  • Shoprite plans Africa’s biggest cleanup exercise

    The Shoprite Group has concluded plans to stage Africa’s biggest cleanup exercise at which over 6000 people in nine countries are expected to participate in almost 500 events from 14-18 July to remove waste from communities. In Nigeria the retail giant is partnering with Nigeria’s pioneer recycling outfit, Wecyclers to execute this huge initiative.

    Head, Business Development of Wecyclers, Ms. Omobolanle Olowu, an environmentalist and recycling champion explains: “The hope is to launch a movement of active citizens who act for change by cleaning and keeping clean public areas. Plastic waste is putting the environment under considerable pressure with the equivalent of a garbage truck of plastic being dumped into our oceans every minute.”

    She further adds, “Recycling is central to this initiative, hence Wecyclers’ decision to partner with Shoprite Nigeria on some of the 45 clean-ups planned in the country. Those organising clean-ups are encouraged to partner with local recyclers to ensure that most of what is collected gets recycled.”

    The retailer also launched a mobile community in which anybody can join via the website www.actforchange.africa. The site was developed in partnership with volunteerism organisation Brownie Points. This digital platform enables users to create their own clean-ups or join an existing one in their area. It also contains information about the nearest recycler or waste management company.

    On the platform cleanup organisers are given guidelines on what their duties are as hosts, how to market their event and what to do on the day and after the cleanup. Participants are to share their experience on social media. In the words of former UN Secretary-General Kofi Annan, “All of us have to share the earth’s fragile ecosystems and precious resources, and each of us has a role to play in preserving them. If we are to go on living together on this earth, we must all be responsible for it.”

    Court awards $10m against Shoprite for breach of contracts

    An Ikorodu High Court has awarded a  $10 million as damages against the owners of Shoprite Stores in Nigeria, Shoprite Checkers (PTY) Limited and Retail Supermarkets Nigeria Limited for breach of contract entered with A.I.C. Limited some years back.

    Justice Lateef Lawal-Akapo  also awarded a cost of N1million in favour of the claimant and ordered that the award of $10million damages must include “interest at the rate of 10 per cent per annum effective from the date of judgment, until final liquidation of the entire sum.”

    In a judgment delivered by the court, Justice Lawal-Akapo held that contrary to the views of the defendants, (Shoprite Checkers and Retail Supermarkets), “there exist a contract between the claimant and the 1st Defendant (Shoprite) which contract is still subsisting till date”.

    In a certified true copy of the judgment by Justice Lawal-Akapo obtained by our correspondent  yesterday,  the court also established that the defendants was in a breach when it “incorporated a company, established the outlet (Shoprite) in 2005 and was running the same without recourse to the claimant”.

    The claimant in the suit, filed through its lawyer, Prof. Taiwo Osipitan (SAN),  in 2012, urged the court to among other prayers  declare that, “by virtue of the agreement between the claimant and first defendant, the joint venture to be formed by the two parties is entitled to exclusively operate and manage by the first defendant’s Shoprite Brand in Nigeria and elsewhere in the coast of West Africa, except Ghana.

    The claimant also sought “a declaration that the agreement for the formation of joint venture between the claimant and the first defendant for the exclusive  operation and management of Shoprite brand in Nigeria and the coast of West Africa except Ghana is valid and subsisting.

    “A declaration that the incorporation of the second defendant by the first defendant to operate its Shoprite brand in Nigeria is in breach of the agreement,” between both parties.

    The claimant prayed the court among other things for payment of $2.2million and  N13.6 million as special damages suffered by the claimant as well as an order for payment  of  $92.3 being loss of profit suffered by the claimant as a result of the breach.

    In addition, the  claimant  urged the court to grant it a sum of $250 million “as aggravated damages for the continue breach of the   agreement between the Claimant and 1st Defendant.”

    Trial commenced on February 18, 2013, during which the claimant called two witnesses, PW1-Mukaila Raji and PW2-Chief Adeniyi Akande, the business development manager of the claimant company, and several documentary evidences were presented.

