyer, Dr. Asue Ighodalo, to succeed him on November 12 while Shaibu insisted he remained the standard bearer of PDP in Edo for the September 21 governorship election.

    The Chief Judge of Edo State, Justice Daniel Okungbowa, yesterday announced the  constitution of  a seven-member panel to investigate the allegations  of impeachable offences  leveled against Edo Deputy Governor, Comrade Philip Shaibu, by the state House of Assembly.

    The panel is headed by Justice S.A. Omonua (rtd.),according to a statement by the Chief Registrar of Edo High Court, Mr. B. O. Osawaru.

    Also on the panel are Profs. Violet Aigbokhaebo, Boniface Onomion Edegbai, and Theresa Akpoghome, as well as Dr. Andrew Oliha, and Messrs. Oghogho Ayodele Oviasu and Idris Abdulkareen.

    Osarawu said the setting up of the panel was in line with Section 188 (5) of the 1999 Constitution (as amended).

    The Assembly had  through a resolution by 19 of its  24 members  , directed the CJ to constitute the panel and proceeded to serve Shaibu with notice of impeachment.

    However,the Deputy Governor approached  the  Federal High Court (FHC), Abuja, through an ex-parte motion, praying it to restrain the legislature  , the chief judge and Governor Godwin Obaseki from taking further action on the impeachment process, pending the determination of the substantive matter.

    The motion, which was filed on March 18 by Edo deputy governor’s lead counsel, Prof. Oladoyin Awoyale, equally joined Edo government, Speaker and Clerk of the state’s House of Assembly, the Director-General of the Department of State Services (DSS) and the Inspector-General of the Police (IGP).

    Justice James Omotoso of the Federal High Court in Abuja has refused to grant an ex-parte motion filed by Edo Deputy Governor Philip Shaibu.

    Shaibu had filed a motion before the Federal High Court in Abuja seeking seeking an interim order to stop the impeachment process by the state’s House of Assembly.

    In the suit, Shaibu sought an order of the court restricting the third to fifth defendants from commencing any process by holding proceedings or setting up any panel of investigation for his removal, pending the hearing of a motion on notice.

    He also sought an interim injunction restraining the defendants, whether by themselves or their agents, from interfering with the subject matter of the Originating Summons filed in the suit targeted at his removal from office as the deputy governor of Edo State pending the hearing of the motion on notice among other reliefs.

    However, in the ruling dated March 13, but cited on Monday, the trial judge, Justice James Omotosho, declined the deputy governor’s prayers.

    It reads: “That the Motion Expartee for Interim Injunction dated and filed 8th day of March 2024 is hereby refused.”

    At the proceedings on Tuesday, the judge fixed Wednesday for hearing in another motion ex-parte brought by the plaintiff seeking substituted service on the defendants due to his inability to serve them.

    Edo Governor Godwin Obaseki and Shaibu, chieftains of the governing Peoples Democratic Party (PDP) in Edo, are at loggerheads over the authentic governorship candidate of PDP in Edo.

    Obaseki is fully backing a Lagos-based lawyer, Asue Ighodalo, who emerged as the party’s standard bearer of the governorship indirect primary election at Samuel Ogbemudia Stadium, Benin.

    Shaibu emerged factional candidate at a parallel primary at his official residence on Commercial Avenue in the same Benin.

    He went to the PDP national secretariat to receive his nomination certificate but was refused.

    Members of the Edo State House of Assembly yesterday directed the state’s Chief Judge, Justice Daniel Okungbowa, to set up a seven-member panel to investigate the allegations of gross misconduct and perjury, among others, levelled against Deputy Governor Philip Shaibu.

    Speaker Blessing Agbebaku told the lawmakers that the seven-day ultimatum it gave Shaibu to respond to the impeachment notice served on him on March 6 had expired.

    Agbebaku averred that since Shaibu had evaded the service of the impeachment notice, the Assembly had ordered a substituted service in two newspapers.

    Majority Leader Charity Aiguobarueghan moved the motion that directed the CJ to raise the seven-member panel, and it was seconded by the lawmaker representing Ikpoba/Okha State Constituency, Nicholas Asonsere.

    Aiguobarueghan said the motion was in line with Section 188, sub-sections 3 and 4 of the Constitution of the Federal Republic of Nigeria.

    The majority leader noted that Shaibu’s failure to respond to the petition at the stipulated times was also in conformity with the provision of Section 188, sub-section 3.

    He added that whether the public office holder responded or not, the lawmakers had a duty to perform.

    In a voice vote, 19 of the 24 lawmakers voted in support of the motion, being more than two-thirds of members of the Assembly.