    The defence team led by Funke Adekoya (SAN) opened its defence on May 5, 2014, and assembled five witnesses, namely-Andre Nico Vanzyl, Anton Andrew Wegenaar, Johannes Hendrik Schreuder, Roelof Louis Barry Slabbert and Malcoln Lawrence Aberman.

    The claimant argued that evidence showed that “the essential  ingredients for the formation of a contract namely :- offer, acceptance, consideration and intention to create legal relation” have been presented.

    The defendants prayed the court to determine among other things whether the claimant has established the “existence of joint venture agreement or any other agreement between the claimant and the first defendant; and whether the  claimant has established any claim against any of the defendants.”

    The defendants submitted that – “there is no offer and acceptance which are fundamental requirements of a valid contract from evidence led by the claimant.”

    In his judgement, Justice Lawal-Akapo held that the prayers of the claimant succeeded in part and awarded damages in its favour.

    According to the court, it has been established that there can be acceptance by conduct not necessarily in writing as canvassed by counsel to the defendants.

    “I therefore hold that there can be an acceptance by conduct and not necessarily in writing.”

    On damages  claimed by the claimant, the court held, “in essence to award exemplary damages alongside aggravated damages will tantamount to double compensation, which is against the spirit and intendment of the law.

    “In this case, the claimant had incorporated a company A.I.C. -Shoprite Nigeria Limited in the hope of a Joint Venture for establishment and running of a Shoprite outlet. The Defendant went behind, incorporated a company, established the outlet in 2005 and was running the same without a recourse to the claimant. The claimant can adequately be compensated,” the court  held.

    Construction of City Centre, Shoprite begins in Ogun

    The construction of the proposed Ogun State City Centre has begun in Abeokuta, the Ogun State capital.

    The project will accommodate the shopping mall of Africa’s largest goods retailer, Shoprite, a 12-storey banking facility, hotel, amphitheatre and service apartment.

    Governor Ibikunle Amosun spoke yesterday when he visited the site.

    The governor said though the project would be private sector-driven, the state government would build the amphitheatre.

    He added that two banks – Guarantee Trust Bank and First Bank Plc – were already building their corporate buildings, which include a 12-storey building, from where banking activities in West Africa will be controlled.

    The centre, Amosun said, will also harbour the central station for Federal Government’s rail project.

    The governor assured the residents that the project would be completed in 24 months.

    Commissioner for Housing Segun Abiodun said the project is among many, which would attract investors to do business and reside in the state.

    The promoter of Shoprite Supermarket Mr. Tayo Amusan said when completed, the project would be the second largest of its type in the country.

    Shoprite celebrates 22 winners of brand new cars

    Shoprite Nigeria hosted the 22 winners of brand new Hyundai Grand Xcent cars at a celebratory fete in Lekki, Lagos.

    The event marked the end of Shoprite Nigeria’s two-month long win-a-car birthday promotion. Between August 21 and October 8, 2017, customers entered the competition by buying any product(s) from the 11 participating brands.

    One of the 22 winners, Mr Olufeyijimi Omobowale, said: “I couldn’t believe my ears when I got the phone call confirming that I was a winner. I initially thought it was a prank until I got to the store. I am so grateful to God and Shoprite for this car. Being invited to this reception with all the other winners crowns it all.”

    Salesgirl docked for stealing N553.9m from Shoprite

    A salesgirl, Mariam Mufutau, who allegedly stole N553, 956, 000 from Shoprite stores in Eti-Osa, Lagos, was on Friday charged before an Igbosere Magistrates’ Court, Lagos.

    She is standing trial on a two -count charge of stealing.

    According to the police, the N553.9 million was the proceeds of sales realised by Mufutau one month after she secured employment in the firm.

    Police prosecutor, Esther Adesulu, informed the court in charge No: J/38/2017 that the defendant committed the alleged offence between April and May, 2017 at Shoprite Stores, Eti-Osa, during working hours.

    Adesulu alleged that the defenfant failed to remit the money into her employer’s account.

    She said the company’s management uncovered the fraud when they audited their accounts.

    The offence, she added, was punishable under sections 411 and 287 of the Criminal Laws of Lagos State, 2015.

    The defendant pleaded not guilty to the charges.

    Magistrate O.O Owunmi granted her bail in the sum of N300, 000 with two sureties in like sum.

    He adjourned the case till July 28.

    Shoprite reaffirms commitment to made-in-Nigeria products

    Shoprite Nigeria has reaffirmed its commitment to local products with its ‘Made- in-Nigeria’initiative, which has benefited producers and customers.

    The majority of products sold by Shoprite are sourced within the country. By pledging to stock more local produce across its 23 stores, Shoprite is highlighting its commitment to the economic  growth.

    The ‘Made-in-Nigeria’ initiative includes quarterly gatherings where local manufacturers can network and showcase their goods. These  have helped strengthen the relationship between Shoprite and local manufacturers, and have enabled manufacturers to identify new markets for their products.

    Integrated Factory Foods Managing Partner, Akhibi Onoke, said the benefits of selling Naija Sweet Rice in Shoprite stores had been evident.

    Onoke, who started supplying to Shoprite four months ago, said: “The big advantage for us is that our products are available in 23 stores nationwide, which increases our market and provides us with growth opportunities. The fact that people see the goods in Shoprite gives us a level of credibility. We are gaining a lot of mileage from that and the exposure to the retailers customer base is definitely working for us.”

    Pally Agro Products Managing Director, Anwuli Onyeagu, who makes  fresh palm fruit extracts, has been a part of the Shoprite ‘Made-in-Nigeria’ initiative for over three months. She said sales volumes of her products increased by over 40 per cent during the period.

    Shoprite is confident that ‘Made- in-Nigeria’ initiative is the boost that local suppliers need to grow the economy. Entrepreneurs and small businesses are encouraged to work with Shoprite.

    Local suppliers are subjected to the same stringent quality standards and demanding targets expected of Shoprite’s international suppliers. The ‘Made-in-Nigeria’ initiative provides more support to local manufacturers to ensure consistency of supply.

    In the past 11 years, the retailer has sourced products locally and has kept to its promise of lower prices.

    Two workers ‘steal’ N1.4m from Shoprite

    Two employees of Shoprite Retail Supermarket Ltd., Lagos, were yesterday arraigned before Igbosere Magistrates’ Court for allegedly stealing N1.4 million from their employer.

    Prosecuting Sergeant Nicholas Akpene said Moses Adeyemi, 19, Rasheed Naasir, 37,

    and others at large committed the offences between April and last month, at Shoprite Victoria Island, Lagos.

    He said the accused stole N1.4 million, while performing their duties.

    ý”The accused diverted money paid by customers through Point of Sale (POS) Terminals into their personal accounts, rather than their employer’s account.

    “They used a special code to transfer the money to their accounts without the knowledge of the company,” he said.

    Akpene said the offences contravened Sections 287 (7) and 411 of the Criminal Law of Lagos State, 2015.

    The accused pleaded not guilty.

    Magistrate S.K. Matepo granted the first accused N500,000 bail and the second, N200, 000 bail with two sureties in the like sum.

    She said the sureties must be employed, tax compliant and their addresses verified.

    The magistrate adjourned till July 10.

    Two Shoprite employees docked over alleged N1.4m theft

    Two employees of Shoprite Retail Supermarket Ltd., Lagos, were on Tuesday arraigned in Lagos for allegedly stealing N1.4 million from their employer.

    The accused, Moses Adeyemi,19, and Rasheed Naasir, 37, with residence address at No. 23, Patey St., Lagos Island and Lekki Beach Road, Jakande, respectively.

    They appeared in an Igbosere Magistrates’ Court on a two-count charge of conspiracy and stealing.

    The prosecutor, Sgt. Nicholas Akpene, told the court that the accused and others at large committed the offences between the months of April and May, at Shoprite Retail Supermarket, Victoria Island, Lagos.

    He said that the accused stole the sum of N1.4 million, while performing their duties.