    Members of Edo State House of Assembly on Tuesday, March 19, directed the state’s Chief Judge, Justice Daniel Okungbowa, to set up a seven-member panel to investigate the allegations of gross misconduct and perjury, among others, levelled against Deputy Governor Philip Shaibu.

    Speaker of the Assembly, Blessing Agbebaku, notified the lawmakers that the seven-day ultimatum given Shaibu to respond to the impeachment notice served on him on March 6 had expired.

    Agbebaku claimed that in view of Edo deputy governor’s evasion of service of the impeachment notice, the House ordered substituted service in two newspapers.

    The House majority leader, Charity  Aiguobarueghan, moved the motion asking the chief judge to put in place the seven-member panel, and it was seconded by the representative of Ikpoba/Okha constituency, Nicholas Asonsere.

    Edo 2024: Compel INEC to reject Ighodalo, Shaibu tells Abuja court

    The Deputy Governor of Edo State, Comrade Philip Shaibu, has urged the Federal High Court (FHC) in Abuja to declare the governorship indirect primary election of the Peoples Democratic Party (PDP) on February 22, which produced Asue Igbodalo at Samuel Ogbemudia Stadium, Benin, as invalid and unlawful.

    Shaibu, represented by his lead counsel, Doyin Awoyale, SAN, is also seeking a court order for PDP to conduct a fresh primary election.

    He also urged the presiding judge to instruct the Independent National Electoral Commission (INEC) to reject Ighodalo, a Lagos-based lawyer, as the PDP’s standard bearer in Edo for the crucial poll scheduled for September 21.

    He asked the court to nullify the PDP’s “purported” Edo governorship primary election and withdraw forthwith, the certificate of return issued to Ighodalo, stating that the factional shadow poll was conducted, contrary to the provisions of PDP’s constitution and the Electoral Act.

    Edo deputy governor, in the suit with reference number: FHC/ABJ/CS/308/2024, sought an order to restrain Ighodalo from parading himself as the duly-nominated governorship candidate of PDP in Edo, with the party’s National Vice Chairman, Southsouth, Chief Dan Orbih, as the third defendant in the suit.

    The originating summons, as obtained in Benin by our reporter, read: “An order of injunction restraining the 1st defendant (INEC) from accepting and/or recognising the name of the 4th defendant (Ighodalo) as the governorship candidate of the 2nd defendant (PDP) in the 2024 Edo State governorship election, scheduled to be conducted by the 1st defendant on the 21 of September 2024.

    “An order of this honourable court restraining the defendants, by themselves and/agents, representatives, organs, chapters, etc. from tampering with and/or discarding the delegates lists that emerged from the 2nd defendant’s congresses of 4th February 2024 and 10th February 2024, conducted by the National Working Committee (NWC) of the 2nd defendant.

    “An order of this honourable court mandating the 2nd defendant to conduct a fresh governorship primary election for the nomination of the governorship candidate for the 2nd defendant in the 2024 Edo governorship election.”

    Edo deputy governor also sought these reliefs: “A declaration that upon a proper construction of the provisions of Sections 84 (1), (5B) & (13) of the Electoral Act, 2022; Article 15 (2) of the 2nd defendant’s Constitution; Part 1 Paragraph 1 (A), (B) and Part 1 Paragraph 1 (1) of the 2nd defendant’s electoral guidelines for governorship primary election, it is only ad hoc delegates that emerge from a special local government area congress and special ward congresses conducted by the 2nd defendant’s National Working Committee (NWC) that are eligible to vote in the Edo State PDP Governorship Primary Election, held on the 22nd February, 2024.

    “A declaration that upon a proper construction of the provisions of Sections 84(1), (5B), (8) and (13) of the Electoral Act 2022; Articles 15(2), 50 (1), (2B) of the 2nd defendant’s Constitution; Part 1 Paragraph 1 (A), (B) and Part 1 Paragraph 1 (1) of the 2nd defendant’s guidelines for governorship primary election, the 2nd defendant cannot alter, modify, amend, exclude or substitute the list of ad hoc delegates from a special local government area congress and special ward congresses conducted by the 2nd defendant’s National Working Committee (NWC) who emerged as delegates for the purpose of nominating the Edo State PDP governorship candidate in the forthcoming Edo State governorship election scheduled for the 21 of September, 2024.

    “A declaration that upon a proper construction of the provisions of Sections 84 (1), (2), (5B) and 13 of the Electoral Act, 2022; Articles 15 (2), 50 (1), (2B) of the 2nd defendant’s Constitution; Part 1 Paragraph 1 (A), (B) and Part 1 Paragraph 1 (1) of the 2nd defendant’s guidelines for governorship primary election, the purported governorship primary election conducted by the 2nd defendant at Samuel Ogbemudia Stadium, Benin-City on the 22nd of February, 2024, from where the 4th defendant purportedly emerged as the governorship candidate of the 2nd defendant, is null and void.

    “A declaration that the 1st defendant is not entitled to accept or recognise the 4th defendant as the duly-nominated governorship candidate of the 2nd defendant in Edo State for the 21st of September, 2024 governorship election, having emerged from invalid, unlawful and illegal primaries conducted, contrary to Sections 84(1), (5B), (8) and (13) of the Electoral Act 2022; Articles 15(2), 50 (1), (2B) of the 2nd defendant’s Constitution; Part 1 Paragraph 1 (A), (B) and Part 1 Paragraph 1 (1) of the 2nd defendant’s guidelines for governorship primary election.”

    Edo Governor, Godwin Obaseki, is backing Ighodalo, to succeed him on November 12 this year.

    However, Shaibu emerged as the governorship candidate on the same February 22 at a parallel primary election held at his official residence on Commercial Avenue, Government Reservation Area (GRA), Benin.

    The Speaker of the House of Assembly, Blessing Agbebaku, said Shaibu has refused to acknowledge the impeachment notice sent to him from the court through DHL courier service.

    The impeachment saga of the Deputy Governor of Edo State, Philip Shaibu, continues as the state House of Assembly says it will resort to substituted service to serve the impeachment notice.

    The relationship between Shaibu and the Governor, Godwin Obaseki, has deteriorated in recent months.

    In his recent appearance on Channels Television’s Sunrise Daily, Shaibu attributed his fallout with Obaseki to his ambition to succeed him as the governor of Edo State.

    He said Obaseki is not happy that he is not supporting his preferred candidate.

    “He has not been happy that I’m not supporting his candidate. It is my right to contest in an election and I’m exercising that right. And he has done a lot of negative things. It doesn’t really matter, I see it as politics.

    “I’ve made up my mind to always respect the office of the governor, and I’ll continue to respect the office of the governor till the end, whether as deputy or any other thing.

    “So the relationship is not cordial, I can tell you that. It’s not from my own end, it’s from his own end because I have made attempts to bridge the gap, but he doesn’t allow it”, Shaibu said.

    Edo State Deputy Governor Philip Shaibu is on the verge of being kicked out of office, unless judicial intervention holds back the boot. The Edo House of Assembly, last week, commenced impeachment proceedings against him that are all but certain to carry through, because Shaibu isn’t likely to defend himself against the charges and the lawmakers aren’t exactly keen on fair hearing.

    The assembly on Wednesday unveiled the impeachment bid, which it anchored on alleged perjury and disclosure of government’s secrets by the deputy governor. Majority Leader Charity Aiguobarueghian announced the impeachment notice during plenary, saying it was based on a petition dated March 5th, 2024 and signed by 21 out of the 24 members of the House. “The number of members who signed the petition was more than the two-thirds requirement stipulated in the Constitution,” he added. House Speaker Blessing Agbebaku, who acknowledged receipt of the petition, directed the Clerk of the House to serve the impeachment notice on Shaibu and gave the deputy governor seven days to respond.

    Moves by the lawmakers to sack Shaibu are obviously an escalation in his war of attrition with Governor Godwin Obaseki over his (Shaibu’s) insistence on contesting the September 2024 Edo governorship poll on the platform of the Peoples Democratic Party (PDP). Obaseki prefers as successor Asue Ighodalo, who emerged party torchbearer at a primary election held on February 22nd at the Samuel Ogbemudia Stadium in Benin. Shaibu boycotted that primary and was declared winner at a parallel poll held at his Benin residence, and where he was sole contestant. He has since insisted he is the rightful party candidate, though the party leadership issued Ighodalo the certificate of return.

     Earlier on in his face-off with Governor Obaseki, Shaibu caged the impeachment moves by securing a preemptive court injunction. He subsequently let go that injunction as part of truce mediation by state elders. Now that lawmakers have beaten him to serving an impeachment notice, it remains to be seen if he could yet find refuge with the judiciary. Following his parallel primary, he had spurned impeachment threat and vowed to stay the course in his governorship pursuit, even if doing so would lead to the state assembly moving against him.

    At last, the deputy governor has come to daggers drawn with the lawmakers. The allegation of leaking government secrets levelled against him is spurious because it is doubtful any secret was shared with him since he got kicked out of the governor’s office complex and relocated to a remote corner of town last year. But he also has made the Edo situation more tense than necessary by nominally staying in government and pissing in. Something needs to give, and it seems it is about to.
